Earlier in the day, JD(U) leader K C Tyagi told reporters here that the party has demanded a review of the Agnipath scheme, and will “pursue” the caste census issue. Speaking to PTI Videos, Singh said, “Agniveer is betrayal with Mother India and the Army. The prime minister should have withdrawn it earlier.” “Earlier a jawan was trained for a year but under this scheme (Agnipath), you reduced the training period to six months. Every youth is ready to sacrifice his or her life for the country. But you are weakening the army. This demand from JDU is 100 per cent correct,” the AAP leader added. In June 2022, the government rolled out the Agnipath recruitment scheme for short-term induction of personnel with an aim to bring down the age profile of the three armed services. Man with religious tattoo in hand found unfit for central forces, moves Delhi High Court

NEW DELHI: A man who was declared unfit for recruitment by the Central Armed Police Forces, National Investigation Agency (NIA) and other forces for having a “religious tattoo” on the dorsum of his right hand has approached the Delhi High Court challenging the authorities’ decision.
The counsel for the authorities opposed the plea saying that the right arm is the saluting hand and this tattoo was not permissible under the relevant guidelines of the Ministry of Home Affairs.
The court, which was told by the petitioner that he was willing to remove the tattoo by minor laser surgery, noted the detailed medical examination and the review medical examination showed there were no other defects found in him.
It disposed of the petition by giving liberty to the man to appear before the new medical board constituted by the authorities after the removal of the tattoo.
“Keeping in view the aforesaid position as well as in the interest of justice, we hereby dispose of the present petition by giving liberty to the petitioner to appear before the freshly constituted medical board of the respondents after two weeks from today after having the tattoo in the dorsum of the right hand removed,” the court said.
“In case the petitioner is found fit by the said medical board, the respondents shall further process the selection of petitioner for the post in question in accordance with the law,” a bench of Justices Suresh Kumar Kait and Saurabh Banerjee said in its order.
The petitioner submitted that he was found unfit in the detailed medical examination held on September 28 and thereafter, in review medical examination on September 29 for the post of constable (general duty) in Central Armed Police Forces, NIA, SSF and Rifleman GD in Assam Rifles Examination, 2021 on the ground that he has a religious tattoo marks on the dorsum of the right hand which was not permissible.
He sought quashing of the results of the two examinations and that he be appointed to the post.

Delhi Waqf Board irregularities: Court sends AAP MLA Amanatullah Khan to 14 days judicial custody

NEW DELHI: A Delhi court on Monday sent AAP MLA Amanatullah Khan to 14 days of judicial custody in a case related to alleged irregularities in the Delhi Waqf Board recruitment.
Special Judge Vikas Dhull passed the order and posted the bail hearing for Khan on Tuesday.
Noting that an application was filed by the Anti-Corruption Branch (ACB) for 14 days of judicial custody of the accused, the judge said,” Having regard to the pending investigation and to the fact that alleged offence is non-bailable, the application filed is allowed and accused Amanatullah Khan is remanded to Judicial Custody till October 10, 2022.
The judge further said that at the request of the counsel for the accused, the bail application of Khan was posted for Tuesday at 12 noon.
“ACB is at liberty to file a reply to the bail application of the accused,” the court said.
Earlier, on September 21 the court had extended the custodial interrogation of Khan by five days. The Anti-Corruption Branch (ACB) arrested Khan after conducting raids at his premises on September 16.
According to the FIR, Khan, while working as chairman of the Delhi Waqf Board, illegally recruited 32 people by violating all norms and government guidelines.
The then CEO of Delhi Waqf Board had clearly given a statement and issued a memorandum against such illegal recruitment, it said.
Further, it was alleged that as chairman of the Delhi Waqf Board, Khan rented out several properties of the Waqf Board illegally amid allegations of corruption and favouritism, it added.
The FIR also alleged that Khan misappropriated funds of the Waqf Board comprising grants-in-aid from the Delhi government.

AAP MLA Amanatullah Khan arrested after raids by Delhi anti-corruption branch

NEW DELHI: The Delhi Anti-Corruption Branch on Friday arrested AAP MLA Amanatullah Khan in connection with a graft case, officials said.
The ACB is probing alleged irregularities in the recruitment in the Delhi Waqf Board, which Khan heads as the chairman.
The ACB on Friday conducted searches at Khan’s house and other premises linked to him and seized Rs 24 lakh as well as two unlicensed weapons, the officials said.
The ACB had issued a notice to Khan on Thursday for questioning in connection with the Prevention of Corruption Act case registered in 2020. The Okhla MLA was called for questioning at 12 pm on Friday.
Khan, the chairman of the Delhi Waqf Board, had tweeted about the notice, claiming he has been summoned as he built a new Waqf board office.
A senior official said the searches were conducted on Friday at the house of Khan and his other locations.
A total of Rs 24 lakh in cash, two unlicensed weapon and some cartridges were seized, the official said.
Earlier, the ACB had written to the Lieutenant Governor’s Secretariat that Khan be removed as the Delhi Waqf Board chairman for allegedly hampering a probe by “bullying” witnesses in a case against him.

EWS quota damages “equality” which is the heart of the Constitution: Supreme Court

NEW DELHI: Petitioners challenging the 10% reservation granted to the Economically Weaker Sections (EWS) for admission to central government and private educational institutions and recruitment in central government jobs on Tuesday told the SC that the amendment damages the heart of the Constitution which is equality.
The submission was made before a 5 judge bench comprising CJI UU Lalit, Justices Dinesh Maheshwari, SR Bhat, Bela Trivedi & JB Pardiwala in 39 pleas lead one filed by Janhit Abhiyan that challenged the 103rd Constitutional Amendment that provided a 10% quota for EWS. The pleas were referred to the constitution bench by a bench comprising the then CJI SA Bobde, Justice R Subhash Reddy and Justice BR Gavai on August 5, 2020.
Professor Dr Mohan Gopal assailing the amendment said that the same sought to nullify, and neutralize the constitution’s idea of treating unequals unequally. Asserting that the quota was a fraud on the Constitution, Gopal said that reservation was a tool of representation in the Constitution for backward groups but EWS confined the benefits of reservation only to “forward classes”.
Senior Advocate Meenakshi Arora argued that the 103rd amendment was violative of equality in a manner that diluted Socially and Educationally backward classes which were the beneficiaries of reservation and violated the equality code. She also argued that
“It violates in a manner that it excludes particular segments and thus commitment to equality. For the first time, we’re having an explicit exclusion of the poorest of the poor and the most vulnerable. The procedure is also unequal and discriminatory. To pretend that EWS and backward class both need reservation is not proper. Economic disadvantage is neither entrenched nor enduring. It is temporary and it’s based on an individual disadvantaged which can be remedied with money,’ Arora further said.
Senior Advocate Sanjay Parikh submitted that the 103rd amendment which provided reservation based on economic criteria by excluding SC, ST and OBC was against the equality code and thus violated the basic features of the Constitution. It was also Parikh’s contention that the economic criteria could not fall within the parameters of reservation or special provision as conceived under the Constitution.

Fresh plea in SC challenging government’s Agnipath scheme

NEW DELHI: A fresh plea has been filed in the Supreme Court challenging the Centre’s ‘Agnipath’ scheme for recruitment in the armed forces.
The petition filed by ex-servicemen Ravindra Singh Shekhawat has sought quashing of notification issued by the Ministry of Defence, contending it as illegal, unconstitutional, and ultra vires to the rights guaranteed under the Constitution.
The recently launched scheme has received skepticism nationwide from the armed forces aspirants and has left several questions unanswered. Some of the concerns are related to the aspirants who were in the middle/final stages of their recruitment process.
This abrupt change in the recruitment process has evoked several unforeseeable circumstances for the aspirants and has put their futures at stake/ in the dark.
“The scheme fails to accommodate the individuals who have been preparing for the armed forces for the last many years and have not been able to participate in the recruitment process due to lack of vacancies due to Covid-19,” the plea said.
The petition contended that this scheme jeopardizes the future of aspirants who have already successfully gone through the rigorous selection process of the armed forces once, compelling these individuals to initiate a fresh start for the selection process under the Agnipath Scheme.
“As there is no assurance for these candidates to receive recruitment in the armed forces for which they have already qualified, the time devoted by these candidates for the preparation has gone down the drain.”
“There is no assurance if these individuals will qualify for the Agnipath scheme and despite years of hard work and qualifying for the exam, no fruitful purpose has been served to these candidates,” the plea filed through advocate Rohit Pandey said.
The plea has also sought directions to constitute a committee of Veterans, the Chief of all the Armed Forces, and other appropriate persons to look into the proposed scheme.
It has also sought direction to initiate a ‘Pilot Project’, to study the cause and effect of the Agnipath Scheme, and the impact of the newly introduced training process on combat effectiveness, operational readiness, and defence preparedness.
Several petitions have been filed against the scheme in the apex court. The Agnipath scheme, announced on June 14, provides for the recruitment of youths between the age of 17-and-a-half and 21 for only four years with a provision to retain 25 per cent of them for 15 more years.
Protests have erupted in several states against the scheme. Later, the government extended the upper age limit to 23 years for recruitment in 2022.

Over 9,000 vacancies filled up through fast-track recruitment in Jammu and Kashmir

JAMMU: Over 9,000 vacancies in different departments have been filled up under fast track recruitment in Jammu and Kashmir, officials said on Saturday.
The selection for 5,000 more posts would be finalised by the end of this year, they said.
The government has initiated the largest ever recruitment drive in the union territory in a transparent manner, they said, adding an accelerated committee was constituted for identifying gazetted, non-gazetted and class 4 posts.
“Under the fast track recruitment, 20,323 posts stand advertised by J&K Service Selection Board (SSB) since July last year and presently the selection process has been completed with respect to 9,205 posts. Around 5,000 more selections will be finalised up to December 31,” an official spokesman said.
He said the selection process of remaining posts has reached various stages like skill test, CBRT (Computer Based Written Test) and document verification.
A meeting was chaired by Commissioner Secretary, General Administration Department (GAD), Manoj Kumar Dwivedi here to review the progress of different recruitment being done by J&K Public Service Commission (PSC) and SSB, the spokesman said.
In order to expedite the selection process on a fast track recruitment basis, he said government instructions were reiterated to refer all vacancies as on December 31, both Gazetted and Non-Gazetted, to the PSC and SSB by January 15, next year.
The recruiting agencies were also directed to finalise the calendar for conduct of various examinations well in advance so that the selection process could be completed within a period of one year, the spokesman said.
He said the meeting was informed that the largest ever written test examination has been conducted by SSB wherein 3.5 lakh candidates participated for class 4 posts this year.
Special consideration by way of additional weightage was given to candidates, including those who worked as casual workers for five or more years and widows, divorced women, judicially separated women, orphan girls and others whose family member has not been in government service.
Within a record time of seven days, more than 4,600 appointment orders of class 4 posts have been issued, the spokesman said.
He said 2,119 selections for gazetted posts have been made by JKPSC in various departments and 726 selections are in progress.
JKPSC has also recommended promotions of 287 officers in the year 2020 and 769 officers during the current year, the spokesman said.

The process of recruitment of 14580 teachers is going to start in the country. School Education Department has issued directives in this regard to the Directorate of Public Education. According to the order issued by the School Education Department, the appointment of teachers will be done at the required vacant positions from 9th to 12th standard. In the first phase, teachers will be appointed for 9th, 10th, 11th and 12th only. The candidates selected for these posts have been asked to issue appointment orders. Separate appointment letters will be issued to the candidates. The seniority of the candidates to be appointed will be in the order of merit list of Vyapam. It will be mandatory for the appointed teachers to follow the instructions of the Finance Department regarding salary in the probation period.
