  • BJP cites news Newsclick’s ‘dubious’ funding to attack ‘anti-India’ forces, portal rebuts

    NEW DELHI: Seizing on the alleged dubious foreign funding of a news portal, the BJP claimed on Sunday that “anti-india” elements in league with foreign forces are part of a conspiracy to demean the country and target the Modi government.

    Addressing a press conference, BJP spokesperson Sambit Patra cited media reports about the Enforcement Directorate probe into the portal, Newsclick, and said that it received FDI of Rs 9.59 crore and foreign funding of another Rs 28.46 crore to dubious purposes.

    Newsclick Editor-in-Chief Prabir Purkayastha said in a statement that a smear campaign has been launched against the portal, and “selective leaks” from the ED, whose probe is already under challenge before court, reflect the “inherent weakness” in the investigation and the course that it will take in the courts.

    Patra alleged that the funding received by the portal was diverted to various people, including activist Gautam Navlakha, an accused in the Bhima Koregaon case, and said this was a “price tag” to foment anti-India sentiments, “abuse” Prime Minister Narendra Modi and do propaganda for foreign forces.

    “Anti-India forces are doing this conspiracy in league with foreign forces,” he said, alleging that the portal wore the mask of a media house to demean India.

    Some mainstream politicians of India and foreign forces are also with such portals, and they have been working as a gang in a planned way, he alleged.

    Patra claimed that whenever any “good” thing happened in the country, be it the Covid vaccination policy or the Central Vista project, some people targeted it.

    He alleged that the incident highlights the role of foreign funding and foreign conspiracy behind such campaigns to demean India.

    The Central Vista project received nod from courts but some people still went ahead with their agenda in a “stubborn” manner to demean India, he said.

    Since Modi became prime minister, he has been a thorn in the flesh of some leaders not only here but also of foreign forces, Patra claimed.

    Purkayastha said in a rejoinder that the foreign direct investments have been made in Newsclick and the fees received for syndication services it has carried out, through normal banking channels.

    “Newsclick has received funds, which have been duly disclosed to authorities in India, both from reputed entities and foundations in the US and as per rules and regulations in India and the United States governing such transactions,” he said.

    “Since the matter is already in the courts, Newsclick does not believe that it should participate in a media trial. It is unfortunate that the BJP, the ruling party, also sees fit to air such unfounded allegations,” he added.

    The portal reserves the right to initiate appropriate legal action on these matters, he said, adding it will continue to carry out its journalistic duties as it has been doing and will not be forced into submission by these attacks.

    All the revelations in the Newsclick FDI case clearly indicate that the entire operation of the portal was in foreign hands and they were controlling it.

    The persons running Newsclick were completely sold out to their foreign funders, Patra said.

    Patra said that the ED investigation has also revealed that the funding was secured from America’s Justice and Education fund Inc, GSPAN LLC and Tricontinental Ltd Inc.

    “All these US companies are registered in one address. All this clearly reveals that those running Newsclick were not only running a campaign to defame and destabilize the Narendra Modi government but also conspiring against India and trying to create unrest and disturb harmony,” he claimed.

  • Delhi HC extends interim protection to Newsclick founder in money laundering case

    NEW DELHI: The Delhi High Court on Monday extended the interim protection from coercive action granted to news portal Newsclick and its editor-in-chief in connection with a money laundering case lodged by the Enforcement Directorate (ED).

    Justice Mukta Gupta also issued notice and sought ED’s response on a plea by Newsclick founder and editor-in-chief Prabir Purkayastha seeking anticipatory bail in the PMLA case. The high court noted that a copy of Enforcement Case Information Report (ECIR) registered by the ED in the case has not been provided to the petitioners yet.

    “Interim order to continue till the next date of hearing,” the court said while posting the matter for July 29.

    The ED has taken cognisance of a Delhi Police FIR to initiate a money laundering probe and conducted searches on the premises of a digital news platform and several other places in connection with the money received from overseas.

    Senior advocate Kapil Sibal, appearing for the news portal and its founder, submitted that till date they have not received the copy of ECIR by the ED, as it was assured earlier. The petitioners were also represented through senior advocate Dayan Krishnan and lawyer Arshdeep Singh.

    Advocate Amit Mahajan, representing the ED, submitted that Purkayastha had appeared before the agency for investigation once and had sought 10 days’ time to bring certain documents. However, thereafter he did not appear and said that their petition is pending in the high court, he said.

    When the court asked why the agency has not yet supplied the ECIR copy to the petitioners, the counsel said ED was waiting for him to appear before it where it would provide the ECIR copy. Mahajan also said the agency has filed an application seeking to dispose of the petition for supply of ECIR copy as they will provide the document.

    He also said the agency will issue fresh summons to Purkayastha to join the investigation. To this, the judge orally said, “So when you issue summons, also give the copy of ECIR to him.”

    The company, through another petition, has already sought quashing of the FIR lodged by Delhi Police on the allegations of foreign funding on the ground that it does not disclose any cognisable offences as alleged.

    The allegations in the FIR are that the petitioner company PPK Newsclick Studio Pvt Ltd received Foreign Direct Investment (FDI) of Rs 9.59 crore from Worldwide Media Holdings LLC USA during the financial year 2018-19.

    It was alleged that the investment was made by greatly overvaluing the shares of the petitioner company to avoid the alleged cap of 26 per cent of FDI in a digital news website.

    It was further alleged that over 45 per cent of this investment was diverted/siphoned off for the payment of salary/consultancy, rent and other expenses, which payments are alleged to have been made for ulterior motives.

    Therefore, it was alleged that the company has violated the FDI and other laws of the country and has caused a loss to the government exchequer. The petition seeking quashing of the Delhi Police FIR is already listed for hearing on July 29.

    The high court had on June 21 directed the ED not to take coercive action against the news portal and its editor-in-chief in connection with the case. It had issued notice to the ED on the portal’s plea seeking a copy of the ECIR lodged by it in the case.

  • ED allowed to record jailed activist Gautam Navlakha’s statement in case against news portal

    MUMBAI: A special NIA court here on Wednesday allowed the Enforcement Directorate (ED) to record a statement of activist Gautam Navlakha, arrested in the Elgar Parishad-Maoist links case, in its money laundering probe against ‘Newsclick’, a news website.

    Navlakha is currently lodged in Taloja Jail in neighbouring Navi Mumbai. The ED had filed an application before the special National Investigation Agency court seeking to record his statement in a Prevention of Money Laundering Act case filed against the website.

    Judge DE Kothalikar granted the agency’s plea. Following a First Information Report (FIR) registered by Delhi Police against Newsclick, the ED registered a money laundering case against the portal with regard to `suspicious’ foreign funding.

    In February this year, the ED raided the website’s office and properties of its promoters in Delhi. Navlakha is among several activists arrested in connection with Elgar Parishad, a conclave held in Pune on December 31, 2017.

    Pune Police had claimed that inflammatory speeches at the event triggered violence the next day near the Koregaon-Bhima war memorial, and the conclave had been backed by Maoists. The case was later taken over by the NIA.

  • ‘Another attack on independent media’: CPM on ED raids at ‘Newsclick’

    NEW DELHI: The CPI(M) condemned on Wednesday the Enforcement Directorate (ED) raids on the offices of a digital news portal and described it as “another attack on independent media”.

    The ED conducted searches on Tuesday at multiple premises linked to news portal Newsclick, its promoters and some others in connection with a money-laundering probe, official sources said.

    “Yet another attack on independent media. The CPI(M) condemns the Enforcement Directorate raids on the offices of Newsclick, a digital news portal, and the houses of its editors and owner.

    “The ED action is a blatant attempt to intimidate and suppress an independent news portal. Newsclick has been providing credible and wide coverage of the farmers protests,” the Communist Party of India (Marxist) said in a statement.

    It further alleged that central agencies are being used by the Narendra Modi government to “harass and silence independent media”.

    “The CPI(M) demands an end to the vindictive action against Newsclick and its management,” the Left party said.

  • ED raids premises of ‘Newsclick’, its promoters in Delhi on ‘money laundering charges’

    NEW DELHI:  The Enforcement Directorate (ED) on Tuesday conducted searches on the premises of news portal Newclick and its promoters in connection with charges of money laundering.

    According to sources in ED, they conducted searches in the premises of the website Newsclick and its promoters and Editor in Chief in South Delhi and other locations of the city.

    While no further details were revealed by the sources, they added this is in connection with charges of money laundering they received against the company and its promoters and they have collected some documents and laptops to get additional information. 

    “At this point, we cannot reveal much. This is regarding a complain we received regarding foreign funding and this is an ongoing probe. We will share details if and when required,” an ED source said. Employees of the website confirmed that ED had conducted a search. Social media went vocal saying this was an attempt to gag the website for its coverage of farmer’s protest.
