  • Two media houses get Press Council notice for carrying misleading Patanjali ads

    Express News Service

NEW DELHI: The Press Council of India (PCI) has issued show cause notices to two prominent media houses for carrying misleading advertisements claiming a cure for diabetes, blood pressure, and other ailments, released by Baba Ramdev’s Patanjali group.

The show cause notices to national and regional groups of publications came on complaints filed by a Kerala-based RTI activist Dr K V Babu, an ophthalmologist, who objected to the advertisements claiming them to violate the Drugs and Magic Remedies (Objectionable Advertisements) Act.

Divya Pharmacy, a marketing arm of the Patanjali group, issued the advertisements. Before PCI swung into action, Uttarakhand state drug controller and the central government authorities had taken serious note of the violations.

The show cause was issued in accordance with Regulation 5(1) of the Press Council (Procedure for Inquiry) Regulations.

Dr Babu told TNIE though it is clear that the advertisement carried violated the norms of journalistic conduct, 2020, which says advertisements that offend the provisions of the DMR (Objectionable Advertisement) Act as amended in 2002, or any other statute should be rejected, many print media are continuing the violation.

“This is against the interest of patients and public health. I am sure this will act as a deterrent in the future. I welcome the notice sent by PCI to the editors of the two Indian dailies,” he told TNIE.

The media houses have been given two weeks to respond. The Divya pharmacy had advertised Divya Lipidom, Divya Livogrit, Divya Livamrit Advance, Divya Madhunashini Vati, and Divya Madhunshini tablets as a cure for heart ailments and other diseases.

  • Ayush ministry makes a U-turn on action against Ramdev’s pharmacy for misleading ads

    Express News Service

NEW DELHI: The Ayush ministry has made a U-turn on misleading advertisements of Ayush products contradicting its stand and the minister’s statement in Parliament, an RTI reply has revealed.

After Kannur-based ophthalmologist Dr K V Babu complained against dubious and misleading advertisements by Baba Ramdev’s Haridwar-based Patanjali Ayurved, the Ayush ministry asked Uttarakhand licensing authority to take action.

Instead of taking action, the state licensing authority cited Rule 170 under the Drugs and Cosmetic Act 1945, which they said prevented them from penalising the Patanjali group’s Divya Pharmacy and claimed the provision’s application was subjudice and pending before the Mumbai High Court.

Despite knowing that action can be taken under the Magic Remedies Act, the Ayush ministry did not correct the state licensing authority, said Babu.

In its reply to Babu on November 22, the ministry reiterated the same stand taken by the state licensing authority, and said, “the matter is under sub judice and pending” before the Mumbai High Court and the “necessary action may be taken subject to the final decision of the court.”

The ministry didn’t correct the state authority that action can be taken under Drugs and Magic Remedies (Objectionable Advertisements) 1954, 3 (d) and Drugs and Cosmetic Rules 1945, 106 (1). Under these sections, advertisements of drugs for 54 and 51 diseases that are under the schedule are prohibited.

The complaint was against an advertisement claiming that Divya Pharmacy’s Lipidom could reduce cholesterol.

“In my complaint in February this year, I had sought action against the misleading advertisement under Drugs and Magic Remedies (Objectionable Advertisements) 1954. I made no complaint under Rule 170. They knowingly cited Rule 170, which they knew could not be used, and flagged it to state that the matter is sub-judice,” Babu told The New Indian Express.

“The Drug Policy Section of the Ministry of AYUSH is misinterpreting the stay on Rule 170, which was added just to reinforce the existing Acts, as a stay on the whole of DMR (OA) 1954 section 3(d) and D & C Act 1945, section 106(1), which prohibits the advertisements of the drugs under schedule.”

Babu said he has now written to the Ayush minister Sarbananda Sonowal for “wrong interpretation of the sub-judice nature of Rule 170 of D & C Rules 1945, thereby exonerating the violators of DMR (OA) 1954” and requested him to intervene on the matter.

The RTI activist said the U-turn by the ministry is contradictory to the statement of the minister in the Parliament in March 2022 and their communications to the state licensing authority in April and then in September, asking them to initiate action against Divya Pharmacy under DMR (OA) 1954.

Even the file notings of the Ayush ministry indicate that though Rule 170 is subjudice, action can be taken under DMR (OA) 1954.

“If the present position of the Ministry of Ayush, which is contradictory to the rules of the land, is implemented, it will lead to flooding of the media with misleading advertisements and will prove a public health disaster,” Babu added.

Sonowal in the parliament had said that “the protocol or guidelines are in force to restrict Ayush products of medicinal use with dubious claims and for selling certain medicines under medical supervision.”

“The Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954 and Rules there under encompass the provisions for prohibition of misleading advertisements and exaggerated claims of drugs and medicinal substances, including Ayush medicines and for the penalty to be imposed on the defaulters,” he had said in the Rajya Sabha on March 22.

“The State/UT Governments are empowered to enforce the legal provisions under Drugs & Cosmetics Act, 1940 and the Drugs & Magic Remedies (Objectionable Advertisements) Act, 1954, and rules made thereunder,” he added.

The minister had also said that media regulators have also been approached to prevent the publication of inappropriate advertisements promoting sale of Ayurvedic and other such medicines in public interest.

Despite the minister’s statement, Patanjali Ayurved products continue to advertise in newspapers, Babu said.

  • Some people ‘spreading anarchy’ to ‘remove’ PM Narendra Modi: Ramdev on Agnipath protests

    By PTI

NEW DELHI: Terming protests against the Agnipath military recruitment scheme as “meaningless politics”, yoga guru Swami Ramdev on Wednesday alleged that a few people are “spreading anarchy” in the country to “remove” Prime Minister Narendra Modi and Home Minister Amit Shah from power.

Addressing a yoga event at Delhi University, Ramdev said that there should be yoga in politics, but there should be no politics in yoga.

“If they (protesters) had done yoga, they wouldn’t have resorted to arson. They should also perform yoga. It (protests against Agnipath) is a meaningless politics. Basically, a few people are running an agenda to spread anarchy in the country. They want to spread anarchy to remove Prime Minister Narendra Modi and Home Minister Amit Shah from power,” he said.

The Agnipath scheme, announced by the Centre on June 14, proposes to recruit soldiers into the armed forces on a short-term contractual basis. The scheme envisages retiring 75 per cent of the recruits after four years of service without pension and health benefits, but with a payout package of nearly Rs 11.70 lakh.

Following the announcement, violent protests broke out in several parts of the country. Ramdev was the chief guest on the second day of Yoga Week organized by the University of Delhi to commemorate the 8th International Day of Yoga.

Union Culture and Parliamentary Affairs Minister Arjun Ram Meghwal was also present with him as a special guest. The programme was presided over by DU Vice-Chancellor Prof Yogesh Singh. “Yoga should be in politics also, but politics should not be in yoga,” Ramdev said.

Explaining yoga, Ramdev said that yoga is self-discipline and self-motivation, and it has many dimensions with self-analysis. Being physically and mentally fit and keeping your mind, thoughts and emotions under control is yoga, he said.

Speaking on the occasion, Meghwal said asanas, pranayam and meditation are complete yoga which feeds the main four organs of the body. “This eliminates negative thoughts and brings excellence. The meaning of yoga is to unite the mind, intellect and soul. When this addition is completed, then yoga takes place according to the Indian system,” he said.

  • Uttarakhand IMA calls for FIR against Baba Ramdev, submits complaint to DGP

    Express News Service
DEHRADUN: Uttarakhand chapter of Indian medical Association on Wednesday submitted a written complaint to the Director General of Police of the state against Yoga Guru Baba Ramdev, others for misguiding people about COVID-19 medicine and other allegations.

The 10-page complaint by the IMA dated June 23, 2021 stated, “Ramdev’s public announcement that no one can arrest him is an example of how he and others with him proved that law and order of this country is nothing before him.”

The IMA requested FIR against him and others from Patanjali Yogpeeth including his aide Balkrishna by explaining every violation point wise.

The association in its letter to the DGP also requested him to direct the concerned officials to register the FIR.

The war of words escalated to next level after Baba Ramdev last month called allopathy ‘stupid Science’.

Later, Ramdev withdrew his statement in reply to Union Health Minister Dr Harsh Vardhan who called his remarks ‘inappropriate’. However, he also asked 25 questions to the IMA.

Earlier this month, Baba Ramdev said that allopathy is best for emergency treatment while ayurveda and Yoga saying are effective in ‘lifestyle’, ‘genetic’ and ‘incurable’ diseases.

“For emergency treatment and surgery, allopathy is the best there are no two opinions about this,” said the Yoga Guru.

DEHRADUN: Baba Ramdev on Thursday said allopathy is best for emergency treatment while ayurveda and Yoga saying are effective in ‘lifestyle’, ‘genetic’ and ‘incurable’ diseases.  “For emergency treatment and surgery, allopathy is the best there are no two opinions about this,” said the Yoga Guru.

He supported ayurveda and Yoga saying that these two are effective in ‘lifestyle’, ‘genetic’ and ‘incurable’ diseases and health problems. “Ayurveda and Yoga are effective in treating lifestyle’, ‘genetic’ and ‘incurable’ diseases. It is a known fact since centuries without any doubt,” added Ramdev.

The Yoga Guru was replying to the queries related to the scuffle between him and the Indian Medical Association after his comments calling allopathy a ‘Stupid Science’. The Yoga Guru also praised the doctors.

“Doctors are devdoots. They are a boon to humankind on this earth by God. We can’t be enemies with any group. If someone does a mischief it’s that individual’s fault not of any ‘pathy’,” said the Yoga Guru while interacting with scribes in Haridwar.

Targeting high cost of patent drugs, he said, “Prime Minister Medicine Centers were opened to address this problem of unaffordable cost of patent medicines which costs 10, 20, 50, 100 and even 200 times in some cases. All we want is that no one should be forced to buy medicines at inflated costs.”

He also advised people to be aware of excessive medication and surgical procedures though did not elaborate on it.

On June 4, 2021, after learning that Baba Ramdev has suggested the Uttarakhand government to include Patanjali Yogpeeth’s ‘Coronil’ in COVID kit, Uttarakhand chapter of Indian Medical Association wrote a letter to Chief Secretary to take action in the matter.

The letter said that addition of Coronil with Allopathic drugs shall also amount to ”mixopathy”- a cocktail of Allopathy and Ayurved which is not permitted as per rulings of the apex court. It asserted that apart from the apex court several High Courts of various states have also ruled that mixopathy is not allowed.

The letter dated June 4, 2021 by the IMA said, “Sir, I would be highly obliged if you kindly take prompt action and direct the Secretary Health, Govt. of Uttarakhand accordingly. This is for your information, necessary action and appraisal of the Honourable Chief Minister.”

The COVID kit is provided by the state health department to the people who are diagnosed with mild symptoms or have no symptoms at all. The kit includes a thermometer, paracetamol, Vitamin D, Zinc and ivermectin tablet and an anti-parasitic drug.

The letter mentioning that tablet Coronil is ‘NOT approved by WHO, DGCI and even Ayush Vibhag’ and furthermore has no place in the central guidelines for Corona of Union Ministry of Home Affairs (MHA) stated, “Coronil is however recognized as a food supplement by Ayush Vibhag of central government and it is not a drug or medicine as claimed by Baba Ramdev on national TV on hourly basis advertisements,” it said.

“Hence, addition of Coronil shall be contempt of court. I am sending you the various decisions and rulings of Hon’ble Supreme Court and High courts on your whatsapp for your kind perusal,” the letter said.  The IMA letter further added that Section 34 of National Medical Commission also does not allow the practice of mixing allopath and ayurvedic prescriptions.

    Express News Service
DEHRADUN: A new video of yoga guru Baba Ramdev surfaced on Wednesday in which he can be heard saying no one has the courage to arrest him after his remarks that “allopathy is stupid science” kicked up a firestorm. In the video, the yoga guru is heard saying, “No one can arrest Saint Ramdev. They are just making noises. Let them do what they do best.”

“They are just making a noise. They keep creating trends like Thug Ramdev, Mahathug Ramdev, Giraftar Ramdev and so on,” he said responding to #Arrest Ramdev trends on social media.

“Arrest to khair unka baap bhi nahin kar sakta Swami Ramdev ko (even their father cannot arrest Swami Ramdev),” he is caught saying in the video.

The yoga guru’s latest video shows he is not apologetic at all about making “insensitive” comments about allopathy and allopathic practitioners, a doctor said in Dehradun.

“Ramdev’s statement is full of arrogance. It shows that he considers himself above the law,” he said reacting to the latest video of Ramdev.

  • IMA serves defamation notice on Baba Ramdev for remarks against allopathic doctors

    By PTI
DEHRADUN: The Indian Medical Association (IMA) has served a defamation notice on Ramdev for alleged disparaging remarks against allopathy and allopathic doctors, demanding an apology from him within 15 days, failing which it said it will demand a compensation of Rs 1,000 crore from the yoga guru.

The six-page notice served on behalf of IMA (Uttarakhand) secretary Ajay Khanna by his lawyer Neeraj Pandey describes the remarks by Ramdev as damaging to the reputation and the image of allopathy and around 2,000 practitioners of it who are part of the association.

Terming the remarks of the yoga guru a “criminal act” under section of 499 of the Indian Penal Code, the notice demanded a written apology from him within 15 days of its receipt, saying a compensation of Rs 1,000 crore will be demanded from him at the rate of Rs 50 lakh per member of the IMA if he failed to do so.

The notice has also asked Ramdev to make a video clip contradicting all his allegations and circulate it on the social media platforms where he had uploaded his earlier video levelling them.

It further asked the yoga guru to withdraw a “misleading” advertisement from all platforms endorsing “Coronil kit”, a product of his firm, as an effective medicine for COVID-19, failing which an FIR and a criminal case will be lodged against him by the IMA.

On Sunday, Ramdev was forced to withdraw a statement made in a viral video clip in which he is heard questioning some of the medicines being used to treat the coronavirus infection and saying that “lakhs have died from taking allopathic medicines for COVID-19”.

The remarks were met with vociferous protests from the doctors’ association, following which Union Health Minister Harsh Vardhan asked him to withdraw the “extremely unfortunate” statement.

A day later, the yoga guru posed 25 questions to the IMA in an ‘open letter’ on his Twitter handle, asking if allopathy offered permanent relief for ailments such as hypertension and type-1 and 2 diabetes.

He went on to list modern day ailments such as Parkinson’s disease and wondered if allopathy had any painless cure to treat infertility as well as to reverse ageing and increase hemoglobin.

Soon after, Ramdev’s close aide Acharya Balkrishna took to Twitter, saying the yoga guru and Ayurveda were being targeted by allopathic practitioners under the IMA as part of a conspiracy.

“As part of the conspiracy to convert the entire country into #Christianity, #Yoga and #Ayurveda are being maligned by targeting @yogrishiramdev jee. Countrymen, wake up now from the deep slumber otherwise the generations to come will not forgive you,” Balkrishna said in a tweet.

Balkrishna in his Tweet said, “As part of the conspiracy to convert the entire country into #Christianity, #Yoga and #Ayurveda are being maligned by targeting @yogrishiramdev jee. Countrymen, wake up now from the deep slumber otherwise the generations to come will not forgive you.”

In a series of tweets, Balkrishna accused Dr. Johnrose Jayalal, president of the Indian Medical Association, that he is involved in the conversion of people to Christianity. To support his claims, Balkrishna tweeted some news clippings too.

Medical doctors reacting to the Tweet said this is unacceptable and instead of taking responsibility for unwarranted, unsubstantiated comments about life-saving medicine stream, Ramdev and his aides have resorted to a smear campaign.

Dr. DD Chaudhary, a member of the central working committee of the Indian Medical Association commenting on the issue said, “This is unfortunate that such people with a big following are making statements like this. At this hour, there should be nothing like this to create confusion and divide among the masses. People will be confused and suffer.”

The tweet left the netizens divided with some supporting Ramdev and Balkrishna and others slamming and opposing them.

A user wrote, “Indian Medical Association doctors often mock Ayurveda as a pseudoscience may be out of competition or ignorance.”

Another user Tweeted, “Glad that Acharya Balkrishna and Baba Ramdev isn’t taking this lying down. The fact is IMA Chief advocated Christianity and that’s the root for their enemies with Ayurveda.”

One of the users who slammed the Yoga Guru and his aide wrote, “Low life pathetic guys you both are, you target allopathy branch to promote your concoction which is untested and now give it a communal angle.”

Another user who criticized the duo tweeted, “By exploiting sentiments of ordinary Indians over Yoga & # Ayurveda, Baba Ramdev alias Baalkishan Yadav & Modi have formed a criminal nexus. Modi is using his reach to gain votes & in return awarding him government lands in BJP ruled states to expand his business.”

Responding to the queries related to Balkrishna’s Tweet, SK Tijarawala, spokesperson of Patanjali Yogpeeth said, “This is as per best of information in social media etc. These things (conversion allegations) must be looked into and investigation must be initiated against a person who is electoral head of an organisation of noble professionals.”

Uttarakhand chapter of the Indian Medical Association is mulling to file defamation case against Yoga Guru Baba Ramdev following his remarks about allopathic medicine.

A notice has been already sent to the Yoga Guru and if a satisfactory reply is not received,  a case will be filed against him.

Ramdev withdrew his statement in reply to union health minister Dr Harsh Vardhan who called his remarks ‘inappropriate’. However, he also asked 25 questions to the IMA.

Earlier, a video went viral in which Ramdev can be seen reading out a message that has gone viral on social media.

Meanwhile, another video of the Yoga Guru surfaced on Monday in which be can be heard saying that more than 10,000 doctors in India have died even after getting both doses of Covid 19 vaccine.

  • Maligning image of Kumbh, Hinduism with toolkit’s help a ‘political conspiracy, says Ramdev

    By ANI
HARIDWAR: Yoga Guru Ramdev on Wednesday alleged that there is an attempt to maligning the Kumbh and Hinduism with the help of a toolkit and termed it as a “political conspiracy”. This comes a day after BJP accused Congress of designing a toolkit to malign Kumbh as a “super spreader” COVID-19 event.

Ramdev, in a video message, urged the people to boycott “such power” who are against the country. “Maligning the image of Kumbh and Hinduism with the help of a toolkit is a political conspiracy. I request people, who are politicising the matter, do whatever you want to do but do not disrespect 100 crore Hindus. This is disgusting. I urge people to boycott such power who are against the country,” the Yoga Guru said.

Earlier in the day, Acharya Mahamandaleshwar of Juna Akhara Swami Avdheshanand Giri Maharaj urged people not to politicise the Kumbh. He alleged that the culture, rituals, faith and traditions of the nation are being tarnished in a “well-planned manner”.

The BJP had on Tuesday alleged that the toolkit has instructions for social media volunteers of Congress to call the new COVID-19 mutant as “Indian strain” or “Modi strain” against the World Health Organization (WHO)’s instructions.

The first Shahi Snan of Kumbh was held on March 11 on the occasion of Mahashivratri, while the second and third were held on April 12 and 14. The last snan took place on April 27. The duration of the Kumbh has been shortened to 30 days this year due to the ongoing COVID pandemic.

  • Skepticism surrounds relaunch of ‘Coronil’ by Patanjali

    By Express News Service
NEW DELHI: Yoga guru Ramdev on Friday released a research paper on the “first evidence-based medicine for Covid-19 by Patanjali” amid scepticism that the product claimed to be a cure for coronavirus may not have any scientific basis.

Coronil, introduced in the Indian market last June during the peak of the pandemic, was relaunched on Friday in the presence of Health Minister Harsh Vardhan and Road Transport and Highways Minister Nitin Gadkari.

“Coronil has received the Certificate of Pharmaceutical Product (CoPP) from the Ayush section of Central Drugs Standard Control Organisation as per the WHO certification scheme,” said a statement by Patanjali.

Under CoPP, Coronil can now be exported to 158 countries.

The CDSCO or the Ayush ministry have not yet clarified the claims made by the company so far. Last June, Patanjali launched ‘Coronil and Swasari’, claiming that these were not immunity boosters but “sure shot Ayurvedic cure” for Covid-19. According to them, it had shown 100 per cent favourable results during trials on participants.

The launch of Coronil, however, had drawn flak. Many said the claim lacked scientific data.

The company has been claiming that the medicine which costs Rs 545 can cure Covid-19 in three to seven days, but experts point out that most mild and asymptomatic cases of Covid-19 recover on their own.
