The U.S. Department of Homeland Security has recently issued crucial updated guidance regarding the $100,000 fee associated with H-1B visas. This clarification arrives amidst ongoing legal challenges, including a lawsuit filed by the U.S. Chamber of Commerce against the previous administration’s rules, which were described as “unlawful.”

Key updates for current H-1B visa holders indicate significant relief. Individuals transitioning to H-1B status from other visa types, such as F-1 student visas, will be exempt from the $100,000 application fee. Furthermore, existing H-1B workers who require amendments, changes of status, or extensions of stay within the United States will also not face this new fee requirement.

In a substantial positive development for current H-1B visa holders, the updated guidelines confirm they will not be prevented from traveling internationally. This proclamation is specifically targeted at new visa petitions for individuals located outside the U.S. who do not currently possess a valid H-1B visa. An online payment portal has been made available for these new applications.

The US Department of Homeland Security (DHS) has put forward new regulations that would significantly alter the way nonimmigrant visas are handled for academic students (F visas), exchange visitors (J visas), and representatives of foreign information media (I visas). The proposal replaces the existing “duration of status” framework with fixed admission periods. The aim is to ensure that these nonimmigrants are admitted for a specific, defined period, rather than indefinitely, contingent upon their adherence to the terms of their status. Under the proposed changes, individuals seeking to extend their stay beyond the initial admission period would need to apply directly to DHS for an extension. This move comes amid concerns related to oversight and national security, with DHS highlighting that the current system does not provide sufficient opportunities to verify that visa holders are engaged in authorized activities. The changes propose a maximum four-year admission and extension period for F and J visa holders, a reduction in the grace period for F-1 students after completing their studies, restrictions on graduate-level F-1 students changing programs mid-course, and a 240-day cap for I visa holders, with certain exceptions. The DHS believes these changes will enable immigration officers to regularly assess whether nonimmigrants are complying with the conditions of their visas and US immigration laws.

Argentina has eased entry regulations for Indian citizens holding valid US visas, making it easier for them to visit the South American nation. The Argentine government announced this change, allowing Indian citizens with US visas to enter the country without applying for a separate Argentine visa. This decision, aimed at boosting tourism, was announced on social media by Argentina’s Ambassador to India, Mariano Caucino. The official gazette published the resolution, stating that Indian citizens with a tourist visa for the United States can enter Argentina without needing an Argentine visa. This move is expected to strengthen tourism and bilateral relations between the two countries, offering easier access for Indian travelers planning vacations in Argentina. The policy also highlights the growing cooperation between the US and India, fostering increased people-to-people and tourism ties. Approximately 2.2 million Indians traveled to the US in 2024, and the US issues over one million visas to Indians annually.

Over 55 million foreign nationals in the United States are facing visa reviews, with potential cancellations and deportations for those violating immigration laws. This has created an atmosphere of fear…

Over 55 million foreign nationals in the United States are facing visa reviews, with potential cancellations and deportations for those violating immigration laws. This has created an atmosphere of fear among Pakistani citizens and students. The Pakistani embassy in Washington estimates that between 700,000 and 1 million Pakistanis reside in the US, many of whom have become US citizens or have been long-term residents. The exact number remains uncertain.

The US Department of State states that actions will be taken against individuals involved in criminal, terrorist, or anti-American activities, and those who overstay their visa. Investigations will include scrutiny of foreign nationals’ social media accounts and potential legal proceedings in their home countries. Actions will also be taken if there are signs of hostility towards American citizens, culture, government, or institutions.

Students who participated in pro-Palestine demonstrations are worried. Samina Ali, a student in Baltimore, Maryland, stated that she and her friends participated in pro-Palestine protests, and are now concerned about visa cancellations or deportation.

Approximately 12,500 Pakistani students are expected to be in the US by 2025. Pakistani officials are advising students to be cautious regarding legal documents and political activities.

Violations of traffic rules and protests on college campuses must be reported to the US Department of Homeland Security (DHS). A court in North Virginia recently informed two Pakistani students that courts are now required to share traffic violation records with the DHS.

Pakistani students are now avoiding demonstrations. Yunus Khan, a student in Baltimore, said they were planning a trip to Chicago but were advised against it, as even a small mistake could lead to visa revocation. The Pakistani embassy has stated it is monitoring the situation and advising caution in political activities.

Mohammad Sajid, a student at George Mason University, said that it has become difficult to get short-term jobs. Concerns are also emerging regarding the future of Pakistanis seeking political asylum.

Applicants for specific US visas are now required to make their social media profiles public. The US Embassy in India announced on June 23rd that those applying for F, M, or J non-immigrant visas must adjust their privacy settings to ‘public.’ This change aims to enhance security checks and verify applicants’ identities and admissibility. This follows the existing requirement since 2019 for applicants to provide social media identifiers. The U.S. government uses all available information to identify those inadmissible, including threats to national security. While this impacts visa applicants globally, India is currently unaffected by the new travel ban, although Indian applicants may still face significant processing delays due to high demand.
