  • Delhi HC upholds man’s acquittal in case of raping 15-year-old wife

    NEW DELHI: The Delhi High Court has refused to entertain the State’s appeal against a man’s acquittal in a case of raping his 15-year-old wife, saying his physical relationship with her cannot be termed as rape.

    The high court upheld a trial court’s judgement which had declared the Muslim man not guilty of raping his second wife, saying he has been rightly acquitted.

    “The additional sessions judge had rightly observed that in view of the testimony of the child that she got married to the respondent (man) in the month of December 2014 and only thereafter did they have a physical relationship, no offence under Section 6 read with Section 5(1) of POCSO Act was made out and the respondent was rightly acquitted,” a bench of Justices Suresh Kumar Kait and Neena Bansal Krishna said.

    The high court said there was no ground for grant of leave to appeal against the trial court’s verdict and dismissed an application filed by the police.

    “We find that since the child victim was the wife who was almost fifteen years of age, the physical relationship of the respondent with the victim, cannot be termed as rape. The respondent has been rightly acquitted,” the bench said.

    Under the exception given in Section 375 (rape) of the IPC, sexual intercourse or sexual acts by a man with his wife, the wife not being under 15 years, is not rape.

    According to the prosecution, a rape case was lodged against the man in 2015 on the complaint of the girl’s mother after finding out that her minor daughter was pregnant.

    The girl, in her testimony before the trial court, submitted that the man who was her brother-in-law had married her in December 2014 after which he established physical relations with her with her consent and she became pregnant.

    She said the fact that she had got married to the man was not known to her mother, who lodged a complaint with the police upon discovering that she was pregnant.

  • Minor girl raped in MP’s Satna district; 2nd incident in four days

    SATNA:  A 17-year-old girl has been allegedly raped by a man at a village in Madhya Pradesh’s Satna district, police said on Sunday.

    This is the second incident of rape of a minor girl in the district in four days.

    The latest incident took place on Friday, following which the family members of the teenage girl lodged a complaint at Ramnagar police station, an official said, adding the accused was arrested on Saturday.

    The accused, Vijay Saket (19), caught hold of the girl when she went to answer nature’s call in a deserted area on Friday afternoon, Ramnagar police station in-charge Aditya Naryan Dhurve said quoting the victim’s complaint.

    The accused allegedly threatened to kill the girl and raped her, he said.

    The girl got scared and did not inform her family about the incident after returning home, the police official said.

    She narrated the ordeal to her family members on Saturday following which a complaint was lodged, he said.

    The police registered a case under relevant provisions of the Indian Penal Code (IPC) and the Protection of Children from Sexual Offences (POCSO) Act for rape, abduction and threatening the victim and arrested the accused, the official said.

    On Thursday, a 12-year-old girl was raped, bitten multiple times and brutalised allegedly by two men working for the trust managing a famous temple in Maihar town of Satna district, police earlier said.

    The two accused, Ravindra Kumar and Atul Bhadoliya, were arrested following the incident and the local administration on Saturday demolished their houses, an official said.

  • Man moves SC for anticipatory bail after wife revives rape charge against him: Report  

    The petitioner's wife had lodged a complaint against him for rape in the year 2015 after he refused to marry her following a live-in relationship for a period of about four years. A man has moved the Supreme Court seeking anticipatory bail after a rape case filed by his wife before their marriage was revived by her due to an alleged matrimonial dispute.

    According to legal news site Bar and Bench, the petition was filed challenging an order of the Allahabad High Court refusing to grant the petitioner-husband anticipatory bail in a rape case by his wife arising out of incidents that took place in 2011 and 2014, before the two were married.

    The present case is a matrimonial dispute between the petitioner and his wife. The petitioner’s wife had lodged a complaint against him for rape in the year 2015 after he refused to marry her following a live-in relationship for a period of about four years. Following this, the petitioner said he persuaded his family members for the marriage and the same was solemnised in 2015 as per Muslim rites. Subsequently, an affidavit was filed by her to the effect she married the petitioner consensually and without pressure. Hence, the FIR was closed. 

    The plea before the top court said that after the wedding, the couple lived cordially for the first two years but following this, his wife became quarrelsome. She allegedly threatened the petitioner’s family with false cases if he did not provide her with a separate accommodation. Thereafter, she filed a complaint of rape relating to the same incident which was earlier settled between the two. The Chief Judicial Magistrate, Bareilly issued summons in the case. The respondent simultaneously also filed a case for maintenance.

    When a non-bailable warrant was issued against the petitioner, he moved the Sessions Court for anticipatory bail and the bail was refused. The Allahabad High Court also rejected the application for anticipatory bail leading to the present plea before the top court.

  • Teenage girl gang-raped in car in Nagpur; two held

    NAGPUR: A teenage girl was allegedly raped by two persons in a car in Nagpur district of Maharashtra after they gave her lift in the vehicle, police said on Wednesday.

    The incident took place in the Saoner area, around 40 km from here, on Monday evening and accused have been arrested, they said.

    According to the police, the accused gave lift to the 17-year-old victim in their car, parked the vehicle in an isolated spot and raped her.

  • Mumbai: Class 8 girl raped by two classmates in civic-run school, case filed

    MUMBAI: Two boys allegedly raped their 13-year-old classmate inside the classroom of their civic-run school in the Matunga area of Mumbai, after which the police registered a case against them, an official said on Friday.

    The incident took place on Monday, he said.

    “The girl was sexually assaulted by her two classmates when their fellow classmates stepped out of the classroom for dance practice. The two accused indulged in the crime by taking advantage of the situation,” an official of Matunga police station said. The victim and the accused are students of Class 8, he said.

    “The incident left the girl shaken and she shared her ordeal with her family members, who immediately lodged a complaint against the accused,” the official said.

    Based on the complaint, the police registered a case against the boys under Indian Penal Code (IPC) section 376 DA (gangrape of a woman under sixteen years of age) and under relevant sections of the Protection of Children from Sexual Offences (POCSO) Act, he added.

    The minor accused were produced in a juvenile court, which sent them to the juvenile detention centre at Dongri in south Mumbai and further investigation is underway.

    KOLKATA: Four men, two of them students, were arrested for allegedly raping a 21-year-old woman at a birthday party organised in a bungalow in Kolkata’s northern outskirts Rajarhat on Thursday.

    The woman filed a police complaint on Friday alleging that she was gang-rapped by four men at the party after spiking her drink and making her barely conscious. 

    According to the complaint lodged by the victim, she was invited to the party by her female friend, who was also friends with one of the accused, who had thrown the party at Vedic village on Thursday night. “There were more than 10 people, including women. The four men raped me in turns after spiking my drink,” the woman mentioned in the complaint.

    “She left the venue on Friday morning after realising that she had been raped the previous night. She immediately filed a complaint on Friday night,” said a police officer. 

    The four accused were arrested and produced in a Barasat court, North 24 Parganas, and sent to police custody for seven days. 

    “We have collected footage from CCTV cameras installed near the bungalow and the resort’s entry and exit gates. Investigators are examining the footage,’” said Gaurav Sharma, Bidhannagar police commissioner.

  • Woman who was allegedly gang-raped in Ghaziabad discharged from Delhi’s GTB Hospital

    NEW DELHI: A 36-year-old woman who claimed she was raped by five men was discharged from the GTB Hospital here on Saturday, according to hospital authorities.

    The woman came to the hospital at 7:15 am on October 18 and her medico-legal case (MLC) was made and it was kept confidential, they said.

    When the woman reached the hospital, her vitals were stable, the GTB Hospital said in a statement.

    “She was investigated and treated as per hospital protocols and all formalities were completed. She has been discharged on October 22 and the patient’s condition was stable at the time of discharge,” it said.

    The Delhi Commission for Women (DCW) said the woman told its counsellor that she was gang-raped by five men for two days in Ghaziabad and they inserted an iron rod into her private parts.

    However, Ghaziabad police on Friday registered a case against the woman and three others, alleging that she levelled a “fabricated” gang-rape charge in an attempt to grab property.

    DCW chief Swati Maliwal on Saturday wrote to Uttar Pradesh Chief Minister Yogi Adityanath and urged him to set up a high-level committee to probe the alleged gangrape of a 36-year-old woman in Ghaziabad.

    She also said that strong action should be taken against the woman if her allegations are found to be false.

    Three associates of the woman have been arrested, police said, adding that they have been identified as Azad, Afzal and Gaurav.

    The police had on Wednesday said four people had been taken into custody in connection with the case.

    Asked if a clean chit will be given to the four of them, Inspector General, Meerut, Praveen Kumar told reporters, “We have not got any evidence against them. Prima facie, in this case, no such incident has taken place. So, there is no question of getting evidence.”

    Asked whether the woman was kidnapped or illegally confined, the officer said,”No. She had gone to a designated place of her own will. Chats analysed by us also show that money was also paid to individuals to publicise the case.”

    The woman claimed that she was raped by five men for two days.

    Following the incident, the Delhi Commission for Women chief Swati Maliwal also claimed that the 36-year-old woman was found wrapped in a jute bag, with her hands and legs tied, and an iron rod was inserted in her private parts.

    Maliwal had said the incident reminded her of the Nirbhaya case.

    She was referring to the brutal gang-rape and assault of a 23-year-old paramedic student on the intervening night of December 16-17, 2012 inside a moving bus in south Delhi by six people before being thrown out on the road.

    The DCW has also issued a notice to Ghaziabad police in connection with the case.

    During investigation, we found that Azad’s phone was switched off around the time the woman purportedly disappeared.

    Azad is the main conspirator, the vehicle used belonged to Gaurav and the help of the woman’s associate Afzal was also taken, police said.

    In her statement to the police, the woman had said she had been to Ghaziabad to celebrate her brother’s birthday, a day before the incident.

    The SP said the victim’s brother dropped her back and some people, who were known to her, picked her up from there.

    The woman has alleged that she was forced to get into the car at gunpoint. The senior police officer said the dispute was about a small property.

    “A woman named Sameena gave the property to Azad in 2021 who in turn gave its power of attorney to a man named Deepak Joshi. There was talk about giving this property to the Delhi woman. The case regarding this was going on in the court,” the officer said.

    Authorities at the Guru Teg Bahadur Hospital had on Wednesday said the woman’s condition is stable and no internal injury has been found yet.

    Nipun Agarwal, Superintendent of Police (City-I) Ghaziabad, on Wednesday had said the victim claimed that after raping her, the accused had inserted an iron rod in her private part but when the police tried to get her medically examined at a Meerut hospital, she refused.

    “Doctors then referred her to the Meerut Medical College for treatment but she refused to go there as well. The woman was then taken to a Delhi hospital,” the SP had said.

    After learning about the pregnancy, the mother-daughter duo took the minor to their house on the pretext of getting her married to the accused.

    However, later on Saturday night, they poured kerosene on the girl and set her ablaze, they said.

    Superintendent of Police Kamlesh Dixit said the neighbours rescued the minor and rushed her to a hospital with critical burn injuries.

    She was later referred to Saifai Medical College and her condition is stated to be critical, he said.

    According to police, on Thursday the girl’s mother discovered her daughter’s pregnancy after she took her to a doctor for a check-up following a stomach ache.

    A case was registered against the 25-year-old accused of rape and his mother and sister have been charged with attempt to murder, he said.

    The mother of the accused was arrested on Saturday and sent to jail, he said, adding efforts are on to nab the youth and his sister.

    The SP said all possible help is being given to the victim for her treatment.

    The incident had taken place Friday evening when a 23-year-old BTech student flagged an SUV for lift to go back home, they said.

    The driver allegedly raped her inside the car, threw her near a canal, and fled. The girl later told her family members about the incident when she reached her home.

    Circle officer, Jaisinghpur, Prashant Singh said that they have got a complaint and a probe is on in the matter and FIR will be registered after prima facie investigation.
