As per the Supreme Court’s order, the documents ED garnered during the investigation and even if they are not relying on that, still they have to provide the list of it to the accused, and they (the accused) have full right to inspect those documents. In the trial, the accused and prosecution have rights; however, a strong agency should not engage in such kiddish activity. AAP leader Saurabh Bharadwaj has said that Delhi Chief Minister Arvind Kejriwal’s wife Sunita is the best person to keep the party together in the prevailing circumstances and asserted that her presence has had a “positive effect” on the cadre. In an interaction with PTI editors at the agency’s headquarters here, Bharadwaj, who is also a cabinet minister in the Delhi government, said Sunita Kejriwal has always said that she is the “messenger” of the Delhi chief minister who is currently in jail.
Noting that the politics of a party does not just revolve around its manifesto, Bharadwaj said the support base and the emotional connection between the cadre and the top leadership also plays a crucial role in keeping an organisation together.
Sunita Kejriwal’s presence has had a positive impact, he adderted. “She is delivering the messages of Arvind Kejriwal ji. This has had a great impact on our party cadre and among our sympathisers. We want to propagate it. In the present circumstances, she is the best person to keep the party together,” Bharadwaj said.
Kejriwal, arrested by the Enforcement Directorate in a money-laundering case linked to the Delhi government’s now-scrapped excise policy, is in judicial custody till April 15.
His wife has addressed three digital briefings so far, in which she read out his messages from the ED custody and Tihar Jail. In a political debut of sorts, she read out his message at the INDIA bloc ‘maharally’ on March 31. Asked if Sunita Kejriwal will campaign for the party in the Lok Sabha polls, he said, “We would love if this thing happens… if Sunita ji does take part in campaigning but it is her personal decision.”
On further prodding whether there was some kind of “messaging” in Sunita Kejriwal taking centre stage after her husband’s arrest, the minister replied in the negative.
AAP Rajya Sabha MP Sanjay Singh, who too was arrested in the excise policy case and received bail on Wednesday, had met Sunita Kejriwal immediately after getting out of jail and was seen touching her feet.
Talking about it, the minister said if someone’s elder brother is in some difficulty, he is duty-bound to look after his family.
“This is our culture. The BJP was saying that there would be fights among the party members after Kejriwal’s arrest. Sanjay Singh considers Arvind Kejriwal his family, his elder brother. So, he touched her (Sunita Kejriwal) feet. We are working as one unit and one family,” he said.

Singh accused the BJP of involvement in the Delhi Excise Policy scam, suggesting that high-ranking members of the party were complicit in the alleged wrongdoing.
Magunta Reddy Forced To Accuse Kejriwal: Sanjay Singh
Singh highlighted the case of Magunta Reddy and his son Raghav Magunta, asserting that their statements underwent significant alterations under duress. According to Singh, Magunta Reddy initially provided statements that did not implicate Kejriwal but changed his stance following his son’s arrest and prolonged detention. Similarly, Raghav Magunta allegedly altered his testimony after enduring months of incarceration, eventually inculpating Kejriwal in the purported conspiracy.

Singh accused the Enforcement Directorate (ED) of selectively removing statements that did not implicate Kejriwal, thereby allegedly manipulating the narrative to suit their agenda. He claimed that the agency disregarded testimonies that exonerated Kejriwal while emphasizing those that inculpated him, insinuating bias in the investigative process.
ED Raids And Alleged Intimidation
Singh further alleged that individuals who initially denied any association with Kejriwal were coerced into incriminating him after facing prolonged detention and intimidation tactics by investigative authorities. He cited the case of Sarath Reddy, whose prolonged detention allegedly led to a change in his testimony, implicating Kejriwal under duress.

Following his release, Singh visited a Hanuman temple in Connaught Place, where he prayed for wisdom to prevail within the BJP-led central government. Additionally, he paid homage to Mahatma Gandhi at Rajghat. Singh’s post-release activities included a meeting with Sunita Kejriwal, the wife of Chief Minister Arvind Kejriwal.
Arrest Of Delhi CM
Kejriwal was arrested on March 21 by the Enforcement Directorate in connection with the excise policy case. The trial court on April 1, sent Arvind Kejriwal to Judicial Custody till April 15, 2024. ED alleged that the Aam Adami Party (AAP) is the major beneficiary of the proceeds of crime generated in the alleged liquor scam. The agency claimed that Kejriwal was directly involved in the formation of the excise policy.
The case pertains to alleged irregularities and money laundering in framing and implementing the Delhi Excise Policy 2022, which was later scrapped. While Kejriwal was not named in the FIRs registered by the ED or the Central Bureau of Investigation in the Delhi excise policy case, his name first found a mention in the ED’s chargesheet, wherein the agency claimed that he allegedly spoke to one of the main accused, Sameer Mahendru, in a video call and asked him to continue working with co-accused and AAP communications-in-charge Vijay Nair.
Nair was among the first people to be arrested by the CBI in the case, in 2022. Subsequently, former deputy chief minister Manish Sisodia and Rajya Sabha MP Sanjay Singh were arrested in connection with the case.

Arvind Kejriwal: AAP to cite Subrata Roy precedent to give Arvind Kejriwal access to facilities to run govt
The Aam Aadmi Party plans to plead in court that a part of the Tihar Central Jail complex be declared as ‘prison’ to allow Delhi chief minister Arvind Kejriwal to gain access to video conferencing and other office facilities essential to run the Delhi government.
According to AAP insiders, the party’s legal team is doing spadework to petition the court citing precedents when undertrials were allowed to operate their offices from inside Tihar jail.
“The most high-profile precedent is that of Sahara group’s Subrata Roy who got permission from court to use office facility inside Tihar jail to negotiate sale of his luxury hotels in New York and London to raise his bail money. In 2014, the special court complex inside Tihar was declared ‘jail’ by director-general (prisons),” a senior AAP functionary, who did not wish to be identified, told ET.The functionary said that Unitech promoters Sanjay Chandra and Ajay Chandra were also found to be illegally operating an office from Tihar jail. “If those who have swindled money of the people can run their offices, the court should not have a problem to grant the request of an elected chief minister for similar facilities.” Under the Prisons Act, the director-general (prisons) or the lieutenant-governor have the powers to declare any facility as a “prison” for security reasons or for ease of operation.
With Kejriwal remanded to jail and refusing to quit as CM, an unprecedented situation has emerged for the first time in history, of a CM insisting on running the government from behind bars. As per Rule 1349 of the Jail Manual, only 10 facilities are extended to an undertrial prisoner – legal defence, interviews with lawyers or family members (for legal purposes), signing vakalatnamas, delegation of power of attorney, execution of will, essential religious necessities as per rules, applications to courts for legal aid at government cost as per provisions of law, other applications to courts, application to legal aid societies for free legal aid and such other facilities as are sanctioned by the government. These do not include video conferencing facilities or signatures on files.

The Jail Number 2 will be 24×7 in the CCTV surveillance. His jail barrack will have a bed, drinking water and a cooler to avoid the summer heat. Moreover, Tihar Jail also provides continuous medical support to inmates, including Kejriwal, who struggles with diabetes. Considering his health condition, specific dietary requirements have been sought for Kejriwal. Similar to other inmates, Kejriwal is provided access to television channels broadcasting news, entertainment, and sports, except during scheduled prison activities. The Delhi CM has also requested to be provided with a few books including Ramayana, Mahabharata, Geeta and ‘How Prime Minister Decides’.
Arvind Kejriwal’s Routine In Jail
Arvind Kejriwal’s daily regimen in Tihar Jail follows a stringent timetable, starting promptly at sunrise, around 6:30 am. The day begins with a simple breakfast consisting of tea and slices of bread, followed by possible court appearances or meetings with his legal advisors. At around 10.30 am, he will get rice, vegetable, 5 rotis and pulse. At 3.30 pm, he will be given tea and biscuits. He will be allowed to meet visitors and lawyers at 4pm. The Delhi CM will once again get rice, vegetable, 5 rotis and pulse at 5.30 pm and between 6-7pm, he will have to return to his cell.

BJP govt subverting democracy and Constitution: Opposition leaders
New Delhi: In a show of strength and unity, the INDIA bloc came together at Delhi’s Ramlila Maidan on Sunday and blew the poll bugle for Lok Sabha elections with a scathing attack on Narendra Modi government, accusing it of subverting democracy and Constitution.
All major Opposition leaders – Sonia Gandhi, son Rahul, daughter Priyanka, Mallikarjun Kharge, Sharad Pawar, Akhilesh Yadav, Tejashwi Yadav, Sitaram Yechury, D Raja, Uddhav Thackerary, son Aditya, Farooq Abdullah, Mehbooba Mufti, Champai Soren – came together at ‘Loktantra Bachao Rally’ to press for the release of Delhi chief minister Arvind Kejriwal and Jharkhand’s former CM Hemant Soren.
Kejriwal’s March 21 arrest is the immediate trigger for the entire Opposition to come together, but the finer optics of the rally went far beyond. For starters, Trinamool Congress, which could not hammer out a seat-sharing pact with the Congress in West Bengal, came out strongly in support of the INDIA bloc, with leader Derek O’Brien stating that his party “was, is and will be with INDIA bloc”. Sonia, who has been keeping away from most public engagements, made a rare appearance and sat next to Kejriwal’s wife Sunita to show her support. Two chairs were kept empty on the stage for Kejriwal and Soren to emphasise that Opposition leaders’ arrest by central investigative agencies was the central point of the rally.The Opposition put forth following demands to the Election Commission of India: A level playing field before elections, efforts to forcefully scuttle Opposition parties’ finances should be immediately stopped, action by ED, CBI and the Income-Tax department should be stopped and a Supreme Court-monitored special investigation team should probe the electoral bonds scheme.
Wife reads Kejriwal messageThe rally, which was organised by AAP to garner support for its jailed national convenor, saw emotions run high when Sunita carried a message from her husband and read it out. Striking an instant chord with the crowd, she said BJP wanted her husband to resign as CM and asked the crowd if he should. As supporters responded in the negative, Sunita said she believed her husband was a “lion” and “they won’t be able to keep him in jail for too long”. Her voice choked with emotion as she said that though her husband had not taken the permission of other INDIA bloc partners, he wanted to give six guarantees on behalf of the Opposition.
The guarantees included 24×7 power across the country, free electricity to the poor, constructing excellent government schools in every village and neighbourhood, establishing mohalla clinic in every village, ensuring fair price for crops to farmers as given in Swaminathan Commission report and full statehood for Delhi.MODI trying to fix polls: RahulSenior Congress leader Rahul Gandhi warned that Prime Minister Narendra Modi was desperately trying to “fix” elections, the way sometimes cricket matches are fixed. Pointing out the way cricket matches are fixed by various methods like appointing umpires of choice, buying out players and intimidating captains, same way Modi appointed election commissioners of his choice, was trying to pressurise judiciary and had jailed two chief ministers, Soren and Kejriwal, just ahead of elections. He said all bank accounts of Congress had been frozen right at the start of the election process in a clear attempt to prevent it from campaigning.
Shiv Sena UBT chief Uddhav Thackeray gave a catchy slogan to counter BJP’s call of “is baar chaar sau paar”. He said this time it should be “is baar BJP tadi paar” (throw out BJP this time). Tejashwi said the way BJP was showing confidence that it would cross 400, it seemed that it had already tampered with electronic voting machines (EVMs). The rally came on a day Modi flagged off BJP’s campaign in Uttar Pradesh. Akhilesh, however, appeared confident. “I have heard that people from Delhi are outside today somewhere. This is an indication of the times to come. People will throw him out of Delhi very soon,” he said.
