Clarification on FCRA 2026: No Ban on NGOs Receiving Overseas Grants

New Delhi – The Indian foreign ministry has issued a formal clarification to dispel the notion that the upcoming FCRA amendment seeks to block foreign assistance to non‑governmental organisations. Ambassador Vinay Mohan Kwatra, speaking on X, affirmed that the bill strengthens monitoring but does not shut down compliant civil‑society bodies.

He pointed out that foreign contribution regulations are a common feature of modern governance, aiming to ensure that funds are channelled responsibly and that beneficiaries are accountable. The amendment builds on the 1976 FCRA framework, which was modernised in 2010 and further refined in 2016, 2018 and 2020.

The ambassador cited figures indicating that foreign contributions to registered NGOs more than doubled over the past decade, reaching $2.67 billion in the 2024‑25 fiscal year. Yet only about 14,450 of the estimated three million NGOs in the country hold an FCRA registration, underscoring that most organisations are not directly affected by the new provisions.

Addressing concerns about potential asset confiscation, Kwatra explained that any assets tied to foreign donations are already overseen by a state‑appointed authority since 2010. The 2026 amendment adds a dedicated body to safeguard those assets and to facilitate their return when an organisation reinstates its registration.
