    NEW DELHI: Senior Congress leader Shashi Tharoor on Thursday took a dig at the government over the Cabinet reshuffle, saying Indians are more affected by the seaworthiness of the ship and the direction it is sailing than by the arrangement of the chairs on the upper deck.

    His remarks came a day after a major Union Cabinet makeover was effected with Prime Minister Narendra Modi dropping 12 ministers, including Health Minister Harsh Vardhan, IT and Law Minister Ravi Shankar Prasad and Information and Broadcasting Minister Prakash Javadekar, and bringing in Sarbananda Sonowal, Narayan Rane and Jyotiraditya Scindia along with 33 other new members to his government.

    Apart from 15 Cabinet ministers, 28 Ministers of State, comprising new faces and those elevated, were sworn in at a ceremony, which was held in the Darbar Hall of the Rashtrapati Bhavan.

    “Wishing the new Council of Ministers well in fulfilling their duties to the people. But Indians are more affected by the seaworthiness of the ship & the direction it’s sailing than by the arrangement of the chairs on the upper deck,” Tharoor tweeted using the hashtag ‘CabinetReshuffle2021’.

    Earlier in the day, the Congress took a dig at the Cabinet expansion in a tweet from its official Twitter handle.

    “Those who used to shout slogans of ‘Minimum Government – Maximum Governance’ till yesterday, those people are today working on the model of ‘Maximum Government – Minimum Governance’. This expansion of the cabinet is not for the country but only a means to serve the interests of their respective parties,” the Congress alleged.

  • ‘Pogonotrophy’: Shashi Tharoor shares new English word, refers to PM Modi while explaining meaning

    NEW DELHI: Congress leader Shashi Tharoor, known for his penchant for rarely used English words, sent the Twitterati running for their dictionaries on Friday with another head-scratcher — pogonotrophy.

    Tharoor said he learnt of the new word pogonotrophy, which means the growing or cultivation of a beard, from a friend. He also used the word to take an apparent dig at Prime Minister Narendra Modi.

    A Twitter user reached out to Tharoor, saying she was waiting to learn a new word and the former Union minister was quick to oblige.

    “My friend Rathin Roy, the economist, taught me a new word today: pogonotrophy, which means ‘the cultivation of a beard’. As in, the PM’s pogonotrophy has been a pandemic preoccupation,” he said in a tweet.

    Tharoor’s tweet left many bemused with a Twitter user saying, “If the world has Oxford dictionary Why not India has Tharur Dictionary (sic)?” “Thanks for sharing this one from Tharoorictionary,” said another user.

    This is not the first time Tharoor has sent Twitterati scurrying for their dictionaries.

    In May, Tharoor engaged in a friendly banter with TRS working president KT Rama Rao over COVID-19 medicine names and threw in another head-scratcher — floccinaucinihilipilification.

    Oxford dictionary describes floccinaucinihilipilification as the action or habit of estimating something as worthless.

    Tharoor has been a man of many words earlier too.

    In the past, he has stumped people with rarely used English words such as “farrago” and “troglodyte”.

    While farrago means a confused mixture, a troglodyte means a person regarded as being deliberately ignorant or old-fashioned.

    Tharoor has also started a new weekly column on words in the Weekend Magazine of the ‘Khaleej Times’ of Dubai.

  • Sunanda Pushkar death case: Delhi Court adjourns to July 27 orders on framing of charges against Shashi Tharoor

    NEW DELHI: Delhi’s Rouse Avenue Court on Friday once again adjourned the passing of order on the issue of framing of charges in Sunanda Pushkar death case to July 27.

    Shashi Tharoor, husband of Sunanda Pushkar is the main accused in the matter according to the Delhi Police.

    Tharoor, former union minister, who is currently on bail in the case, was chargesheeted by Delhi Police under Sections 498-A (husband or relative of husband of a woman subjecting her to cruelty) and 306 (abetment of suicide) of the Indian Penal Code (IPC).

    Special Judge Geetanjali Goyal recently had kept the order reserved after prosecution and defence counsel concluded their arguments on the issue of framing of charges. Public prosecutor stressed that Pushkar has undergone mental cruelty which led to her bad health. Public Prosecutor also argued that it was not an accidental death and relied on the post mortem report which suggests that the cause of death is poisoning which could be oral or injected.

    Prosecutor also said due to the mental cruelty caused to Pushkar, her health became worse. The prosecutor further added that Pushkar was earlier not facing any health issue but problems began due to “stress and betrayal”.

    Tharoor’s Defence counsel and Senior Advocate Vikas Pahwa said the prosecution is not able to establish evidence against the leader and the theory of injecting poison is in the air and can not be admissible.

    Pushkar was found dead in a suite of a luxury hotel in the city on the night of January 17, 2014. Tharoor was later charged under various sections of the Indian Penal Code (IPC) including for abetment to suicide and cruelty. 

  • Social media misuse: Facebook, Google representatives depose before parliamentary committee

    NEW DELHI: Facebook and Google representatives Tuesday deposed before the Parliamentary Standing Committee on Information Technology over the issue of social media misuse and safeguarding citizens’ rights, with sources saying they were told to comply with the new IT rules, government instructions and court orders.

    The panel, chaired by Congress MP Shashi Tharoor, had asked them to appear in-person at the parliament secretariat here.

    The sources also said the representatives were conveyed that there are loopholes in their existing data protection and privacy policy mechanism, and that they need to put in place stringent safeguards to protect data privacy and data security of their users.

    While Facebook’s country public policy director Shivnath Thukral and general counsel Namrata Singh appeared before the panel on behalf of the company, search engine Google was represented by its country head (government affairs and public policy) Aman Jain and director (legal) Gitanjali Duggal.

    The agenda of the parliamentary panel meeting was to safeguard citizens’ rights and prevent the misuse of social/online news media platforms.

    The sources said that Tharoor expressed concern about the privacy of women users of social media platforms.

    He said he has also received complaints from several women MPs in this regard.

    Later, Google said in a statement that it has consistently invested in product changes, resources and personnel as part of its efforts to keep users safe in compliance with the local laws in India.

    “We always welcome opportunities to engage in dialogue with the policy makers and share details of our efforts in combating illegal content and ensuring the safety of users across our platforms,” a Google spokesperson said.

    The spokesperson further stated: “We have consistently invested in significant product changes, resources and personnel, and have made significant progress in balancing the openness of our platforms with the responsibility of keeping the community safe in compliance with the local laws in the country.”

    Comments from Facebook were not immediately available.

    Tharoor also expressed displeasure over some members of panel being quoted in the media to report about the proceedings, with sources saying the MPs present in the meeting agreed the confidentiality clause should be adhered to.

    Earlier, Facebook representatives had informed the parliamentary panel that their company policy does not allow their officials to attend in-person meetings because of their Covid-related protocol.

    But Tharoor conveyed to Facebook that its officials will have to appear in-person since the parliament secretariat does not allow any virtual meetings.

    Facebook and Google representatives were called days after Twitter officials deposed before the panel.

    In the last meeting, several members of the panel had categorically told Twitter that the rule of land is supreme not the social media platform’s policies.

    Also on Tuesday, the parliamentary panel asked Twitter to explain with 48 hours why it had blocked access of Union minister Ravi Shankar Prasad and Tharoor to their accounts, the sources said.

    Last week, Twitter had blocked Union Information and Technology Minister Prasad from accessing his account which ratcheted up tensions with the government as it came under renewed attack for not following local laws.

    NEW DELHI: A parliamentary panel has sought Twitter’s response on the recent locking of the accounts of Union minister Ravi Shankar Prasad and Congress MP Shashi Tharoor, sources said on Tuesday.

    The Parliamentary Standing Committee on Information and Technology has sent a letter to Twitter seeking its response within two days, sources said.

    The panel was instructed by its chairman Tharoor to seek reply from Twitter on the blocking of accounts of Prasad and others on its platform, sources said.

    Last week, Twitter had blocked Union Information and Technology Minister Prasad from accessing his account which ratcheted up tensions with the government as it came under renewed attack for not following local laws.

    Twitter denied Prasad access to his account ‘@rsprasad’ for almost an hour on the grounds that he violated the US Digital Millennium Copyright Act, but the minister said the microblogging platform violated new IT rules that require intermediary or a host of user content to give prior notice before locking access.

    The IT Minister called out Twitter over the brazen arbitrariness and running its “own agenda”.

    Soon after Prasad flagged the issue, Congress leader Shashi Tharoor tweeted that he too had faced something similar.

    “Raviji, the same thing just happened to me. Clearly DMCA is getting hyperactive.

    This tweet has been deleted by @Twitter because its video includes the copyrighted BoneyM song ‘Rasputin’,” Tharoor tweeted.

    Tharoor further said: “As Chairman of the Parliamentary Standing Committee on Information Technology, I can state that we will be seeking an explanation from @TwitterIndia for the locking of @rsprasad’s & my accounts & the rules & procedures they follow while operating in India”.

    Prasad lashed out at Twitter, and in a series of posts on rival social media platform Koo said it was apparent that his statements calling out the “high handedness and arbitrary actions” of Twitter, had ruffled feathers.

  • Parliament panel to seek explanation from Twitter on locking of Ravi Shankar Prasad, Tharoor’s accounts

    NEW DELHI: After Twitter briefly blocked IT Minister Ravi Shankar Prasad from accessing his account for alleged copyrights violation, chairman of the parliamentary panel on information technology Shashi Tharoor on Friday said the same thing happened with him and the standing committee will be seeking an explanation from the social media firm over the temporary locking of their accounts and the rules it follows while operating in India.

    Confronting Twitter, Prasad said it was apparent that his statements calling out the high handedness and arbitrary actions of the micro-blogging platform, particularly sharing clips of interviews to TV channels and the powerful impact had “clearly ruffled its feathers”.

    “Friends! Something highly peculiar happened today. Twitter denied access to my account for almost an hour on the alleged ground that there was a violation of the Digital Millennium Copyright Act of the USA and subsequently they allowed me to access the account,” Prasad said in a tweet.

    Tagging Prasad’s tweet, Tharoor said, “Raviji, the same thing just happened to me. Clearly DMCA is getting hyperactive.”

    He said one of his tweets has been deleted by Twitter because its video included the copyrighted BoneyM song”Rasputin”.

    After a process, the account was unlocked, the Congress leader said.

    Indians creatively make videos using short snippets of foreign music and most people would consider that “fair use”, Tharoor argued in a series of tweets.

    Instead of letting the clip enhance the popularity of their song, the copyright holders have issued a notice, the Lok Sabha MP said, adding that though he had just retweeted it, he was not about to contest their act.

    In this case the complainant was the International Federation of the Phonographic Industry which is zealously defending the rights of Sony Music to “Rasputin”, he said.

    Ironically, Tharoor said, at their last conference in India, he was a keynote speaker.

    “So I won’t blame @Twitter for this action or attribute the motives to them that @rsprasad does, though it wasn’t pleasant finding my account locked. Clearly they had no choice but to honour a DMCA takedown notice, however stupid & pointless the request was,” he said in another tweet.

    But getting a notice from a UK-based organisation, citing Twitter’s role as a service provider under a US law, points to the challenges of Twitter India’s operations in India, Tharoor said.

    The minister has pointed to possible violations of Indian regulations while conforming to foreign rules, he said.

    “As Chairman of the Parliamentary Standing Committee on Information Technology, I can state that we will be seeking an explanation from @TwitterIndia for the locking of @rsprasad’s & my accounts & the rules & procedures they follow while operating in India,” Tharoor said.

    A couple of hours after his series of tweets, Tharoor tweeted that Twitter had locked him out again because to explain the problem, the first tweet in his thread of tweets included the offending copyrighted video.

    “Locking is a foolish response to a DCMA notice; disabling the video (which they’ve now done) should be enough. @Twitter has a lot to learn,” he said.

    Weighing into the issue, Rajya Sabha MP and Shiv Sena leader Priyanka Chaturvedi said this has happened to her verified Facebook page as well with respect to television debates.

    “I had also raised this copyright issue in the department related Committee meeting. Unfortunately, it only pinches when it hits home. No conspiracy sir, it is something that has gone unaddressed & is less understood,” Chaturvedi said, tagging Prasad’s tweet.

    “I had in a committee meeting on copyright and Intellectual Property Rights asked this specific question: how can a TV channel flag a segment as copyright violation for a debate in which I was a part & is shared on my page? The page was allowed access only when post was taken down,” she tweeted.

    However, there was no answer then and not even taken up as a larger issue that needs clarity, she said in her series of tweets on the issue.

    “Today it happened to the IT Minister and he blames the platform! The issue is not you, your position or the platform, it is the lack of clarity. But then we live in the times of narrative setting,” Chaturvedi said.

    The temporary locking of the IT Minister’s Twitter account comes at a time when the US-based digital giant has been engaged in a tussle with the Indian government over the new social media rules.

    The government has slammed Twitter for deliberate defiance and failure to comply with the country’s new IT rules, which has led to the microblogging platform losing its legal shield as an intermediary in India and becoming liable for users posting any unlawful content.

    Lashing out at Twitter, Prasad — in a series of posts on rival social media platform Koo — said it was apparent that his statements calling out the “high handedness and arbitrary actions” of Twitter had ruffled feathers.

    He also tweeted on the issue.

  • Prasad cries foul after Twitter denies him access to account, Tharoor says happened to him too

    NEW DELHI: Union Minister for Information Technology Ravi Shankar Prasad cried foul saying social media giant Twitter denied him access to his account for around an hour on Friday. This was over complaints that he had violated copyright laws by posting his clippings from TV debates.

    “Friends! Something highly peculiar happened today. Twitter denied access to my account for almost an hour on the alleged ground that there was a violation of the Digital Millennium Copyright Act (DMCA) of the US and subsequently they allowed me to access the account,” said Prasad in a tweet.

    He attached a screenshot of the account when it was locked and Twitter’s message which read, “Your account has been locked because Twitter received a compliant Digital Millenium Copyright Act (“DMCA”) Notice for content posted to your Twitter account. Under the DMCA, copyright owners can notify Twitter claiming that a user has infringed their copyrighted works. Upon receipt of a valid DMCA notice, Twitter will remove the identified material. Twitter maintains a repeat copyright infringer policy under which repeat infringer accounts will be suspended. Accruing multiple DMCA strikes may lead to suspension of your account.”

    He posted a subsequent screenshot where it said the account was ‘available for use’.

    Congress leader Shashi Tharoor tweeted saying it happened to him too and said a hyperactive DMCA might be to blame.

    It was something Twitter confirmed in a statement when The New Indian Express reached out to them. A Twitter spokesperson said, “We can confirm that the Honourable Minister’s account access was temporarily restricted due to a DMCA notice only and the referenced Tweet has been withheld. Per our copyright policy, we respond to valid copyright complaints sent to us by a copyright owner or their authorised representatives.”

    Prasad posted a series of tweets in which he alleged Twitter’s actions were in ‘gross violation of Rule 4(8) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021’ where they failed to provide Prasad with any prior notice before denying him access to my own account.

    “It is apparent that my statements calling out the high-handedness and arbitrary actions of Twitter, particularly sharing the clips of my interviews to TV channels and its powerful impact, have clearly ruffled its feathers,” he said in another tweet.

    “Further, it is now apparent as to why Twitter is refusing to comply with the Intermediary Guidelines because if Twitter does comply, it would be unable to arbitrarily deny access to an individual’s account which does not suit their agenda,” he added.

    “Furthermore, in the past several years, no television channel or any anchor has made any complaints about copyright infringements with regard to these news clips of my interviews shared on social media,” Prasad said.

    He added that Twitter’s actions indicated that they were not the harbinger of free speech that they claim to be but were ‘only interested in running their own agenda, with the threat that if you do not tow the line they draw, they will arbitrarily remove you from their platform’.

    “No matter what any platform does they will have to abide by the new IT Rules fully and there shall be no compromise on that,” he said in the last tweet.

    The Digital Millennium Copyright Act of the US criminalises production and dissemination of technology, devices, or services intended to circumvent measures that control access to copyrighted works. It also criminalises the act of circumventing an access control, whether or not there is actual infringement of copyright itself.

    While the Act exempts online service providers exempts them from filtering out copyright infringement, the onus is on copyright holders to request removal of violations.

    This places the burden on copyright holders to request the removal of violations.

    The Centre and Twitter have been at loggerheads since the government notified the IT Rules in February, and over Twitter’s ‘non-compliance’ of rules.

    Recently, Prasad had tweeted that Twitter failed to comply with the new IT Rules despite being given multiple opportunities. He had said that the ‘rule of law’ was bedrock of Indian society. 

  • Rule of land is supreme, not your policy, Twitter told by Parliamentary panel on IT

    Twitter India officials on Friday deposed before a parliamentary panel chaired by Shashi Tharoor of the Congress on preventing the misuse of social media.

    The Parliamentary Standing Committee on Information and Technology, chaired by Tharoor, had last week summoned Twitter over issues related to misuse of the platform and protection of citizens’ rights.

    Twitter India’s public policy manager Shagufta Kamran and legal counsel Ayushi Kapoor deposed before the panel on Friday.

    Coming against the backdrop of the faceoff between the Union government and the microblogging platform, the panel told the Twitter officials that the rule of land is supreme and not its policy, reported PTI.

    According to sources, members of the panel have asked Twitter why it should not be fined for ‘violating’ the rule of the land.

    Earlier, the Uttar Pradesh Police on Thursday sent a legal notice to the Managing Director of Twitter India Manish Maheshwari regarding the viral video of the assault on an elderly man in Loni. The MD has been asked to record his statement after the microblogging site “let the anti-social messages go viral”.

    This is the second time the Twitter MD has been called for an inquiry in the last 20 days.

    The police reportedly had also questioned Twitter India MD Manish Maheshwari on May 31 and visited the Twitter India offices in Delhi and Gurgaon on May 24 over the toolkit issue.

    Recently, Twitter also lost its legal indemnity over its failure to comply with the new IT norms.

  • Union minister Ravi Shankar Prasad acquitted in defamation case as Shashi Tharoor withdraws plaint

    THIRUVANANTHAPURAM: Union Minister Ravi Shankar Prasad has been acquitted in the criminal defamation case filed by Shashi Tharoor, MP, as the latter requested the court to withdraw the case. Tharoor made a request to withdraw the case following an out-of-the-court settlement reached between both leaders. 

    In March last year, Ravi Shankar Prasad, who is the Union Minister for Communications, Law and Justice, wrote to Tharoor expressing apology for making certain derogatory remarks against him. The case related to an incident that occurred in October, 2018 when Prasad had alleged that Tharoor was an accused in a murder case. 

    “On receiving subsequent information regarding the conclusion of investigation in the concerned case, I learnt that the said allegation against you is not factually correct. I accordingly, withdraw it unconditionally,” Prasad wrote to Tharoor. The remarks by Prasad against Tharoor were made when the latter had criticised PM Narendra Modi in strong words. In the letter, Prasad said had Tharoor done introspection, he should also have understood his comments against Modi were avoidable.

    “While we differ politically, at times strongly, we both have maintained mutual respect and amity. You could surely appreciate that in a democratic polity, debate, discussion, differences, arguments as well as criticism are of essence. However, while upholding these statutory principles, one should not hurt other’s sentiments and reputation, and I had no intention of doing so in your case”, said Ravisankar Prasad in his letter.

    Acknowledging the apology, Tharoor wrote to Prasad. “It was very gracious of you to withdraw your words in respect of myself, which had offended me greatly. I welcome your sentiments in view of our long association. I am happy to treat the matter as closed,” he said. Subsequently, Tharoor’s lawyer informed the Chief Judicial Magistrate Court, Thiruvananthapuram, about their decision to withdraw the case and the CJM acquitted Ravi Shankar Prasad in the case.
