The apex court said that the Delhi Special Police Establishment Act, which requires the consent of the state government for the CBI for powers and jurisdiction. These provisions conform to the federal character of the Constitution.
In fact, the Maharashtra government had issued an order withdrawing the permission given to the CBI for investigation in the state. However, with the withdrawal of permission from Maharashtra government, there will be no impact on the ongoing investigation. But if the CBI wants to investigate into a new case in Maharashtra in future, it will need to get permission from the state government.
