    NEW DELHI: A Delhi court is likely to pronounce on Thursday its order on the quantum of sentence against the five accused in the killing of television journalist Soumya Vishwanathan in 2008.

    Vishwanathan, who was working with a leading English news channel here, was shot dead in the wee hours of September 30 on Nelson Mandela Marg while she was returning home from work.

    Police had claimed that the motive behind the killing was robbery.

    On October 18, Additional Sessions Judge (ASJ) Ravindra Kumar Pandey convicted Ravi Kapoor, Amit Shukla, Baljeet Malik and Ajay Kumar for the offence of murder and common intention under the IPC.

    They were also held guilty under provisions of the Maharashtra Control of Organised Crime Act (MCOCA) for committing organised crime resulting in the death of the person.

    The offences entail the death penalty as the maximum sentence.

    The court also convicted the fifth accused Ajay Sethi under section 411 (dishonestly receiving stolen property) and MCOCA provisions for conspiring to abet, aid or knowingly facilitate organised crime and for receiving the proceeds of organised crime.

  • Delhi Police seize laptops, mobile of journalists

    The Special Cell of the Delhi Police on Tuesday morning conducted raids and seized laptops and mobile phones from journalists associated with the news portal NewsClick.

    According to official sources, the Special Cell has registered a case in the matter under the stringent Unlawful Activities (Prevention) Act (UAPA).

    UAPA is a law designed to be used against terrorisit organization, and enables authorities to detain suspects for up to six months without filing chargesheet. They can also keep suspects in police custody for up to 30 days.

    Authoritiies have previously indicated that they suspect the owners of the portal to have received money from Chinese sources to fund the daily operations of the organization.

    At the same time, it is unusual for journalists of an organization to be raided in a case involving financial mismanagement by the owners or the parent company.

    In today’s raid, the journalists have been questioned and their mobile and laptops were seized by the cops. However, no arrests have been made so far.

    Senior Journalist Abhisar Sharma took to social media to inform about the raid being conducted at his residence.

    “Delhi police landed at my home. Taking away my laptop and Phone…,” Sharma wrote on X, formerly Twitter.

    Sources confirmed to the New Indian Express that searches are being made at around a dozen locations, including the office of NewsClick.On August 5, The New York Times published a report titled “A Global Web of Chinese Propaganda Leads to a US Tech Mogul” which claimed that the news portal NewsClick was part of a global network that received funding from American millionaire Neville Roy Singham, who allegedly works closely with the Chinese government media.

    Referring to the NYT report, Union Information and Broadcasting Minister Anurag Singh Thakur had alleged that the Congress, China and NewsClick are attached to an ‘anti-India umbilical cord’ and the agenda of the Communist Party of China is being pushed through the website.

    Following the NYT report, the NewsClick had also issued a statement two days later and claimed that the allegations were made against it “are unfounded and without basis in fact or law.”

  • Delhi Police seeks journalist Zubair’s judicial custody, adds conspiracy section in FIR among others

    NEW DELHI: Delhi Police has sought judicial custody of Alt News co-founder Mohammed Zubair after his 4-day remand ended on Saturday in a case related to an alleged objectionable tweet.

    The police have also alleged conspiracy and destruction of evidence in the case by the accused and the relevant sections of the same were added in the FIR.

    Meanwhile, Atul Shrivastava has been appointed as the Special Public Prosecutor for Delhi Police in a case related to an alleged objectionable tweet by Zubair. The police also stated in the court that Zubair received donations from foreign countries.

    Delhi Police have added three new Sections – 201 (for the destruction of evidence – formatted phone and deleted tweets), 120-(B) (for criminal conspiracy) of IPC and 35 of Foreign Contribution (Regulation) Act, 2010, in the matter.

    Notably, Section 35 of the FCRA states the punishment for contravention of any provision of the Act, whoever accepts any foreign contribution or any currency or security from a foreign source, in contravention of any provision of this Act or any rule or order made thereunder, shall be punished with imprisonment for a term which may extend to five years, or with fine, or with both.

    Meanwhile, a bail application has been filed by the counsel for Mohd Zubair which is likely to be heard today.

    The accused was produced before the Patiala House court in Delhi today after the end of his 4-day police remand.

    The FIR against Zubair was lodged on June 20 based on the complaint filed by the Duty Officer of the IFSO unit of the Delhi Police Special Cell which tackles cyber crimes.

    Zubair was arrested and sent to one day of police custody after a First Information Report (FIR) was registered against him based on a Twitter posting, which another Twitter handle alleged “hurt Hindu sentiments.”

    Delhi Police said that Zubair was evasive during questioning and did not cooperate in the investigation. “He was evasive on the questions and neither provided the necessary technical equipment for the purpose of the investigation nor cooperated in the investigation,” said Delhi Police senior officials.

    Meanwhile, Zubair moved Delhi HC challenging the police remand granted by Patiala House Court to the Delhi Police Special Cell.

    Meanwhile, the Delhi High Court on Friday issued a notice to Delhi Police on the plea moved by Zubair challenging the police custody remand granted by a trial court.

    He was remanded to four days of police custody on 28 June in a case related to an objectionable tweet.

    The vacation bench of Justice Sanjeev Narula issued notice to Delhi Police on the plea and directed it to file a reply in two weeks and a rejoinder to it in one week. The matter has been listed for July 27 for further hearing.

    Justice Narula observed, “This petition raises a legal question on the remand granted by the lower, the matter will be heard. I am inclined to issue notice on the petition.”

    The bench also said, “The remand is ending tomorrow, the court will decide the matter according to the material police have after the remand.”

    The hearing at the lower court would not be prejudiced by the arguments of the counsel who appeared in this petition and during the pendency of it, the bench observed.

    Avi Lerner, Trevor Short, Boaz Davidson, and Tanner Mobley from Millennium are executive producers. The film will begin production next month in Europe.

  • SC to hear plea of journalist Tejpal for in-camera hearing of appeal in sexual assault case

    NEW DELHI: The Supreme Court would hear on Friday the appeal of journalist Tarun Tejpal against the Bombay High Court’s order rejecting his plea for an in-camera hearing of the proceedings challenging his acquittal in a 2013 rape case.

    A bench comprising Justices L Nageswara Rao and B R Gavai has listed for hearing the plea of Tejpal whose application for conducting an in-camera hearing of the proceedings under section 327 of the CrPC was rejected by the Goa bench of the Bombay High Court on November 24, last year.

    The acquittal of the former editor-in-chief of Tehelka magazine, who was accused of sexually assaulting his then-woman colleague in the lift of a five-star hotel in Goa in November 2013, by a sessions court in May 2021 was challenged in the Goa bench of the high court by the state government.

    Senior advocate Amit Desai, who had appeared for Tejpal, had referred to the Law Commission and various judgements of high courts supporting his application for an in-camera hearing.

    The high court, however, had rejected the submissions.

    Solicitor General Tushar Mehta, representing the Goa government, had argued that the judgement (of acquittal of Tejpal) by the district court is in the public domain.

    “Section 327 applies for the purpose of inquiring into or trying any offence. It has limited application during inquiry or trial. The appeal is something very clear. Appeals, revisions, etc are neither investigation nor inquiry nor a trial,” he had said.

    In its order in May last year, the Mapusa district and sessions court had held that the complainant had not shown the “kind of normative behaviour” expected from a “victim of sexual assault”.

    The court had granted Tejpal the “benefit of the doubt” in the absence of corroborative evidence to support the allegations made by the complainant.

    Challenging Tejpal’s acquittal, the state government had said that the court’s judgement was “coloured by prejudice and patriarchy”.

  • Journalist arrested, another booked for publishing ‘incorrect place’ of arrest of terrorist

    AMBALA: A journalist was arrested and another was booked at Ambala Cantonment here for allegedly mentioning “incorrect place” of arrest of a suspected terrorist in a news report, prompting the opposition to attack the Haryana government for “suppressing” freedom of press.

    An FIR was registered against reporter Sunil Brar and news editor Sandeep Sharma of Dainik Bhaskar on Thursday under different sections of the IPC, police said, adding that Brar was taken into custody on Friday.

    Efforts are on to nab Sharma, they said. A suspected terrorist was arrested by the Punjab Police on Wednesday over an alleged tiffin bomb plot from Mardon Sahib village of Ambala.

    The newspaper headline on the following day stated “Punjab police claims arrest of terrorist at Cantt from near IOC depot’. However, the newspaper published a correction the next day on the location from where the suspected terrorist was arrested. SHO Ambala Cantt Vijay Kumar said the case against the journalists was registered as they published the news without any authentication.

    Journalists Sunil Brar and Sandeep Sharma have created fear among the masses by publishing false news, he added.

    The duo has been booked under IPC sections 153 (wantonly giving provocation with intent to cause riot), 177 (furnishing false information), 504 (intentional insult with intent to provoke breach of peace) and 505 (2) (statement creating or promoting enmity, hatred or ill will between classes), police said.

    Meanwhile, Brar was on Saturday produced in the court of Duty Magistrate Mukesh Kumar. The court granted him bail on furnishing a personal bond of Rs 50,000.

    Latching onto the issue, the opposition parties, including the Congress, INLD, Haryana Democratic Front and BSP, criticised the action taken against the media persons.

    Senior Congress leader Rohit Jain said the arrest was made against the direction of Supreme court. He said the police had not issued any prior notice to the journalist before arresting him.

    Chitra Sarwara, a senior leader of the Haryana Democratic Front, and BSP leader Prakash Bharti alleged the police had violated the norms of democracy. It is an attack on the freedom of press, they said.

  • Case against 3 journalists for reporting on plight of children at UP govt event

    KANPUR: Three local journalists working with a news channel have been accused of public mischief and criminal intimidation in an FIR filed against them for airing a news report on school children allegedly exercising in biting cold conditions without winter wear at a government function here, a police official said.

    The FIR lodged by a Basic Shiksha Adhikari (BSA), an official who takes care of primary education in government schools, also accused the journalists of threatening him.

    “The case was registered on Tuesday against three journalists–Mohit, Amit and Yasin on complaint off Basic Siksha Adhikari (BSA) Sunit Dutt at Akbarpur police station of Kanpur Dehat under IPC Section 505 (statements conducing to public mischief) and Section 506 (criminal intimidation),” Station House Officer (Akbarpur), Tulsiram Pandey, said.

    He said the journalists aired the news repot which alleged that several government school students “shivered in biting cold while government officials were busy with an event”.

    The BSA also alleged that the three journalists were not present at the event.

    Officials concerned claimed the children were made to take off their winter wear only for the exercises.

    The videos was of a function held to mark the UP foundation day on Sunday and was attended by state minister for technology, Ajit Pal Singh, several MLAs and government officials, including DM Kanpur Dehat Dinesh Chandra.

    The video, after being aired by the journalists, also went viral on social media on Tuesday in which students were seen braving the biting cold, dressed in cotton shirts and knickers.

    In the FIR, the BSA said the children wore woollens after the drill and the videos were shared with malafide intention. He added that the journalists also hurt the sentiments of yoga teachers, who were insulted in the process.

    District Magistrate, Kanpur Dehat, Chandra, told reporters, “It was painful that some journalists who were not present here spread such news.

    You all know that yoga cannot be performed wearing sweater, coat and pants. The students did good performance and we all appreciated them.

    ” One of the journalists, Amit Singh, said making the children do yoga in inadequate clothing in harsh winter conditions could not be justified and authorities could have been more careful.

    Superintendent of Police (Kanpur Dehat), Keshav Kumar Choudhary, said that FIR has been registered against three local journalists for airing news reports by allegedly misrepresenting facts conducing to public mischief and threatening the BSA.

    The instructions have been issued to the Investigation Officer to probe the charges in a fair manner, he said.
