  • Woman files rape complaint against LJP MP and Chirag Paswan’s cousin Prince Raj

    NEW DELHI:  A woman has filed a complaint of rape against Prince Raj, Lok Sabha MP and cousin of Lok Janshakti Party (LJP) leader Chirag Paswan, with Delhi Police at the Connaught Place Police Station. The complaint came hours after Chirag had mentioned a complaint of sexual misconduct against Prince. 

    According to police, the woman associated with the party filed a three-page-complaint on Tuesday evening. “We have recived a complaint of rape against the Prince Raj at CP police station. The woman has alleged that Raj raped her after sedating her drink,” said a senior police officer. 

    “We have not filed any FIR yet. The complaint is currently being investigated to verify the allegations against the Lok Sabha MP. A case will be filed after ascertaining all angles,” the police said.  

    On Tuesday, Chirag Paswan shared a letter dated March 29, addressed to his uncle and Lok Sabha MP Pashupati Kumar Paras, in which he had mentioned a complaint of alleged sexual assualt by a woman party worker against cousin Prince Raj. 

    “A few days ago, a woman associated with the party was blackmailing Prince by accusing him of sexually assualting her. Being the elder of the family, I consulted you on this matter but you ignored it. Later, I asked Prince to go to police, so the truth and lies can come out and whoever is guilty shall be punished,” said Chirag in the letter. 

    On the same day, Chirag was removed from the post of LJP president by a group led by his uncle. Chirag, son of LJP fouder Ramvilas Paswan, has also been removed as the leader in the Lok Sabha.

  • Police plea for further custodial interrogation of Sushil Kumar rejected, sent to judicial custody

    NEW DELHI:  A court on Wednesday rejected a Delhi Police plea for three more days of custodial interrogation of wrestler Sushil Kumar in connection with the alleged murder of a young wrestler at Chhatrasal Stadium, and sent him to nine-day judicial custody. The Olympic medallist faces charges of murder, culpable homicide and kidnapping.

    Metropolitan Magistrate Rashmi Gupta said, “As per the settled law, PC [police custody] remand should not be granted in a mechanical manner. It should be granted only when the situation warrants and it is justified.” Sushil was arrested on May 23. The court had initially remanded him to six days of police custody, which was later extended by four more days on May 29. He was produced in the court after the expiry of his extended custody.

    Sushil Kumar and his associates allegedly assaulted Sagar Dhankar and two of his friends Sonu Mahal and Amit Kumar at the stadium on the intervening night of May 4 and 5 over a property dispute. The 23-year-old Dhankar succumbed to the injuries later.

    Police has called Sushil the “main culprit and mastermind” of the alleged murder and said there is electronic evidence wherein he and his associates could be seen beating Dhankar with sticks.Additional Public Prosecutor Atul Shrivastava, representing the police, told the court that Sushil is not cooperating and that his custody is required to recover his mobile phone and the weapon of offence.

    He called it a “cold-blooded murder” as he referred to the purported video of the brawl. Advocate Pradeep Rana, representing Sushil Kumar, said that his client’s further custodial interrogation is not required as he is merely a victim of circumstances and not a dreaded criminal. 

    Co-Accused also in Judicial custodyAjay Kumar Sehrawat, a co-accused in the murder case, was also sent to judicial custody for nine days. Ajay was arrested along with Sushil Kumar from Mundka area by Delhi Police.

  • ‘Contrived fear-mongering’: Delhi Police, Centre slam Twitter’s threat to expression salvo

    NEW DELHI: Gloves were off on Thursday as the spat between Twitter and the Union Ministry of Electronics and Information Technology (MeitY) turned ugly, with the former calling out the Centre’s new regulatory regime and the latter saying the platform has no locus in dictating India’s legal policy framework. Both claimed their goal was to protect the user’s privacy and the freedom of speech and expression. 

    With Twitter claiming it was being intimidated by the Delhi Police for flagging BJP leader Sambit Patra’s tweet on an alleged Congress toolkit as ‘manipulated media’, the latter piled on it, calling the statement mendacious and “designed to seek dubious sympathy and impede a lawful enquiry”.

    “Twitter Inc. has taken upon itself, in the garb of terms of service, to adjudicate the truth or otherwise of documents in public space. Twitter is purporting to be both an investigating authority as well as an adjudicating judicial authority. It has no legal sanction to be either. The only legal entity… to investigate is the police and to adjudicate is the courts,” said Delhi Police spokesperson Chenmoy Biswal.

    The ministry said the company is refusing to comply with those very regulations in the intermediary guidelines on the basis of which it is claiming a safe harbour from any criminal liability in India. The Centre said that Twitter’s statement is an attempt to dictate its terms to the world’s largest democracy.

    The ministry charged Twitter with being complacent in taking action against those who incited violence during the Red Fort violence, promoting vaccine hesitancy through its platform as well as showing Ladakh a part of China during the border disputes between two countries. It asked Twitter to stop beating around the bush and comply with the laws of land. “Twitter is just a social media platform and it has no locus in dictating what India’s legal policy framework should be,” the ministry said.

    Earlier in the day, Twitter said it is planning to advocate changes in the core elements of the recently-framed social intermediary guidelines. “To keep our service available, we will strive to comply with applicable law in India. But, just as we do around the world, we will continue to be strictly guided by principles of transparency, a commitment to empowering every voice on the service, and protecting freedom of expression and privacy under the rule of law,” the company said in a statement.Anatomy of the confrontation in three statements – the Delhi Police’s, Centre’s and Twitter’s

    Delhi Police’s Full Statement:

    We have come across press reports that quote Twitter Inc. statements pertaining to the ongoing inquiry by Delhi Police.

    Prima facie, these statements are not only mendacious but designed to impede a lawful inquiry by a private enterprise. Twitter Inc. has taken upon itself, in the garb of terms of service, to adjudicate the truth or otherwise of documents in public space. 

    Twitter Inc. is purporting to be both an investigating authority as well as an adjudicating judicial authority. It has no legal sanction to be either. The only legal entity, so empowered by the duly laid down law, to investigate is the Police and to adjudicate is the Courts.

    However, since Twitter Inc. claims to have material information basis which it not only ‘investigated’ but arrived at a ‘conclusion’, it must share that information with the Police. There should not be any confusion about this logical course.  

    The entire conduct by Twitter Inc, including its Indian entity, in the last few days has been obfuscatory, diversionary and tendentious. There is one simple thing to do which Twitter refuses to do. That is, cooperate with the law enforcement and reveal to the legal authority the information it has.

    Twitter, being a public platform, must lead by example in demonstrating transparency in its functioning which has a bearing on public discourse and should proactively bring clarity into what are subject matters of public domain. 

    Since the matter has been put in public domain, it is important to set the record straight on the tendentious statements made.

    First, Delhi police has registered a preliminary inquiry at the instance of a complaint filed by the representative of the Indian National Congress. Hence, the efforts by Twitter Inc. that portray that this as an FIR filed at the behest of the Government of India is wholly and completely incorrect. 

    Second, Delhi Police is conducting a preliminary inquiry on the same and the matter is under investigation. Twitter Inc., while placing the cart before the horse, went ahead and declared that the toolkit was ‘Manipulated Media’. This clearly demonstrates that Twitter Inc. was acquainted with the facts of the case and it had material information which was germane to the inquiry by a duly recognized law enforcement agency. Therefore, Twitter was asked, by way of multiple communications, to join the inquiry to provide the information it possesses.Third, the purpose of Twitter being served a notice to participate in the inquiry was to allow the investigation to process to proceed and bring all relevant matters on record. Twitter India’s subsidiary, TCIPL’s Managing Director, chose to adopt a path of evasiveness instead of cooperation. 

    Initially, TCIPL’s Managing Director stated in his response that he was merely a sales head, had no role whatsoever in any operations relating to content and thereby refused to join the inquiry. It is to be noted that TCIPL’s stance that it’s Managing Director is a mere sales head runs contrary to his very own previous press interviews wherein he elaborately discussed Twitter’s plan to devise methods to identify abusive/ manipulative content. The above interview makes it clear, that Twitter India’s convoluted stance is similar to a deer caught in the headlights. 

    Fourth and last, the contrived fear-mongering by Twitter Inc. unfounded and misplaced. The Managing Director of TCIPL was merely served a notice, not as an accused but to participate in the inquiry as Twitter claims to have been acquainted with certain facts. 

    Twitter’s Inc’s latest statements are devised to seek dubious sympathy when they themselves not only refuse to comply with the law of the land but also claim to be possession of material evidence but refuse to share it with legal authority duly recognized.

    Government of India’s statement:

    The Government strongly controverts the claims made by Twitter today in its press release. India has a glorious tradition of free speech and democratic practices dating back centuries. Protecting free speech in India is not the prerogative of only a private, for-profit, foreign entity like Twitter, but it is the commitment of the world’s largest democracy and its robust institutions.

    Twitter’s statement is an attempt to dictate its terms to the world’s largest democracy. Through its actions and deliberate defiance, Twitter seeks to undermine India’s legal system. Furthermore, Twitter refuses to comply with those very regulations in the Intermediary Guidelines on the basis of which it is claiming a safe harbour protection from any criminal liability in India.

    The larger question is if Twitter is so committed then why it did not set up such a mechanism in India on its own? Twitter representatives in India routinely claim that they have no authority and that they and the people of India need to escalate everything to the Twitter Headquarter in USA. The purported commitment of Twitter, to its Indian user base, thus not only sounds hollow but completely self-serving.

    Twitter has a large user base in India, it earns significant revenue from its Indian operations but is also the most reluctant to appoint an India-based grievance redressal officer and mechanism, chief compliance officer and nodal officer to whom its own users can complain when they are subjected to offensive Tweets.

    The Rules empower the ordinary users who become victims of defamation, morphed images, sexual abuse and the whole range of other abusive content in blatant violation of law, to seek redress.

    These Rules were finalized after widest possible consultations including with representatives of social media platforms. Ministry of Electronics and IT put the draft Rules in public domain and invited public comments. The Ministry received large number of comments from individuals, civil society, industry associations and organizations. A significant number of counter comments to these comments were also received. There are also various judicial orders by various courts including the Supreme Court of India directing the Government to take appropriate steps. There are also several Parliamentary debates and recommendations to take appropriate measures.

    Freedom of Speech and Expression is a Fundamental Right under the Indian Constitution. The Government of India respects the right of people to ask questions and also criticize on these social media platforms including on Twitter. The Government equally respects the right of privacy. However, the only instance  of scuttling free speech on Twitter is Twitter itself and its opaque policies, as a result of which people’s accounts are suspended and tweets deleted arbitrarily without recourse.

    Twitter needs to stop beating around the bush and comply with the laws of the land. Law making and policy formulations is the sole prerogative of the sovereign and Twitter is just a social media platform and it has no locus in dictating what should India’s legal policy framework should be.

    Twitter has claimed that it is committed to the people of India. Ironically, this commitment of Twitter has been most invisible in recent times. It is pertinent to share some recent examples:

    Twitter chose to show the geo-location of certain locations in Union Territory of Ladakh as part of People’s Republic of China at a time when India and China were engaged in peaceful resolution of border-related issues through bilateral dialogue. Twitter took several days, that too only after repeated reminders, to rectify this blatant disrespect to India’s sensitivity and territorial integrity.

    Twitter chose to take suo-moto action against those users who it considered as perpetrators of violence at the Capitol Hill in the USA. But, just a few days after the unlawful incidents on Red Fort in Delhi, Twitter refused to take prompt action on the lawful request made by the Government of India to block contents that sought to incite violence on the pretext of a fake genocide plan. Later, it chose to comply, that too partially, .when the damage had been done.

    Twitter’s lack of responsibility has led to rampant proliferation of fake and harmful content against India and Indians. Promoting vaccine hesitancy has been rampantly done through the use of Twitter platform and yet Twitter has taken no action. Is this commitment to the people of India?

    Discriminatory behavior has been practiced against Indians and people of Indian origin because of malicious tagging of B.1.617 mutant as ‘Indian variant’ name despite strict WHO guidelines against it. Again, Twitter has taken no action against such fake narratives and Tweets while grandiosely claiming to serve the people of India.

    Twitter Inc., a USA-based private company, in its communique says that it seeks “constructive dialogue”, “collaborative approach” from the government of a sovereign democratic republic to “safeguard interests of the public”. It is time that Twitter disabuses itself of this grandiosity and comply with the laws of India. 

    The Government also wishes to emphatically assure that representatives of social media companies including Twitter are and will always remain safe in India and there is no threat to their personal safety and security.

    Government condemns the unfortunate statement issued by Twitter as totally baseless, false and an attempt to defame India to hide their own follies.

    The Delhi Police has also issued a detailed press release, pertaining to an ongoing investigation, which answer the completely baseless allegations raised by Twitter.

    Twitter’s statement:

    “Twitter is deeply committed to the people of India. Our service has proven vital for public conversation and a source of support for people during the pandemic. Right now, we are concerned by recent events regarding our employees in India and the potential threat to freedom of expression for the people we serve.

    “We, alongside many in civil society in India and around the world, have concerns with regards to the use of intimidation tactics by the police in response to enforcement of our global Terms of Service, as well as with core elements of the new IT Rules. We plan to advocate for changes to elements of these regulations that inhibit free, open public conversation. We will continue our constructive dialogue with the Indian Government and believe it is critical to adopt a collaborative approach. It is the collective responsibility of elected officials, industry, and civil society to safeguard the interests of the public.”

    NEW DELHI: The government on Thursday slammed as “baseless and false” a statement by Twitter that had alleged intimidation by police over the ‘manipulated media’ tags issue and threat to freedom of expression, with IT Ministry terming the company’s stance as an attempt to dictate terms to the world’s largest democracy.

    The ministry asserted that representatives of social media companies, including Twitter, “are and will always remain safe in India”, and that there is “no threat to their personal safety and security”.

    In a hard-hitting statement, the ministry said India has a glorious tradition of free speech and democratic practices dating back centuries.

    “Protecting free speech in India is not the prerogative of only a private, for-profit, foreign entity like Twitter, but it is the commitment of the world’s largest democracy and its robust institutions,” it said.

    Twitter’s statement is an attempt to “dictate its terms” to the world’s largest democracy, the ministry said, adding that through its actions and deliberate defiance, the company is seeking to undermine India’s legal system.

    Twitter refuses to comply with the very regulations in the Intermediary Guidelines on the basis of which it is claiming a safe harbour protection from any criminal liability in India, the ministry contended.

    It questioned Twitter on why it did not set up a robust mechanism of its own in India, and said the company’s officials in India routinely claimed that they have no authority and that “they and the people of India need to escalate everything to Twitter headquarter in USA”.

    The purported commitment of Twitter to its Indian user base thus not only sounds hollow but completely self serving, the ministry said.

    “The only instance of scuttling free speech on Twitter is Twitter itself and its opaque policies, as a result of which people’s accounts are suspended and tweets deleted arbitrarily without recourse,” the ministry pointed out.

    It asked Twitter to “stop beating around the bush” and comply with laws of the land.

    “Law making and policy formulations is the sole prerogative of the sovereign and Twitter is just a social media platform and it has no locus in dictating what India’s legal policy framework should be,” the ministry said.

    The government said although Twitter claimed that it is committed to people of India, that commitment has been “most invisible in recent times”.

    Flagging some instances, it said Twitter chose to show the geo-locations of certain locations in Union Territory of Ladakh as part of China, and took several days to rectify “this blatant disrespect to India’s sensitivity and territorial integrity”.

    The ministry also called out Twitter for delay in taking action on its order to block provocative content that could impact public law and order, even though the company had been quick to act on similar instance during violence at US Capitol Hill.

    The ministry said that Twitter’s “lack of responsibility” had led to rampant proliferation of fake and harmful content against India and Indians.

    It is time that Twitter disabuses itself of this grandiosity and comply with laws of India,” it said.

    Earlier on Thursday, Twitter had called the recent visit by Delhi Police to its offices a form of “intimidation” and said it was concerned about its employees and the potential threat to freedom of expression.

    Twitter had marked tweets by ruling BJP leaders on the alleged strategy document of Opposition to target the government over COVID as containing ‘manipulated media’, which prompted the police to visit its offices late on Monday.

    Opposition Congress has disputed the document, calling it fake.

    In its first official statement after the Delhi Police visited the company’s offices in Delhi and in Gurugram to serve notice to its country managing director as part of its investigation into the ‘manipulated media’ tag, Twitter said it will continue to be strictly guided by principles of transparency and protecting freedom of expression.

    “Right now, we are concerned by recent events regarding our employees in India and the potential threat to freedom of expression for the people we serve,” Twitter said in the statement.

    “We, alongside many in civil society in India and around the world, have concerns with regards to the use of intimidation tactics by the police in response to enforcement of our global Terms of Service, as well as with core elements of the new IT rules,” Twitter had said.

  • Railway orders suspension of wrestler Sushil Kumar after his arrest in murder case

    NEW DELHI: The Northern Railway issued an order on Tuesday suspending wrestler Sushil Kumar following his arrest by the Delhi Police in a murder case.

    Olympic medallist Kumar was arrested, along with his associate and co-accused Ajay, from outer Delhi’s Mundka area on May 23 for his alleged involvement in the death of a 23-year-old wrestler at Chhatrasal Stadium.

    A senior commercial manager with the Northern Railway, Kumar had been on deputation with the Delhi government since 2015 and was posted as an Officer on Special Duty (OSD) at Chhatrasal Stadium for development of sports at school level.

    His deputation was extended in 2020 and Kumar had applied for an extension for 2021 as well which had been rejected by the Delhi government and he was sent back to his parent cadre — Northern Railway — officials said.

    “A case against Sushil Kumar, (Adhoc)JAG/ IRTS, on premature repatriation to Northern Railway from NDMC, in respect of a criminal offence is under investigation. He was detained in police custody on 23rd May, 2021 for a period exceeding forty-eight hours.

    “Now, therefore Sushil Kumar JAG/ (Adhoc) IRTS is deemed to have been suspended with effect from the date of detention i.e. 23rd May, 2021 in terms of Rule 5 (2) of (D&A) Rules, 1968 and shall remain under suspension until further orders,” Northern Railway spokesperson Deepak Kumar said.

    Senior officials have said that if a government servant is found involved in grievous crimes, he or she is usually suspended till the case is underway.

  • Toolkit row: Two Congress leaders get notices; party seeks ‘manipulated media’ tag on tweets of 11 ministers

    NEW DELHI: The Delhi Police has served notices to two Congress leaders in the ‘Covid toolkit’ case, asking them to join the probe into a complaint in the matter, officials said on Tuesday.

    A senior police officer confirmed that the notices were served to Congress social media head Rohan Gupta and party spokesperson MV Rajeev Gowda in connection with the probe.

    “These are not fresh notices. These notices were served around 8-9 days ago based on a complaint received from the Congress. They were asked to join the probe so that it could help us in carrying the investigation forward,” the officer said.

    A priliminary enquiry into the complaint is still being carried out by the Delhi Police’s Special Cell team and no FIR has been registered in the matter yet, officials said.

    On Monday, the Delhi Police’s Special Cell sent a notice to Twitter India in connection with the probe into a complaint about the alleged ”COVID toolkit”, asking it to share information based on which it had classified a related tweet by BJP spokesperson Sambit Patra as “manipulated media”, officials had said.

    The police teams also descended on the microblogging site’s offices in Lado Sarai in Delhi and in Gurgaon Monday evening.

    “The Delhi police team went to the Twitter office to serve a notice to Twitter as a part of routine process. This was necessitated as we wanted to ascertain who is the right person to serve a notice, as replies by Twitter India MD have been very ambiguous,” Delhi Police PRO Chinmoy Biswal had said The BJP has accused the Congress of creating a ”toolkit” on how to tarnish the image of the country and Prime Minister Narendra Modi over the handling of the COVID-19 pandemic.

    However, the Congress has denied the allegation and claimed that the BJP is propagating a fake ”toolkit” to defame it.

    Last week, Twitter labelled as “manipulated media” a tweet by Patra on the alleged ”toolkit”.

    Twitter says it “may label Tweets that include media (videos, audio, and images) that have been deceptively altered or fabricated”.

    Biswal said the Delhi Police is inquiring into a complaint in the toolkit matter.

    “It appears that Twitter has some information which is not known to us and on the basis of which they have classified it (Patra’s tweet) as such. This information is relevant to the inquiry. The Special Cell, which is conducting the inquiry, wants to find out the truth. Twitter, which has claimed to know the underlying truth, should clarify,” he said.

    The government had earlier asked Twitter to remove the ”manipulated media” tag as the matter is pending before law enforcement agency, and made it clear that the social media platform cannot pass judgment when the issue is under investigation.

    BJP leaders, including Patra, have posted numerous tweets to attack the Congress over the purported ”toolkit”.

    Meanwhile, Congress on Tuesday demanded that Twitter affix manipulated media tag to tweets of several union ministers for allegedly spreading false and malicious propaganda against the party.

    Congress general secretary and chief spokesperson Randeep Surjewala wrote to Twitter’s Lead for Legal, Policy and Trust and Safety Vijaya Gadde and its Deputy General Counsel and Vice President (Legal) Jim Baker, seeking stern action against 11 union ministers for allegedly spreading false and forged documents.

    Surjewala has alleged that the “forged, fabricated material” and the claims made under the #CongressToolkitExposed by various ministers are identical to the material that has already been marked as ‘manipulated media’ by Twitter.

    He alleged that the subject matter of the forged Toolkit document was created by certain BJP leaders to gain undue and wrongful political advantage by spreading potentially dangerous, false and fabricated material through their Twitter handles against the Indian National Congress and its leaders.

    The union ministers against whom the Congress has sought action are Giriaj Singh, Piyush Goyal, Smriti Irani, Ravi Shankar Prasad, Prahlad Joshi, Dharmendra Pradhan, Ramesh Pokhriyal Nishank, Thawarchand Gehlot, Harsh Vardhan, Mukhtar Abbas Naqvi and Gajendra Singh Shekhawat.

    Surjewala said, “It is a matter of fact that people tend to believe ‘true’ and take on face value, any information that is put up directly by a Union Minister of the Government of India through his/ her official/ verified Twitter account.”

    “Hence, it becomes all the more imperative to tag, ‘manipulative media’ (sic), on all such tweets made by Ministers of the Government of India on the above referred forged toolkit document created by the BJP,” he said in his complaint.

    “It is reasonable to expect that the aforementioned individuals will be dealt with the same yardstick as applied in other cases where the Twitter platform is misused to broadcast forged and fabricated material,” he also said.

    This comes a day after Delhi Police’s Special Cell sent a notice to Twitter India in connection with the probe into a complaint about the alleged ‘COVID toolkit’, asking it to share information based on which it had classified a related tweet by BJP spokesperson Sambit Patra as “manipulated media”, with two police teams descending on the microblogging site’s offices in Lado Sarai in Delhi and in Gurgaon on Monday evening.

    Earlier, Twitter tagged tweets of BJP leaders Sambit Patra and Gajendra Singh Shekhawat as “manipulative media”.

    The Congress has accused BJP leaders, including union ministers, of misusing the Twitter platform to disseminate forged and fabricated material.

    The Congress had earlier complained to Delhi police to register an FIR against BJP leaders for allegedly spreading “false” information about the Congress toolkit.

    The NSUI has already registered an FIR against Raman Singh and Sambit Patra in Raipur, Chhattisgarh, where the Congress is in power.

    NEW DELHI: After two police teams descended on Twitter’s offices in Delhi and Gurgaon, the Congress on Monday alleged that the “cowardly raid” on the microblogging site’s offices by the Delhi Police “exposes lameduck attempts” to hide a “fraudulent toolkit” by BJP leaders.

    The Delhi Police’s Special Cell on Monday sent a notice to Twitter India in connection with the probe into a complaint about an alleged ‘COVID toolkit’, asking it to share information based on which it had classified a related tweet by BJP spokesperson Sambit Patra as “manipulated media”, officials said.

    Two police teams also descended on the microblogging site’s offices in Lado Sarai in Delhi and in Gurgaon this evening.

    Reacting to the development, Congress’ chief spokesperson Randeep Surjewala said on Twitter, “Cowardly raid on @Twitter unleashed by Delhi Police exposes lameduck attempts to hide the fraudulent toolkit by BJP leaders.”

    Such attempts to “murder” freedom of speech lay bare the BJP’s guilt, he said and tagged his video statement on the issue.

    In the video statement, Surjewala alleged that the “subjugation of free speech, the attempts to stifle every voice that is a dissenting voice against this government and the state-sponsored fraudulent means to propagate and to instill fear continue unabated in Modi government”.

    He alleged that the BJP forged documents to produce a “fake toolkit”.

    The Congress leader claimed that after the toolkit was “exposed”, the BJP and the Modi government, being scared of it, was “raiding” Twitter offices both in Delhi and in Gurgaon.

    “Why, the guilty people are sitting in BJP headquarters and in seat of power, but, you are raiding Twitter’s office in Delhi and Gurgaon, what is the reason there of?” he said.

    Surjewala alleged that the BJP is “running scared of its lies” and getting caught and being branded as manipulated and fraudulent by social media platforms.

    The BJP had accused the Congress of creating a ‘toolkit’ that seeks to tarnish the image of the country and Prime Minister Narendra Modi over the handling of the COVID pandemic.

    However, the Congress denied the allegation and claimed that the BJP is propagating a fake ‘toolkit’ to defame it.

    Last week, Twitter labelled as “manipulated media” a tweet by Patra on the alleged ‘toolkit’.

    Twitter says it “may label Tweets that include media (videos, audio, and images) that have been deceptively altered or fabricated”.

    In his statement, Surjewala said the intermediary rules, which give the power to the government to direct people to take off various posts, have not even come into play.

    “They come into play only on 25th May, 2021 then why the action today? Under what provision of law notices are being issued?” he said.

    Surjewala asked that when BJP leaders are being accused of fraud then why is the government standing in shelter thereof.

    “None less than the IT Minister himself and half a dozen other ministers have also tweeted this manipulated and fraudulent media.

    Now they are scared that their lies are going to get exposed and the oath of the constitution that they took will stand annihilated and violated and that’s why social media platforms are being targeted,” he alleged.

    “Please remember Mr.Prime Minister that free speech and rights to express opinion is our fundamental right in this country,” Surejwala said.

    “You can’t subjugate the constitution, you can’t stifle free speech and you will not be able to suppress the voice of the young or voice of people of this country,” he said.

    The government had earlier asked Twitter to remove the ‘manipulated media’ tag as the matter is pending before a law enforcement agency, and made it clear that the social media platform cannot pass judgment when the issue is under investigation.

    BJP leaders, including Patra, have posted numerous tweets to attack the Congress over the purported ‘toolkit’.

    On May 19, the Congress lodged a police complaint seeking registration of cases against BJP chief J P Nadda, Union minister Smriti Irani, BJP general secretary B L Santosh and Patra over the alleged forgery of documents.

    The Chhattisgarh unit of the Congress’ students wing NSUI also lodged a complaint against Patra and former chief minister Raman Singh for allegedly “forging” the letterhead of the AICC Research Department and printing “false and fabricated” content on it.

    On the basis of the complaint, a case has been filed against Patra and Singh at the Civil Lines police station in Raipur.

  • Court extends period of investigation against alleged Al-Qaeda member in terror case

    NEW DELHI: A Delhi court has granted two more months to complete the investigation against an alleged member of terrorist outfit Al-Qaeda, arrested in connection for providing logistic and financial assistances to other members of the organisation in India and abroad.

    Special Judge Dharmender Rana allowed an application moved by Delhi police, which had sought more time to complete the probe against Sabeel Ahmed.

    The accused, a member of banned terrorist outfit Al-Qaeda in the Indian Sub-Continent (AQIS), was arrested on February 22 by the special cell of Delhi Police, for providing assistance to other members to carry out terrorist activities.

    The police had moved the application since the investigation related to the accused was still continuing and the period to file charge sheet against him was going to expire on May 22, 2021, i.e. three months from the arrest.

    If the charge sheet was not filed within three months from the arrest, or the court had not granted more time to the probe agency to complete the investigation, the accused would have been entitled to get statutory bail in the case.

    The judge observed that the prosecution had set out a case for the extension of the statutory time period to conclude the investigation. “As a cumulative effect of the aforesaid discussion, I have no hesitation in observing that the prosecution has set out a case for extension of the statutory time period to conclude investigation and the application at hand deserves to be allowed,” the judge said in an order passed on May 13.

    “However, the IO (investigating officer) is not divested of his obligation of concluding investigations expeditiously. Therefore, he is permitted to conclude the pending investigation qua accused Sabeel Ahmed till July 22, 2021,” he added.

    In its application seeking extension of the period to complete the probe by August 18, the police said the investigation could not be concluded despite efforts due to present pandemic situation. The application was opposed by advocates MS Khan and Qausar Khan, appearing for the accused, who said that the probe agency had already got enough time to complete the investigation.

    Ahmed is also an accused in suicidal terror attack at Glasgow Airport (United Kingdom) on June 30, 2007. He was deported from Saudi Arabia on August 20, 2020 and was taken into custody by NIA in another terror case lodged in Bengaluru.

    His custody was later taken by the special cell of Delhi Police in the present matter on February 22, this year.
