  • SC stays conviction of Congress leader Hardik Patel in rioting case

    NEW DELHI: The Supreme Court on Tuesday stayed the conviction of Gujarat Congress working president Hardik Patel in a rioting and arson case.

    A bench of Justices S A Nazeer and Vikram Nath said this is a fit case for the high court to have stayed the conviction.

    At the outset, senior advocate Maninder Singh submitted that not allowing Patel to contest election is a violation of his right to freedom of expression.

    “It is a violation. I have already lost one chance to contest the election in 2019. We are before your lordships to get our rights under Article 19(1)(a) to be enforced. They have misused the police power. Therefore, I don’t know what they have to say, but my lords must decide this case soon,” he said.

    Solicitor General Tushar Mehta said the basic parameters for conviction are set.

    “In criminal law, there is no one standard guideline to say which one is right. Your lordship may decide the issue. Whether Patel might have won or not, is not the issue in this case,” he said.

    The bench then passed the order and said,”Having regard to the facts and circumstances, we are of the view that this is the fit case for the high court to have stayed the conviction. The conviction is, hereby, stayed until the appeals are decided accordingly.”

    The top court was hearing a plea filed by Patel against the judgment of the Gujarat High Court seeking suspension of the conviction so that he could contest the 2019 Lok Sabha elections.

    Patel had sought a direction to suspend the conviction order passed on July 25, 2018, by a sessions court in Mahesana in Visnagar.

    He had also challenged the validity of the high court’s order of March 29 refusing his plea for a stay on the conviction.

  • Caste equation plays out ahead of revamp in Congress’ Gujarat unit

    NEW DELHI:  Ahead of key appointments, including that of state president, in the Gujarat Pradesh Congress Committee (GPCC), the party high command is weighing caste equations to ensure representation of influential communities in the state with an eye on the next year’s assembly election.    

    The party is expected to announce names of new state president, leader of opposition and other committees by this week. Sources said that the caste factor is expected to play a key role in appointments to the vacant and new posts.

    “The party is expected to pick an OBC-Tribal-Patidar combination for party chief, leader of opposition and head of the campaign committee. This combination gives representation to communities in the majority of seats,” said a senior Gujarat leader.

    In the 182-seat Assembly, there are 80 seats with OBC dominance, 27 reserved for tribals and Patidars with 12 per cent population having dominance on around 60 seats.

    The OBC population has influential Thakors in north and Kolis in central Gujarat.

    Sources further said that the party has already picked Hardik Patel as working president and now focus would be to appoint leaders from OBC and tribal communities.

    “In 2018, the party brought an OBC (Amit Chavda) as GPCC chief and Patidar leader Paresh Dhanani as LoP. This time also the caste combination has to be kept in mind to give a tough fight,” said another leader.

    In 2017, the party contested elections under OBC leader Bharatsinh Solanki while tribal leader Mohan Rathva was LoP. 

    Names of Patel, former state chiefs  Solanki and Arjun Modhwadia and Rajya Sabha MP Shaktisinh Gohil are doing rounds for the top post in the state.

    “The party is likely to give reins of the Gujarat unit to a senior and experienced leader so that everyone is united while young leaders like Patel and Mevani are expected to lead the election campaign,” said sources.

    PATNA: With the entry of trio-Kanhaiya Kumar, Jignesh Mevani and Hardik Patel in Bihar politics, the Congress party took an exit from its political alliance with the RJD in Bihar on Friday. The party made an announcement that it will not onlt contest in the bypolls alone but also contest all 40 Lok Sabha seats in 2024.

    The turning point in Congresss political strategy happened when Kanhaiya Kumar, Jignesh Mevani and Hardik Patel reached Bihar as star campaigners to party’s candidates in upcoming bypolls.

    The discomfort between Bihar’s main opposition RJD and the Congress Party became evident soon after the induction of Kanhaiya Kumar into the Congress Party.  

    The Congress Party is staking claim on the Kusheshwar Asthan Assembly seat in Darbhanga, elections for which will be held on October 30.

    The discord in the Grand Alliance also came to the fore recently when the Congress sought to field its candidate for bypoll to Kusheshwar Asthan – a seat which it had contested in the 2020 state elections, in line with the Grand Alliance’s seat-sharing pact – but the RJD went ahead and named its nominees from both the constituencies.

    General Secretary of AICC and senior Congress leader of Bihar Tariq Anwar said “The assembly by-elections in two seats in have definitely given a lesson that the Congress should now stand on its own feet. It will not be appropriate to depend on the crutches of any other party for a long time”.

    “The Congress Party is fully geared up with its leaders like Kanhaiya Kumar and others to register victory on both the assembly seats in Kusheshwarasthan and Tarapur. Our party is not in friendly fight with the RJD. Rather, we are fighting to win with the massive supports of people,” said Bhakat Charan Das, the state in-charge of Bihar Pradesh Congress Party.

    Enthused at the arrival of party’s trio-Kanhaiya Kumar, Jignesh Mevani and Hardik Patel in Bihar for campaigning as start campaigners, Das announced that the Congress Party will contest on all 40 LS seats in Bihar in 2024 alone.

    “The Congress Party is preparing itself for the next LS elections to take on the NDA. Since our party is the grand old national party, our responsibility is to save the nation and save the state also”, Das said, accusing the RJD of having betrayed the alliance with RJD in the Grand Alliance.

    Adopting a tit-for-tat stand against the RJD, Das told the media that if the RJD can not give the Congress Party respect, how can the RJD expect the same from Congress party?

    He categorically denied that the Congress party and RJD were in friendly fight in the upcoming bypolls.

    Putting faith in new trioof the Congress, Das said that Kanhaiya, Jignesh and Patel will certainly strengthen the party.

    Kanhaiya Kumar, speaking on Friday, for the first time after joining Congress Party, asked the people to save freedom by being with the Congress Party.

    According to sources, the RJD was never in favour of Kanhaiya’s entry into the Congress Party as he was seen with a potential to emerge as a rival against Tejashwi Yadav.

    In Bihar’s politics, Kanhaiya Kumar has entered as the third bachelor politician after Tejashwi Yadav and Chirag Paswan, who pulls the crowd.

    According to Dr Nawal Kishor-national spokesperson of RJD, the Bihar assembly held in 2000, February 2005 and October 2005, the RJD had won the Kusheshwar Asthan seat.

    Meanwhile, sources said the possibility for forging a new alliance of RJD with LJP(Ram Vilas), led by Chirag Paswan, has increased more after the splits in alliance with the Congress Party.

  • Dalit leader and Gujarat MLA Jignesh Mevani to join Congress

    MUMBAI: Jignesh Mevani, an independent Gujarat MLA and influential Dalit leader, announced on Saturday that he would join Congress on the birth anniversary of Bhagat Singh on September 28 along with former JNU student leader Kanhaiya Kumar, in Delhi.

    The development comes ahead of the next year’s Assembly elections in the BJP-ruled Gujarat.

    Mevani had won election from the Vadgam Assembly constituency in Banaskantha district in 2017 with the backing of Congress.

    “On September 28, I will be joining the Indian National Congress along with Kanhaiya Kumar,” he said, adding that he will be able to talk in detail about the decision only after that.

    Sources said Mevani will be made a working president of the party’s state unit while Prashant Kishor will be made general secretary of Congress with special department election in charge and Kanhaiya Kumar will be also given a bigger role in Bihar Congress ahead of the 2024 Lok Sabha polls.

    Working president of Gujarat Congress Hardik Patel will also attend the function in Delhi where he will be inducted into the party in the presence of Rahul Gandhi, Mevani said.

    “We welcome all the revolutionary youths who are willing to work for the development of the country and strengthen the Congress party and the ideals of (Mahatma) Gandhi, Sardar (Patel) and (Jawaharlal) Nehru,” Hardik Patel said in a statement.

    He described Mevani as “an old friend” and said his entry will help the party both in the state and at the national level.

    Chief spokesperson of Gujarat Congress Manish Doshi said Mevani became an MLA with the support of Congress workers in the 2017 elections, and his entry “will strengthen the party’s fight against the corrupt policies of the BJP”.

    “Congress party welcomes everyone who fights against the corrupt policies of the BJP.

    The party policy is to ensure justice to everyone in Gujarat and fight against every such policy of the BJP which is anti-people, anti-youth, anti-farmer, anti-poor,” Doshi said.

  • Not joining AAP, says Gujarat Congress leader Hardik Patel

    AHMEDABAD: Gujarat Congress working president Hardik Patel on Monday asserted he would not join the Arvind Kejriwal-led Aam Aadmi Party after reports emerged on social media said that he could be the face of AAP for the 2022 Assembly elections in the BJP-ruled state.

    While discarding these reports as “baseless”, Patel saw the BJP’s hand behind the circulation of such “fake reports”, a claim rejected by the ruling party.

    The reports emerged in the backdrop of AAP chief Kejriwal’s visit to Gujarat on Monday.

    “I am surprised at the reports coming in from various media quarters that I am going to join the AAP and become their face for the next year’s Assembly election in Gujarat. Such claims are baselss. Such fake reports are being planted in the media with a malicious intent at the behest of the BJP,” Hardik Patel said in a statement.

    “These are being circulated to create confusion among Congress supporters and the Patidar community. The BJP is circulating such baseless reports in order to hide its failure during the COVID-19 crisis in Gujarat” he added.

    Patel said he is the youngest working president ever of the Gujarat Congress and he joined the party “with the sole aim of removing the anti-farmer, anti-worker and anti-Patidar BJP government.”

    Patel said he will try his best as the opposition party’s state working president to see that the Congress forms a government in Gujarat in 2022.

    Earlier in the day, former head of a Gujarati news channel, Isudan Gadhvi, joined the AAP in the presence of Kejriwal.

    The BJP rejected Patel’s allegations of planting fake news against him.

    “The BJP fights elections on the agenda of development and that is why people elect us. Hardik Patel is having his own agenda and we are not concerned about it. His allegations are far from the truth,” said Gujarat BJP spokesperson Yamal Vyas.

  • Gujarat Congress didn’t give me work in local body polls; even opinion not sought: Hardik Patel

    NEW DELHI:Gujarat Congress working president Hardik Patel on Sunday slammed the functioning of the state unit after the party’s humiliating defeat in the local body elections, claiming that no work was given to him in the polls and his opinion was also not sought for ticket distribution.

    He, however, also dismissed speculation about leaving the Congress in the future and said he would remain in the party and carry out whatever responsibility he is given.

    In an interview with PTI, Patel also raised questions over the understanding of the party’s central leadership of Gujarat and said the Congress has failed to struggle as an opposition in the state.

    In order to strengthen the party, the high command has to understand Gujarat, he said.

    Patel also argued that the legislators have to be kept away from the work of the organisation.

    The comments by Patel, who was the face of the Patidar quota agitation in 2015, came days after the BJP won all 31 district panchayats, 74 out of 81 municipalities and also trounced its main rival Congress in 231 taluka panchayats.

    The success followed the BJP’s clean sweep in elections for six municipal corporations in the first phase last month.

    The Congress could not even open its account in the Surat Municipal Corporation.

    Following the party’s debacle, Gujarat Congress president Amit Chavda and leader of opposition Paresh Dhanani sent their resignations to the party leadership.

    When asked about the reasons for the party’s defeat, Patel said, “We have failed to win the public’s trust. The struggle which we should have undertaken as an opposition, we have failed in that. The public feels that the Congress did not do its job as an opposition and that is why the Aam Aadmi Party got votes in many places.”

    “In Surat, people from our movement had asked for only two tickets. The party did not even give that. Just because of those two seats we lost all the 36 seats there,” he said.

    It is worth noting that in the last civic elections, the Congress had won more than 30 seats in the Patidar-dominated areas of Surat.

    Without naming any leader, Patel claimed, “I am the working president and I had no role in ticket distribution. I was told that the working president has no role in it. Nevertheless, I held several meetings on my own. I was not given any programme or work by the Pradesh Congress Committee.”

    “Preparations for the local body elections had been going on for three months. Not even once in three months have I been told that you have to do this work. Tickets were distributed in more than 5,000 seats, but not even for one seat, I was asked to give my opinion. Even in Patidar-dominated areas, my opinion was not taken,” he said.

    Asked about the resignation of Amit Chavda from the post of state president and Paresh Dhanani from the post of the leader of opposition, Patel said, “If I were also the president, I would have taken responsibility. They have resigned, but the responsibility lies with everyone.”

    “Now everyone has to work hard,” he added.

    Asked if the Congress high command did not take necessary steps in time, Patel said they have to understand Gujarat, and give importance to it.

    “We have not been in power in the state for 30 years. If we do not understand Gujarat, young workers like us will be left disappointed. The party is slumping day by day and no one is paying attention,” Patel said.
