The arrests were made on charges of criminal conspiracy and helping Dubey in his nefarious design by providing him cash and cartridges hours before the Bikru village ambush.

Vikas Dubey encounter: Judicial commission gives clean chit to Kanpur Police

LUCKNOW: The three-member judicial inquiry commission set up on the directives of the Supreme Court to probe into the encounter killing of gangster Vikas Dubey after the Bikhru massacre has given a clean chit to Kanpur Police. The panel said there is no doubt about the police version of the episode.
The report of the commission was tabled by the state parliamentary affairs minister Suresh Khanna in the Assembly. In its report, the commission said there was no contradiction of police claims from either the public or media regarding the encounter killings of Dubey and his aides following the massacre of eight police personnel including a DySP in Bikhru village of Kanpur on the intervening night of July 2 and 3, last year, according to sources.
The commission, which took eight months to complete the investigation, had submitted an 824-page report to the state government on April 21. The commission said that even no evidence was filed to rebut the police claims regarding Dubey’s killing.
Dubey and his men ambushed the police party killing 8 cops on the spot. However, later it was established that the Chaubeypur police station in-charge and some other cops of the same police station were hand in gloves with Dubey and had informed him beforehand of the arrival of the police party.
The judicial commission, headed by Justice BS Chauhan, a retired judge of Supreme Court, also comprised of retired Allahabad High Court judge Justice Shashi Kant Agarwal and former DGP of Uttar Pradesh KL Gupta.
The commission in its report further said there was enough material on record to establish that Dubey and his gang had the patronage of the local police, revenue, and administrative officials.

After the Bikhru massacre, Dubey was arrested by Ujjain police in front of the Mahakal temple and handed him over to Kanpur police. He was killed in an encounter when the police vehicle carrying him from Ujjain to Kanpur met with an accident and he tried to escape from custody, the police had said.
The commission said the evidence and post-mortem reports supported the police version of the killing of Dubey and other members of his gang.
However, the slain gangster’s wife Richa Dubey had filed an affidavit calling the incident a fake encounter, but she did not appear before the commission. The commission said in its report that there was no suspicion or doubt about the police version of this incident and the magisterial inquiry report conducted by CMM (chief metropolitan magistrate) Kanpur had a similar finding.
The report observed that though Dubey’s name appeared on the list of top-10 criminals in the police circle, he was not on the list of top-10 criminals of the district. Rather, the family members of Dubey were elected to local bodies. Most of the family members were granted arms licenceS, passport Sand fair price shopS on the recommendations of the competent authorities, the report further stated.
Investigation in any case lodged against the members of the gang headed by Vikas Dubey was never impartial, the report said. There was a total failure of the intelligence unit in Kanpur in gathering information about the possession of sophisticated weapons by Vikas Dubey, the commission report added.

LUCKNOW: A three-member commission probing the encounter of gangster Vikas Dubey has given a clean chit to police, stating their version of events about his death were supported by evidence.
The commission said that Kanpur ambush in which eight cops were killed occurred because of “poor planning” by the police as it did not assess the situation correctly and there was “total failure” of Kanpur local intelligence.
Parliamentary Affairs Minister Suresh Khanna tabled the report in the Uttar Pradesh Assembly on Thursday.
“The evidence adduced in the (Dubey encounter) case supports police’s version of the incident. The injuries suffered by policemen could not be self-inflicted or fabricated. Dr RS Mishra, who was on the panel of doctors, conducted the post-mortem and clarified that the injuries found on his person (Dubey) could be caused as per the version of police,” the report said.
“Nobody came forward from the public and media to controvert the police version and no evidence is filed in rebuttal. Richa Dubey, wife of Vikas, filed an affidavit calling the incident a fake encounter but she did not appear before the commission,” it said, adding that in such eventuality, no suspicion or doubt arises about the police’s version of the incident.
A magisterial inquiry conducted by Chief Metropolitan Magistrate Kanpur Nagar has a similar finding.
Eight police personnel, including deputy superintendent of police, were killed during a raid on Dubey’s house at Bikru village in Kanpur district on the night of July 2-3, 2020.
Later, Dubey was killed in an encounter when a police vehicle carrying him from Ujjain to Kanpur met with an accident and he tried to escape from custody, the police had said.
The commission comprised Justice (Retd) BS Chauhan, Justice (Retd) SK Agarwal and former UP director general of police KL Gupta.
It had submitted a 824-page report to the state government on April 21.
The commission said there is “sufficient material on record” to show that Vikas Dubey and his gang were patronised by the local police, revenue and administrative officials.
“He (Vikas) and his associates had been in touch with such officials, and the officers were also communicating with them.
If any person lodged any complaint against Vikas or his associates, the complainant was always humiliated by the police.
Even if higher authorities gave directions to lodge a complaint, the local police dictated the terms,” it said.
Though his name appeared in the list of top 10 criminals in the circle, he did not feature among top 10 criminals of the district, it said, adding that the members of his gang were included in a peace committee to resolve communal disputes.
“His wife was elected as a Zila Panchayat member and his brother’s wife was elected as Bikru village’s pradhan. They were both living in Lucknow. If any person of the area wanted help from them, he would contact Vikas Dubey and he would resolve their problem.
The elected people never came into the picture,” the report said.
Most of his family members had arms licences, and recommendations for them had been made by competent authorities by concealing material facts of their involvement in criminal cases.
Their position was the same when it came to issuance of passports in their favour and/or grant of fair price shop licences, the commission noted.
“Investigation in any case lodged against them (Dubey’s gang) was never impartial. Sections relating to serious offences were dropped before filing the chargesheet. During the trial, most of the witnesses turn hostile.
Vikas Dubey and his associates got bail orders from courts easily and quickly as there was no serious opposition by state authorities or government advocates,” it added.
“He was involved in 64 criminal cases. State authorities never considered it appropriate to engage a special counsel for his prosecution,” it said, adding the state never moved any application for cancellation of bail or approached a superior court for cancellation of any bail orders.
In most of the cases, the high court had granted interim relief to Dubey, staying the proceedings before subordinate courts in criminal cases, and he remained under the protection of such orders for 13-14 years, it said.
The commission said the HC granted bail to Dubey and his associates mainly on the ground that he had been acquitted in a large number of cases, without attempting to know under what circumstances he was acquitted and how and why the witnesses turned hostile in most of the cases.
About the ambush, it said some police personnel posted in Chaubeypur police station had intimated Dubey about the impending raid which gave him an opportunity to call his associates with arms.
“There was a total failure of intelligence unit in Kanpur in collecting information about criminal activities and possession of sophisticated weapons (legal and illegal) by Vikas Dubey and his gang. No proper caution was taken while preparing for the raid, as 38/40 police personnel reached village Bikru and none of them was wearing a bulletproof jacket.
Only 18 of them had arms, the rest had gone empty-handed or with sticks,” the report said.
The incident occurred because of “poor planning” by the police as it did not assess the situation correctly.
“In fact, it did never expect that Dubey would retaliate with sophisticated weapons and his associates would take positions on on the roofs of houses. They were unaware that some police officials of Chaubeypur had already informed Dubey about the raid,” it said.

Allahabad HC denies bail to slain gangster Vikas Dubey’s relative

ALLAHABAD: Terming the killing of eight policemen in the Kanpur ambush last year as a “horrendous crime”, the Allahabad High Court denied bail to a woman relative of the slain gangster Vikas Dubey.Khushi is the widow of Amar Dubey, an aide and relative of the slain gangster.
She had allegedly taken an active part in the ambush at Kanpur’s Bikru village on July 3 last year, according to police.
Days after the ambush, Vikas Dubey was shot dead by the UP Police as he allegedly tried to flee from their custody.
Khushi had filed the plea against the rejection of bail by a lower court, citing that she had no role in the ambush.
In her plea, Khushi said she was declared a juvenile by a board on September 1, 2020.
According to her counsel, Khushi’s age was around 16 years 10 months on the date of the incident.
It was further pleaded that she was not a member of the gang of Vikas Dubey, rather her husband was a relative of the slain gangster and they had gone to Vikas Dubey’s house on the day of the incident.
However, the state government opposed the bail plea on the ground that as per statements of the policemen who survived the ambush, she actively participated in the assault.
She was aiding and instigating the men not to spare any policeman, the state government said in the court.
Dismissing the bail plea on Friday, Justice J J Munir observed, “An overall look on the circumstances of the case brings to mind the fact that the occurrence, in which the revisionist was involved, was not of an ordinary kind.”
“Not only the spontaneous elimination of eight policemen in action and six others left injured, is a horrendous crime that shocks the conscience of the society but also an act that strikes at the roots of the state’s authority in its territory,” the court said.

Inquiry commission gives ‘clean chit’ to UP Police in Vikas Dubey encounter case

LUCKNOW: The three-member inquiry commission probing the encounter killings of gangster Vikas Dubey and five of his alleged associates has given a clean chit to Uttar Pradesh Police because of lack of evidence, sources said on Wednesday.The commission is headed by former Supreme Court judge B S Chauhan.
The other two members are former Allahabad High Court judge Sashi Kant Agrawal and former UP Director General of Police K L Gupta.
The panel submitted its reported to the state government on Monday, eight months after it was set up.
“Yes the commission has submitted its report to the state government on Monday. A copy of the report will be submitted in the Supreme court also,” Gupta told PTI.
He, however, did not elaborate on the contents of the report.
Asked about it, Additional Chief Secretary, Home, Awanish Kumar Awasthi said, “I would not like to comment on it.”
According to the sources, the inquiry commission has found no evidence of wrongdoing by the state police.
Speaking to PTI, a senior police official said, “No witnesses came forward to challenge the police claims even after advertisements in newspapers and media. Also, no one from the media came forward to get their versions recorded.”
There were, however, witnesses supporting the police version, he added.
On July 3 last year, eight policemen were killed in an ambush in Bikru village in Chaubeypur area of Kanpur when they were going to arrest Vikas Dubey.
Police later killed Prem Prakash Pandey (55) and Atul Dubey (35) in an encounter in Kanpur on July 3.
On July 8, Amar Dubey (30), who carried a reward of Rs 50,000 on him, was killed in an encounter in Maudaha village in Hamirpur district.
On July 9, Praveen Dubey, alias Bauwa (48), and Prabhat, alias Kartikeya (28), were killed in separate encounters in Etawah and Kanpur districts.
Six PILs were filed in the Supreme Court after this to seek a court-monitored probe into the encounter killings.
The apex court had then on July 22, 2020 approved the Uttar Pradesh government’s decision to institute the inquiry commission.

Vikas Dubey encounter: Late gangster’s aides try to sell weapons through links in Madhya Pradesh

BHOPAL: Eight months after he was gunned down in an alleged encounter on Kanpur’s outskirts by the Uttar Pradesh Police’s Special Task Force, slain gangster Vikas Dubey and his gang are still said to have loyalists in Madhya Pradesh.Two men, Abhishek Sharma and Jaggu Kushwah, both natives of Mehgaon and Bhind Dehat area of Bhind district were arrested by the police on Saturday and two guns belonging to the slain gangster’s gang were seized from them.
One of the two guns was a semi-automatic rifle of US make, while the other gun was a 12 bore double barrel gun. Both the seized guns were licensed weapons owned by Dubey’s kin and gang members. One of the guns was licensed in the name of Dubey’s brother Deepak Dubey, who had quietly surrendered before a Lucknow court in December 2020, five months after his most wanted brother’s arrest and encounter.
According to IG (Chambal Range) Manoj Sharma, the two men had been tasked to sell the two guns to interested people, particularly the semi-automatic rifle which was likely to fetch prices running into lakhs of rupees.
Among the arrested duo, Sharma is also accused in the theft of 14 guns from the safe custody of the Bhind district court a year and half back. 12 of those guns have been seized so far. The recent arrest comes close on the heels of the arrest of seven men by the Uttar Pradesh STF from Kanpur Dehat area.
The arrested men included another Bhind resident Manish Yadav, who is the alleged link between Dubey’s gang and his aides in UP and the duo arrested on Saturday. The seven men arrested from Kanpur Dehat area on March 1 had allegedly rendered shelter to Dubey and were accused of selling and buying weapons used by Dubey’s gang members.
It is recalled that Dubey and hs gang had allegedly killed eight Uttar Pradesh police personnel on the intervening night of July 2 and 3 last year. He had subsequently gone underground, particularly after his key aides were killed in police encounter, before surfacing at the Mahakaleshwar Temple in Ujjain on July 9.
He was arrested by the Madhya Pradesh Police and handed over to the UP Police the same day. Dubey was gunned down by the UP cops in an alleged encounter the next morning, after he tried to escape following the overturning of the vehicle in which he was being taken.
After Dubey’s dramatic arrest in Ujjain and subsequent encounter in UP last year, two men were held by the Uttar Pradesh STF from Gwalior for giving shelter to key aides of Dubey, who were allegedly involved in the killing of the UP police personnel.

Clean chit to Kanpur cops as probe finds gangster encounter genuine

LUCKNOW: The Magisterial and judicial probe into the killing of four criminals in three encounters subsequent to the massacre of eight police personnel in Bikru village in July, last year, has given a clean chit Kanpur police.A customary probe was ordered by the Kanpur DM into the encounter killings, including dreaded gangster Vikas Dubey’s who masterminded and executed the massacre of eight policemen, in Bikru village under Chaubeypur police station area in Kanpur Dehat on July 2, last year.
On July 3, Kanpur police had launched a hunt for the killers during which they spotted Vikas Dubey’s two accomplices – Prem Kumar Pandey and Atul Dubey — in Kanshiram Nivada adjacent to Bikru.
When the policemen challenged the criminals, they allegedly opened fire and the police team retaliated and eliminated both of them. The probe into this encounter was handed over to Additional District Magistrate (ADM-Land Procurement).
The second encounter killing was that of Prabhat Mishra. He was eliminated by the police team while being brought to Kanpur from Faridabad in Haryana, where he was arrested.
Prabhat tried to escape taking advantage of the punctured tyre of the police vehicle in which he was being transported to Kanpur. The third encounter killing was that of the gangster Vikas Dubey himself.
He was shot dead by the sleuths of Special Task Force (STF) of UP police while being brought back to Kanpur from Ujjain in Madhya Pradesh.
According to Kanpur DM Alok Tiwari, while judicial probe was ordered into the killing of Vikas Dubey and Prabhat Mishra, Magisterial probe was ordered into the killing of Prem Kumar Pandey and Atul Dubey.
“All the three probes have been completed and the policemen have been given a clean chit as the encounter killings were found genuine,” he said while addressing media.
