  • SC to hear Arvind Kejriwal’s plea against arrest in money laundering case on April 29

    New Delhi, The Supreme Court is scheduled to hear on Monday a plea by Delhi Chief Minister Arvind Kejriwal challenging his arrest in a money laundering case stemming from the alleged excise policy scam. A bench of Justices Sanjiv Khanna and Dipankar Datta is likely to hear the matter. Kejriwal had earlier told the apex court that his “illegal arrest” in the case constitutes an unprecedented assault on the tenets of democracy based on “free and fair elections” and “federalism”. In a rejoinder to the Enforcement Directorate’s (ED) reply affidavit filed on his petition challenging his arrest in the case, Kejriwal said the mode, manner and timing of his arrest just before the Lok Sabha elections when the Model Code of Conduct had come into play, speaks volumes about the “arbitrariness” of the agency. Kejriwal claimed it is a “classical case” of how the Centre has misused the ED and its wide powers under the Prevention of Money Laundering Act to “crush” the Aam Aadmi Party (AAP) and its leaders. He said a level playing field, which is a pre-requisite for ‘free and fair elections’, has clearly been compromised with his illegal arrest. It said the entire basis of Kejriwal’s arrest rests upon certain statements which are in the nature of “self-incriminating confessions” by alleged accomplices who have been given the immunity by way of pardon etc. “Whether such statements could qualify as materials to reach the conclusion of guilt as envisaged under section 19 PMLA to justify the arrest of a sitting chief minister of NCT of Delhi or a national convenor of a national political party in India in the midst of general elections,” it asked.

    In the rejoinder, Kejriwal alleged the only objective of the ED was to procure and obtain some statement against him and as soon as the statement was taken, the mission of the probe agency was accomplished and thereafter, the co-accused were neither arrested nor any further statements were taken.

    The AAP leader claimed the malicious intent of the ED in conducting the investigation was apparent from its deliberate concealment of statements made by co-accused individuals where either no allegations were made or allegations were explicitly denied.

    Kejriwal also said there is no link whatsoever established by the ED to claim that an amount of Rs 45 crore was transferred by the South group as advanced kickback which was then utilised by the AAP in the Goa elections.

    The chief minister said the ED, in its reply affidavit filed in the apex court, has said that one of the reasons which necessitated his arrest was that he did not remain present before the investigating officer (IO) despite being summoned nine times.

    In its reply affidavit filed in the apex court earlier this week, the ED has claimed that Kejriwal is the “kingpin and key conspirator” of the excise policy scam and the arrest of a person for an offence based on material can never violate the “concept of free and fair elections”.

    The ED arrested Kejriwal on March 21 after the Delhi High Court refused to grant him protection from coercive action by the federal anti-money laundering agency. He is currently lodged in Tihar jail under judicial custody.

    On April 15, the top court issued a notice to the ED and sought its response to Kejriwal’s plea.

    The high court had on April 9 upheld Kejriwal’s arrest in the money laundering case, saying there was no illegality about it and that the ED was left with “little option” after he skipped repeated summonses and refused to join the investigation.

    The matter pertains to alleged corruption and money laundering in the formulation and execution of the Delhi government’s excise policy for 2021-22 which was later scrapped.

    NEW DELHI: Delhi Chief Minister Arvind Kejriwal on Saturday filed his response to the Enforcement Directorate’s affidavit in the Supreme Court, saying that there is no proof that AAP received funds or advanced kickbacks in connection with the ongoing probe into the liquor policy case. In his reply, the AAP chief stated that the mode, manner, and timing of his arrest just before when the schedule of the Lok Sabha elections 2024 was announced and the Model Code of Conduct had come into force speaks volumes about the arbitrariness of the ED.

    The jailed Delhi Chief Minister further claimed that there exists no proof or material demonstrating that the AAP received funds or advanced kickbacks from the South group, let alone utilising them in the Goa election campaign. 

    “Not a single rupee was traced back to the AAP, and the allegations put forth in this regard are devoid of any tangible evidence, rendering them vague, baseless without any corroboration,” Arvind Kejriwal said in his affidavit.

    Kejriwal also accused the Enforcement Directorate (ED) of acting in a “most highhanded manner” in a money-laundering case stemming from the alleged excise policy scam. In a rejoinder to the ED’s reply affidavit filed on his petition challenging his arrest in the case, Kejriwal said he has always cooperated with the investigation.

    The Aam Aadmi Party (AAP) national convenor said the ED, in its reply affidavit filed in the apex court, has said that one of the reasons which necessitated his arrest was that he did not remain present before the investigating officer (IO) despite being summoned nine times.

    Kejriwal said the ED has said in its reply that in such a case, the IO was justified in forming an opinion that custodial interrogation would lead to “a qualitatively more elicitation orientated” questioning of the accused.

    “The aforementioned tenor, text and contents of the reply leave no manner of doubt that the ED has acted in a most highhanded manner in a gross affront to the due process of law,” he said.

    Kejriwal further claimed that a cumulative reading of the ED’s stand in its reply would expose the “bogey and blatant falsehood” in the conduct of its proceedings. The AAP supremo said the record would reveal that each and every summons issued to him was duly responded to while seeking vital details and information, which under no circumstances can be claimed to be privileged or confidential by the ED.

    Kejriwal claimed that the ED has never spelt out the alleged non-cooperation by him. “What was the requirement in not calling the petitioner (Kejriwal) either through an authorised agent or seeking information or documents from him in writing or through a virtual mode and insisting on his presence physically in person, is not forthcoming,” he said.

    Kejriwal maintained that his plea deserves to be allowed and he is entitled to be released forthwith.

    HC was dealing with a PIL by NGO Social Jurist, represented by advocate Ashok Agarwal, and had earlier summoned the MCD commissioner who blamed the absence of a standing committee, which has the power to award contracts worth more than Rs 5 crore, for the delay.

    “Your client is just a person looking for more and more power.….I don’t know how much power you want. The problem is because you are trying to appropriate power…you are not getting it,” the bench said. It said people who lead must “carry everyone along” as it cannot be a case of “one-man upmanship.”

    The court took a dim view of the submissions by Farasat, made on instructions from urban development minister Saurabh Bharadwaj. “We will record your statement that it is because the chief minister is in custody that the minister cannot do anything. If that’s his personal call, good luck to him….You are asking us to go down that track and we will come with full vigour. Don’t think we don’t have the guts to pass an order,” said justice Manmohan.

    HC had prima facie said there could not be a vacuum in the absence of a standing committee, and in such a situation, the financial power has to be delegated by Delhi govt to another authority.

    Highlighting the “admitted facts”, HC remarked that several projects concerning distribution of books and medicines were stalled and asked, “Don’t you have a heart? Don’t you feel for them? I don’t think you are seeing any of this. I think you are just shedding crocodile tears.”

    It said Delhi government does not feel for the common man. “Desks and chairs are broken. Will the mayor like her children to study in a place where tables are broken?” asked the court, posting the PIL for directions on April 29.

    New Delhi, The Aam Aadmi Party on Saturday alleged that Delhi Chief Minister Arvind Kejriwal is being pushed towards a “slow death” inside Tihar jail by denying him insulin and consultations with his doctor. Kejriwal, who has Type-2 diabetes, has been asking for insulin and a video conferencing with his family doctor but his requests are being denied by the jail administration, party spokesperson Saurabh Bharadwaj said in a press conference. “I want to say with full responsibility that a conspiracy is underway for the slow death of Kejriwal,” Bharadwaj claimed citing blood sugar readings of the Chief Minister in jail. He also slammed the Tihar administration, BJP, Centre and Delhi LG for allegedly denying insulin to Kejriwal and said the Delhi Chief Minister had been suffering from diabetes for the last 20-22 years. On Friday, the chief minister council Senior advocate Abhishek Singhvi said Kejriwal has not been administered insulin to control his sugar levels since his arrest, terming it “shocking” and “alarming”. Bharadwaj said Kejriwal was allowed by the court to use a machine in the jail to monitor his daily blood sugar levels.

    “Overall, it was a conspiracy to finish Kejriwal so his multiple organ damage and when he comes out of jail after 2-4 months he goes for treatment of kidney, heart and other organs,” said Bharadwaj, who holds the portfolio of health in Delhi government.

    AAP MP Sanjay Singh emphasized the substantial achievements of the AAP-led governments in Delhi and Punjab, asserting that their exemplary work has garnered recognition from nations across the globe. He underscored Chief Minister Arvind Kejriwal’s pivotal role in realizing the vision of ‘Ram Rajya’ in Delhi and reiterated the party’s commitment to translating this vision into tangible reality.

She accentuated Kejriwal’s unwavering dedication over the past nine years, likening it to Lord Ram’s steadfast resolve during his exile.

    “Being inspired by Ram Charit Manas, Kejriwal ji has said that he has been working for the last 9 years to fulfil the promises made by him to the people of Delhi and Punjab. Lord Ram had to face a struggle to fulfil Ram Rajya. He went into exile for 14 years but did not break his promise. Kejriwal also had to go through a similar struggle,” she said.

By showcasing the developmental strides made in Delhi and Punjab, the initiative aims to inspire citizens to make informed electoral choices for a better future. “He (Kejriwal) sends a message from jail, asking if the water, electricity, and health arrangements in Delhi are fine or not.     Delhi Court Extends Kejriwal’s Judicial Custody

    The Rouse Avenue court on Monday extended the judicial custody of AAP chief Arvind Kejriwal till April 23, 2024. The Delhi CM attended the court session via video conferencing. Meanwhile, the Supreme Court also issued notice to the Enforcement Directorate (ED) on a plea by Kejriwal challenging his arrest by the agency and his subsequent remand in the excise policy case.

    A bench of Justices Sanjiv Khanna and Dipankar Datta refused to give an early hearing of the case as sought by senior advocate Abhishek Manu Singhvi appearing for Kejriwal. Kejriwal, who was arrested on the night of March 21, was produced virtually before Special Judge Kaveri Baweja of the Rouse Avenue Courts on the expiry of his judicial custody.

    The Court said it is extending custody until April 23, when judicial custody of the co-accused (BRS leader K Kavitha) is also ending. Earlier, AAP leader Kejriwal approached the Supreme Court challenging a Delhi High Court judgement that dismissed his plea against arrest by the ED and his subsequent remand in the excise policy case.

    On April 9, the High Court dismissed his plea for release from jail and rejected his argument of political vendetta amid the looming Lok Sabha elections. The High Court had said that Kejriwal’s absence from nine ED summons over six months undermined any claims of special privilege as Chief Minister, suggesting his arrest was an inevitable consequence of his non-cooperation.

    Filing the appeal against the High Court judgement, Kejriwal said that there is no material in the possession of the Enforcement Directorate on the basis of which an inference of guilt can be made under Section 19 of the Prevention of Money Laundering Act (PMLA).

    The arrest was made solely based on the subsequent, contradictory, and highly belated statements of co-accused who have now turned approvers, the appeal stated. Kejriwal was arrested by the ED on March 21 in connection with a money laundering probe relating to alleged irregularities in the now-cancelled Delhi excise policy 2021-22.

    The BJP leader further stated, “For the so-called Aam Aadmi chief minister, the court has clearly said that the law cannot be different for the common man and AAP’s chief minister…The ‘Aam Aadmi’ cape has been pulled off as he (Arvind Kejriwal) wanted the treatment of a ‘Khas Aadmi’.”

    The reaction from the BJP came after the Delhi High Court dismissed Chief Minister Arvind Kejriwal’s plea challenging his arrest by the Enforcement Directorate in connection with the Excise policy case and said that Kejriwal’s arrest is not in contravention of Law and remand can’t be termed “illegal”.

    The bench of Justice Swarna Kanta Sharma said ED was in possession of enough material which had led them to arrest Kejriwal. Non-joining of the investigation by Kejriwal, the delay caused by him also impacting those in judicial custody.

    The material collected by the Enforcement Directorate reveals that Arvind Kejriwal conspired and was actively involved in the use and concealment of proceeds of crime. The ED case also reveals that he was involved in his personal capacity as well as the convenor of Aam Aadmi Party.

    The court further stated that this court is of the opinion that the accused has been arrested and his arrest and remand have to be examined as per law and not as per the timing of elections. Kejriwal’s challenge to the timing of arrest before General elections in the absence of any mala fide on part of ED not sustainable, said the court.

    Arvind Kejriwal through the plea alleged that the ED has at the time of arrest “failed to establish” that the petitioner is guilty of committing activities stipulated under Section 3, i.e., be it one of concealment, possession, acquisition, use of proceeds of crime as much as projecting it as untainted property or claiming it to be so.

    Kejriwal was arrested on March 21 by the Enforcement Directorate in relation to the excise policy case. The trial court on April 1, sent Arvind Kejriwal to judicial custody till April 15, 2024. ED alleged that the Aam Adami Party (AAP) is the major beneficiary of the proceeds of crime generated in the alleged liquor scam. The agency also claimed that Kejriwal was directly involved in the formation of the excise policy.

    Delhi Liquor Policy Case: A Background 

    The case pertains to alleged irregularities and money laundering in framing and implementing the Delhi Excise Policy 2022, which was later scrapped.

    While Kejriwal was not named in the FIRs registered by the ED or the Central Bureau of Investigation in the Delhi excise policy case, his name first found a mention in the ED’s chargesheet, wherein the agency claimed that he allegedly spoke to one of the main accused, Sameer Mahendru, in a video call and asked him to continue working with co-accused and AAP communications-in-charge Vijay Nair.

    Nair was among the first people to be arrested by the CBI in the case, in 2022. Subsequently, former deputy chief minister Manish Sisodia and Rajya Sabha MP Sanjay Singh were arrested in connection with the case. The latter, however, was granted bail by the Supreme Court last week.
