  • Aryan Khan to spend one more night behind bars; jail official says papers did not reach in time

    Bollywood actor Shah Rukh Khan’s son Aryan Khan, who was granted bail by the Bombay High Court in a drugs case on Thursday, will not be released from jail on Friday. He will be released on Saturday morning, according to Arthur Road Jail officials.

    “We won’t give special treatment for anyone. The law is the same for all. The deadline for receiving the bail papers was 5. 30 pm. That has passed. He won’t be released today,” an official told PTI.

    The assertion by the prison official came even as there were indications from Aryan’s legal team that a “slight postponement till 7 pm” was possible.

    While granting Aryan bail on Thursday in the drugs-on-cruise case, the Bombay High Court imposed 14 bail conditions on him, paving the way for his release from jail.

    In the five-page order, the high court said that Aryan Khan and and his two co-accused Arbaaz Merchant and Munmun Dhamecha, who were also granted bail, shall be released on a personal bond of Rs one lakh each with one or two sureties of the same amount.

    The court has accepted Juhi Chawla, a co-star of SRK in many films, as the surety in Aryan’s bail and she signed the relevant papers and executed the bail bond before the court officials, said Aryan Khan’s lawyer Satish Maneshinde.

    Maneshinde said the Bombay High Court will send the orders directly to the jail after the court formalities are completed.

    Earlier, Shah Rukh Khan had reportedly left in a small motorcade along with aides and security personnel to pick up son Aryan from the jail.

    Justice NW Sambre granted bail to Aryan and two others – Arbaaz Merchant and Munmun Dhamecha – on Thursday evening, but the bail orders were received only on Friday, paving the way for the trio to return home.

    Soon after the bail verdict was pronounced Thursday, SRK reportedly shed tears of joy, and later met his entire legal defence team which had been fighting for Aryan’s release for the past four weeks.

    The happy-go-lucky Aryan – who left home on October 2 for a fun-filled Mumbai-Goa cruise voyage, totally oblivious of what was in store – was suddenly detained after the NCB swoop, arrested the following day, and has been in custody since then – making it a total of 28 days that he slept away from his ‘Mannat’ bedroom.

  • Juhi Chawla withdraws HC plea over dismissal of her suit against 5G roll out

    NEW DELHI: Bollywood actress Juhi Chawla Thursday withdrew from the Delhi High Court her plea in connection with the dismissal of her lawsuit against 5G wireless network technology.

    Justice Jayant Nath allowed the withdrawal of the plea after a statement made by Chawla’s counsel, advocate Deepak Khosla.

    “Learned counsel for the plaintiff (Chawla) wants to withdraw the application with liberty to avail remedy before the appellate court. Application is dismissed as withdrawn,” the court said.

    Chawla had moved the application seeking that her lawsuit against 5G rollout be declared ‘rejected’ instead of ‘dismissed’.

    Chawla’s counsel argued that the plaint, which “ever went up to the level of suit”, could only be rejected or returned in terms of the Civil Procedure Code, and not dismissed.

    The court had then also granted a week’s time for a deposit of Rs 20 lakh costs after Chawla decided to not press the application for its waiver.

    Application for refund of court fees was also withdrawn by Chawla.

    In June, the court had described the lawsuit by Chawla and two others against 5G roll out as “defective”, “abuse of process of law” and filed for “gaining publicity” and dismissed it with costs of Rs 20 lakh.

    Justice J R Midha said the plaint in which questions have been raised about health hazards due to the 5G technology was “not maintainable” and was “stuffed with unnecessary Scandalous, frivolous and vexatious averments” which are liable to be struck down.

    The court said the suit filed by actress-environmentalist and others was to gain publicity which was clear as Chawla circulated the video conferencing link of the hearing on her social media account which resulted in the repeated disruptions thrice by unknown miscreants who continued disruptions despite repeated warnings.

    NEW DELHI: The Delhi High Court on Monday deferred hearing on the plea by Bollywood actress Juhi Chawla in connection with the dismissal of her lawsuit against 5G wireless network technology.

    Justice Sanjeev Narula recused from hearing Chawla’s plea and directed that it be listed before another bench on July 29.

    “Subject to the order of the Chief Justice, list before another bench on July 29,” the judge said.

    Last week, Justice J R Midha had directed that Chawla’s application, which seeks that her lawsuit against 5G rollout be declared “rejected” instead of “dismissed”, be placed before Justice Narula after the deposit of previously imposed Rs 20 lakh costs.

    Chawla’s counsel argued that the plaint, which “never went up to the level of suit”, could only be rejected or returned in terms of the Civil Procedure Code, and not dismissed.

  • ‘Ghoonghat ki aad mein..’: Man sings Juhi Chawla songs during virtual hearing of 5G plea in Delhi HC

    NEW DELHI: Some of the hit songs of actress Juhi Chawla’s movies made their way in the proceedings before the Delhi High Court on Wednesday when a man started singing them during the virtual hearing relating to the Bollywood star’s plea against the 5G wireless network.

    The action of the man resulted in the periodic interruption of hearing and on the judge’s directions, the person was repeatedly removed from the hearing, but he kept on joining and started singing till the time the proceedings were locked.

    Chawla also joined the virtual proceedings from South Africa.

    The man, who was logging in the virtual hearing with different names first started singing “Ghoonghat ki aad mein dilbar ka didaar adhura’ from her block buster movie ‘Hum hai rahi pyar ke’ and he was then removed.

    He again joined the proceedings and started singing from her another hit film Naajayaz “Lal lal hoton pe gori kiska naam hai” Juhi Chawla’ and was again removed from the hearing.

    The third time, he joined and sang ‘Meri banno ki aayegi baraat ke dhol bajao ji’ from the movie Aaina.

    At the outset, the man was heard saying “where is Juhi Ma’am I can’t see her” and when the judge asked the court master to mute the concerned person, he said “you want to mute me. Oh really! Initially, he joined the hearing with the name of Azaan, thereafter, changed name to Manisha Koirala and then to Janvi.

    The film star herself on her Twitter account last evening had shared the link for joining the proceedings.

    She had tweeted “if you do think this concerns you in any way, feel free to join our first virtual hearing conducted at Delhi High Court to be held on 2nd June, 10.45 AM onwards”.

    Justice J R Midha asked the court master to lock the proceedings and to contact Delhi Police and ask them to identify the person so that a contempt notice could be issued against him for his conduct.

    On a lighter note, Chawla’s lawyer said maybe the person is already affected by the radiations.

    NEW DELHI: The Delhi High Court Wednesday questioned actress-environmentalist Juhi Chawla for directly filing a suit against setting up of 5G wireless networks in the country without giving any representation to the government on her concerns related to the technology.

    Justice J R Midha said the plaintiffs, Chawla and two others, were required to first approach the government for their rights and if denied, they should come to the court.

    The court after hearing the arguments of various parties reserved its order on the suit.

    The plea claimed that 5G wireless technology plans threaten to provoke serious, irreversible effects on humans and permanent damage to the earth’s ecosystems.

    The suit, filed by Chawla, Veeresh Malik and Teena Vachani, said that if the telecom industry’s plans for 5G come to fruition, no person, animal, bird, insect and plant on earth will be able to avoid exposure, 24 hours a day, 365 days a year, to levels of RF radiation that are 10x to 100x times greater than what exists today.

    NEW DELHI: The Delhi High Court Wednesday asked actress-environmentalist Juhi Chawla to file a short note on her plea against the setting up of 5G wireless networks in the country while raising issues related to the technology’s radiation impact on citizens, animals, flora and fauna.

    Justice J R Midha said a two-page note be filed by the plaintiff by 2:30 PM and the court will take up the suit for hearing at 3 PM.

    The court said it will first take up four applications filed by Chawla and two others in the plea, including permission to institute the suit.

    The court also permitted advocate Amit Mahajan, representing the Department of Telecommunication (DoT) to file a one-and-a half page note to see if an audience is required to be given to it.

    “Defendants cannot claim right to audience till I issue notice. I will see if they have a right,” the judge said.

    The plea, filed through advocate Deepak Khosla, claimed that these 5G wireless technology plans threaten to provoke serious, irreversible effects on humans and permanent damage to the earth’s ecosystems.

    The suit, filed by Chawla, Veeresh Malik and Teena Vachani, has said if the telecom industry’s plans for 5G come to fruition, no person, animal, bird, insect and plant on earth will be able to avoid exposure, 24 hours a day, 365 days a year, to levels of RF radiation that are 10x to 100x times greater than what exists today.

    The suit has sought a direction to the authorities to certify to the public at large that how 5G technology is safe to humans, animals and every type of living organism, flora and fauna.

    “This suit will reveal a complete sell-out by the regulatory agencies who, statutorily, have been tasked to protect the health and life of the public, but whose actions reveal an utter derogation of their own statutory duty in order to advance private interests.” the plea has alleged.

    “Since ‘prevention’ is well-accepted to be far better than ‘cure’, immediate measures must be taken to protect humanity and the environment, in accordance with ethical imperatives as well as formal international agreements, before such harm is actually unleashed,” it said.

    The plea said that in April 2019, Brussels became the first major city in the world to halt any further steps in the 5G rollout on account of health hazards.

    “In fact, as recently as on May 5, 2021, the Parliament of Belgium, still not willing to allow 5G rollout in Brussels, invited 45 ordinary citizens drawn at random to address it on their concerns, assuring them that the 5G roll-out will not be permitted till they are heard by Parliament and their concerns are properly and fully addressed,” it said.

    It said the plaintiffs are not against the implementation of technological advancements and they are filing the suit with the sole intent to ensure that health and safety of citizens are preserved and not compromised at any cost, mainly due to the developments and advancements in the ‘admittedly-untested field’ of advanced wireless communication, especially 5G.

    The plea said that India has also entered the ‘5G race’ in an effort to ‘flaunt its advancements and achievements’ in the field of technology and digital communication.

    It said the urge to compete in this race has somewhat distracted the nation from taking into consideration some alarming factors to the health of present and future generations.

    The plea said it is not widely acknowledged that this will also result in unprecedented environmental change on a global scale because the harm from such frequencies is not just to human life but to everything at an ‘atomic level’.

    “In other words, in the case of 5G cellular telecommunication, what is being paved the way for is another health-disaster regulatory fiasco, very much like tobacco, asbestos, etcetera, where palpably-visible dangers by such products were being shouted literally from the rooftops, but repeatedly ignored by the regulatory agencies for decades altogether despite undeniable evidence laid on the table, until the protests had reached a deafening crescendo,” it said.

  • Juhi Chawla files suit against implementing of 5G in India

    NEW DELHI: Bollywood actor Juhi Chawla, who has been actively creating awareness on harmful effects of radiofrequency (RF) radiation, has filed a lawsuit against implementation of 5G mobile technology in India.

    The actor said that 5G technology exposes people and animals to RF radiation that is 10 to 100 times greater than it exists today.

    The Bench of Justice C Harishankar on Monday recused to hear the matter and transferred it to another bench of the Delhi High Court. The matter will now be heard on June 2.

    In a statement, Chawla’s spokesperson said that the suit has been instituted to seek direction to the “arrayed defendants” to certify that 5G technology is safe for humans and every type of living organism and to produce their studies regarding RF radiation in support.

    The spokesperson further said that if not already conducted, efficient research should also be conducted without the participation of private interests.

    The statement added that the urge to compete in the race to roll out 5th generation wireless network has “somewhat distracted our nation from taking into due consideration some alarming factors to the health of present and future generations.”

    “No person, no animal, no bird, no insect and no plant on Earth will be able to avoid exposure, 24 hours a day, 365 days a year, to levels of RF radiation that are 10x to 100x times greater than what exists today,” the statement by Chawla said.

    It further said that 5G plans threaten to provoke “serious, irreversible effects on humans and permanent damage to all of the Earth’s ecosystems”.

    “The accumulated clinical evidence of sick and injured human beings, coupled with experimental evidence of damage to DNA, cells and organ systems in a wide variety of plants and animals, further coupled with epidemiological evidence which supports the conclusion that the major diseases of modern civilization – cancer, heart disease and diabetes – are, in large part, caused by electromagnetic pollution, stems from a literature-base comprising of over 10,000 (ten thousand) peer-reviewed studies, a number much, much, much too large to be ignored,” it added.

    It further said that in response to RTI Act dated 20 March 2019, the Ministry of Telecommunications informed in writing from Science and Engineering Research Board that ‘no studies by SERB have been conducted specifically on the effect of 2G, 3G, 4G and 5G cellular technologies on humans, animals, birds, plants and other living organisms.’

    Chawla in the statement clarified that they were not against the implementation of technological advancements, including wireless communication.

    “We are in a constant dilemma, because after doing our own research and studies regarding the RF radiation from wirefree gadgets and network cell towers, we have sufficient reason to believe that the radiation is extremely harmful and injurious to the health and safety of the people.” it said.
