  • Delhi HC upholds man’s acquittal in case of raping 15-year-old wife

    NEW DELHI: The Delhi High Court has refused to entertain the State’s appeal against a man’s acquittal in a case of raping his 15-year-old wife, saying his physical relationship with her cannot be termed as rape.

    The high court upheld a trial court’s judgement which had declared the Muslim man not guilty of raping his second wife, saying he has been rightly acquitted.

    “The additional sessions judge had rightly observed that in view of the testimony of the child that she got married to the respondent (man) in the month of December 2014 and only thereafter did they have a physical relationship, no offence under Section 6 read with Section 5(1) of POCSO Act was made out and the respondent was rightly acquitted,” a bench of Justices Suresh Kumar Kait and Neena Bansal Krishna said.

    The high court said there was no ground for grant of leave to appeal against the trial court’s verdict and dismissed an application filed by the police.

    “We find that since the child victim was the wife who was almost fifteen years of age, the physical relationship of the respondent with the victim, cannot be termed as rape. The respondent has been rightly acquitted,” the bench said.

    Under the exception given in Section 375 (rape) of the IPC, sexual intercourse or sexual acts by a man with his wife, the wife not being under 15 years, is not rape.

    According to the prosecution, a rape case was lodged against the man in 2015 on the complaint of the girl’s mother after finding out that her minor daughter was pregnant.

    The girl, in her testimony before the trial court, submitted that the man who was her brother-in-law had married her in December 2014 after which he established physical relations with her with her consent and she became pregnant.

    She said the fact that she had got married to the man was not known to her mother, who lodged a complaint with the police upon discovering that she was pregnant.

  • Class IX student who was abducted, gang-raped a week ago dies in Bengal

    KOLKATA: A Class IX student in Cooch Behar, who was allegedly abducted while returning from school and gang-raped a week ago, died on Wednesday in a state-run hospital in the north Bengal district. Police arrested five suspects in connection with the gruesome incident.

    The death of the teenager triggered a tug-of-war between the BJP and TMC as both parties wanted to stand beside the family of the victim.

    The deceased went into a coma and was shifted to the state government’s hospital from a private healthcare unit where her family found her. A medical examination of the victim revealed she went into a coma because of inadequate supply of oxygen to her brain during the sexual assault.

    According to a complaint lodged with the police by the family members of the victim, it was learnt that she did not return home from school on July 18.

    “They searched the area and contacted their relatives to know the whereabouts of the girl but all their efforts were in vain. It was on July 21 when the family members came to know that the girl was admitted to a nursing home in Cooch Behar-II block in an unconscious state. They rushed there and shifted the girl to MJN Medical College and Hospital in the district headquarters,” said a police officer quoting the family’s complaint.

    The local leaders of the Trinamool Congress intervened and admitted the unconscious girl to another private healthcare unit but as her condition deteriorated, she was again shifted to the medical college and hospital on Tuesday afternoon.

    “The girl was pronounced dead by the doctors of the hospital on Tuesday morning,” said the police officer.

    As the news of the girl’s death spread, local BJP leaders visited her family members and promised to stand by them.

    “We have no faith in the police administration. We want to help the girl’s family, but the local leaders of the TMC took the victim’s father away from the hospital premises and we are not being allowed to meet him,” said a BJP leader in Cooch Behar.

    The police arrested five youths, including key suspect Bappa Burman, residing in the same area where the girl’s house is located. “The four other suspects are Bappa’s associates,” said another police officer.

    Another incident of sexual assault on a minor was reported in Chanchal in Malda district.

    “The girl received a call on her cellphone and was asked to come out of her home by one of her friends on Tuesday evening. Her family members alleged, the person, who called her, assaulted her sexually. We started searching for the suspect who is on the run,” said a police officer in Malda.

    WASHINGTON: American actor-singer Bella Thorne, while attending the 2023 Sundance Film Festival, has called out “inappropriate” sexualization of herself as a minor.

    According to Fox News, a USA-based news outlet, Thorne claimed a man looking to get her autograph on a bunch of items only wanted her to sign “sexy” images of her — which included one of her at 16 years old.

    After being asked about the group of autograph seekers while being interviewed by The Hollywood Reporter, Thorne explained, “I normally don’t tell them off but they offended me… “It was this guy and he was shoving photos in front of me and I looked away for a second and looked back and there was a photo of me from my GQ magazine cover.”

    “It’s super sexy and my butt is out and I’m wearing lingerie and I’m topless… I said I wouldn’t sign that and he took it away and then put it back in front of me again. I said, ‘No, I’m not signing that.’ He pulled out another photo of a magazine with another sexy image. He was like, ‘Come on, Bella. Sign it for me.’ I didn’t like it. It was inappropriate,” she added, reported Fox News.

    Thorne stressed that she doesn’t mind signing autographs for strangers, but she objected to the specific images of herself that he wanted to be signed.

    “There was some stuff there from a Candie’s campaign that I did when I was 16 and it was clear that he wanted me to sign things that were viewed as sexy and even underage and I was like, ‘Give me something else.’ He said, ‘Aren’t they all sexy?’ No, enough is enough… But I get it, they have to make money and everyone has a job so I get that. It was just that I was under 18 and it’s inappropriate,” she continued.

    According to Fox News, the former Disney Channel star admitted she “definitely” rethinks some of those images as she’s gotten older.

    “Definitely, but it’s just that, I wouldn’t do that now. You also can’t spend your time trying to take back these moments or moments that you were too sexy or think that being a woman is only this or that,” Thorne explained.

    Thorne also noted that she feels she “made it out” of child stardom pretty clean. “I also think when you’re growing up, now you have boobs all of a sudden and everything’s growing and becoming more and more intense. You start liking people and everything changes,” she told the outlet, as per Fox News.

    After a handful of smaller roles, Thorne launched her career with the Disney channel show ‘Shake It Up’ and went on to release music including the single ‘Watch Me’ and a couple of EPs. She also dabbled in the adult film industry with the release of “Her & Him,” which she directed.

  • Sexual assault of nursery student in school bus in Bhopal; CM asks cops to act against lapses

    BHOPAL: Three days after the shocking incident of three and half years old nursery student having allegedly been sexually assaulted in the school bus by bus driver in presence of a woman caretaker was reported, the Bhopal police have started specific investigations into the school management’s role in the case.

    Members of Bhopal Police’s special investigation team (SIT) constituted to probe the case, spent hours at the prominent school on Thursday, recording statements of all possible staff members in connection with the case, particularly the school’s failure to put in place fully operational CCTV cameras inside the bus (in which the alleged incident happened on September 8) and timely report the matter to police, even after coming to know about it from the little girl’s parents on September 9 only.

    Thursday’s development happened just after the state’s chief minister Shivraj Singh Chouhan, reviewed the progress of investigations in the case and questioned top police brass of Bhopal, about why action wasn’t taken against the school, when it was found wanting in many key aspects, pertaining to security provisions in the bus as well as timely reporting of the alleged crime to the police.

    “Call the school management and take action against it for whatever lapses have been committed by it. This isn’t a small incident, but a serious incident, which pertains to the safety and security of all school children in the city. We need to send a strong message across to all schools that any lapses and compromise with students’ safety will not be tolerated at any cost,” the CM reportedly told the top brass of Bhopal police at the meeting to review the case’s probe.

    “Irrespective of the prominence of the school, action needs to be taken against its management in case of lapses in students safety,” the CM asked the police officers, while also questioning what was the School Education Department doing in the matter, to ensure safety and security of students of all schools in Bhopal and elsewhere.

    Meanwhile, as per informed sources, the police has got enough evidence to nail the school management (particularly the school’s owner and principal in the case) over the non-operation of the CCTV cameras installed on the bus and the delay in reporting the alleged crime to the police.

    Importantly, the parents of the nursery student girl who was allegedly sexually assaulted had informed about it to the school management on September 9 only (just a day after the shocking incident), but instead of reporting it to Bhopal police, the school management preferred to be inactive in the matter.

    With the school management not reporting the incident to the police, even three days after coming to know about it, the girl’s parents reported the crime to Bhopal Police on September 12, after which the cops not only booked the bus driver and the bus’s woman caretaker under IPC Sections and Protection of Children from Sexual Offences (POCSO) Act but also arrested the duo the same day.
