  • SC To Hear Kejriwal’s Plea Challenging Interim Stay On Bail In Money Laundering Case Today |

The Supreme Court is set to hear Chief Minister Arvind Kejriwal’s petition on Monday challenging the Delhi High Court’s interim stay on his release on bail in a money laundering case related to the alleged liquor policy scamccording to the additional causelist published on the Supreme Court’s website, a vacation bench consisting of Justices Manoj Misra and SVN Bhatti will hear the case this afternoon. Previously, Kejriwal’s legal team requested an urgent hearing on his petition by the Supreme Court.

On June 21, the Delhi High Court issued an interim judgement staying the release of the Aam Aadmi Party (AAP) supremo in response to the Enforcement Directorate’s petition contesting the trial court’s bail order.

The Delhi High Court stayed the release of the Aam Aadmi Party (AAP) supremo on June 21 in an interim ruling based on the Enforcement Directorate’s petition contesting the trial court’s bail order. A vacation bench of Justices Sudhir Kumar Jain and Ravinder Dudeja of the High Court ordered that CM Kejriwal’s discharge be stayed till the petition was heard in its entirety.

Later that day, the Delhi High Court reserved its decision in the petition, stating that it will issue it within two to three days. Following the order’s announcement, the ED requested a 48-hour postponement in signing the bail bond from the trial court on Thursday. However, the trial court vehemently denied the ED’s

  • Enforcing law against paper leak mere whitewash: Congress chief Mallikarjun Kharge

New Delhi: Congress president Mallikarjun Kharge on Saturday termed the enforcement of the anti-paper leak law a “whitewash” and asserted that the BJP cannot evade its responsibility in “promoting corruption and education mafia”. The Centre on Friday night operationalised the Public Examinations (Prevention of Unfair Means) Act, 2024, which aims to curb malpractices and irregularities in competitive examinations and entails provisions for a maximum jail term of 10 years and a fine of up to Rs 1 crore for offenders.

In a post in Hindi on ‘X’, the Congress president claimed that 70 question papers were leaked in the last seven years and sought to know why the BJP has taken no action so far.

“No matter how much effort BJP makes in the NEET scam, it cannot escape its responsibility in promoting fraud, corruption and education mafia,” Kharge said. He said the law against paper leaks got the President’s assent on February 13 this year but was notified only on Friday night.

“When the education minister was asked about it in the press conference, he had said the law was notified… Why did the Education Minister of the Modi Government lie that the law has been notified when the Ministry of Law and Justice had yet to frame the rules?” Kharge asked.

He said the Union education minister first denied the paper leak and after arrests were made in Gujarat, Bihar, and Haryana, he said the exam will not be cancelled since papers were leaked locally in some places. “The fact is that in 2015, 44 students were involved, yet the Pre-Medical Test was held again for six lakh candidates on the orders of the Supreme Court,” the Congress president said. He said that on NEET too, the Supreme Court has said if there has been even 0.001 fraud, then action should be taken.

“Why is the Modi government not conducting the exam again even though the education minister has admitted to the irregularities?” Kharge posed.

“In nine days, NTA has cancelled or postponed three major exams. Even after passing the law, the leak of the UP Police Recruitment and Promotion Board’s (UPPRPB) exam paper in BJP-ruled Uttar Pradesh has been found to be linked to a Gujarat company,” he said.

The Congress president asked, “Why are (question) papers still being leaked despite a law being passed against it? When 70 papers were leaked in the last seven years, why did the Modi government not take any strict action against it?”

“Bringing a new law is merely a whitewash by the BJP. Unless the education system and autonomous institutions are freed from the interference and negative influence of BJP-RSS, this fraud, theft and corruption will continue,” Kharge said.

The National Testing Agency, which conducts the competitive exams, on Friday, announced the postponement of the June edition of the Joint Council of Scientific and Industrial Research and University Grants Commission National Eligibility Test, citing unavoidable circumstances and logistic issues.

It came two days after the agency cancelled the UGC-NET examination within 24 hours of its conduct saying the integrity of the exam had been compromised, and a massive row on NEET over alleged irregularities, with the issue now before the Supreme Court.

  • ‘Even If 0.001% Negligence…’: Supreme Court Slams Exam Body NTA Over NEET Row |

NEET 2024 Exam Result Row Latest News: With the National Eligibility-cum-Entrance Test (NEET) examination facing all-around criticism, the Supreme Court has slammed the National Testing Agency for the alleged irregularities and negligence in conducting the prestigious national exam for medical college aspirants. “Even if there’s 0.001% negligence on anyone’s part, it should be thoroughly dealt with,” said the top Court while hearing the petitions filed by aspirants challenging the exam result.

The results for the medical entrance examination, taken by 2.4 million students on May 5, were announced on June 4. Allegations of an exam paper leak soon emerged, with 67 students reportedly achieving perfect scores of 720/720.

The next hearing in the case is scheduled for July 8. The top court emphasized the importance of fairness in the examination process, stating, “As an agency conducting the examination, you must act fairly. If there is a mistake, acknowledge it and outline the corrective action. This approach inspires confidence in your performance.”

Grace marks were allegedly given to compensate for lost time at the exam centres. Numerous student organizations have protested against the alleged NEET irregularities, including incidents of incorrect question papers being distributed, Optical Mark Recognition (OMR) sheets being damaged, and delays in sheet distribution.

Last week, the National Testing Agency (NTA) informed the Supreme Court that the grace marks awarded to 1,563 candidates in the NEET-UG exam would be revoked, offering these candidates the opportunity to retake the exam on June 23. The results of the re-test are expected to be released before June 30.

Candidates who opt not to retake the exam will have their original scores reinstated, minus the extra marks.

Bihar police have arrested 13 people in connection with an alleged NEET paper -leak while the Gujarat Police have arrested some persons accused of compromising an entire exam centre in Bharuch.

  • DMK blames testing agency over NEET, slams BJP-led govt for being ‘spectator’

Chennai: Tamil Nadu’s ruling DMK on Saturday accused the National Testing Agency of spoiling the sanctity of NEET and blamed the BJP-led government at the Centre for being a ‘spectator’ and backing coaching centres that earned in crores. Yet again, the DMK sought scrapping the national test, saying it alone would protect the sanctity of education sector.

Referring to the Centre telling the Supreme Court days ago that the grace marks of 1,563 students would be cancelled, DMK’s Tamil mouthpiece ‘Murasoli’ said the BJP government would not have done this if the matter had not been taken to the apex court. Over the years, several irregularities have been happening in NEET and the BJP government did not take note of it, the daily in an editorial on June 15 alleged.

The irregularities and scams that happened in ‘secret’ so far in the conduct of NEET was held in ‘open’ this year. Only to hide this, the test result that was scheduled to be released on June 14 was advanced to June 4, when the result of Lok Sabha polls was declared. However, the scam got exposed. “We have heard about grace marks, it will be one or two marks. But, how could 70 and 80 marks be termed grace marks? The NTA awarded full marks and this is national injustice.” The BJP government remained ‘servile’ to coaching centres that earned crores every month and it ‘established’ the ‘rule of corporates’ in the education sector too.

Right from the beginning, Tamil Nadu and key political parties including the DMK have been opposing NEET and the Assembly passed a Bill to exempt the state from the purview of the exam and it was sent to the Centre to secure Presidential assent.

“We (the state) have requested scrapping NEET or exemption to Tamil Nadu from the test.” The BJP government, however, rejected the staunch opposition as merely political. However, today, the students themselves have realised the ‘fraudulent’ aspects and the affected students approached the top court with a plea to cancel the May 5, 2024 National Eligibility cum Entrance Test and sought strong measures to prevent irregularities. “The Supreme Court itself said the sanctity of NEET-UG has been affected and ‘who spoiled the sanctity? it was the National Testing Agency and the BJP government at the Centre was a spectator.”

On the whole, only abolishing NEET will be the permanent and fair solution to this problem and only then the sanctity of the education sector would be protected.

On behalf of the NTA and the Centre, the same advocate appeared before the apex court and it makes it clear that there is no difference in stand whatsoever between the agency and the union government. Also, the Centre aided the agency in its decisions. Even after the grace mark scam was exposed, the union government does not appear to have realised its mistake.

Referring to the retest on June 23 for students whose grace marks were withdrawn, the Dravidian party daily wondered about the nature of the outcome of the exam to be held again. “See the manner in which they (centre/agency) argue (in court) for the coaching centres that earn in crores.”

  • SC halts release of Annu Kapoor’s ‘Hamare Baarah’ | Movies News

New Delhi: The Supreme Court on Thursday halted the screening of the Bollywood movie ‘Hamare Baarah’ till the petition challenging its release is decided by the Bombay High Court.

Asking the high court to expeditiously decide the plea challenging the certification given by the Central Board of Film Certification (CBFC), a vacation bench of the apex court presided over by Justice Vikram Nath rejected the filmmakers’ contention that objectionable parts were taken away from the teaser.

“We saw the teaser this morning. It continues with all those offensive dialogues,” added the Bench, also comprising Justice Sandeep Mehta.

In an order passed on June 7, the Bombay High Court lifted the interim stay granted on the release of the film after a panel formed by the CBFC on the court’s direction sought an extension of time to give an uninfluenced opinion on the film.

Further, a bench of Justices Kamal Khata and Rajesh S. Patil of the high court noted that the filmmakers have voluntarily agreed to delete certain controversial dialogues.

Last week, the Karnataka government banned the release of the film in the state, stating that it may disturb communal harmony.

Kejriwal later addressed a large gathering of workers and leaders of the AAP before leaving for Tihar jail. AAP leaders, including Atishi, Kailash Gahlot and Saurabh Bharadwaj, Rajya Sabha MPs Sanjay Singh and Sandeep Pathak, and party leaders Durgesh Pathak, Rakhi Birla and Reena Gupta were also present.

Patriotic songs and slogans of “Kejriwal Zindabaad” filled the air at the party headquarters.

Addressing the gathering, Kejriwal said, “I am going back to jail not because I was involved in corruption but because I raised voice against dictatorship… I campaigned for the Lok Sabha polls to save the country.”

Kejriwal said that the BJP will not form the next government at the Centre, saying the exit polls were “fake” and “mind games” by the BJP.

Several exit polls, which were aired on Saturday evening, predicated a comfortable majority for the BJP-led NDA. Counting of votes for the Lok Sabha polls will be held on Tuesday.

The address at the party headquarters was summed up with the national anthem and Kejriwal left for Tihar amid a sea of Indian flags.

Minutes before the chief minister’s surrender, security arrangements were beefed up at Tihar jail with heavy police deployment. Traffic was also restricted in the area.

The chief minister surrendered to the Tihar authorities after 21 days of bail granted by the Supreme Court for the election campaign.

He was released from prison on May 10 on an interim bail granted by the apex court in the excise policy-linked money laundering case.

The bail expired on June 1, the day the seventh and last phase of the general elections was held.

  • Hemant Soren drops plea against arrest after SC questions ‘conduct’

The Supreme Court on Wednesday criticised Hemant Soren for his “blameworthy conduct” of not disclosing complete facts in a plea challenging his arrest by the Enforcement Directorate (ED) even as the former Jharkhand chief minister’s counsel withdrew the plea.

A vacation bench headed by Justice Dipankar Datta verbally observed that Soren had availed “parallel remedies” by filing two separate pleas, one challenging his arrest and another seeking bail, but did not disclose it to the top court.

Soren also did not disclose that his regular bail already stands dismissed by the trial court, the bench observed. It disapproved of the “crafty drafting” of Soren’s petition and told senior advocate Kapil Sibal that the court expected “some candour from your client”.AllUttar PradeshMaharashtraTamil NaduWest BengalBiharKarnatakaAndhra PradeshTelanganaKeralaMadhya PradeshRajasthanDelhiOther StatesSibal said it was his own mistake and not of Soren. “It is my personal fault and not of my client,” he told the bench. “The client is in jail and we are lawyers acting for him. Our intention was never to mislead the court and we have never done it.”Speaking for the bench, Justice Datta verbally observed that it appears that “the person in custody is not acting with bona fide”.To this, Sibal responded that Soren “is not in touch with us. It is not his (Soren) fault at all”.Sibal withdrew the plea after the bench said it would dismiss the same.

Pointing out factual dissimilarities between the case of Delhi chief minister Arvind Kejriwal and Soren, both challenging their arrest by Enforcement Directorate (ED), the apex court on Tuesday had sought to know whether Soren’s plea would be maintainable especially after his regular bail has been rejected and the fact that a special court has taken cognisance of a prosecution complaint (equivalent of a charge sheet) filed by ED against Soren and other accused.

  • ED opposes JMM leader Hemant Soren’s interim bail plea in SC

New Delhi: The Enforcement Directorate opposed in the Supreme Court on Monday former Jharkhand chief minister Hemant Soren’s plea seeking interim bail in a money-laundering case linked to an alleged land scam to campaign in the Lok Sabha polls. In its affidavit filed in the top court on Soren’s plea against his arrest and for interim bail, the probe agency said the materials on record establish that the Jharkhand Mukti Morcha leader was involved in the acquisition and possession of properties in an illegal manner which are proceeds of crime. A vacation bench headed by Justice Dipankar Datta is scheduled to hear Soren’s plea against his arrest and interim bail on Tuesday. “Various Statements recorded under section 50 of PMLA, 2002, which establish that property admeasuring 8.86 acres, situated at Shanti Nagar, Near Lalu Khatal, Bariyatu is under illegal acquisition, possession and use of Hemant Soren and the same has been done in a camouflaged and concealed manner,” the agency said. Opposing the interim bail of Soren for campaigning during the ongoing Lok Sabha elections, the ED said, “It is relevant to note that the right to campaign for an election is neither a fundamental right nor a constitutional right and not even a legal right.” AllUttar PradeshMaharashtraTamil NaduWest BengalBiharKarnatakaAndhra PradeshTelanganaKeralaMadhya PradeshRajasthanDelhiOther StatesThe probe agency said that there is an active attempt on Soren’s part to subvert the investigation by misusing state machinery and project the proceeds of crime as “untainted through his stooges”. Soren was arrested on January 31 in the money-laundering case linked to the alleged land scam after he resigned as the Jharkhand chief minister. He has challenged a May 3 order of the Jharkhand High Court that dismissed his petition against his arrest by the ED. He has also sought interim bail for campaigning in the Lok Sabha polls till the court delivers its verdict on his plea against his arrest.

On May 13, referring to the top court’s recent order in a money-laundering case involving Delhi Chief Minister Arvind Kejriwal, Soren sought interim bail for campaigning in the election.
