  • TN fishers can use purse seine nets two days per week with riders: SC

    NEW DELHI: The Supreme Court on Wednesday allowed conditional use of purse seine nets by the fishermen of Tamil Nadu beyond territorial waters but within the exclusive economic zone of the state on two days per week.  A bench headed by Justice AS Bopanna said that only fishing vessels registered with the state government and under the marine fishing regulation law will be allowed to fish on Mondays and Thursdays from 8.00 am to 6.00 pm using purse seine fishing nets.  

    The bench also said permission will be given by the state fisheries department to only those boats that have approved vessel tracking system. The tracking system must be kept running during the operation of vessels, the court said.  

    The bench also mandated sailors to keep their biometric card/photo ID with them and also provide the code of the vessel tracking system to the fisheries department, marine police, coast guard and the Indian Navy. “The state fisheries department shall also give a colour code to these purse seine net using fishing boats for the above purposes,” the Supreme Court bench  said.   

    ‘Central govt has not restricted use of net’

    The order came on an application seeking interim stay on the state government’s G.O. dated February 17, 2022, banning the use of purse seine nets for fishing. It was argued that the state’s ban was arbitrary and had been passed to destroy the union of India policy.

    It was contended by the petitioners that only union of India has jurisdiction beyond the territorial waters and the centre has not placed any restrictions on purse seine net fishing. It was further contended that the powers of the state legislatures and its executive could not travel beyond the territorial waters of Tamil Nadu.

    Opposing the arguments, senior advocate Mukul Rohatgi said the fishing method is ‘pernicious’ as it is harmful to marine life, including fish. The nonselective fishing method, which captures all kinds of fish including protected species, has a dangerous effect on ecology, Rohatgi said.

  • Plea in SC seeks direction to arrest Sri Lankan Navy personnel accused of killing Indian fishermen

    NEW DELHI: A petition was Tuesday filed in the Supreme Court seeking a direction to the Centre and others to arrest Sri Lankan Navy personnel who are accused of killing four Tamil Nadu fishermen within Indian waters last month.

    Citing information from fishermen that four of their community “died due to an attack” by the Sri Lankan Navy, Tamil Nadu Chief Minister K Palaniswami had on January 21 condemned the island nation maritime force for such acts shattering their livelihood.

    The plea filed in the apex court has also sought a direction to the authorities to take steps to protect Tamil Nadu’s fishermen and their properties from Sri Lankan Navy and to avoid such incidents in future.

    The petition, filed by Tamil Nadu-based organisation ‘Kadalsar Makkal Nala Sangamam’, has sought direction to the authorities to get compensation of Rs five crores each to the family members of four victims from the Sri Lankan government.

    It said that four fishermen, who had set out for fishing from Pudukottai district on January 18, had not returned and later information was received through other fishermen that they had allegedly died due to attack by the Sri Lankan Navy.

    “Three days after, Sri Lanka said an Indian fishing boat sank in its waters following a ‘collision’ with its Navy vessel,” the plea said, alleging that the incident has again brought into focus the tussle over marine resources, fishing rights and maritime boundary.

    The plea, drawn by advocate CR Jaya Sukin, has also referred to the case related to two Italian marines, who were accused of killing two Indian fishermen off the Kerala coast.

    In February 2012, India had accused two Italian marines, Salvatore Girone and Massimiliano Latorre, on board the MV Enrica Lexie — an Italian flagged oil tanker — of killing two Indian fishermen who were on a fishing vessel in India’s Exclusive Economic Zone (EEZ).

    In July last year, the Centre had moved the top court seeking closure of judicial proceedings here against the two Italian marines.

  • MEA for talks with Sri Lanka to address fishermen issue

    NEW DELHI:  A day after lodging a strong protest with the acting Sri Lankan high commissioner over the death of three Indian fishermen, New Delhi on Friday said the matter has been on the agenda of discussions between the two sides for a long time, and there is a realisation at the highest level that it is a humanitarian issue, which has to be handled in a humanitarian manner.

    “Both the countries have agreed that it is a humanitarian issue and should be dealt with accordingly,” Ministry of External Affairs spokesperson Anurag Srivastava said. Three fishermen from Ramanathapuram district in Tamil Nadu had been reported missing on January 19. They were out fishing in a mechanised boat along with many other vessels from the same area.

    The Sri Lankan Navy initially said an Indian boat, with four fishermen on board, sank when patrol vessels sought to apprehend it with other fishing boats that were allegedly poaching in Sri Lankan waters. “Our strong protest in regard to the incident was conveyed by our high commissioner to the Sri Lankan foreign minister (on Thursday). A strong demarche was also made to the Sri Lankan acting high commissioner in New Delhi,” the MEA said in a  statement.
