    New Delhi: AAP Rajya Sabha MP Sanjay Singh on Thursday said the JD(U)’s demand for review of Agnipath scheme is “100 per cent correct” and stressed that the scheme should have been withdrawn earlier. Earlier in the day, JD(U) leader K C Tyagi told reporters here that the party has demanded a review of the Agnipath scheme, and will “pursue” the caste census issue. Speaking to PTI Videos, Singh said, “Agniveer is betrayal with Mother India and the Army. The prime minister should have withdrawn it earlier.” “Earlier a jawan was trained for a year but under this scheme (Agnipath), you reduced the training period to six months. Every youth is ready to sacrifice his or her life for the country. But you are weakening the army. This demand from JDU is 100 per cent correct,” the AAP leader added. In June 2022, the government rolled out the Agnipath recruitment scheme for short-term induction of personnel with an aim to bring down the age profile of the three armed services.     “On behalf of all party MPs and MLAs, we are also writing to the Election Commission and will also seek an appointment with them. This is the language of the BJP. The Election Commission should take cognizance of this matter and take immediate action,” he said.

    The BJP attacked Delhi Chief Minister Arvind Kejriwal on Thursday for avoiding media questions about the alleged assault on his party MP Swati Maliwal at his residence in Delhi, accusing him of behaving more like a “goon”. The Aam Aadmi Party convener was speaking at a press conference earlier in the day in Lucknow with Samajwadi Party leader Akhilesh Yadav, when the Delhi chief minister was questioned about the incident. Kejriwal avoided the question, which was fielded by AAP MP Sanjay Singh, who was also present. Singh stated that his party has already taken a clear position on the issue.

    Delhi BJP chief Virendra Sachdeva chastised the chief minister for avoiding media questions and demanded his resignation immediately, accepting responsibility for the incident.

    BJP national spokesperson Gaurav Bhatia claimed Kejriwal is the main “criminal” in the incident in which his aide Bibhav Kumar allegedly physically attacked Maliwal at the chief minister’s residence. Bhatia also mentioned a phone call Maliwal made to the Delhi Police on the day of the incident.

    “Kejriwal’s silence speaks volumes. “Out of jail, he’s more of a ‘goonda’ than a chief minister,” Bhatia told journalists. Bhatia noted that Bibhav Kumar was photographed with Kejriwal during his visit to Lucknow.
    At the press conference, Sanjay Singh used incidents of crimes against women in Manipur, women wrestlers’ complaints against BJP MP Brij Bhushan Sharan Singh, and the Prajwal Revanna case to criticise the BJP.

    The AAP has made its position clear in the Maliwal case, and no one should politicise it, Singh said.
    Bhatia noted that Singh admitted that a condemnable incident had occurred against Maliwal, and that Kejriwal was expected to act in a case involving a party colleague. Instead, he described the accused as a “twin brother” travelling with him.

    “This shows Kejriwal has no commitment to justice for women, while the BJP is fighting for justice for an opposition leader,” he said, accusing him of cowardice. Bhatia demanded that the AAP leader break his silence or, if he is a coward, resign. He said that the woman The Rajya Sabha MP has been incommunicado since the incident, and the BJP leader wondered if she had been kidnapped or forcibly removed from the public eye.

    He also criticised Yadav for attempting to downplay the incident by claiming that it is not a big deal. Targeting the Samajwadi Party, Bhatia recalled the late SP leader Mulayam Singh Yadav’s controversial defence of some men accused of rape, claiming that “they are boys, they make mistakes.”

    Sachdeva echoed Bhatia’s attack on Akhilesh Yadav, saying nothing more was expected of him. Sachdeva stated that Kejriwal was photographed with Bibhav Kumar and Sanjay Singh at Lucknow airport, demonstrating how seriously the Chief Minister is taking the matter.

    “They are travelling with Kumar, whom they consider an offender. “Lies, deception, and cunning are the hallmarks of Kejriwal and his Aam Aadmi Party,” the Delhi BJP president charged. “Was it not a responsibility of Kejriwal who holds the constitutional post of chief minister and was present at his home at the time of the incident, to lodge a police complaint,” he asked.

    Sanjay Singh also claimed that efforts are being made 24 hours to demoralise Arvind Kejriwal. “This is Arvind Kejriwal, he is made of a different clay… The more you try to break him, the stronger he will come back…Yesterday, CM Bhagwant Mann became emotional during the meeting.     Delhi Court Extends Kejriwal’s Judicial Custody

    The Rouse Avenue court on Monday extended the judicial custody of AAP chief Arvind Kejriwal till April 23, 2024. The Delhi CM attended the court session via video conferencing. Meanwhile, the Supreme Court also issued notice to the Enforcement Directorate (ED) on a plea by Kejriwal challenging his arrest by the agency and his subsequent remand in the excise policy case.

    A bench of Justices Sanjiv Khanna and Dipankar Datta refused to give an early hearing of the case as sought by senior advocate Abhishek Manu Singhvi appearing for Kejriwal. Kejriwal, who was arrested on the night of March 21, was produced virtually before Special Judge Kaveri Baweja of the Rouse Avenue Courts on the expiry of his judicial custody.

    The Court said it is extending custody until April 23, when judicial custody of the co-accused (BRS leader K Kavitha) is also ending. Earlier, AAP leader Kejriwal approached the Supreme Court challenging a Delhi High Court judgement that dismissed his plea against arrest by the ED and his subsequent remand in the excise policy case.

    On April 9, the High Court dismissed his plea for release from jail and rejected his argument of political vendetta amid the looming Lok Sabha elections. The High Court had said that Kejriwal’s absence from nine ED summons over six months undermined any claims of special privilege as Chief Minister, suggesting his arrest was an inevitable consequence of his non-cooperation.

    Filing the appeal against the High Court judgement, Kejriwal said that there is no material in the possession of the Enforcement Directorate on the basis of which an inference of guilt can be made under Section 19 of the Prevention of Money Laundering Act (PMLA).

    The arrest was made solely based on the subsequent, contradictory, and highly belated statements of co-accused who have now turned approvers, the appeal stated. Kejriwal was arrested by the ED on March 21 in connection with a money laundering probe relating to alleged irregularities in the now-cancelled Delhi excise policy 2021-22.

Singh accused the BJP of involvement in the Delhi Excise Policy scam, suggesting that high-ranking members of the party were complicit in the alleged wrongdoing.

    Magunta Reddy Forced To Accuse Kejriwal: Sanjay Singh

    Singh highlighted the case of Magunta Reddy and his son Raghav Magunta, asserting that their statements underwent significant alterations under duress. According to Singh, Magunta Reddy initially provided statements that did not implicate Kejriwal but changed his stance following his son’s arrest and prolonged detention. Similarly, Raghav Magunta allegedly altered his testimony after enduring months of incarceration, eventually inculpating Kejriwal in the purported conspiracy.

    Selective Editing by Authorities

    Singh accused the Enforcement Directorate (ED) of selectively removing statements that did not implicate Kejriwal, thereby allegedly manipulating the narrative to suit their agenda. He claimed that the agency disregarded testimonies that exonerated Kejriwal while emphasizing those that inculpated him, insinuating bias in the investigative process.

    ED Raids And Alleged Intimidation

    Singh further alleged that individuals who initially denied any association with Kejriwal were coerced into incriminating him after facing prolonged detention and intimidation tactics by investigative authorities. He cited the case of Sarath Reddy, whose prolonged detention allegedly led to a change in his testimony, implicating Kejriwal under duress.

    Following his release, Singh visited a Hanuman temple in Connaught Place, where he prayed for wisdom to prevail within the BJP-led central government. Additionally, he paid homage to Mahatma Gandhi at Rajghat. Singh’s post-release activities included a meeting with Sunita Kejriwal, the wife of Chief Minister Arvind Kejriwal.

    Arrest Of Delhi CM

    Kejriwal was arrested on March 21 by the Enforcement Directorate in connection with the excise policy case. The trial court on April 1, sent Arvind Kejriwal to Judicial Custody till April 15, 2024. ED alleged that the Aam Adami Party (AAP) is the major beneficiary of the proceeds of crime generated in the alleged liquor scam. The agency claimed that Kejriwal was directly involved in the formation of the excise policy. 

    The case pertains to alleged irregularities and money laundering in framing and implementing the Delhi Excise Policy 2022, which was later scrapped. While Kejriwal was not named in the FIRs registered by the ED or the Central Bureau of Investigation in the Delhi excise policy case, his name first found a mention in the ED’s chargesheet, wherein the agency claimed that he allegedly spoke to one of the main accused, Sameer Mahendru, in a video call and asked him to continue working with co-accused and AAP communications-in-charge Vijay Nair. 

    Nair was among the first people to be arrested by the CBI in the case, in 2022. Subsequently, former deputy chief minister Manish Sisodia and Rajya Sabha MP Sanjay Singh were arrested in connection with the case.

    The Aam Aadmi Party’s Rajya Sabha MP Sanjay Singh was released from Tihar jail on Wednesday after the procession of his bail order was completed.

    This is a time for struggle and our jailed leaders will also come out soon, said the Rajya Sabha MP after walking out of jail.

    “This is the time to struggle. The biggest leaders of our party (AAP) – Arvind Kejriwal, Manish Sisodia and Satyendar Jain – have been kept behind the bars. I am confident that one day the locks of this prison will be broken and they will come out. This is why I want to say that this is not the time to celebrate, this is the time to struggle.”The Supreme Court on Tuesday granted him bail in a money laundering case related to the Delhi excise policy scam after the Enforcement Directorate said it had no objections.

    Counsel for Sanjay Singh stated that the appellant Sanjay Singh will not make any comment about his role in the present case.

    A three-bench led by Justice Sanjiv Khanna directed to release of Sanjay Singh on bail during the pendency of proceedings in a money laundering case relating to excise policy irregularities.Beside Justice Khanna, other judges on the bench were Justices Dipankar Datta and Prasanna Bhalachandra Varale.Additional Solicitor General SV Raju appearing for the respondent Directorate of Enforcement stated that the probe agency has no objection in case the appellant -Sanjay Singh is released on bail during the pendency of the proceedings.The ED response came after the court sought to know from the investigating agency whether it needed further custody of AAP leader Sanjay Singh in the excise policy case.

    “Given the statement made, we allow the present appeal and direct that the appellant – Sanjay Singh will be released on bail during the pendency of the aforesaid proceedings, on terms and conditions to be fixed by the trial Court,” the top court said.

    “We clarify that the concession given in the Court today would not be treated as a precedent. We also clarify that we have not made any comments on the merits of the case,” the top court added.

    The court observed that Sanjay Singh had spent six months in jail.

    The top court was hearing AAP leader Sanjay Singh’s plea against the Delhi High Court order refusing to grant him bail in the excise policy irregularities case.

    Aam Aadmi Party leader Sanjay Singh has approached the Supreme Court against the Delhi High Court order refusing to grant him bail in connection with an excise policy irregularities case.

    In his bail plea, Sanjay Singh has challenged the Delhi High Court order dated February 7, 2024. Sanjay Singh moved to the High Court when, on December 22, 2023, the trial court dismissed his bail.

    Sanjay Singh was arrested by the Enforcement Directorate on October 4, 2023, in the case.

    According to ED, Sanjay Singh was alleged to be involved in creating a special purpose vehicle to launder the proceeds of crime that would have been generated from the business arising out of the policy changes as conspired by him and his co-conspirators.

    ED also stated that Sanjay Singh has had certain confidential documents about the investigation of this case that are not in the public domain.

  • Sanjay Singh: Delhi excise policy case: Court allows AAP MP Sanjay Singh to take oath in custody

    The Rouse Avenue court on Saturday allowed AAP MP Sanjay Singh to take oath as MP Rajya Sabha on February 5, 2024, in custody. He has been arrested and charge-sheeted in the Delhi Excise Policy money laundering case.Meanwhile, the court extended the judicial custody of Deputy CM Manish Sisodia and AAP MP Sanjay Singh till February 17. Both were produced physically before the court.Special Judge M. K. Nagpal allowed Sanjay Singh’s request to allow him to take oath in judicial custody.He withdrew the plea, seeking interim bail to attend the ongoing Parliament session and to take the oath. It was submitted that he has to appear before a court in Sultanpur, Uttar Pradesh, on February 7.

    Advocates Rajat Bhardwaj, Dr Farrukh Khan and Prakash Priydarshi appeared for Sanjay Singh.

    During the hearing, advocate Tanveer Ahmed Mir, counsel for Amandeep Singh Dhall, submitted that he had received CCTV footage without audio supplied.It was also submitted that the footage contains a confrontation between Dinesh Arora and Amandeep Singh Dhall in March 2023 but it is without audio. Tanveer Ahmed Mir has again submitted that the CCTV footage with audio be provided.He also submitted that some allegations were levelled by Dinesh Arora on April 23, 2023, three days before the filing of the prosecution complaint against Dhall. These allegations were not made in March 2023.

    He also referred to the Supreme Court judgement in Paramveer Saini, where it was directed that all investigation agencies shall have CCTV cameras with video and audio facilities installed.

    Advocate Rajat Bhardwaj moved an application seeking a supply of statements recorded before the court, including those of Raghav Magunta and P Sharat Reddy. Their statements were recorded and given a pardon; now their statements are under unrelied documents.

    The court noted that an application seeking CCTV footage of Dinesh Arora and Sharat Reddy was also filed, but reply not filed.

    An application seeking a direction to place a record of the emails written by accused Dhall to ED is also filed. All these applications will be heard on the next date of hearing.

    The court, on December 19, took cognizance of the supplementary prosecution complaint (charge sheet) filed against AAP MP Sanjay Singh and his Associate Sarvesh Mishra.

    The Enforcement Directorate (ED) on December 2, filed a supplementary prosecution complaint (charge sheet) against Aam Aadmi Party leader Sanjay Singh and his alleged associate Sarvesh Mishra in a money laundering case related to the Excise policy case.

    On October 4, AAP MP Sanjay Singh was arrested by the Enforcement Directorate.

    Earlier, a charge sheet was filed against Manish Sisodia. According to the Enforcement Directorate, it’s a fifth supplementary chargesheet in the case. This case is presently at the stage of scrutiny of documents.

    ED earlier told the court that Sanjay Singh was part of the conspiracy to collect kickbacks from liquor groups in the Delhi excise policy 2021-22.

    Dinesh Arora was in regular touch with Sanjay Singh. This has been proven by an analysis of Call Detail Records. Singh allegedly received proceeds of crime of Rs 2 crore, stated the ED.

    ED earlier claimed that Singh and his associates played a part in the Delhi government’s decision to give licenses to alcohol shops and merchants in 2020, causing losses to the state exchequer and violating anti-corruption laws

    ED had previously searched a number of locations, including the homes and offices of Sanjay Singh’s close associate, Ajit Tyagi and other contractors and businessmen who allegedly benefited from the policy. In its nearly 270-page supplementary charge sheet, the ED has called Sisodia a key conspirator in the case.

    The Delhi liquor scam case or the excise policy case pertains to allegations that the Arvind Kejriwal-led Delhi government’s excise policy for 2021-22 allowed cartelization and favoured certain dealers who had allegedly paid bribes for it, a charge that has been strongly refuted by the AAP.

    Last year, ED filed its first chargesheet in the case. The agency said it has so far undertaken over 200 search operations in this case after filing an FIR after taking cognizance of a CBI case that was registered on the recommendation of the Delhi lieutenant governor.

    The CBI inquiry was recommended based on the findings of the Delhi chief secretary’s report filed in July showing prima facie violations of the GNCTD Act 1991, Transaction of Business Rules (ToBR)-1993, Delhi Excise Act-2009, and Delhi Excise Rules-2010.

    The Enforcement Directorate opposed the bail petition of Aam Aadmi Party leader Sanjay Singh in Excise Policy case before Delhi High Court and alleged that he was involved in creating a special purpose vehicle to launder the proceeds of crime that would have been generated from the business arising out the policy changes as conspired by him and his co-conspirators.Sanjay Singh was then involved in acquiring, possessing, concealing, dissipating and using proceeds of crime generated from the Delhi Liquor Scam pertaining to the policy period of 2021-22, said ED.ED in its reply copy also stated that Sanjay Singh has been in possession of certain confidential documents pertaining to the investigation of this case which are not in public domain. During the search conducted at the premises of the accused Sanjay Singh on 04.10.2023, certain confidential documents which are print of images taken in the office of ED and the same are obtained illegally.Sanjay Singh is one of the key conspirators in the Delhi Liquor Scam. Sanjay Singh is closely associated with number of accused/suspects in this case.

    Singh has gained illegal money/kickbacks which is Proceeds of Crime generated from the liquor policy (2021-22) scam. Further, he has also played role in conspiracy with others in respect of Excise Policy 2020-21.

    Recently, Delhi High Court had sought response of Enforcement Directorate on regular bail plea moved by Aam Aadmi Party’s senior leader Sanjay Singh in a money laundering case related to alleged Delhi’s excise policy scam case. Sanjay Singh was arrested by the Enforcement Directorate in the case on October 4, 2023.The bench of Justice Swarna Kanta Sharma is examining the bail plea of Sanjay Singh.Sanjay Singh through plea stated that he is neither an accused nor a suspect in a scheduled/predicate offence (CBI Offence), wherein, investigation is continuing since 17.8.2022 and despite 3 Charge-Sheets/ Supplementary Charge-Sheets having been filed, absolutely nothing has been surfaced against him till date.

    Bail Plea further stated that at the outset, the Applicant states that the Applicant is not guilty of any criminal wrongdoing or any violation of the provisions of the PMLA in any manner whatsoever and therefore, the Applicant’s life and liberty must be protected from unwarranted and unjustified encroachment at the hands of the DoE on the basis of a false, malicious and motivated case without any merit.

    On December 22, 2023 the trial court had dismissed his bail and said, “the Court is of prima facie view that the case against him is genuine. Evidence shows his involvement in alleged offence of money laundering. There is reasonable grounds for believing that he is guilty of the alleged offence of money laundering.”

    Trial Court Judge expressed his prima facie view and said, “The evidence and material shows involvement of applicant in commission of the alleged offence of money laundering because he is shown to have been, directly or indirectly, involved in the process or activities connected with proceeds of crime generated through the scheduled offences case of CBI.”

    The trial court further had said, “The evidence and material is also sufficient to furnish this court reasonable grounds for believing that he is ‘guilty’ of the said offence in terms of provisions contained Under section 45 of the PMLA.

    It can be said that the conditions laid down by the section 45 for grant of bail are not satisfied.
