<p>The Congress party has launched a strong attack on the central government, asserting that the Right to Information (RTI) Act has been significantly weakened since 2014. This, they claim, has eroded transparency and the democratic fabric of India. The party alleges that the current BJP-led administration has imposed restrictions on public access to information through amendments to the RTI Act.</p>



<p>During a press conference at Congress Bhavan, State Congress President Keshav Mahto Kamlesh detailed the accusations. He highlighted that the historic RTI Act was enacted on October 12, 2005, under the UPA government led by Dr. Manmohan Singh and Sonia Gandhi. Its primary objective was to grant citizens easy access to information held by public authorities, thereby fostering a transparent and accountable governance system.</p>



<p>Kamlesh pointed to the 2019 amendments as a major blow to the autonomy of the RTI Act, increasing executive influence. Previously, Information Commissioners had a fixed five-year tenure with secure service conditions. However, the amendments empowered the central government to determine their service terms and tenure. Furthermore, the Digital Personal Data Protection Act of 2023 expanded the definition of personal information, restricting its disclosure in the public interest, which was previously permissible. This change could potentially obstruct the revelation of information concerning public duties or the utilization of public funds.</p>



<p>He cited examples of past revelations made possible by the original RTI provisions, such as financial irregularities in MPLADS funds, ghost beneficiaries in MGNREGA, and opaque political funding. The party also raised concerns about the Central Information Commission (CIC), where only two commissioners are currently functioning against 11 sanctioned posts. As of November 2024, approximately 23,000 cases are pending before the CIC. When information regarding the expenditure on the Prime Minister&#8217;s foreign tours, the actual number of COVID-related deaths due to oxygen shortages, and the use of the PM CARES Fund was sought through RTI, no satisfactory response was provided. Data requests related to electoral bonds were also initially denied, only becoming public after a Supreme Court order.</p>



<p>The Congress further criticized the delay in notifying the Whistleblowers Protection Act, passed by both houses of Parliament during the UPA era. This crucial law, intended to protect those who expose corruption, has reportedly not been implemented by the Modi government since 2014.</p>



<p>Marking 20 years of the RTI Act, the Congress has put forth several demands: the repeal of the 2019 amendments, a review and revision of Section 44(3) of the DPDP Act that undermines RTI&#8217;s objectives, immediate appointments to fill vacant positions in the CIC, public disclosure of the commission&#8217;s performance standards and disposal rates, implementation of the Whistleblowers Protection Act, and the inclusion of journalists, social activists, academics, and women representatives in the Information Commissions.</p>

<p>The ECI is taking these steps in light of allegations and scrutiny, particularly concerning the upcoming Bihar assembly elections. The commission is responding to issues raised by opposition parties and suggestions for increased transparency. The context is drawn from the understanding that the margins in postal ballot results can be narrow, potentially inviting allegations. Questions have been raised about postal ballot counting, especially when the winning margin is small. The 2024 by-election in the Nanded Lok Sabha seat in Maharashtra serves as an example, where a close victory highlighted these concerns.</p>



<p>The ECI&#8217;s decision to complete EVM counting after postal ballots aims to address these issues. This policy will be implemented in the upcoming Bihar assembly elections, where the final EVM/VVPAT count will begin only after postal ballot counting is complete. Previously, EVM counting could occur before postal ballot counting, sometimes leading to confusion due to time differences. The ECI believes that issuing new guidelines for postal ballot counting is a significant step towards streamlining the electoral process, reducing delays, and increasing clarity in the vote counting procedure. Postal ballot counting will start at 8 a.m., followed by EVM counting at 8:30 a.m. EVM/VVPAT counting will commence only after postal ballots have been counted. <p>The Election Commission has taken decisive action against political parties deemed inactive. The commission removed 474 unregistered political parties (RUPPs) from its list for not contesting elections or adhering to regulations over the past six years. This action follows the removal of 334 parties on August 9th, bringing the total to 808 parties delisted in the last two months. The Election Commission stated that this move aims to make the electoral system cleaner and more transparent.</p>



<p>The Election Commission clarified that it was necessary to remove parties that had not contested any elections for six consecutive years. Based on this, 474 parties were delisted on September 18th. Before this, on August 9th, 334 parties were removed. Now, a total of 808 parties have been removed. Previously, there were 2,520 unrecognized parties across the country, which has now reduced to 2,046. In addition, there are 6 national and 67 state-level recognized parties in the country.</p>



<p>This action by the Election Commission comes at a time when the Bihar Assembly elections are scheduled for November. Among the delisted parties, 14 are from Bihar. This means these parties will no longer be able to field their candidates in the elections. Officials said that many parties were neither contesting elections nor submitting reports of their annual accounts and expenses. During 2021-22, 2022-23, and 2023-24, 359 parties were found that did not submit audited accounts and election expense reports.</p>



<p>Previously, several parties were found violating income tax and money laundering laws. The Election Commission believes that removing such inactive or suspicious parties is necessary to make the system clean and transparent. Under Section 29A of the Representation of the People Act, 1951, registered parties are entitled to facilities like tax exemptions. Therefore, removing parties that are not active will improve the system. However, delisted parties can re-register later.</p>
