    By PTI

GHAZIABAD: A woman who had allegedly levelled a “fabricated” gang-rape charge in an attempt to grab property was arrested on Saturday, a day after police booked her and three of her accomplices for cheating and forgery.

The Delhi woman had claimed that she was kidnapped and raped by five men for two days.

“The woman was arrested by our police team. She was presented before a magistrate to record her statement. The court has sent her to 14 days in judicial custody,” Superintendent of Police (City-I) Ghaziabad Nipun Agarwal said.

Her accomplices Azad, Afzal and Gaurav were arrested earlier.

On Friday, police had said that the woman, Azad, Afzal and Gaurav have been booked under Indian Penal Code (IPC) sections pertaining to cheating, forgery and fraudulently using genuine documents.

They have been charged under IPC sections 420 (cheating and dishonestly inducing delivery of property), 467 (forgery of valuable security), 468 (forgery for purpose of cheating) and 471 (fraudulently using as genuine document which the person knows or has reason to believe to be forged), Circle Officer, City-2, Ghaziabad, Alok Dubey, had said.

Delhi Commission for Women chief Swati Maliwal on Wednesday had said that the 36-year-old woman was found wrapped in a jute bag, with her hands and legs tied, and an iron rod was inserted in her private parts.

However, during a press conference on Thursday, the Ghaziabad police dismissed as “fabricated” the woman’s claim that she had been raped and brutalised by the five men and said a conspiracy had been hatched over a dispute over a “small” property.

Of the five, four were arrested.

During the conference, when asked if a clean chit will be given to the four persons, Inspector General (IG), Meerut, Praveen Kumar, had said, “We have not got any evidence against them. Prima facie, in this case, no such incident has taken place. So, there is no question of getting evidence.”

The National Commission for Women (NCW) on Friday had said that contradictory statements were made by the woman and her family members.

On the women’s claim that she was kidnapped, IG Kumar had said,” No. She had gone to a designated place at her own will. Chats analysed by police also show that money was also paid to individuals to publicise the case,” he had said.

Kumar had also said that during the investigation, it was found that Azad’s phone was switched off around the time the woman purportedly disappeared.

On the property dispute, he said the dispute was about a “small” property.

The NCW had said that police said the incident was planned to implicate the five men, the initial suspects, who had a property dispute with the woman.

“Evidence also suggests that (payment of) Rs 5,000 were also made to sensationalise the case in the media,” it said.

The property dispute is subjudice at the Karkardooma district court in Delhi.

The present three suspects (Azad, Afzal and Gaurav) and the woman planned to implicate gang-rape charges against the five men, an NCW official had said.

IG Kumar had also said that “a woman named Sameena gave the property to Azad in 2021 who in turn gave its power of attorney to a man named Deepak Joshi”.

“There was talk about giving this property to the Delhi woman. The case regarding this was going on in the court,” the officer had said.

Authorities at the GTB Hospital had on Wednesday said the woman’s condition is stable and no internal injury has been found.

The NCW official had said that “also, the hospital told us that in preliminary medical examination, no semen was found on the victim”.

Police have also told the commission that the Delhi woman’s claim that she had been raped and brutalised by five men is “false”, the official had said.

GHAZIABAD: The police on Thursday dismissed as “fabricated” a Delhi woman’s claim that she had been gang-raped and brutalized by five men here. Police claimed that the entire “conspiracy” was hatched over a property dispute.

Three associates of the woman have been arrested, police said, adding that they have been identified as Azad, Afzal and Gaurav.

The police had on Wednesday said four people had been taken into custody in connection with the case.

Asked if a clean chit will be given to the four of them, Inspector General, Meerut, Praveen Kumar told reporters, “We have not got any evidence against them. Prima facie, in this case, no such incident has taken place. So, there is no question of getting evidence.”

The woman claimed that she was raped by five men for two days.

Following the incident, the Delhi Commission for Women chief Swati Maliwal also claimed that the 36-year-old woman was found wrapped in a jute bag, with her hands and legs tied, and an iron rod was inserted in her private parts.

Maliwal had said the incident reminded her of the Nirbhaya case.

She was referring to the brutal gang-rape and assault of a 23-year-old paramedic student on the intervening night of December 16-17, 2012 inside a moving bus in south Delhi by six people before being thrown out on the road.

The DCW has also issued a notice to Ghaziabad police in connection with the case.

During investigation, we found that Azad’s phone was switched off around the time the woman purportedly disappeared.

Azad is the main conspirator, the vehicle used belonged to Gaurav and the help of the woman’s associate Afzal was also taken, police said.

In her statement to the police, the woman had said she had been to Ghaziabad to celebrate her brother’s birthday, a day before the incident.

The SP said the victim’s brother dropped her back and some people, who were known to her, picked her up from there.

The woman has alleged that she was forced to get into the car at gunpoint. The senior police officer said the dispute was about a small property.

“A woman named Sameena gave the property to Azad in 2021 who in turn gave its power of attorney to a man named Deepak Joshi. There was talk about giving this property to the Delhi woman. The case regarding this was going on in the court,” the officer said.

Authorities at the Guru Teg Bahadur Hospital had on Wednesday said the woman’s condition is stable and no internal injury has been found yet.

Nipun Agarwal, Superintendent of Police (City-I) Ghaziabad, on Wednesday had said the victim claimed that after raping her, the accused had inserted an iron rod in her private part but when the police tried to get her medically examined at a Meerut hospital, she refused.

“Doctors then referred her to the Meerut Medical College for treatment but she refused to go there as well. The woman was then taken to a Delhi hospital,” the SP had said.

  • Vaccination of inmates at shelter home: SC directs charitable trust to approach Ghaziabad DM

    By PTI

NEW DELHI: The Supreme Court has asked a charitable trust to approach the District Magistrate with its plea seeking directions for the vaccination of 13 inmates, who do not possess Aadhaar cards, of a shelter home at Loni in Ghaziabad district.

A bench of Justices D Y Chandrachud and B V Nagarathna asked the Collector to scrutinise the grievance of the petitioners and, if it is found to be genuine, to ensure that necessary steps are taken for vaccinating the inmates without their being required to travel.

“We must make it clear that since we are not issuing notice at this stage, there is no material in regard to the veracity or authenticity of the information which has been provided in the writ petition.

“However, having regard to the nature of the grievance, the ends of justice would be served by permitting the petitioners to move the Collector and District Magistrate, Ghaziabad, together with a certified copy of this order,” the bench said.

At the outset, the apex court made it clear that it was not inclined to issue notice at this stage as there is no material in regard to the veracity or authenticity of the information which has been provided in the writ petition.

The top court, in its October 8 order, said it had no occasion to verify the correctness of the grievance or to comment on any of the factual aspects which have been adverted to in the petition, including the legal status of the Home.

The apex court was hearing a plea filed by ‘Ek Ehsaas Foundation’ seeking directions for the vaccination of thirteen inmates of a shelter home maintained at Flat No 001, Plot No B-43, SLF, Ved Vihar, Loni, District Ghaziabad.

The petitioner stated it is a registered charitable trust and among its objects, it maintains a home for orphans, destitute widows, abandoned and aged persons in Ghaziabad.

The petitioner provides shelter to 13 inmates, some of them suffering dementia, some on wheelchair and others suffering from old age ailments.

The trust told the bench that some of the inmates are stated to have Aadhaar cards and some were found abandoned in the street.

In this backdrop, the plea stated that while a Covid-19 vaccination camp was held, the officials informed the petitioners that they could contact the State Government for remedial action.

  • Bharat Bandh: Security up at UP-Delhi borders; police put up barricades, check vehicles

    By PTI

GHAZIABAD/NOIDA: Security was beefed up along the borders of Ghaziabad and Noida with Delhi while traffic movement on some key routes was hit on Monday morning due to the Bharat Bandh called by a section of farmers against the Centre’s three agri laws.

The Ghaziabad Police closed a national highway that connects Ghaziabad and Nizamuddin in Delhi.

Heavy police force and the provincial armed constabulary (PAC) has been deployed in the district and routes have been diverted, Senior Superintendent of Police Pawan Kumar said, adding that the forces are on alert.

Farmer leaders had declared that the ‘Raj Talkies’ intersection of Modi Nagar would be blocked, and therefore vehicles have been diverted from Partapur, Meerut, to the expressway.

Vehicles arriving from Hapur and Ghaziabad have been diverted towards Noida as the peripheral expressway is closed, the police said.

At the UP Gate, which is also the protest site of the Bharatiya Kisan Union (BKU) since November last year, police have put up barricades on the highway to check vehicles.

“Nobody is allowed to travel from this route between Delhi and Ghaziabad due to the Bharat Bandh call,” Superintendent of Police (second) Gyanendra Singh told PTI.

Apart from UP Gate at Ghazipur border, all three borders between Delhi and Ghaziabad — Ananad Vihar, Dilshad Garden-Apsara Cinema, and Tulsi Niketan — are open, the SP said.

Meanwhile, the Noida traffic police cautioned commuters against taking the routes passing through Ghazipur in adjoining Ghaziabad for travelling to or from Delhi.

The Samyukta Kisan Morcha (SKM), an umbrella body of over 40 farmers’ unions leading the 10-month-old agitation for withdrawal of three contentious farm laws, has called for the Bharat Bandh on Monday.

“Routes between Noida and Delhi via Chilla and DND flyway are open. But there was an increased traffic on these routes during the peak office hours. The traffic movement had slowed down a bit because of the pressure,” a traffic police official told PTI.

On the other side, the expressways, including the Yamuna Expressway, leading from Greater Noida into the interior districts of Uttar Pradesh like Mathura, Agra, Aligarh, Lucknow, among others were open without any hindrance in the morning, according to officials.

In Greater Noida, hundreds of farmers, chiefly supporters of the Bharatiya Kisan Union (BKU), took out a procession which included scores of tractors and two-wheelers.

The Delhi Police also increased security checks at its border points which led to the slowing down of traffic.

The dual carriageway at the Ghazipur border was closed for traffic by the Delhi Police, which informed commuters about road closures and traffic snarls on Twitter.

“Due to blocking of National Highway 24 and 9 by protesters, commuters coming from Sarai Kale Khan can take alternate route for Ghaziabad i.e.Vikas Marg for Ghaziabad and for Noida via DND,” the traffic police said on Twitter.

“The Ghazipur border is closed for traffic from both sides due to farmers’ protests. Commuters wishing to commute to and fro between UP and Delhi may use DND flyway, Vikas Marg, Signature bridge, and Wazirabad road. Traffic on NH 24 and 9 is being diverted towards Maharajpur, Apsara and Bhopura borders,” it said in a tweet.

This comes after Twitter lost its status as an intermediary platform in India as it does not comply with new IT rules. According to the sources, Twitter is the only social media platform among the mainstream that has not adhered to the new laws.

Now, instead of being considered just a platform hosting content from various users, Twitter will be held directly editorially responsible for posts published on its platform.

The implication of this development is that if there is any charge against Twitter for alleged unlawful content it would be treated as a publisher – not an intermediary – and be liable for punishment under any law, including IT Act, as also the penal laws of the country, sources stated.

Earlier, a senior-level team of Delhi Police’s Special Cell questioned the Twitter India managing director Manish Maheshwari at Bengaluru over the ‘Congress toolkit case’ matter on May 31.

The Delhi Police had earlier sent a notice to Twitter, seeking an explanation from the microblogging platform to explain the rationale and share all the information on how it described the toolkit as manipulated media.

The police had also visited the Twitter India offices in Lado Sarai, Delhi and Gurgaon on May 24 with the notice over the tagging some of the posts on an alleged Congress “toolkit” against the Central government, as “manipulated media”.

The Uttar Pradesh Police had confirmed that there is no communal angle in the incident in Loni and arrested five accused of assaulting the 72-year-old man. The police also stated that action would also be taken against the complainant for providing wrong facts.

The UP Police on Tuesday filed FIR against nine entities, including Twitter India in connection with the Loni incident.

In the FIR, the Police had said, “There is no communal angle to the incident in Loni where a man was thrashed and his beard was chopped off. The following entities — The Wire, Rana Ayyub, Mohammad Zubair, Dr Shama Mohammed, Saba Naqvi, Maskoor Usmani, Salman Nizami — without checking the fact, started giving communal colour to the incident on Twitter and suddenly they started spreading messages to disrupt the peace and bring differences between the religious communities.”
