MUMBAI: The Bombay High Court on Monday clubbed all the FIRs lodged against Marathi actor Ketaki Chitale and student Nikhil Bhamre, accused of uploading defamatory posts against NCP president Sharad Pawar, at the police station where the first case was lodged against them.

There are 22 FIRs registered against Chitale and six against Bhamre, a resident of Nashik.

With the HC order, all the FIRs against Chitale have now been clubbed with the first FIR lodged against her at Kalwa police station in neighbouring Thane district.

All FIRs against Bhamre would now be clubbed at Naupada police station in Thane.

A division bench of Justices N M Jamdar and N R Borkar took note of a Supreme Court order which said when there are multiple FIRs, then the first case lodged can be considered as the main FIR and the remaining cases can be considered as witness statements in the first FIR.

The bench also directed the Maharashtra government and all complainants in the case to file their affidavits, replying to other prayers made in the petitions filed by Chitale and Bhamre seeking compensation for wrongful arrest and for their arrest to be declared as illegal.

“What is the state government’s stand on these prayers made in the petition? Both the government and the complainants shall file their affidavits,” the court said while posting the matter for further hearing on September 6.

Chitale and Bhamre was arrested in May this year and released on bail in June.

Chitale had been arrested sharing on Facebook a Marathi verse, which allegedly referred to NCP chief Sharad Pawar in a derogatory way.

Bhamre was arrested for an alleged objectionable tweet against Pawar.

THANE: A court here in Maharashtra on Wednesday remanded Marathi actor Ketaki Chitale in judicial custody in connection with the case of allegedly sharing an objectionable post on social media about NCP chief Sharad Pawar.

Chitale (29), a film and TV actress, was arrested by the Thane police last Saturday over the post she allegedly shared on her Facebook page. A court had on Sunday sent her in Thane police’s custody till May 18.

On Wednesday, Thane crime branch officials produced Chitale before a magistrate who remanded her in the magisterial custody. A police official said they had completed the probe into the case registered here.

On Sunday, the Pune cyber police, who have also registered a case against Chitale, said they will seek the actor’s custody after the expiry of her remand with the Thane police.

Earlier, cases were also registered against the actor in Mumbai, Akola and Dhule districts in connection with the online post.

The cases at these police stations were registered under various Indian Penal Code (IPC) sections, including 500 (defamation), 501 (printing or engraving matter known to be defamatory), 505 (2) (making, publishing or circulating any statement, rumour or report promoting enmity, hatred or ill will between classes) and 153 A (spreading disharmony among people), police said.

The post shared by Chitale, which was in verse form, was purportedly written by someone else. It contained phrases like “hell is waiting” and “you hate Brahmins”, allegedly referring to Pawar, whose party shares power in Maharashtra with the Shiv Sena and Congress.

THANE: A court here in Maharashtra on Sunday remanded Marathi actor Ketaki Chitale in police custody till May 18 following her arrest for allegedly sharing an objectionable post on social media about NCP chief Sharad Pawar, an official said.

Later, the Pune cyber police, who have also registered a case against Chitale, said they will seek the actor’s custody after the expiry of her remand with the Thane police.

In more trouble for Chitale, two cases were registered at separate police stations in Mumbai for allegedly sharing the objectionable post, an official said on Sunday.

Besides, an organisation in Pune demanded that Chitale be charged with treason over the alleged reference to Sant Tukaram in the post shared by her.

Chitale (29), a film and TV actress, was arrested by the Thane police on Saturday over a post she allegedly shared on her Facebook page.

The post shared by Chitale, which was in verse form, was purportedly written by someone else.

It contained phrases like “hell is waiting” and “you hate Brahmins”, allegedly referring to the NCP president.

She was on Sunday produced before a holiday court which remanded her in the Thane police custody till May 18, a senior police official said.

Later in the day, Pune cyber police inspector Dagadu Hake said, “We have booked Chitale and will seek her custody after her remand with the Thane police gets over.”

Meanwhile, the Nashik sessions court on Sunday remanded 23-year-old pharmacy student, Nikhil Bhamre, to police custody till May 16, a day after he was arrested for allegedly posting an objectionable comment alluding to Pawar on Twitter.

The fresh FIRs were registered against Chitale at Bhoiwada police station and Goregaon police station in Mumbai on Saturday night.

The case at Bhoiwada was lodged by advocate Prashant Duete, who heads NCP’s student wing in Mumbai.

Chitale was booked under Indian Penal Code sections 500 (defamation), 501 (printing or engraving matter known to be defamatory), 505 (2) (making, publishing or circulating any statement, rumour or report promoting enmity, hatred or ill will between classes), 153 A (spreading disharmony among people).

Cases were already registered against her in Mumbai, Kalwa, Pune, and Dhule, mainly on complaints of NCP activists.

In Dhule, in north Maharashtra, a case was registered against Chitale and Nitin Bhave, the purported author of the post shared by her, police said on Saturday.

Meanwhile, the Sant Tukaram Dehu Sansthan has written to Dehu police in Pune, demanding action against Chitale over the alleged reference to the 17th Century poet in the post shared by the actor.

“Not just Sant Tukaram’s name, but one should not use the name of any saint to gain such publicity. She (Chitale) should be booked under charges related to treason,” Ajit More, the sansthan trustee, told reporters.

Maharashtra Deputy Chief Minister and his cousin Baramati MP Supriya Sule, daughter of Sharad Pawar, on Sunday condemned the perverted mindset behind the social media post.

Ajit Pawar said such remarks against the veteran politician were unfortunate.

“This is Maharashtra’s misfortune,” the senior NCP leader told reporters.

The Constitution has guaranteed citizens the right to express and free speech.

But, people need to keep in mind what they speak and what impact it has on society, he said.

He called Chitale a “pervert” and termed as “unfortunate” the comments shared by her against Sharad Pawar.

Speaking to reporters in Nashik, Sule said this is the issue of culture and about someone wishing death to your parents and someone you idolize in public life.

Such a perverted mindset is not good for society.

Shiv Sena leader and former Mumbai mayor Kishori Pednekar said that one must respect the age and seniority in public life.

“The actor had said she was ill,” Pednekar claimed.

  • Marathi actor Ketaki Chitale, pharmacy student held over ‘objectionable’ posts about Sharad Pawar

    By PTI

THANE/MUMBAI: Marathi actor Ketaki Chitale and a 23-year-old pharmacy student were arrested in Maharashtra on Saturday over allegedly objectionable social media posts about Nationalist Congress Party (NCP) chief Sharad Pawar.

While Chitale (29), a film and TV actress, was arrested by the Thane police over a post she allegedly shared on her Facebook page, the student, identified as Nikhil Bhamre, was arrested in the Nashik district for allegedly making an objectionable comment against Pawar on Twitter.

The post shared by Chitale, which was in verse form, was purportedly written by someone else. It only mentioned the surname Pawar and the age of 80. The NCP supremo is 81 years old.

The post contained phrases like “hell is waiting” and “you hate Brahmins”, allegedly referring to Pawar whose party shares power in Maharashtra with the Shiv Sena and Congress.

Speaking to reporters in Nanded, Pawar said he didn’t know who Chitale was and also had no idea about what she posted about him on social media. “The offence against Chitale was registered at Kalwa police station in Thane on Saturday based on a complaint lodged by Swapnil Netke,” a police official said.

Subsequently, Chitale was arrested from Navi Mumbai by the crime branch of Thane Police.

Black ink and eggs were thrown at her outside Kalamboli police station in Navi Mumbai by workers of the NCP’s women wing as she was being taken away.

She was booked under Indian Penal Code sections 500 (defamation), 501 (printing or engraving matter known to be defamatory), 505 (2) (making, publishing or circulating any statement, rumour or report promoting enmity, hatred or ill will between classes), 153 A (spreading disharmony among people).

In Pune too, a case was registered against her based on a complaint filed by an NCP worker for similar offences.

In Dhule, in north Maharashtra, a case was registered against Chitale and Nitin Bhave, the purported author of the post shared by her, on a complaint lodged by an NCP leader.

In his tweet, Bhamre had said that the time has come to create “Baramati’s Nathuram Godse for the Gandhi of Baramati”. He had, however, not mentioned the name of any leader or political party in the tweet.

Baramati, a town in the Pune district of the state, is the home turf of Sharad Pawar, while Godse was the assassin of Mahatma Gandhi. “After probing the tweet, Maharashtra Cyber had intimated Nashik rural police for further action,” a police official said.

Bhamre has been charged under Indian Penal Code (IPC) sections 153 (A) (promoting enmity between different groups), 500 (defamation), 504 (intentional insult with intent to provoke breach of the peace), 506 (criminal intimidation), he added.

Earlier, NCP leader Anand Paranjpe had lodged a complaint against Bhamre at Naupada police station in Thane city, following which a case was registered against him.

Maharashtra ministers and NCP leaders Jitendra Awhad and Chhagan Bhujbal called for strict action against Chitale.

“In Maharashtra, our youth will go to at least 100-200 police stations to register offence. He is the father of the family – that is NCP. He is everything for us and such hideous comments are made about him and that too by a woman!” Awhad told a news channel.

Some NCP leaders also sought to link the BJP and the RSS for such remarks being made against Pawar on social media.

NCP spokesperson Clyde Crasto said the actor had learnt from Maharashtra BJP leaders that the best way to get “cheap and free publicity” is to make derogatory statements against Pawar.

“That criticism is condemnable. She should not engage in such a criticism,” Maharashtra State Women’s Commission chairperson Rupali Chakankar told reporters in Nagpur.

Maharashtra Navnirman Sena (MNS) chief Raj Thackeray also condemned Chitale, saying “such writing” does not have a place in the culture of Maharashtra. Such writing is “not a tendency, but wickedness” and it needs to be controlled promptly, he said in a statement issued on Twitter and Facebook.

“We have differences with them (Pawar) and those will be there. But it is quite wrong to come to such a hideous level. It needs to be told quite clearly that this is not Maharashtra’s culture. To write something like this is not a tendency, but wickedness. It needs to be checked in time,” he added.

Pawar said he didn’t know the person (Chitale) and also have no idea about what you are saying (about the actress’s post).

Asked about the post allegedly shared by Chitale on Facebook, the NCP chief told reporters that he didn’t know about it.

The veteran leader further said it would not be right for him to comment on the issue until he learns what the actress had done.
