Hamid Hussain Khan was appointed on 5 October 2021 as per the provisions contained in the Waqf Act. On January 1, 2024, the presiding officer of Chhattisgarh General Administration Department, citing the order issued on December 15, 2023, issued an order to terminate the service of Hamid Hussain Khan.

The order of the presiding officer was challenged by Hamid Hussain Khan in the High Court through his advocates Sandeep Dubey and Manas Vajpayee. The hearing of the said case took place on 29 February in the court of single bench Justice Rakesh Mohan Pandey of the High Court.

Advocate Sandeep Dubey cited that the appointment of Hamid Hussain Khan as a member of the Chhattisgarh State Waqf Tribunal was as per the provisions contained in the Waqf Act. While hearing the petition of Hamid Hussain Khan, the High Court has put a stay on the matter till further orders issued by the Presiding Officer.
