  • EC pulls up Gujarat chief secy, DGP for failing to file compliance report on transfer of officials

    NEW DELHI: Taking a stern view of the failure of Gujarat government officials to send a compliance report on transfer and posting of officials ahead of the Assembly polls, the Election Commission has sought an explanation from the state chief secretary and DGP.

    Citing a letter the EC shot off to the Gujarat chief secretary on Friday, sources said despite reminders the chief secretary and the Director General of Police failed to send compliance reports on transfer and posting of certain category of officials ahead of the polls.

    Now they have been asked to explain the circumstances as to why the compliance reports have not been furnished “so far even after the lapse of stipulated time limit despite issuing of the reminder in the matter,” a source said quoting the letter.

    The letters regarding transfer and posting of officials were sent to Himachal Pradesh and Gujarat.

    While Himachal Pradesh will go to polls on November 12, dates are yet to be announced for Gujarat election.

    The commission had directed the two state governments to transfer officials posted in their home districts and those who have spent three years in a district in the last four years.

  • Have ‘zero tolerance’ towards distribution of any kind of inducement: Chief Election Commissioner

    NEW DELHI: The Election Commission on Friday said it has “zero tolerance” towards distribution of inducement to voters in the Himachal Pradesh polls and bodies including the GST will ensure that freebies are not given out to influence voters.

    Chief Election Commissioner Rajiv Kumar also said the poll panel is awaiting response from political parties on its proposal to introduce a fresh proforma where they can explain how they propose the election promises made to voters.

    Parties have been asked on how will they manage the required finances. The EC plans to tweak the model code by making the proforma part of it.

    “Political parties, candidates have an undisputed right to announce or make a promise which they feel is feasible. Voters also have a right to know how will it be fulfilled. So this consultative process will be governed by the existing extant legislative framework . The political parties are to come back to us by October 19 and thereafter we will decide on what needs to be done,” Kumar said.

    Responding to questions on attempts to induce voters by distributing freebies, the CEC said the poll panel has “zero tolerance” towards distribution of any kind of inducement and it has energised the entire machinery.

    “GST will look at all the e-ways and goods which are going to the poll-bound states, even the nearby states. They have mapped all the godowns, warehouses, sarees, mixers, all this so that nothing is used (as an inducement),” he said.

    He said airports will keep a strict watch, including the private airstrips, through the ATC so that “no illegal, unscheduled, irregular flight goes unchecked”.

    Inter-state borders will be sealed in Himachal Pradesh.

    “Nothing comes in. The chief secretary, district commissioners, police personnel understand this very well. And if there is any deficiency in this understanding, we’ll make sure they understand,” he asserted.

  • Himachal goes to polls on Nov 12; Gujarat announcement later

    NEW DELHI: Elections to the Himachal Pradesh assembly will be held on November 12, the Election Commission announced on Friday.

    The counting of votes will be on December 8, Chief Election Commissioner Rajiv Kumar told a press conference here.

    The Commission did not announce the elections for the Gujarat assembly, the term of which ends on February 18, 2023.

    Over 55 lakh voters are eligible to exercise their franchise for 68 assembly seats in Himachal Pradesh, Kumar said.

    The CEC said the Commission was following past precedence in keeping the announcing in abeyance the schedule for Gujarat assembly.

    There are 1.86 lakh first-time voters, 1.22 lakh aged 80-plus and 1,184 voters who are above 100 years of age.

    Himachal Pradesh has a 68-member assembly and the BJP had won a clear majority by winning 44 seats in the 2017 elections.

    The Congress managed to win 21 seats, Independents bagged two seats and the CPI(M) emerged victorious on one seat.

    In percentage terms, the BJP won 48.79 per cent of the total valid votes, followed by the Congress (41.68 per cent) and Independents (6.34 per cent).

  • Centre’s ‘colonial settler project’ initiated: Mehbooba on ECI order for new voters’ registration

    SRINAGAR: PDP president Mehbooba Mufti on Wednesday flayed the Election Commission’s order for registration of new voters in Jammu, charging that the Centre’s “colonial settler project” has been initiated in the region.

    The former J-K chief minister said the BJP’s alleged attempts to create religious and regional divisions between Jammu and Kashmir must be “thwarted” because “whether its a Kashmiri or a Dogra, safeguarding our identity and rights will be possible only if we put up a collective fight”.

    “ECI’s latest order for registration of new voters makes it clear that GOIs colonial settler project has been initiated in Jammu. They will bear the first blow to Dogra culture, identity, employment & business,” she charged on Twitter.

    Her remarks come after authorities in Jammu on Tuesday authorised tehsildars (revenue officials) to issue certificate of residence to those residing in the winter capital for more than one year to facilitate their entry in the ongoing special summary revision of electoral rolls.

    Talking to reporters in Kulgam district in south Kashmir, Mufti said her party has been saying for the last many years now that the “BJP has an ‘illegitimate intent’ behind the abrogation of Article 370”.

    ““Their aim is to change the population ratio in J-K. It will start in Jammu when a sea of people will come to Jammu from outside, which will not only harm the Dogra culture there, but the business, employment and resources there will be attacked. The crime rate there has increased manifold since they opened the doors for the outsiders,”” she alleged.

    “”But, the people of J-K should understand that our future, destiny and our goal is the same. The way the people of Kargil and Leh, Ladakh, foiled the BJP’s divide and rule policy, and stood united to secure their land and jobs, similarly, the people of J-K have to stand united to foil the BJP’s illegitimate intentions, because outsiders, who do not even have a house, will get to vote which means reducing the importance of the vote of the people of J-K,”” she said.

    Mufti claimed that the delimitation of constituencies in J-K was done in such a way that the BJP benefits from it.

    ““But, despite that, they (BJP) feel the people of Jammu are against them as the people of Jammu have understood that the BJP uses them for their electoral benefits. So, they have come up with this voter law which is nowhere else in the country,”” she said.

    District Election Officer and Deputy Commissioner, Jammu, Avny Lavasa had passed the directive on electoral rolls after taking serious note of some eligible voters facing hardships in registration as voters for non-availability of required documents.

    The Special Summary Revision of electoral rolls has been started in the Union Territory with effect from September 15 for registration of new voters, deletion, correction, transposition of voters who have migrated, died since last summary revision, amid serious concern expressed by various political parties over the inclusion of non-locals as voters.

    The National Conference (NC) said the BJP is “scared” of the elections and knows it will lose badly.

    “The Government is going ahead with its plan to add 25 lakh non-local voters in J&K and we continue to oppose this move. BJP is scared of the elections & knows it will lose badly. People of J&K must defeat these conspiracies at the ballot box,” the NC said in a tweet.

    Peoples Conference said the DC Jammu’s order on facilitating registration of non-locals as electors was “highly suspicious”.

    ““The latest order by DC Jammu authorising revenue officials to issue certificate of residence to outsiders residing in Jammu for more than one year is highly suspicious aimed at enabling them to vote. This goes against the SC judgement on the issue. The onus of proving our suspicions wrong yet again lies on the ECI and the J&K administration. They must clarify if such a directive is permissible,”” the party said on Twitter.

    MUMBAI: The Uddhav Thackeray-led Shiv Sena faction has submitted to the Election Commission its three options of a trident, rising sun or Mashaal (burning torch) for its poll symbol, sources said on Sunday.

    The Election Commission had on Saturday barred the Shiv Sena factions led by former chief minister Thackeray and present Maharashtra CM Eknath Shinde from using the party name and its election symbol ‘bow & arrow’ in the Andheri East Assembly by-poll scheduled on November 3.

    In an interim order over claims by the rival factions for control of the organisation, the commission asked them to suggest by Monday three different name choices and also as many free symbols for allocation to their respective groups.

    A source from the Thackeray faction said, “The Sena has submitted three options as an alternative before the Election Commission – a trident, rising sun or a burning torch, also known as Mashaal in Marathi and Hindi languages.”

    The Thackeray camp has also given some options for its official name in polls, the source said without elaborating.

    The EC’s interim order on Saturday came on the Shinde faction’s request seeking it be allocated the symbol as the Andheri East assembly bypoll is approaching.

    The rival factions had approached the Election Commission after the split in the Shiv Sena ranks in June this year, with both sides claiming to be the ‘real Shiv Sena’.

    The bypoll to Andheri East Assembly seat in suburban Mumbai has been necessitated due to the death of incumbent Sena MLA Ramesh Latke.

    The Congress and the NCP have decided to support Ramesh Latke’s wife Rujuta Latke, the candidate of the Thackeray faction of the Shiv Sena, their coalition partner in the Maharashtra Vikas Aghadi (MVA).

    The Bharatiya Janata Party (BJP), an ally of the Shinde faction, has decided to field Murji Patel, a corporator in the Brihanmumbai Municipal Corporation.

    NEW DELHI: Mumbai-based AB General Electoral Trust donated Rs 10 crore to the ruling Bharatiya Janata Party in the financial year 2021-22, the Election Commission of India said on Tuesday.

    The trust received Rs 10 crore in two instalments of Rs 5 crore each from Hindalco Industries Ltd in the financial year and donated the entire sum to the BJP in two instalments of Rs 5 crore each.

    Chennai-based Triumph Electoral Trust received Rs 50 lakh from Tube Investments of India Limited in FY 2021-22. It donated the entire amount to Dravida Munnetra Kazhagam, the party which rules Tamil Nadu.

    Both trusts had submitted their annual contribution statements to the EC which put them in public domain on Tuesday.

    Electoral trusts are non-profit companies established for receiving donations from a person or a company and distributing the same to political parties. The trusts get income tax exemptions as well.

  • Big question mark over Election Commission’s fairness in last few years: Prashant Bhushan

    NAGPUR: Activist-lawyer Prashant Bhushan on Sunday said the fairness of the Election Commission of India (ECI) has come under cloud in the last few years.

    He accused the ECI of keeping mum when big leaders from the ruling party violate the poll code, while acting swiftly against the opposition parties in such cases, and also claimed that the schedule of elections is made keeping in mind the convenience of the government.

    Bhushan alleged that the independence of the judiciary is under threat and those speaking against the government face sedition and other serious charges, and they are not able to get bail for years.

    He was speaking on the topic ‘Challenges before Democracy ‘ during a programme organised here by ‘Deshonnati’, a Marathi daily.

    “After T N Seshan became the chief election commissioner, for many years we could see that the Election Commission was very fair and impartial. But in the last six to seven years, a big question mark has arisen on its fairness,” he said.

    The Election Commission takes action if the Model code of conduct is violated by the opposition parties. But it keeps quiet when big leaders from the ruling party violate it. We have been witnessing this for a very long time, he alleged.

    The election dates are prepared as per the convenience of the government, he said.

    “Earlier, even the government did not know what dates will be decided by the EC for elections. But now, it is being witnessed that representatives of the ruling party even before the formal announcement tell what the polling dates are and the same dates are later announced by the EC,” he said.

    “The reason for the EC not being fair anymore. The problem with this has always been the selection in the poll watchdog is done by the government and there is no independent selection committee. And now, what the government is doing is that it is selecting people mostly from Gujarat and they are those who will do what the government will ask them to do. This also is an issue before democracy,” he said.

    Bhushan also alleged that there was a lack of independence in all regulatory institutions, and termed it as one of the biggest problems. He said the judiciary was formed to protect the fundamental rights of people and to keep the legislature and the executive within limits.

    “But now we are seeing that this is not happening. Those speaking against the government are facing sedition and sometimes false cases under the Unlawful Activities (Prevention) Act. They are not able to get bail for years and this is being done blatantly. Our judiciary is not able to act against it. Hence, the independence of the judiciary is also under threat,” he said.

    “Media is also being controlled by the government. The police agencies are also being used for political use. The selection of some agencies like the Enforcement Directorate (ED), the National Investigation Agency (NIA) and the Income Tax department is completely in the hands of the government, which has put democracy in real danger,” he alleged.

    On the electronic voting machines (EVMs), he said that although there was no significant manipulation in EVMs at present, in the coming times it cannot be ruled out.

    “There is a possibility of manipulation and I feel EVMs are very dangerous. Paper ballots should return and they have returned in most of the countries,” he said.

    In order to tackle these challenges, a number of reforms can be brought by introducing Initiatives and Referendum law, Pre-legislative Transparency and Consultation law, he said, adding that parliamentary committees should be revived.

    Since the opposition has become weak now, these reforms cannot be done by it alone and hence people need to raise their voices now. They can raise voices against unfair practices like which was done for the Lokpal Bill.

    People can launch big agitations on issues like unemployment and privatisation of public sector units, which will also strengthen the opposition, he said.

    Replying to a query by PTI on the sidelines of the programme about why the Supreme Court was not taking up the issue of electoral bonds on a priority basis, Bhushan said the government was not interested in the issue and probably they were stalling it.

    “However, with the new Chief Justice of India at the helm, the matter will be heard,” he said.

    Bhushan has filed a PIL challenging laws permitting funding of political parties through the electoral bond scheme.

    When asked whether the opposition parties would be able to put up a united fight against the Bharatiya Janata Party (BJP) in the next elections, he said he was not sure whether united opposition would be a good idea or not.

    “But, in any case, civil society needs to play a major role to any major political change is to be brought in the country,” he said.

The problem with this has always been the selection in the poll watchdog is done by the government and there is no independent selection committee. And now, what the government is doing is that it is selecting people mostly from Gujarat and they are those who will do what the government will ask them to do. This also is an issue before democracy,” he said.

    Bhushan also alleged that there was a lack of independence in all regulatory institutions, and termed it as one of the biggest problems. He said the judiciary was formed to protect the fundamental rights of people and to keep the legislature and the executive within limits.

    “But now we are seeing that this is not happening. Those speaking against the government are facing sedition and sometimes false cases under the Unlawful Activities (Prevention) Act. They are not able to get bail for years and this is being done blatantly. Our judiciary is not able to act against it. Hence, the independence of the judiciary is also under threat,” he said.

    “Media is also being controlled by the government. The police agencies are also being used for political use. The selection of some agencies like the Enforcement Directorate (ED), the National Investigation Agency (NIA) and the Income Tax department is completely in the hands of the government, which has put democracy in real danger,” he alleged.

    On the electronic voting machines (EVMs), he said that although there was no significant manipulation in EVMs at present, in the coming times it cannot be ruled out.

    “There is a possibility of manipulation and I feel EVMs are very dangerous. Paper ballots should return and they have returned in most of the countries,” he said.

    In order to tackle these challenges, a number of reforms can be brought by introducing Initiatives and Referendum law, Pre-legislative Transparency and Consultation law, he said, adding that parliamentary committees should be revived.

    Since the opposition has become weak now, these reforms cannot be done by it alone and hence people need to raise their voices now. They can raise voices against unfair practices like which was done for the Lokpal Bill.

    People can launch big agitations on issues like unemployment and privatisation of public sector units, which will also strengthen the opposition, he said.

    Replying to a query by PTI on the sidelines of the programme about why the Supreme Court was not taking up the issue of electoral bonds on a priority basis, Bhushan said the government was not interested in the issue and probably they were stalling it.

    “However, with the new Chief Justice of India at the helm, the matter will be heard,” he said.

    Bhushan has filed a PIL challenging laws permitting funding of political parties through the electoral bond scheme.

    When asked whether the opposition parties would be able to put up a united fight against the Bharatiya Janata Party (BJP) in the next elections, he said he was not sure whether united opposition would be a good idea or not.

    “But, in any case, civil society needs to play a major role to any major political change is to be brought in the country,” he said.

    Members of the state’s ruling coalition will gather for the third round of meeting in the morning at the chief minister’s residence in the midst of intense speculation about the political fate of Soren, whose assembly membership hangs in balance over a mining lease case.

    “The governor will sign the disqualification order today and it will be sent to the ECI,” a Raj Bhavan source told PTI.

    Sources in the governor’s official residence had on Thursday claimed that the ECI has recommended Soren’s disqualification as an MLA for violating electoral norms by extending a mining lease to himself, but there has been no official confirmation yet.

    The legislators of the ruling JMM-Congress-RJD coalition, who had held marathon meetings on Friday morning and evening, will again meet around 11 AM on Saturday to chalk out further strategies.

    Sources in the ruling alliance said that strategies were being chalked out to ensure there was no threat to the government.

    Insiders in the Congress, a crucial ally in the JMM-led ruling coalition, had said that “ring-fencing” of MLAs by parking them in a resort in a “friendly state” such as West Bengal, Bihar or Chhattisgarh is being considered as an option to prevent legislator poaching by the BJP.

    However, they said a decision on the future course of action can be taken once the governor communicates to them the ECI’s opinion on the possible disqualification of Soren as an MLA.

    Soren, who was in Latehar on Friday to attend a programme, lashed out at the Centre for “unleashing” all constitutional agencies to “de-stabilise a democratically elected government”.

    The Jharkhand Mukti Morcha (JMM) executive president said “satanic forces” were all out to execute evil designs.

    He later tweeted, “The Centre has unleashed all agencies on me after I asked for legitimate Rs 1.36 lakh crore dues which are pending to the state. When they saw that they cannot harm me, they are trying to harass ‘Guruji’ (Shibu Soren), who is in a certain age bracket, to get to me.”

    The BJP, the petitioner in the case, has sought Soren’s disqualification for violating Section 9(A) of the Representation of the People Act, 1951, which deals with disqualification for government contracts.

    The clause states that “a person shall be disqualified if, and for so long as, there subsists a contract entered into by him in the course of his trade or business with the appropriate government for the supply of goods to, or for the execution of any works undertaken by, that government”.

    RANCHI: The Election Commission of India is believed to have told Jharkhand Governor Ramesh Bais that Chief Minister Hemant Soren should be disqualified as an MLA for violating electoral norms, Raj Bhavan sources said.

    However, Raj Bhavan has officially not confirmed the development.

    Jharkhand Governor Ramesh Bais after touching down at Ranchi airport this afternoon told media persons that he will be in a position to comment on the issue once he takes stock of developments after reaching the Raj Bhavan.

    “I was in AIIMS, Delhi for two days. I will be in a position to tell about any such decision when I reach Raj Bhavan,” he said.

    Since then he has not communicated to the media on the issue.

    The Election Commission sent its opinion to Jharkhand Governor Ramesh Bais earlier this morning on a plea seeking that Chief Minister Hemant Soren be disqualified as an MLA for violating electoral norms by extending a mining lease to himself.

    The opinion was sent to the Jharkhand Raj Bhavan in a sealed cover.

    The BJP, the petitioner in the case, has sought Soren’s disqualification for violating section 9 A of the Representation of the People Act, 1951, which deals with disqualification for government contracts.

    The clause states “A person shall be disqualified if, and for so long as, there subsists a contract entered into by him in the course of his trade or business with the appropriate Government for the supply of goods to, or for the execution of any works undertaken by, that Government.”

    Jharkhand Chief Minister Soren alleged blatant misuse of constitutional authorities and public agencies after reports claimed that the Election Commission recommended his disqualification as an MLA in the mining lease case.

    ‘No communication in this regard has been received by the Chief Minister’s Office” from either the Election Commission or Governor Ramesh Bais, his secretariat said.

    “It seems that BJP leaders including a BJP MP and his puppet journalists have themselves drafted the ECI report, which is otherwise always given in a sealed cover,” Soren said in a statement issued by his secretariat.

    “This blatant misuse of constitutional authorities and public agencies and its complete takeover by BJP HQ in Deendayal Upadhay Marg in this shameful manner is unseen in Indian Democracy,” he said.

    The Chief Minister is apprised of several media reports about ECI sending a report to the governor “apparently recommending his disqualification as a MLA,” his office said.

    The UPA alliance has 439 MLAs in the 81-member Assembly.

    Within the United Progressive Alliance, JMM as the largest party has 30 MLAs, the Congress 18 legislators, and the RJD one. The main opposition BJP has 26 MLAs in the House. The coaltion partners said there was no threat to the government.

    Congress leader and Parliamentary Affairs Minister Alamgir Alam ruled out any threat to the ruling coalition in the state and said “even in the probability of Soren, who is also the JMM executive president, being disqualified from Assembly in an office of profit case, there is no threat to the government”.

    “It is a policy matter. Our government will continue. Hemant Soren continues to be our leader,” he said.

    JMM chief spokesperson Supriyo Bhattacharya also told PTI, “Attempts have been made to destabilise a democratically elected government ever since it came in power in December 2019 but all such evil designs of the BJP would be thwarted.”
