Making profit is not a public nuisance: Delhi High Court in Coronil case

NEW DELHI: While hearing a petition seeking action against Yoga Guru Ramdev for wrongfully promoting Coronil as a cure for COVID-19 during second wave, the high court on Monday stated that making profit is neither a public nuisance nor a wrongful act.
“Let’s not go into commercial gain. Everyone works for profit. You have to make a case of public nuisance or wrongful act. Making profit is not a public nuisance nor a wrongful act,” said Justice C Harishankar.
Slamming Yoga Guru Baba Ramdev for promoting Coronil as a cure for COVID-19, a bunch of doctors association argued through their counsel said that Ramdev made irresponsible statements by saying that allopathy is killing people and he has a cure for it in Coronil. Representing the doctors, senior advocate Akhil Sibal said that Ramdev marketed a drug for commercial use having a two-fold objective.
“The idea is nobody says don’t indulge in commerce. This is not merely a case of somebody exercising a bona fide opinion about something. This is somebody exercising a bona fide opinion about something. This is somebody who is marketing a drug for commercial use having a twofold objective. He says I have cured 90 percent of people, allopathy might have cured 10 percent so you come to me,” said Sibal.
The petition was filed by three Resident Doctors’ Association of the All India Institute of Medical Sciences at Rishikesh, Patna and Bhubaneshwar; Association of Resident Doctors, Post Graduate Institute of Medical Education & Research, Chandigarh; Union of Resident Doctors of Punjab (URDP); Resident Doctors’ Association, Lala Lajpat Rai Memorial Medical College, Meerut, and Telangana Junior Doctors’ Association, Hyderabad, and had moved the high court earlier this year.

‘Doctors are god’s envoy’: Baba Ramdev backs allopathy for emergency treatment

DEHRADUN: Baba Ramdev on Thursday said allopathy is best for emergency treatment while ayurveda and Yoga saying are effective in ‘lifestyle’, ‘genetic’ and ‘incurable’ diseases. “For emergency treatment and surgery, allopathy is the best there are no two opinions about this,” said the Yoga Guru.He supported ayurveda and Yoga saying that these two are effective in ‘lifestyle’, ‘genetic’ and ‘incurable’ diseases and health problems. “Ayurveda and Yoga are effective in treating lifestyle’, ‘genetic’ and ‘incurable’ diseases. It is a known fact since centuries without any doubt,” added Ramdev.
The Yoga Guru was replying to the queries related to the scuffle between him and the Indian Medical Association after his comments calling allopathy a ‘Stupid Science’. The Yoga Guru also praised the doctors.
“Doctors are devdoots. They are a boon to humankind on this earth by God. We can’t be enemies with any group. If someone does a mischief it’s that individual’s fault not of any ‘pathy’,” said the Yoga Guru while interacting with scribes in Haridwar.
Targeting high cost of patent drugs, he said, “Prime Minister Medicine Centers were opened to address this problem of unaffordable cost of patent medicines which costs 10, 20, 50, 100 and even 200 times in some cases. All we want is that no one should be forced to buy medicines at inflated costs.”
He also advised people to be aware of excessive medication and surgical procedures though did not elaborate on it.
On June 4, 2021, after learning that Baba Ramdev has suggested the Uttarakhand government to include Patanjali Yogpeeth’s ‘Coronil’ in COVID kit, Uttarakhand chapter of Indian Medical Association wrote a letter to Chief Secretary to take action in the matter.
The letter said that addition of Coronil with Allopathic drugs shall also amount to ”mixopathy”- a cocktail of Allopathy and Ayurved which is not permitted as per rulings of the apex court. It asserted that apart from the apex court several High Courts of various states have also ruled that mixopathy is not allowed.
The letter dated June 4, 2021 by the IMA said, “Sir, I would be highly obliged if you kindly take prompt action and direct the Secretary Health, Govt. of Uttarakhand accordingly. This is for your information, necessary action and appraisal of the Honourable Chief Minister.”
The COVID kit is provided by the state health department to the people who are diagnosed with mild symptoms or have no symptoms at all. The kit includes a thermometer, paracetamol, Vitamin D, Zinc and ivermectin tablet and an anti-parasitic drug.
The letter mentioning that tablet Coronil is ‘NOT approved by WHO, DGCI and even Ayush Vibhag’ and furthermore has no place in the central guidelines for Corona of Union Ministry of Home Affairs (MHA) stated, “Coronil is however recognized as a food supplement by Ayush Vibhag of central government and it is not a drug or medicine as claimed by Baba Ramdev on national TV on hourly basis advertisements,” it said.
“Hence, addition of Coronil shall be contempt of court. I am sending you the various decisions and rulings of Hon’ble Supreme Court and High courts on your whatsapp for your kind perusal,” the letter said. The IMA letter further added that Section 34 of National Medical Commission also does not allow the practice of mixing allopath and ayurvedic prescriptions.

‘Coronil a supporting measure, not cure’: Uttarakhand health department

DEHRADUN: In the wake of the controversy over Coronil tablet made by yoga guru Ramdev’s Patanjali group, Uttarakhand health department has said the drug can only be used as a supplementary measure and not for treatment of Covid-19 patients.YS Rawat, joint director, state licensing authority (AYUSH), said, “The drug by Patanjali is allowed for use as a supporting measure, like Vitamin C or multivitamin and mineral tablets, not as the cure for Covid-19.”
Union AYUSH ministry had written to the state licensing authority on January 14 saying it might consider Patanjali’s application for using Coronil tablets as a supporting measure in the management of Covid-19 without claiming cure.
A controversy erupted over Coronil being touted as ‘Covid cure’ after Ramdev re-launched the drug last week, with the IMA seeking explanation from the Union health minister.

Sale of Coronil won’t be allowed in Maharashtra without certification: Anil Deshmukh

MUMBAI: The sale of Coronil tablets of Patanjali will not be allowed in Maharashtra without “proper certification”, state Home Minister Anil Deshmukh said on Tuesday.The statement came a day after the Indian Medical Association (IMA) expressed shock over the “blatant lie of WHO certification” for Coronil tablets which Patanjali claims is an evidence-based medicine to fight COVID-19.
While the IMA also demanded an explanation from Union Health Minister Harsh Vardhan in whose presence the medicine was launched, the World Health Organization clarified that it had not reviewed or certified the effectiveness of any traditional medicine for the treatment of COVID-19.
Without naming anyone, Deshmukh said on Twitter that it was “highly deplorable” that two senior Union ministers endorsed the drug.

“The #IMA has questioned the said `clinical trials’ of #Coronil & WHO refuted the false claims made by #Patanjali Ayurveda for giving any certificate regarding its effectiveness for #Covid19 treatment,” Deshmukh said.
“Selling of #Coronil without proper certification from competent health organizations like #WHO, #IMA and others will not be allowed in Maharashtra,” the minister said.
Yoga guru Ramdev’s Patanjali Ayurved had on February 19 said the Coronil tablet had received certification from the Ayush Ministry as a medicine supporting COVID-19 treatment as per the WHO’s certification scheme.
However, Patanjali’s managing director Acharya Balkrishna later said “We want to clarify to avoid confusion that our WHO GMP compliant COPP certificate to Coronil is issued by DCGI, Government of India” and “WHO do not approve or disapprove any drugs”.

NEW DELHI: The IMA on Monday expressed shock over the “blatant lie of WHO certification” for Patanjali’s Coronil tablet, which the company claims is an evidence-based medicine to fight COVID-19, and demanded an explanation from Union Health Minister Harsh Vardhan in whose presence the medicine was launched.This comes in the wake of global health body, WHO, clarifying that it has not reviewed or certified the effectiveness of any traditional medicine for the treatment of COVID-19.

In a statement issued on Monday, the Indian Medical Association (IMA) asked, “Being Health Minister of the country, how justified is it (for you) to release such falsely fabricated unscientific product to people of the whole country. Can you clarify the time frame, timeline for the so-called clinical trial of this said anti-corona product?”
“The country needs an explanation from the minister. The Indian Medical Association will also write to National Medical Commission for seeking suo moto explanation for his blatant disrespect to the code of conduct of Medical Council of India,” the IMA said.
“Indian Medical Association is shocked to note the blatant lie of WHO certification.,” it said.
Haridwar-based Patanjali Ayurved had also released what it claimed was research work supporting Coronil’s efficacy in COVID-19 treatment.
The announcement regarding the Ayush certification for Coronil and release of a research paper calling it the “first evidence-based medicine for COVID-19 by Patanjali” was done at an event attended by Vardhan.
In a statement, Patanjali had said: “Coronil has received the Certificate of Pharmaceutical Product (CoPP) from the Ayush section of Central Drugs Standard Control Organisation as per the WHO certification scheme.”
However, WHO South-East Asia in a tweet said: “@WHO has not reviewed or certified the effectiveness of any traditional medicine for the treatment #COVID19.”
Patanjali had introduced ayurveda-based Coronil on June 23 last year, when the pandemic was at its peak.
It had to face severe criticism as it lacked scientific evidence regarding its efficacy.

NEW DELHI: Yoga guru Ramdev on Friday released a research paper on the “first evidence-based medicine for Covid-19 by Patanjali” amid scepticism that the product claimed to be a cure for coronavirus may not have any scientific basis.Coronil, introduced in the Indian market last June during the peak of the pandemic, was relaunched on Friday in the presence of Health Minister Harsh Vardhan and Road Transport and Highways Minister Nitin Gadkari.
“Coronil has received the Certificate of Pharmaceutical Product (CoPP) from the Ayush section of Central Drugs Standard Control Organisation as per the WHO certification scheme,” said a statement by Patanjali.
Under CoPP, Coronil can now be exported to 158 countries.
The CDSCO or the Ayush ministry have not yet clarified the claims made by the company so far. Last June, Patanjali launched ‘Coronil and Swasari’, claiming that these were not immunity boosters but “sure shot Ayurvedic cure” for Covid-19. According to them, it had shown 100 per cent favourable results during trials on participants.
The launch of Coronil, however, had drawn flak. Many said the claim lacked scientific data.
The company has been claiming that the medicine which costs Rs 545 can cure Covid-19 in three to seven days, but experts point out that most mild and asymptomatic cases of Covid-19 recover on their own.
