  • Agri laws: Five extra hours added to discussion on President’s address in Rajya Sabha; Congress moves adjournment notice in Lok Sabha

    NEW DELHI: Five extra hours have been added to the duration of discussion in Rajya Sabha on a motion thanking the President for his address to the joint sitting of Parliament to allow debate on the farmers’ protest against three agri reform legislations.

    The Rajya Sabha, which following COVID-19 protocols meets for five hours daily, will dispense with the scheduled Question Hour, Zero Hour and Private Member Business for the 15-hour discussion on the Motion of Thanks to the President’s Address beginning Wednesday, Chairman M Venkaiah Naidu said.

    This comes after the government and opposition parties said a consensus has been reached to extend the duration of the allotted time on the discussion on a Motion Thanking the President for his Address to the Joint Sitting of Lok Sabha and Rajaya Sabha at the beginning of the Budget Session, from the currently allocated 10 hours to 15 hours.

    Parliamentary Affairs Minister Pralhad Joshi said,”Consensus has been arrived that more time should be given for discussion on Motion of Thanks to the President.”

    Requesting the Chair to agree to extend the time, he said the Question Hour can be dispensed with on Wednesday and Thursday, and the Zero Hour on Thursday to allow for the 15 hour for the debate.

    Joshi said that also, as already agreed in the Business Advisory Committee (BAC), private member business scheduled for Friday can be dispensed with for the same purpose.

    The House proceedings begin with the Zero Hour where members raise issues of public importance and is followed by the Question Hour where MPs put questions to the government on any issue.

    Leader of the Opposition and senior Congress leader Ghulam Nabi Azad said that 18-19 opposition parties had sought a discussion on the more than two-month-long agitation by farmers at Delhi borders before the Motion of Thanks is taken up.

    But the government informed that there was no precedence of taking any business ahead of the Motion of Thanks to the President, he said, adding that the opposition parties felt that if the farmers’ agitation cannot be discussed as the first item of the session, extra time should be allocated in the debate on Motion of Thanks.

    “So five extra hours should be allocated to discuss the subject (farmers’ protest) during the Motion of Thanks debate. Five standalone hours,” Azad said, adding that he was thankful to the government for agreeing to the demand.

    Naidu said it has been agreed to extend the duration to 15 hours.

    “We will go by that,” he said.

    Accordingly, instructions have been issued to reallocate the business, Naidu said and added that the duration of discussion on the Motion of Thanks to the President would now be 14 and a half hours after considering that the debate would start after the Zero Hour on Wednesday.

    Naidu said normally suspension of Zero Hour and Question Hour is not done but there have been precedences and now there is a broad agreement so “I am willing to go by that.”

    Amendments to the Motion of Thanks on the President’s Address will be taken up after the debate.

    The first Parliament session of 2021 began on Friday with President Ram Nath Kovind addressing members of both Houses of Parliament.

    In the days following the President’s address, a motion is moved in the two Houses thanking the President for his address.

    This is an occasion for MPs in the two Houses to have a broad debate on governance in the country.

    The prime minister replies to the motion of thanks in both Houses.

    Opposition MPs have been successful in getting amendments passed to the motion of thanks in Rajya Sabha on five occasions (1980, 1989, 2001, 2015, 2016).

    Rajya Sabha Chairman Naidu had on Tuesday said that members can raise the issue of farmers’ protest during the debate on the motion as the President had mentioned the agitation in his speech.

    Meanwhile, Congress MPs Manish Tewari and Jasbir Singh on Wednesday gave adjournment motion notices in Lok Sabha over the farmers’ issue.

    Lok Sabha on Tuesday witnessed three adjournments following opposition protests against the new farm laws. Opposition members including those DMK, BSP, AAP, and TMC resorted to sloganeering over the farm laws against which farmers’ unions are protesting at Delhi borders.

    Bharatiya Janata Party (BJP) MP Locket Chatterjee will resume her speech and move the motion of thanks to the President’s address on January 29.

    Several papers and reports of Standing Committees will be tabled during the third day of the Budget Session.

    BJP MPs Ravi Shankar Prasad, Piyush Goyal, Pralhad Joshi among others will table the papers of their respective ministries.

    BJP MPs Jayant Sinha and Gopal Chinayya Shetty will present the reports of Standing Committee on Finance, while the reports of Standing Committee on Labour will be presented by Biju Janata Dal (BJD) Bhartruhari Mahtab and BJP MP Virendra Kumar.

    Pralhad Joshi is scheduled to move a motion for election of 20 members of the Lower House to the Committee on Welfare of Other Backward Classes (OBC).

  • Uttar Pradesh court issues non-bailable warrant against AAP MP Sanjay Singh in ‘hate speech’ case

    LUCKNOW: A court here on Tuesday issued non-bailable warrant against AAP Rajya Sabha member Sanjay Singh in an alleged hate speech case. Judge PK Rai of the MP-MLA court fixed February 17 as the next date of hearing.

    Singh had on August 12, 2020 held a press conference here, wherein he had alleged that the Uttar Pradesh government was favouring one particular caste. An FIR was registered against him with Hazratganj police under sections 153-A, 153-B, 501, 505(1), 505(2) of the IPC.

    After probe, the investigating officer filed a charge sheet on September 7. Ten days later, the state government granted sanction for prosecution of Singh. The special court took cognisance of the charge sheet and issued summons to Singh on December 4.

    Singh moved the Allahabad High Court but Justice Rakesh Srivastava on January 21 dismissed his plea to quash the MP-MLA court’s order, accepting the arguments of government advocate Vimal Srivastava that there was no illegality in the special court’s order.

    Singh’s lawyer on Tuesday requested the MP-MLA court to exempt his personal appearance, but the judge declined the plea saying that he had not obtained bail till date.

  • Rajya Sabha adjourned for the day amid Opposition ruckus; Naidu calls for orderly discussions in House

    NEW DELHI: Rajya Sabha was adjourned for the day on Tuesday without transacting substantial business as Congress and other opposition members created an uproar demanding discussion on the issue of farmers’ protest over the three new farm bills.

    The House was first adjourned for about 40 minutes till 10:30 am, then till 11:30 am and then to 12:30 pm.

    When the House re-assembled at 12:30 pm, protesting members again trooped in the Well raising slogans, forcing Deputy Chairman Harivansh to adjourn proceedings for the day.

    Before adjourning the House, the Deputy Chairman appealed to members to return to their seats and follow COVID-19 protocols.

    However, they did not heed to his requests.

    Four bills were listed for consideration and passing in the legislative business for the day.

    They were: The Major Port Authorities Bill, 2020; The National Institutes of Food Technology, Entrepreneurship and Management Bill, 2019; The Medical Termination of Pregnancy (Amendment) Bill, 2020; and The National Commission for Allied and Healthcare Professions Bill, 2020.

    Earlier in the day, Congress, Left, TMC, DMK and RJD members first walked out from Rajya Sabha after their demand for suspension of business of the day for taking up the discussion was rejected by the Chair.

    Opposition members shouted slogans to disrupt the Question Hour, forcing Chairman M Venkaiah Naidu to adjourn proceedings till 10:30 am.

    As the sloganeering continued, Naidu asked the opposition members to return to their seats.

    “Please go to your seats and allow the House to function. Some of you said the last time that not having question hour is ‘murder of democracy’. This is a statement made outside,” he said.

    “Members who have walked out and again coming to the Well is not fair,” Naidu said before adjourning the House for the first time.

    When the House met at 10:30 am, the sloganeering continued and the Deputy Chairman, who was in the Chair, tried to persuade members to allow the House to function.

    However, as the opposition members did not yield, he adjourned the proceedings till 11:30 am.

    At the time of adjournment, ports, shipping and waterways minister Mansukh Mandaviya was speaking on The Major Port Authorities Bill, 2020.

    Earlier, Parliamentary Affairs Minister Pralhad Joshi said opposition members themselves were demanding Question Hour and the government agreed.

    “Question Hour is going on. Whether they (protesting members) want Question Hour or not, let them place it on record,” he said, as opposition members were raising slogans.

    Opposition parties including the Congress, Left, TMC and DMK had given a notice under rule 267 that calls for setting aside of business of the day to take up a discussion on the issue pressed.

    Chairman Naidu had, however, disallowed the motion saying the members were free to raise the issue during the discussion on Motion of Thanks to the President’s address.

    When the House met for the day, Naidu said he has received notice under rule 267 from various members but the issue can be raised during the discussion on Motion of Thanks to the President’s address to the joint sitting of both houses of Parliament.

    The President, he said, had referred to the farmer’s agitation in his address made at the start of the Budget session of Parliament last week.

    While Lok Sabha is scheduled to start a discussion on the motion on Tuesday, Rajya Sabha will do so on Wednesday.

    “As we are going to start a discussion on Motion of Thanks to President’s Address tomorrow, members can participate and raise their concerns,” he said rejecting the 267 notice.

    He said several rounds of discussions have happened between the government and the farmers’ group.

    “I understand the concern (of members) for the need to resolve the issue at the earliest date,” he said.

    Naidu, however, allowed members who gave notices to make very brief mentions.

    Thousands of farmers have been protesting at the Delhi borders with Haryana and Uttar Pradesh, demanding a rollback of the Farmers’ Produce Trade and Commerce (Promotion and Facilitation) Act, 2020; Farmers (Empowerment and Protection) Agreement on Price Assurance and Farm Services Act, 2020; and the Essential Commodities (Amendment) Act, 2020.

    The protesting farmers have expressed the apprehension that these laws would pave the way for the dismantling of the minimum support price (MSP) system, leaving them at the “mercy” of big corporations.

    However, the government has maintained that the new laws will bring better opportunities to farmers and introduce new technologies in agriculture.

    Leader of the Opposition and senior Congress leader Ghulam Nabi Azad said the farmers have been camping for more than two months and the issue needs to be discussed.

    Sukhendu Sekhar Roy (TMC) said the House is not aware of what is going on between the government and farmers and the House should discuss the issue separately from the Motion of Thanks.

    “We want a discussion on a specific issue,” he said.

    While CPI leader Elamaram Kareem said water and electricity supply to the protests sites has been cut, DMK’s Tiruchi Siva said farmers have been sitting on roads for over two months in the cold and the issue needs to be discussed separately.

    Manoj Jha (RJD) said Parliament should at least discuss the issue.

    However, Naidu did not agree to their motion after which the members of Congress, Left, TMC, DMK and RJD staged a walkout.

    “No one is stopping you from discussing the issue tomorrow. Tomorrow you will get an opportunity,” he said.

    Naidu said 10 hours have been allocated for discussion on Motion of Thanks to the President’s address and an equivalent amount given for discussion on Budget.

    “Please take the opportunity tomorrow,” he said.

    Naidu also asked MPs to follow rules, maintain discipline and dignity while discussing issues of national and public importance in the House.

    “Last time some unfortunate incidents happened,” he said without going into the details.

    In September last year, opposition MPs tore the rule book, climbed on the podium and created a ruckus during the passage of three farm sector reform bills.

    “It is binding on all of us to see that the House functions properly, members follow rules and regulations, maintain discipline and dignity and also participate in debates in a meaningful manner,” Naidu said.

    “I have all along been appealing to members to prevent any such situation which will affect the interest of Parliament and also the nation,” he said.

    On the first full-day functioning of the House in the current Budget session which started on Friday, Naidu said the nation has completed 100 years of representative democracy.

    The first direct elections to the imperial and provincial legislative councils were held during the winter of 1920.

    “Democracy is all about the participation of people in the management of public affairs and policy-making through their elected representatives,” he said.

    “The occasion of being a 100-year-old modern representative democracy calls for serious reflection on the state of democracy and the functioning of legislatures in our country, he said.

    On this occasion, the House should resolve to enhance the dignity through “disruption-free proceedings as per rules and conventions,” Naidu said.

    Over 20 hours have been allocated for discussion on the Motion of Thanks to the President for his address to members of both houses and the General Budget for 2021-2022, offering ample opportunities to raise and discuss a wide range of issues of public concern to which the Government will respond, he said and referred to discussions he had with leaders of all parties on Sunday.

    “I sincerely hope that this important Budget session will turn out to be highly productive in the spirit of the last four sessions,” he said.

    Naidu said he could sense the enthusiasm on the part of all sections of the House to further move on with this important session with the President presenting the vision of the government to members of both the Houses and the government presenting the General Budget for the next financial year with a focus on post-COVID-19 recovery and health.

    “I once again reiterate the importance of this Budget session and the need to ensure the smooth and effective functioning of the august House,” he added.

    Referring to work between two sessions of Parliament, Naidu said eight department-related Parliamentary Standing Committees of Rajya Sabha worked overtime and held a total of 55 meetings during the inter-session period.

    “These committees met for a total duration of 110 hours and 4 minutes which comes to an average duration of 2 hours and 7 minutes. This is an improvement over the previous average of 1 hour 54 minutes per each meeting,” he said.

    The committee on Commerce has reported substantial improvement in holding 10 meetings during the inter-session period for a total duration of 26 hours 18 minutes.

    The average duration of each meeting has increased to 2 hours 37 minutes against the average duration of only 1 hour 42 minutes earlier.

    The committee on Transport, Tourism and Culture held the highest number of 11 meetings for a total period of over 22 hours.

    The committee on Education, Women, Child, Youth and Sports reported the highest average attendance of 53.45 per cent in 7 meetings.

    Six committees of Rajya Sabha, during the inter-session period, spent 38 hours and 34 minutes discussing various aspects of the outbreak of the pandemic, its consequences and management.

    “These committees of Rajya Sabha have examined the pandemic related issues in a bipartisan and constructive manner and not as fault finding so as to provide guidance for such sudden challenges in future.

    “These committees have also complimented the governments, the people and all other stakeholders for rising to the occasion in handling the pandemic challenge,” he said.

    Noting that the change between the same time last year and now is perceptible, he said India has moved from being a nation with few testing facilities, quality masks and personal protection equipment to one that “successfully contained” the pandemic and has emerged as the hope for other countries with indigenously made vaccines and as the vaccine factory for the world.

    “This is a remarkable transformation. This House places on record its appreciation of the people and all others concerned for the same,” he added.

  • Rajya Sabha to consider Port Authorities, MTP (Amendment) Bills on Tuesday

    NEW DELHI: The Rajya Sabha is likely to consider three bills on Tuesday as per the official business list.

    The first Bill, the Major Port Authorities Bill, 2020, is likely to be moved by Mansukh Mandaviya to provide for regulation, operation and planning of major ports in the country and to vest the administration, control and management of such ports upon the Boards of Major Port Authorities, which has been passed by Lok Sabha.

    Also, Health Minister Harsh Vardhan is likely to move an amendment to the Medical Termination of Pregnancy Act, 1971, which has been passed by the Lok Sabha.

    The other Bill likely to be considered by the Rajya Sabha is the National Commission for Allied and Healthcare Professions Bill, 2020 which is to provide for regulation and maintenance of standards of education and services by allied and health care professionals, assessment of institutions, maintenance of a Central Register and State Register and creation of a system to improve access, research and development and adoption of latest scientific advancement.

    The Opposition appears to have made up it mind on its demand for repeal of farm laws. At least 18 parties even boycotted the President’s speech on Friday.

    However, during the all-party meeting chaired by Prime Minister Narendra Modi on Saturday, the Prime Minister said that the government still stands by the proposal to suspend the three contentious farm laws for 18 months.

  • Former Chief Justice of India Ranjan Gogoi provided ‘Z+’ VIP security cover

    NEW DELHI: The Centre has accorded the top category ‘Z+’ VIP security cover to former Chief Justice of India (CJI) Ranjan Gogoi, official sources said on Friday.

    They said that 66-year-old Gogoi will be protected by armed commandos of the Central Reserve Police Force (CRPF) during his travel all across the country. A Rajya Sabha member now, Gogoi was earlier being provided with a security cover of the Delhi Police.

    He retired in November, 2019 and was later nominated to the upper house of Parliament by the government. Sources said that the CRPF has a VIP security unit and Gogoi is its 63rd protectee. They said an armed mobile team of 8-12 CRPF commandos will be securing the former CJI during travel while his house will be guarded by a similar team.

    SRINAGAR: With the terms of its four sitting MPs in Rajya Sabha ending by February 15, the Jammu and Kashmir is unlikely to be represented in the upper house any time soon. The likelihood of Assembly election is slim in the near future, meaning a college of elected members cannot be formed to elect representatives to Rajya Sabha.

    Jammu and Kashmir presently has four representatives in Rajya Sabha – Ghulam Nabi Azad of Congress, Shamsher Singh Manhas of BJP, Mir Mohammad Fayaz  of PDP, and Nazir Ahmad Laway (expelled from PDP). The terms of Fayaz and Manhas expire on February 10, while the terms of Azad and Laway end on February 15.

    After the fall of the then BJP-PDP coalition government on June 18, 2018, the Governor’s rule was imposed in the erstwhile J&K state. After the dissolution of J&K Assembly in November 2018, President’s rule was imposed on J&K on December 19, 2019. After the abrogation of Article 370 and bifurcation of J&K into two Union Territories, the Centre has been ruling J&K through Lt Governor.
