  • Supreme Court allows screening of ‘The Kerala Story’ in West Bengal

    NEW DELHI: The Supreme Court on Thursday stayed the West Bengal government’s May 8 order banning the screening of the film ‘The Kerala Story’ in the state. 

    The bench also directed the filmmaker to put a disclaimer in the movie, which claims 32,000 women from Kerala were converted to Islam, that it is a “fictionalised version of events”. On West Bengal’s contention that screening of the film will disturb social harmony, the bench said it is the duty of the state to maintain law and order as the film has been granted certification by the Central Board of Film Certification. 

    Observing that the film has been released everywhere in the country and that law can’t be used to “put a premium on public intolerance”, the Supreme Court also directed the Tamil Nadu government to provide adequate security to movie goers. “No steps shall be taken by Tamil Nadu govt or its officers or instrumentalities including police to prevent screening of film,” the court said in the order. “You can’t make fundamental right of free speech to be dependent on public display of emotion… You don’t like it, don’t see,” the bench said, adding: “Bad films bomb at the box office”. 

    Earlier, theatre owners in Tamil Nadu had refused to screen the film fearing law and order issues. The order came in a plea filed by makers of the Kerala Story, Sunshine Pictures Private Ltd, and Vipul Amrutlal Shah challenging the Mamata Banerjee government’s decision to ban the screening of the film. The bench, then, posted the petitions for final disposal on July 18 saying the judges would like to watch the movie before deciding the challenge to the grant of certification to the film.

    NEW DELHI: Supreme Court agreed to hear on May 12 pleas filed by makers of the controversial multilingual film ‘The Kerala Story’ challenging Mamata Banerjee Govt’s decision to ban the screening of the film. The plea has also sought protection from screening the film in Tamil Nadu alleging that the movie is also facing a shadow ban in the state. 

    Senior advocate Harish Salve mentioned the matter for urgent listing before a bench comprising Chief Justice D Y Chandrachud and Justice P S Narasimha. Referring to the fact that the bench had listed the plea challenging Kerala HCs order of refusing to ban the movie on May 15, CJI initially proposed to also list this plea on May 15 but when Senior Advocate Harish Salve said that the “makers were losing money every day,” CJI agreed to hear the plea on May 12. 

    Filmmakers in the plea have said that State Government has no power to ban a movie that has been certified for public viewing by the Central Board of Film Certification and that State Government cannot cite law and order issues to stop the screening of the movie, which will result in the violation of the fundamental rights guaranteed to them. 

    Specifically with regards to Tamil Nadu, the plea says that exhibitors in the State withdrew the film after the informal messaging by the State authorities. 

    “Any such ban, it has been repeatedly held, would constitute an unreasonable restriction on the fundamental right under Article 19(1)(a) of the Constitution of India to engage in free speech. The stifling of the right to free speech of the Petitioner, that too on a mere apprehension of unsubstantiated considerations of law and order cannot withstand scrutiny under the Constitutional scheme,” the petition stated.

  • MP becomes first state to declare ‘The Kerala Story’ movie tax free

    BHOPAL: Just a day after its nationwide theatrical release, the controversial Adah Sharma-starrer The Kerala Story was declared tax free in BJP-ruled Madhya Pradesh on Saturday.

    The decision by the Shivraj Singh Chouhan government to give tax breaks to the movie (which focuses on the alleged forced religious conversion of women in Kerala before they were inducted into the terror outfit ISIS) happened six months before the next assembly polls in the central Indian state.   

    Announcing the decision himself, the MP CM Shivraj Singh Chouhan said, “The Kerala Story exposes the plot of Love Jihad, religious conversion and terrorism. It brings to the fore, the disgusting face of these menaces. This film also reveals how the lives of those daughters are destroyed, who in momentary emotions get trapped in Love Jihad. It also tells us about the designs of terrorism.”

    “We’ve already enacted a law to stop forced religious conversion in MP. This film needs to be watched by everyone, including parents and children, particularly the daughters. This is why the MP government is declaring this film tax free,” Chouhan declared in a video message.

    Just a few days ago, some ruling BJP leaders, including state party secretary Rahul Kothari, had written to the MP CM requesting him to declare The Kerala Story tax free in the state.

    With Saturday’s development, MP became the first state in the country to give a tax break to the controversial movie.

    The Kerala Story has now become the fifth film in three years to have been declared tax free in the central Indian state.

    In January 2020, the then Kamal Nath-led Congress government had declared the Deepika Padukone-starrer movie Chhapaak (based on the true story of an acid attack survivor woman) tax free.

    The next month, in February 2020, the same Congress government (just a few days before it was brought down by its own MLAs) had declared Taapsee Pannu-starrer movie Thappad tax free in the state.

    More than two years later in March 2022, the Shivraj Singh Chouhan-led present BJP government declared Vivek Agnihotri-directed The Kashmir Files tax free in the state.

    Three months later the same BJP government declared the Akshay Kumar-starrer Samrat Prithviraj as tax free.

  • SC refuses to entertain pleas against movie “The Kerala Story”, asks petitioners to approach HC

    NEW DELHI: The Supreme Court on Wednesday refused to entertain pleas related to the movie “The Kerala Story”, and asked the petitioners to approach the jurisdictional high court.

    The film is scheduled to release on May 5.

    The pleas, including the one which sought that a disclaimer should be added to the title of the film that it is a work of fiction, was mentioned for urgent listing before a bench comprising Chief Justice D Y Chandrachud and Justice P S Narasimha.

    “The reliefs which have been sought under Article 32 can well be pursued in appropriate proceedings before the high court under Article 226,” the bench said, adding, “We are not inclined to entertain the petition on that ground.

    We leave it open to the petitioners to move the appropriate high court.”

    An advocate, appearing for one of the petitioners, said a petition has been filed in the Kerala High Court against the movie and it is listed for hearing on May 5, the day when the film is scheduled to be released pan India.

    The bench observed, “Seasoned judges are manning the high court.

    They are aware of local circumstances. Why should we become a super (Article) 226 court?”.
