  • SC sets aside Calcutta HC order imposing fine of Rs 25 lakh on TMC leader Kuntal Ghosh

    By PTI

NEW DELHI: In a relief to TMC youth wing leader Kuntal Ghosh, an accused in the alleged teacher’s recruitment scam in West Bengal, the Supreme Court on Friday set aside the Calcutta High Court order imposing a fine of Rs 25 lakh on him.

A bench of Chief Justice D Y Chandrachud and justices J B Pardiwala and Manoj Misra, meanwhile, said Ghosh can raise his plea of “custodial torture” before the special court hearing the matter.

Senior advocate Siddharth Dave, appearing for Ghosh, said the observations made by the high court on the merits of the case and the imposition of the fine of Rs 25 lakh were unwarranted.

“The order for the payment of costs of Rs 25 lakhs shall stand deleted,” the bench said.

Justice Amrita Sinha of the Calcutta High Court had in May rejected the pleas by Abhishek Banerjee, TMC general secretary and a nephew of West Bengal Chief Minister Mamata Banerjee, and Kuntal Ghosh seeking recall of Justice Abhijit Gangopadhyay’s order to the CBI and the Enforcement Directorate (ED) to interrogate the duo in the alleged school recruitment scam.

She had also imposed a fine of Rs 25 lakh on each of them for wasting the court’s time in trying to have Justice Gangopadhyay’s April 13 order set aside.

“The High Court has clarified that, at that stage, it was not expressing any opinion on the legality or correctness of the complaint in regard to custodial torture. In the circumstances, the impugned order of the High Court shall not preclude the petitioner from pursuing the complaint before the Special Court,” the apex court said while disposing of Ghosh’s petition.

Justice Abhijit Gangopadhyay had in his April 13 order said in a speech by Banerjee, quoting Ghosh that he was under pressure from central agencies to implicate the lawmaker in the recruitment scam case should be within the ambit of CBI’s investigation into the alleged recruitment scam.

GONDA: A 32-year-old teacher was strangled by two men at his house in this district while he was giving online video lessons, police said on Wednesday.

The mobile phone, using which the teacher Krishna Kumar Yadav was giving online classes continued to record the video that was later retrieved by police to identify the assailants.

Yadav, a native of Ambedkarnagar district, was living in a rented accommodation in Forbesganj locality here, police said.

Additional Superintendent of Police Shivraj on Wednesday said Yadav was strangled on Saturday evening while he was alone in his room and giving an online tuition class.

“We have arrested both the attackers,” the Additional SP said.

Police said one of the accused said he was in a relationship with the teacher’s sister and was angry at being rebuked by Krishna Yadav over the issue.

“The attackers, Sandeep Yadav and Jawahir Mishra alias Jagga, entered his house and strangulated him after an argument,” the officer said.

Police sources said Yadav worked at a private school and lived with his sister who was also a teacher.

The main accused, Sandeep Yadav, started talking to Krishna Yadav’s sister, who was also a teacher.

Krishna Yadav rebuked Sandeep over the issue.

“Sandeep informed us during interrogation that he killed Krishna Kumar Yadav because he was against his relationship with Krishna Yadav’s sister,” the officer said.

“Sandeep sought help of his friend Jagga to murder Krishna Kumar Yadav. Both the attackers have been arrested and were sent to jail,” he added.

  • 40 DU students, teachers detained during protest on campus in support of G N Saibaba

    By PTI

NEW DELHI: The police here on Saturday detained around 40 students and teachers protesting at the Delhi University’s Arts Faculty without permission to press for the release of former professor GN Saibaba, officials said, hours after the Supreme Court stayed his acquittal by the Bombay High Court in a Maoist-links case.

The Left-backed All India Students’ Association, however, claimed the number of detainees is higher, and also alleged the protesting students and teachers AISA members were “beaten up and manhandled” by the police.

The protest was organised after the Supreme Court suspended a Bombay High Court order acquitting Saibaba and others in a Maoist-links case.

“Students and professors who were peacefully protesting against the stay on the acquittal and wrongful incarceration of our professor, G N Saibaba were brutally detained, beaten up and manhandled,” AISA National Working General Secretary Prasenjeet.

“Around 60 people were detained. The protestors were taken to two police stations. Some of the students were taken to the Maurice Nagar Police Station and the rest were taken to Burari Police Station,” he added.

The police said the students were told they were not given a permission by the university administration to hold a protest on the campus, but they insisted and “misbehaved with the police and security staff of the university”.

“On Saturday around 2.30 pm, some students having affiliation with AISA and other Left organisations started gathering outside the Arts Faculty, Delhi University North Campus. Initially some five students came and started raising slogans,” Deputy Commissioner of Police (north) Sagar Singh Kalsi said.

“They were explained about the denial of permission to hold protest and were directed to disperse, but instead of dispersing they started calling their other friends for protest and their number rose to around 40,” Kalsi added.

The action was taken after the university authorities gave in writing to take legal action as protesting students were disturbing the peace, police added.

“During the process of removal, they resisted and misbehaved with the police and security staff of the university. Now the situation is peaceful,” the police said.

The Nagpur bench of the Bombay High Court had on Friday acquitted Saibaba and ordered his release from jail, noting that the sanction order issued to prosecute the accused in the case under the stringent provisions of the Unlawful Activities (Prevention) Act was “bad in law and invalid”.

The high court had also allowed the appeals filed by five other convicts, acquitting them of all charges. The prosecution had moved the apex court against the acquittal. Saibaba, 52, is lodged at the Nagpur Central Jail.

  • Maharashtra: Teachers seek govt nod to board local trains, priority in vaccination for attending schools

    By PTI
MUMBAI: The Maharashtra government’s recent order directing teachers to attend schools has not gone down well with the teaching fraternity for the lack of any assurance on prioritising them for vaccination against COVID-19 and the permission to travel by suburban trains in Mumbai.

In a circular issued on Monday, the state government made it mandatory for 50 percent of teachers of class 1 to 9 to conduct online sessions for students from their schools.

A 100 percent attendance is made compulsory for teachers of class 10 and lecturers of junior colleges.

The teachers have been directed to attend schools so that results of class 10 can be released by June-end.

This decision was implemented on June 15 barring the Vidarbha region where it will come into effect from June 26.

Sanjay Daware, Mumbai unit president of the Maharashtra State Aided and Non-aided School Action Committee, said on Wednesday, “the government has issued its circular half-heartedly. We had demanded giving teachers priority in the vaccination drive, but there is no communication from the state government.”

“Teachers in Mumbai had also demanded permission to travel by local trains but there is no clear instruction in the circular about this demand. How teachers are expected to reach schools if they are not allowed to board the trains?” he questioned.

Daware said the government, on one hand, expects teachers to issue results on time so that students do not suffer but on the other hand it has not allowed them permission to travel in local trains.
