  • Narada case: Calcutta High Court adjourns hearing till September 13

    KOLKATA: The Calcutta High Court on Monday adjourned till September 13 hearing in the CBI’s prayer for transfer of the Narada sting tape case, in which two West Bengal ministers were arrested and later released on bail, on a plea by the investigating agency.

    CBI lawyers prayed for adjournment of the matter submitting that the Solicitor General of India Tushar Mehta was appearing in other litigations before the Supreme Court.

    The five-judge bench adjourned the matter till September 13, when it will be taken up for hearing again.

    Seeking transfer of the matter, CBI had earlier claimed in its affidavit before the high court that it could not physically produce four leaders arrested by it in the Narada sting tape case before the designated court on May 17 owing to the presence of Chief Minister Mamata Banerjee in its office and that of a large “unruly” crowd outside.

    The investigating agency, which has made a transfer application before the high court for shifting of the Narada case to itself from the Special CBI court on such grounds, also mentioned the presence of state Law Minister Moloy Ghatak in the ‘Bichar Bhavan’ premises, within which the CBI court is located, quoting media reports.

    CBI had arrested ministers Subrata Mukherjee, Firhad Hakim, Trinamool Congress MLA Madan Mitra, and former Kolkata mayor Sovan Chatterjee on May 17 in connection with the case.

    The high court had later ordered their release on bail.

    The Narada sting operation was conducted by journalist Mathew Samuel of Narada News, a web portal, in 2014 wherein some people resembling TMC ministers, MPs, and MLAs, were seen receiving money from representatives of a fictitious company in lieu of favours.

    At that time, the four arrested politicians who were subsequently released on bail were ministers in the Mamata Banerjee government.

    The sting operation was made public ahead of the 2016 assembly elections in West Bengal.

  • Mamata Banerjee moves SC against HC order on filing of affidavits in Narada sting case

    NEW DELHI: West Bengal Chief Minister Mamata Banerjee has moved the Supreme Court challenging the Calcutta High Court’s denial for filing of affidavits by her and state Law Minister Moloy Ghatak on their role on the day of arrest of four Trinamool Congress leaders on May 17 by the CBI in connection with the Narada sting tape case.

    A bench of Justices Hemant Gupta and Aniruddha Bose will be hearing the separate appeals filed by the chief minister, Ghatak and West Bengal Government on Tuesday.

    Earlier, the top court had said that it would hear on June 22 the appeal filed by Ghatak.

    The top court On June 18 had requested the high court to hear the case a day after the apex court considers the appeals of the state government and Ghatak against the order.

    On June 9, a five-judge bench of the Calcutta High Court, hearing CBI’s application for transfer of the Narada sting tape case from the special CBI court to the high court, had said it will decide later on considering the affidavits by the Banerjee and Ghatak on their respective roles on the day of the arrest of four leaders in connection with the case.

    Senior advocates Rakesh Dwivedi and Vikas Singh, appearing for Ghatak and the state government, had said it was necessary to bring on record of the high court the affidavits as they deal with the roles of the persons concerned on May 17.

    The law minister was attending the cabinet meeting and was not in the court premises at the time of hearing, Dwivedi had said, adding that even the CBI officials were not there on the spot as the lawyer for the agency addressed the court virtually.

    It has been alleged that the state ruling party leaders played key role in stopping CBI from performing its legal duty after the agency arrested four leaders on May 17 in the case.

    Singh had contended that under the rules there is a right to file affidavits and, moreover, CBI filed as many as three affidavits and did not take the permission of the court.

    The high court, which on June 9 decided to consider later the affidavits of Banerjee and Ghatak, was urged by the Solicitor General that the affidavits cannot be accepted on the ground of delay as they were filed after the completion of his arguments.

    The CBI, which has filed an application seeking transfer of the Narada sting tape case from the special CBI court to the high court, has made the chief minister and the law minister parties in its plea there.

    It had claimed that while the Chief Minister had sat on a dharna at the CBI office in Kolkata soon after the arrest of the four accused, Ghatak had been present at the Banshall Court premises during the virtual hearing of the case before the special CBI court there on May 17.

    Ministers Subrata Mukherjee and Firhad Hakim, Trinamool Congress MLA Madan Mitra and former mayor of Kolkata Sovan Chatterjee were arrested by the CBI which is investigating the Narada sting tape case on a 2017 order of the high court.

    The five-judge bench, comprising Acting Chief Justice Rajesh Bindal and justices I P Mukerji, Harish Tandon, Soumen Sen and Arijit Banerjee, had adjourned the hearing in the matter.

    The bench had granted interim bail on May 28 to the four accused.

    The special CBI court had granted them bail on May 17 itself, but the order was stayed by the high court, which remanded them to judicial custody.

    They had been placed under house arrest on May 21 by the high court, modifying its earlier order of stay on the bail.

  • Narada case: West Bengal Minister Subrata Mukherjee released from hospital, in house arrest

    KOLKATA: Trinamool Congress heavyweight and senior West Bengal minister Subrata Mukherjee was on Tuesday discharged from a hospital here and returned home where he would be kept under house arrest in the Narada sting tape case till further orders of the Calcutta High Court.

    Mukherjee went to Presidency Correctional Home, where he was lodged before being admitted to the SSKM Hospital, to complete formalities, officials said.

    He then reached his Ballygunge residence in a Kolkata Police vehicle.

    He, minister Firhad Hakim, TMC MLA Madan Mitra and former party leader Sovan Chatterjee were arrested in the case on May 17 and they were taken to the correctional home after the Calcutta High Court stayed their bail granted by a CBI court on the same day.

    Chatterjee, Mukherjee and Mitra were later admitted to the hospital after their health condition deteriorated.

    Hakim had been shifted to a healthcare facility in the correctional home after he developed fever.

    The Calcutta High Court on May 21 ordered their shifting to house arrest from jail incarceration.

    However, they will continue to remain in judicial custody.

    Only Hakim was sent home on that day while others remained in the hospital.

    Chatterjee, who had quit the party to join the BJP only to leave it before the recently concluded assembly election, was discharged from the hospital late on Saturday evening on personal risk bond.

    Mitra is still undergoing treatment in the hospital.

  • Narada case: Firhad Hakim returns home after HC orders house arrest, three others to remain in hospital due to ill health

    KOLKATA: West Bengal minister Firhad Hakim on Friday returned home after the Calcutta High Court ordered the house arrest of him and three others arrested by the CBI in connection with the Narada sting tape case.

    Hakim, the state’s transport minister and chairman of the board of administrators of the KMC, came back to his Chetla residence in the evening, amid tight security.

    “We urged his supporters to not celebrate his return as he and the others are yet to get bail. Please ensure the court directive that there shouldn’t be any crowding in front of the residence,” one of his daughters said.

    Apart from Hakim, the high court earlier in the day ordered the house arrest of Panchayat Minister Subrata Mukherjee, Trinamool Congress MLA Madan Mitra and former Kolkata mayor Sovan Chatterjee.

    The court passed the direction modifying its earlier order that stayed their bail granted by a special CBI court on Monday when the four leaders were arrested.

    However, Mukherjee, Mitra and Chatterjee will not be able to return home immediately as they are undergoing treatment for various health conditions.

    Mitra, who had recently recovered from COVID-19, was diagnosed with severe pulmonary problems.

    “Mr Mitra’s condition is critical. He needs to be in hospital for treatment and is not in a position to be discharged,” one of the three doctors of the medical board constituted for the treatment of the three political leaders, said.

    Chatterjee, who suffers from Chronic Obstructive Pulmonary Disorder (COPD) and is highly diabetic, has developed cirrhosis of the liver, he said.

    The doctor said Mukherjee is on nebuliser.

    “We have to continue their treatment. At the moment, they are under observation,” he added.

  • Narada sting tape case: Calcutta HC asks CBI to clarify position over chargesheet filing

    KOLKATA: The Calcutta High Court on Tuesday directed the CBI to clarify its position through an affidavit on the filing of chargesheet in the Narada sting tape case in which people resembling Trinamool Congress MP, ministers and MLAs were allegedly seen receiving money in lieu of promised favours.

    A division bench presided over by Chief Justice T B N Radhakrishnan directed that the matter would be taken up for hearing two weeks hence, by which time the CBI will be required to file the affidavit.

    The direction was passed after additional advocate general Abhratosh Majumdar submitted that the CBI has not so far applied to the Assembly Speaker for sanction to prosecute anyone in connection with the Narada sting tapes case.

    Bikash Ranjan Bhattacharya, appearing for the petitioner in connection with a PIL seeking speedy completion of investigation and trial in the case, submitted that permission is not required from the Speaker of the state Assembly since the alleged acceptance of money had nothing to do with the official discharge of duties of any member accused in the case.

    The CBI counsel, however, stated that permission of the Speaker of the House was necessary before submission of the chargesheet.

    Hearing all the parties, the division bench asked the CBI lawyer to take instructions from the investigating agency and submit an affidavit clarifying its position on the matter.
