The Supreme Court can give a decision on the interim bail of Chief Minister Arvind Kejriwal on Friday. But before that, ED filed an affidavit in the Supreme Court strongly opposing Kejriwal’s interim bail. ED has said in its affidavit that no one can be given interim bail for election campaign. Campaigning for elections is not a legal right. Giving security for election campaign will start a wrong tradition.
ED Deputy Director Bhanu Priya has filed an affidavit. It has been said in this affidavit that if Kejriwal gets interim bail, dishonest politicians will get a chance to escape under the guise of elections. ED has said that the right to campaign is not fundamental, constitutional or legal. Politicians cannot demand any special facility like any common citizen. Politicians can also be arrested and detained like ordinary citizens if they commit crimes.
Arguing against the interim bail of Arvind Kejriwal, ED has said that to the knowledge of the investigating agency, perhaps no such case has come to light so far in which any leader has been granted interim bail for election campaign. ED said that elections are held throughout the year and if Kejriwal is granted bail then no politician will be detained or arrested. ED said that even a candidate contesting elections while in custody does not get interim bail to campaign. In a new affidavit filed in the Supreme Court, the ED said that Arvind Kejriwal is not contesting the Lok Sabha elections and no political leader was granted interim bail for election campaign.
Arvind Kejriwal was arrested by ED in liquor scam. Arvind Kejriwal has challenged his arrest in the Supreme Court. During the hearing on this, the Supreme Court had said that it would consider granting interim bail to Arvind Kejriwal for election campaign. The court had reserved its decision after hearing the arguments of both the parties. The court may give its verdict on Friday.
