  • Private tutor arrested for raping 6-year-old girl in Rajasthan’s Kota: Police

    KOTA: A private tutor has been arrested on charges of raping a six-year-old girl in Kotsuwa village of this Rajasthan district, police said on Monday.

    A special court dealing with cases registered under the Protection of Children from Sexual Offences (POCSO) Act has remanded accused Abdul Rahim (43) in judicial custody, they added.

    Rahim used to give private tuition in Urdu to children and live in a room allotted by a local madrasa. He hails from Rampura in Kota, police said.

    The parents of the six-year-old girl got a complaint lodged against the accused at the Digod police station late on Sunday, alleging that Rahim asked her to stay back at the madrasa while asking the other students to leave after the class on Saturday afternoon and subsequently, raped her.

    On reaching home, the girl narrated her ordeal to her parents, police said. The accused was arrested soon after the case was lodged, they said, adding that he has been booked under Indian Penal Code section 376 (rape) and the relevant sections of the POCSO Act.

    The girl was sent for medical examination and her statement was recorded under section 164 of the Code of Criminal Procedure (CrPC), police said.

  • Gujarat: Rape accused sentenced to life within 30 days of arrest

    SURAT: A special court for the Protection of Children from Sexual Offences Act cases here on Thursday sentenced a man to life imprisonment for the rape of a four-year-old girl within a month of his arrest.

    Special judge P S Kala awarded `life term till death’ to Ajay Nishad (39), a native of Uttar Pradesh.

    Nishad had been arrested on October 13 by Surat police.

    The court also imposed a fine of Rs 1 lakh on him.

    The accused, a married man with three children, kidnapped the girl on October 12 when she was playing near his house in Sachin GIDC area and then raped her.

    She was found in secluded place by police during search.

    The charge sheet was filed within ten days of Nishad’s arrest while the court wrapped up the trial in five days starting from October 25 when the charges were framed.

    According to the prosecution, this is the first time when a trial court in Gujarat has given a verdict in such a short period.

    The court worked till 12 midnight on some days, said a lawyer.

  • 14-year-old girl gang-raped in Uttar Pradesh’s Firozabad, 3 detained

    FIROZABAD: A 14-year-old girl was allegedly raped by three men in a village here on Diwali night, police said on Monday.

    The teenager was forcibly taken to an agricultural field by three men when she was lighting earthen lamps outside her home on Thursday, according to a complaint lodged by the girl’s father.

    Superintendent of Police MC Mishra said the girl was recovered late in the night and she told her family members about the rape.

    An FIR was registered against Dharmveer, Naresh and Ashish on Sunday and the three of them were detained the next day.

    The police are recording the statement of the girl, Tundla Circle Officer Abhishek Srivastava said.

  • MP: Congress MLA’s absconding son arrested in rape case

    INDORE: Police on Tuesday arrested Karan Morwal, the son of a Congress MLA from Madhya Pradesh, who was absconding for over six months after a woman lodged a rape case against him, an official said.

    Karan Morwal is the son of Murli Morwal, the legislator from Badnagar in Ujjain district.

    Police had earlier announced a reward of Rs 25,000 on his arrest.

    Karan Morwal (30) was arrested near Maksi town in Shajapur district, about 80 km from Indore, Jyoti Sharma, in-charge of the women’s police station in Indore, told PTI.

    Necessary legal formalities were underway following his arrest, she said.

    According to officials, the rape case was registered against Karan Morwal on April 2 this year at the women’s police station in Indore.

    The woman complainant had alleged that he raped her on the pretext of marrying her, they said.

    On October 19, the police questioned the accused’s younger brother Shivam as they suspected he was aware of his brother’s hideout, the officials said.

    Eyewitnesses earlier said Congress MLA Murli Morwal had on October 19 arrived at Palasia police station here, located adjacent to the women’s police station, and held a closed-door meeting with some officials.

    After he came out of the police station, media persons had asked him about his absconding son, but the legislator left while saying he didn’t want to say anything to the media on the issue.

  • HC upholds life term to three men in Pune gang-rape case, slams trial court judge

    MUMBAI: The Bombay High Court has upheld an order of the Pune sessions court passed in 2011 convicting and sentencing three men to life imprisonment in a gang-rape case, but made critical comments against defence lawyers and the judge in the case.

    In an order passed on September 28, a bench of Justices Sadhana Jadhav and Sarang Kotwal, while upholding the conviction and life term, made some strong observations on the conduct of defence lawyers and the judge in the case, particularly during the cross-examination of the victim.

    The HC said in the present case, the sessions judge “failed in his duty” to protect the dignity of the victim, an MBA graduate who was gang-raped in the Hinjewadi area of Pune.

    The HC noted that the lawyers defending the accused persons had tried to suggest, among other things, that the victim had consumed alcohol and that she had had consensual sex with the accused.

    The high court questioned the silence of the prosecution during such cross-examination.

    It further remarked that the sessions judge, who heard the case, should not have remained passive and should have intervened when the lawyers subjected the victim, the primary witness in the case, to improper cross-examination.

    “As far as the main incident is concerned, some suggestions were given on behalf of accused No.1 which show that the defence was trying to develop a theory of consensual sex,” the bench said.

    “Once she had denied suggestion of consensual sex, further suggestions were put to her regarding graphic details of the act. These further suggestions were wholly unnecessary,” it observed.

    The HC said such line of questioning could not be considered a “proper cross examination.”

    “We strongly disapprove all these suggestions put to the witness. We are more pained because of the passive approach adopted by the learned Judge in allowing these questions,” the HC said.

    “These suggestions crossed all lines of basic dignity. Under the garb of giving suggestions, graphic details of the act were put to the witness. This was wholly unwarranted.”

    “The learned Judge has recorded that at that stage the witness was sobbing. The learned Judge should have intervened and stopped this line of cross-examination,” it said.

    The HC said all courts are duty-bound to forbid any questions that might be offensive or meant to insult someone.

    It further said that in the present case, the sessions judge failed to inform the woman that she must not feel compelled to answer the unwarranted questions.

    The bench, however, said that while the cross examination was questionable, there did not exist any infirmity in the session court’s order convicting and sentencing the three accused persons to life imprisonment.

    The HC said it did not find any reason to interfere with the Pune court’s order and thus upheld the life terms awarded to the accused – Subhash Hiralal Bhosale, Ganesh Uttam Kambale and Ranjit Shahaji Gade.

    The victim was gang-raped by the accused near Information Technology Park at Mankar Chowk in Wakad on the outskirts of Pune on April 1, 2010, after she accepted a lift in their car.

    The incident had highlighted the lack of security for women working in the Hinjewadi area, where several IT companies are located.

  • Maharashtra: Teenaged girl becomes pregnant after being raped; relative held

    THANE: A 17-year-old girl was allegedly raped by her cousin on several occasions in Maharashtra’s Thane district following which she became pregnant, police said on Wednesday.

    The 24-year-old accused was arrested from a village in Bhiwandi taluka on Tuesday, an official from the district rural police control room said.

    The girl and the accused, who is her cousin, resided in the same house and the latter allegedly raped her on several occasions, the official said.

    The minor girl became pregnant and delivered a child in a hospital here on Sunday, following which her mother lodged a police complaint against the man, he said.

    The accused was subsequently arrested and booked under Indian Penal Code Section 376 (rape) and provisions of the Protection of Children from Sexual Offences (POCSO) Act, he added.

  • ‘Tantrik’ held for abduction, rape of 17-year-old girl in Uttar Pradesh’s Ballia

    BALLIA (UTTAR PRADESH): A “tantrik” allegedly abducted and repeatedly raped a 17-year-old girl for three months, police in this Uttar Pradesh district said here on Tuesday. The accused, Jog Baba (23), was arrested from the railway station here and the girl, who was also with him, was rescued on Monday, they added.

    The girl, a resident of a village in the Revati police station area, was abducted by the accused in June, Senior Sub-Inspector Ajay Yadav said. In her statement, the teenager has told the police that she met the “tantrik” for her treatment.

    He kidnapped her by promising to marry her, took her to Delhi and Kota, and repeatedly raped her for about three months, the girl has alleged. She has been sent to the district hospital for a medical examination, Yadav said, adding that her father had filed a case of kidnapping against the accused on June 30.

    On the basis of the girl’s statement, police have included the relevant IPC sections dealing with rape and those of the POCSO Act in the case on Monday.

  • Maharashtra: Woman raped by partner tries to abort fetus watching Youtube videos, hospitalised

    NAGPUR: A 25-year-old woman had to be rushed to a hospital after she tried to abort her fetus at home watching Youtube videos and her condition deteriorated, following which the man who had impregnated her was booked for rape and other offences, police in Nagpur in Maharashtra said on Monday.

    The incident took place in Yashodhara Nagar area of the city on Thursday, an official said.

    “The woman has told us one Shoeb Khan (30), on the pretext of marriage, was raping her since 2016. When she got pregnant, Khan asked her to get the fetus aborted by watching Youtube videos and getting medicines prescribed in them,” he said.

    “While trying to carry out an abortion procedure on herself, the woman’s condition plummeted and she had to be rushed by her kin to a hospital. Khan has been arrested for rape,” the official informed.

  • Woman raped, pushed to death from 10th floor in Kanpur; one held

    KANPUR: A 19-year-old woman was allegedly raped and pushed to death from the 10th floor of a building by her employer, police said here on Thursday.

    Accused Prateek Vaish (40), a dairy operator, initially tried to mislead police but later confessed to his crime, an official said.

    The accused took the victim, who worked as his secretary, to his flat in Kalyanpur on Tuesday on the pretext of some official work.

    He tried to persuade her to have a physical relationship by offering money but when she refused, he raped her, Deputy Commissioner of Police (West) BBGTS Murthy said.

    After she was raped, the woman threatened to report the matter to police, following which the accused pushed her from the balcony of his 10h floor flat, resulting in her death, he said.

    The DCP said Prateek was arrested on Wednesday and produced before the chief metropolitan magistrate.

    He was sent to judicial custody by the court, he said.

  • Lok Janshakti Party MP Prince Paswan moves anticipatory bail plea before Delhi court in rape case

    NEW DELHI: Lok Janshakti Party MP Prince Raj on Tuesday moved a Delhi court seeking protection from arrest in a rape case, alleging that the complainant was trying to extort money from him. The anticipatory bail application is likely to come up for hearing before special judge MK Nagpal on Thursday.

    Raj, nephew of late Ram Vilas Paswan and cousin of Chirag Paswan, is a Member of Parliament from Samastipur in Bihar. The application was moved by advocate Nitesh Rana, representing Raj, after a case was registered on the direction of a court here.

    The counsel claimed that the alleged victim and her male friend were extorting money and blackmailing Raj since 2020. He said the alleged victim and her friend had demanded Rs 1 crore and threatened to file a false complaint against Raj if he failed to pay the money.

    A case was filed in that regard on February 10 this year in Parliament police station, in which the woman and her associate were granted anticipatory bail in July, Rana said. On May 31, the woman filed a complaint against Raj for allegedly raping her, he said.

    Rana said the woman later approached the court seeking registration of an FIR against Raj on her complaint, following which the court had sought an Action Taken Report (ATR) from police. In its ATR, the police submitted before the court that nothing was found on her complaint and that it was a matter of extortion, he said.

    Rana claimed that the woman and her friend were trying to politicise the matter and that there were her recorded conversation threatening Raj and asking for money. He further claimed that in her own complaint field before the police in May, the woman did not appear before the police to help in the investigation. “My client has already handed over his phone and other evidence sought by police and has been helping the probe agency in the investigation,” he said.

    The woman had in May this year filed a complaint at the Connaught Place police station here, and Delhi Police filed an FIR on September 9 against Prince Raj on the directions of a Delhi court. The woman, who claims that she was an LJP worker, has accused Raj of raping her while she was unconscious.
