  • Lokpal-referred complaint against Mahua Moitra: CBI asks lawyer Dehadrai to appear before it

    New Delhi: The CBI has asked lawyer Jai Anant Dehadrai to appear before it on Thursday in connection with its probe against former TMC MP Mahua Moitra in a Lokpal-referred corruption complaint against her, officials said Tuesday. Dehadrai, who was once close to Moitra, had levelled serious corruption allegations against the former MP which were strongly refuted by her, they said.

    The agency has asked Dehadrai to appear before the AC-3 unit of the agency at 2 PM on Thursday to record his version, they said.

    The CBI has started a probe into the allegations of corruption against Moitra on a reference from the anti-corruption ombudsman Lokpal. BJP MP Nishikant Dubey had approached the Lokpal with a complaint against Moitra over allegations that she had taken bribes to raise questions in Parliament.

    Last month, Moitra was expelled from the Lok Sabha after the House adopted the report of its Ethics Committee that held her guilty of accepting gifts and illegal gratification from a businessman to further his interest.

    Moitra has challenged her expulsion in the Supreme Court.

    NEW DELHI: Deputy chief minister Manish Sisodia’s residence being raided by the CBI in connection with the ongoing probe into the alleged irregularities in the Delhi excise policy on Friday morning prompted a series of backlash from the Aam Aadmi Party (AAP) with Sisodia initially saying they investigative agency is “welcome” to do so. At the same time, the BJP has been protesting against the policy levelled corruption charges against the AAP-led government. 

    “We welcome CBI. Will give full cooperation in the investigation so that the truth can come out soon. Till now, many cases have been filed against me, but nothing has come out. Nothing will come out of it either. My work for a good education in the country cannot be stopped,” Sisodia said in a tweet in Hindi. 

    He added, “It is very unfortunate that those who do good work in our country are harassed like this. That is why our country has not yet become No 1.” 

    Incidentally, the raid happened on a day when the New York Times published on the front page of its international edition of the overhaul of government schools in Delhi by the AAP government.

    Chief minister Arvind Kejriwal reacting to the CBI raid tweeted: “On a day when the Delhi education model is praised and Manish Sisodia’s picture is printed on the front page of America’s largest newspaper, NYT, the Centre sends CBI to his house.” 

    He further said that the good work being done by the Delhi government will not stop despite these hurdles being created by the Central government to halt this development works in the capital. 

    Outside Sisodia’s residence at Mathura Road, a beeline of press reporters, television channel vans and cabs could be seen right from the morning, as the news broke. 

    Also, Punjab chief minister Bhagwant Mann pitched in to describe Sisodia as the best education minister of Independent India and that this CBI raid was a reward for the AAP government’s good governance receiving accolades across the globe.

    Meanwhile, the BJP and the Congress alleging big-time corruption in the liquor policy slammed the AAP for making”false” claims of honesty. 

    Delhi BJP spokesperson Praveen Shankar Kapoor in a statement said Aam Aadmi Party should stop diverting the issue and tell Delhi why it had to withdraw its Excise Policy if it was clean.?

    “AAP government has made thousands of crores through Excise Policy and now when time has come to rely on it Arvind Kejriwal & Company is trying to feign ignorance. Time has come for Manish Sisodia to share a room with Satyendra Jain in Tihar,” said Kapoor.

    Delhi Congress chief Anil Chaudhary said that the CBI has registered a case against Delhi deputy CM Sisodia in the liquor scam. “The Congress had fought from the road to the investigating agency to prevent Delhi from becoming a drug capital,” he said.

  • Jharkhand HC reserves order on maintainability of PIL seeking probe against CM Hemant Soren

    RANCHI: The Jharkhand High Court kept its order reserved on the maintainability of PIL seeking investigation against Chief Minister Hemant Soren for alleged irregularities in the grant of mining leases and also on transactions of some shell companies purportedly operated by his family members and associates.

    Disposing of a special leave petition filed by the Jharkhand Government on May 24, the Supreme Court had directed Jharkhand High Court to first decide on the maintainability of the PIL before proceeding further as per law.

    According to the PIL filed by an RTI activist Shiv Shankar Sharma, CM Soren and his brother Basant Soren invested black money through businessmen Ravi Kejriwal, Ramesh Kejriwal, Amit Agrawal and several others in 28 small companies to get them converted into white money. Sharma in his PIL also demanded probe by the CBI and ED into the shell companies which are being run in other states including Jharkhand, Bihar and West Bengal.

    “After hearing all sides on the issue of maintainability of the PIL and kept its order reserved till June 3,” said petitioner’s Counsel Rajeev Kumar. As soon as the hearing started, senior counsel Kapil Sibal appearing on behalf of the Jharkhand Government demanded dismissal of the petition saying that the petition was motivated and has been filed with ulterior motives by the petitioner.

    Petitioner’s lawyer Rajiv Kumar said that other than the chief minister, a mining lease was issued in the favour of his brother and MLA Basant Soren and many persons close to him. The court asked Mukul Rohtagi to explain whether or not mining leases were issued to the CM, Basant Soren and others.

    Solicitor general Tushar Mehta, appearing on behalf of the Enforcement Directorate, however, stressed on CBI inquiry based on the facts found by the central agency during the raids conducted by it in Jharkhand in connection with MNREGA scam.

    The material collected shows involvement of people sitting on the top positions and the state government agencies won’t be able to conduct an inquiry, he said. 

    Mehta was also of the view that the credentials of a petitioner could be challenged, but a petition can’t be dismissed just because of certain limitations on technicalities and PIL rules. Mehta said the High court has enough power under Article 226 of the Constitution to even take suo moto cognisance and order inquiry to ensure justice, even if the petition is not as per rules.

    Senior counsel Mukul Rohtagi, appearing on behalf of Hemant Soren, also questioned the credentials of the petitioner and informed the court about the previous involvement of his father in a case related to Shibu Soren.

    “Soren’s Counsel informed the court that the petition has been filed with ulterior motive and the petitioner is targeting the chief minister due to personal enmity with his family,” said Amritansh Vats, who is assisting Rohtagi in the case.
