  • SIT to probe gang-rape of 21-year-old woman in Andaman & Nicobar by former chief secretary, others

    By PTI

NEW DELHI: A Special Investigating Team (SIT) has been constituted to probe allegations of a 21-year-old woman in Andaman and Nicobar Islands that she was gang-raped by officials there including a former chief secretary.

The police registered a case earlier this month on the complaint filed by the woman alleging that she was sexually abused by Narain, a 1990 batch IAS officer, and Labour commissioner R L Rishi at the latter’s official residence on two occasions.

The Aberdeen police station registered the case and a Special Investigating Team headed by a Senior Superintendent of Police was formed to probe the serious allegation against Narain, who is at present posted as the chairman and managing director of the Delhi Financial Corporation.

When contacted, Narain told PTI that he can not comment on the issue as the matter is sub judice.

The woman lodged the complaint with the police on August 21 in which she gave a detailed account of the alleged sexual attack on her twice – in April and May – and requested for preserving the CCTV footage of the then chief secretary’s residence for evidence.

She has also requested a Test Identification Parade of the employees present at the residence of the official.

The complainant has also recorded her statement under section 164 of the Criminal Procedure Code (CrPC) before the chief metropolitan magistrate detailing the allegation.

Anyone giving a statement under this clause of the CrPC will face perjury charges in case it turns out to be false.

The woman claimed that she was in search of a job and was introduced to Rishi through a hotel owner who allegedly took her to the residence of Narain. At Narain’s residence, the woman claimed, she was offered liquor which she refused. She claimed that they assured her of a government job but, subsequently, she was brutally sexually abused by the two men.

Two weeks later, the woman alleged, she was called to the chief secretary’s residence again and the assault was repeated.

She said that instead of giving the promised government job, she was threatened with dire consequences if she revealed the matter to anyone.

She has also filed a separate complaint with the police against a local journalist, who allegedly gave hints about her identity, and a police officer for leaking information about the case, officials said.

According to sources close to Narain, he joined as chief secretary of Andaman and Nicobar Island in March 2021.

  • Some convicts in Bilkis Bano case are ‘Brahmins with good sanskaar’, says Gujarat BJP MLA

    By PTI

AHMEDABAD: Some of the convicts in the Bilkis Bano case of the 2002 Gujarat riots are “Brahmins” with good ‘sanskaar’ or values and it is possible they may have been fixed due to their past family activities, a BJP MLA, who was a part of the state government panel that recommended remission to all the 11 men found guilty, has said.

C K Raulji, the Bharatiya Janata Party (BJP) MLA from Godhra, on Thursday said he does not know whether the convicts, released after spending more than 15 years in jail, were involved in the crime.

On August 15, all the 11 convicts sentenced to life imprisonment in the 2002 case of Bilkis Bano’s gang rape and murder of her seven family members during the communal riots walked out of the Godhra sub-jail after the BJP government in Gujarat allowed their release under its remission policy.

“We took the decision on the basis of a Supreme Court order. We were asked to look at their (convicts’) behaviour and decide (on their early release),” Raulji, who was one of the members of the government-appointed committee that recommended granting of remission to the convicts, told Mojo Story news portal.

“We asked the jailer and learnt that their behaviour was good in the prison. Also (some of the convicts) are Brahmins. They have good ‘sanskaar’ (values),” said the ruling party legislator.

The Gujarat government’s decision has invited sharp criticism from the opposition parties who have said the move was against the Centre’s guidelines. However, Raulji said the convicts may have been fixed.

“It is possible that they (the convicts) might have been fixed in the case due to their past family activities. When such riots take place, it happens that those who are not involved are named. But I don’t know if they committed the crime, we decided (on remission) based on their behaviour,” he said.

Asked about the welcome accorded to the 11 men after their release from prison, he said they had not welcomed them.

The Gujarat government released the 11 convicts after the Supreme Court directed it to consider their plea for relief under the state’s 1992 remission policy.

A special CBI court in Mumbai had on January 21, 2008, sentenced to life imprisonment all the 11 accused in the case for murder of seven family members of Bilkis Bano, a riots survivor, and her gang rape. Their conviction was later upheld by Bombay High Court.

These convicts served more than 15 years in prison after which one of them approached the Supreme Court with a plea for his premature release.

The apex court had directed the Gujarat government to look into the issue of remission of his sentence as per its 1992 policy on the basis of the date of his conviction.

Thereafter, the government formed a committee which took the decision to allow release of all the convicts.

On March 3, 2002, Bilkis Bano’s family was attacked by a mob at Randhikpur village in Limkheda taluka of Dahod district.

Bilkis, who was five months pregnant at the time, was gang raped and seven members of her family were killed during the riots triggered by the Godhra train burning incident.

  • Teenage girl gang-raped, killed in Uttar Pradesh village

CHITRAKOOT: A 13-year-old Dalit girl, who was allegedly gang-raped earlier, has died during treatment, police said on Saturday. Three men have been arrested so far in connection with the rape, they said.

  • Police deliberately killed gang-rape suspects: Panel

    By Express News Service

NEW DELHI: A Supreme Court-appointed panel that probed the alleged encounter killing of four persons in the gang-rape and murder of a young veterinarian in Hyderabad in 2019, tore into the police version of the events, saying it was “concocted”, adding the suspects were “deliberately fired upon with an intent to cause their death”.Pointing out that three of the four suspects were minors, the panel headed by retired Supreme Court judge V S Sirpurkar recommended trial of 10 accused policemen for murder.

“It cannot be said that the police party fired in self-defence or in a bid to re-arrest the deceased suspects. The record shows that entire version of the police party beginning from the safe house to the incident at Chatanpally is concocted. It was impossible for the deceased suspects to have snatched the weapons of the police and they could not have operated the fire arms. Therefore, the entire version is unbelievable,” the report said. “…it cannot be believed that the deceased suspects might have died due to the indiscriminate firing from the pistols allegedly snatched by them and it has to be held that all the deceased suspects died due to the injuries caused by the bullets fired by the police party. It cannot also be believed the deceased suspects opened fire towards the police,” the report said.

“After considering the entire material on record, we conclude that the deceased have not committed any offence in connection with the incident on 06.12.2019, like snatching  weapons, attempting to escape from custody, assaulting and firing at the police party,” it added.Brushing aside the State government’s request to keep it in a sealed cover, the Supreme Court on Fri day shared the report filed by a three-member panel headed by retired Supreme Court judge V S Sirpurkar with all stakeholders and sent the case back to the Telangana High Court.

The report said the suspects, at the time of arrest, were entitled to a number of constitutional and statutory rights that were violated by the police personnel.Taking a sharp look at the criminal justice system, the panel observed that in certain aspects there is absence of clear legal provisions, but in others although legislative mandates are clear, there is laxity in enforcement, like in registration of an FIR, mandatory compliance of laws relating to arrest procedures, use of body cameras, and mandatory videography of all investigation processes.

It suggested that no police officer should hold a press conference in respect of an offence under investigation until such time as it is complete and final report filed in the concerned court. On the night of November 27, 2019, the veterinarian, 27, was kidnapped, gang-raped and murdered near a toll plaza at Tondupally, Shamshabad and her body was dumped and burnt at Chatanpally on the outskirts of Hyderabad.

    What next

    Three scenarios

Telangana High Court resuming hearing pending PILs, but does not take the Sirpurkar Commission report on record. Trial could then go back to the Sessions Court in the main case of gang-rape and murder
If HC accepts panel’s findings, it could also take into consideration that prima facie a case has been established by the report. It can then commit the case to Sessions Court for trial
