  • Dhanbad hit-and-run case: CBI hasn’t submitted anything concrete in status report, notes SC

    NEW DELHI: The CBI  has not submitted anything concrete in its status report with the regard to the probe into the killing of a Jharkhand judge, the SC observed.The top court directed the CBI to submit weekly reports with the High Court.

    A bench headed by Chief Justice of India N V Ramana observed that even though arrests and seizure of vehicles was carried out, nothing with respect to intention or motive behind the crime has been indicated in the report.

    At this, Solicitor General replied that whatever development has taken place after the CBI took over has been given in the sealed cover. “Mr Mehta, that is not the issue that we want. We want something concrete. Your people have not indicated anything about the motive or reason,” the CJI said.

    In response, the Solicitor General said that the persons who were in the vehicle which knocked down Judge Uttam Anand are under custody, and he cannot reveal more as their interrogation is ongoing. 

  • Haryana paper leak: Seven more arrested, Congress demands HC-monitored CBI probe

    CHANDIGARH: Seven more people were arrested in connection with the paper leak during the Haryana Police constable recruitment examination held on August 7, while the Congress reiterated its demand for a high-court monitored CBI probe into the case.

    The total number of people apprehended in the case has gone up to 14, they said.

    Amid reports of a paper leak, the Haryana Staff Selection Commission (HSSC) on Saturday had cancelled the written examination for the recruitment of police constables.

    Saturday was the first day of the examination and candidates appeared in the paper across 35 centres in the state in two shifts.

    Papers were scheduled for Sunday also, but later these too were cancelled.

    Seven more people were arrested in connection with the paper leak case, a Haryana police statement said.

    The police arrested Sandeep (23), Gautam (25), both residents of Khapar in Jind and Naveen (27) of Pyoda, from Mata Gate Kaithal.

    The answer key of Haryana Police constable’s written examination was also recovered from their possession, according to the police.

    During the course of investigation, the police also arrested Ramesh (42), a resident of village Thua from Kaithal, and Rajesh (26) from Ambala, an official statement said.

    “It has also come to light that accused Ramesh runs a coaching centre in Kaithal,” the statement said.

    After interrogation, the sixth member of their gang, Narendra (31), a resident of Hisar, was also arrested from Sirsa.

    “The investigation revealed that the answer key was provided to Ramesh by Narendra on the night of August 6. It also came to light that the answer key was obtained by Narendra by making a deal of Rs 1 crore. Ramesh and his other associates had decided to give it to others for Rs 12-18 lakh,” the statement said.

    During the investigation, it was revealed that the gang members had provided the answer key to a few people through WhatsApp and they took advance cheques from some of them.

    The police said they are constantly raiding the locations to arrest other members.

    Attacking the BJP government in the state, senior Congress leader Randeep Singh Surjewala demanded a high-court monitored CBI probe into the paper leak case.

    Talking to reporters here, Surjewala said the Khattar government and the Staff Selection Commission spend Rs 25 crore every year on “secrecy of exam”.

    “So, where does this money go? The contract to conduct the paper has allegedly been given to a Hyderabad-based company. It is natural that a contract for conducting all the future examinations would also have been given to this company. Since, the said company as also the entire Staff Selection Commission is under the direct needle of suspicion, how can a fair investigation be conducted and who, if any, will be punished?” he asked.

    He alleged that “absurd, idiotic and baseless questions” were asked in Haryana Police recruitment exam, which have no relation with the duties and functions of job of a police constable.

    “In fact, by asking such questions, the Khattar government is executing a conspiracy to select a favoured few perhaps with advance knowledge of the nature of wholly irrelevant questions that would be asked. The way in which the question paper was set and then got leaked and sold is a cruel joke with the future of Haryana’s youth,” the Congress leader said.

  • Jharkhand HC Chief Justice to weekly monitor CBI probe into mowing down of judge at Dhanbad

    NEW DELHI: The Supreme Court Monday said the Jharkhand High Court Chief Justice will monitor weekly the progress made in the CBI probe into the alleged mowing down of a judge by a vehicle on July 28 in Dhanbad, and observed that the sealed cover report of the central agency did not contain much details.

    A bench of Chief Justice N V Ramana and justices Vineet Saran and Surya Kant asked the CBI to file its report weekly with the high court where the bench headed by the Chief Justice would monitor it.

    The top court had on July 30 taken suo motu cognizance of the “unfortunate” “sad demise” of the judge in “gruesome incident” and had sought a status report within a week from Jharkhand’s Chief Secretary and the DGP on probe.

    CCTV footage showed that District and Sessions Judge-8 of Dhanbad court, Uttam Anand, was jogging on one side of a fairly wide road at Randhir Verma Chowk early on July 28 when a heavy auto-rickshaw veered towards him, hit him from behind and fled the scene.

    Locals took him to a nearby hospital, where the doctors declared him dead.

  • Madhya Pradesh: Six arrested for looting Rs 2 lakh by posing as CBI officials

    CHHATARPUR: Six people who robbed Rs 2 lakh at gunpoint from a distillery in Chhatarpur in Madhya Pradesh by posing as CBI officials were held from Delhi, Bhopal and Uttar Pradesh, an official said on Sunday.

    The gang, on the morning of August 6, entered a distillery in Naugaon posing as Central Bureau of Investigation officials probing the Aligarh hooch tragedy that took place in neighbouring UP, he said.

    “They threatened the distillery owner Nikhil Bansal with action in connection with the tragedy but when he refused to oblige them, the accused took out a firearm and robbed Rs 2 lakh and also took away the CCTV recording hard disk.

    Police seized two SUVs without number plates, CBI uniforms, fake ID cards, the CCTV hard disk and recovered the looted Rs 2 lakh,” Chhatarpur Superintendent of Police Sachin Sharma told reporters.

    He said the six had told police they were inspired by the Hindi film ‘Special 26’, a heist saga about conmen carrying out raid-cum-robberies by posing as probe agency officials.

    He said Dharmendra Balmiki (45) from Bulandshahar and Devendra Pathak (39) from Mauranipur in UP, Devendra Julaha (44), Avinash Maurya (40) and Budhram Gurjar (44), all from Delhi, and Shivpal Singh Bhadoriya (42) from Bhopal were arrested.

  • CBI arrests five people for posting defamatory content against judges

    NEW DELHI: The CBI has arrested five people for allegedly posting defamatory content against judges of the Andhra Pradesh High Court and the Supreme Court on social media, officials said on Sunday.

    The role of a Lok Sabha member, Nandigam Suresh, and Amanchi Krishna Mohan, both of the YSR Congress, are under scanner in the case, and both have been examined by the agency in its effort to unearth a larger conspiracy, they said.

    “To investigate the larger conspiracy, the CBI has also examined certain persons, including an MP, ex-MLA and also continued investigation into the role of other persons who were not mentioned in the FIR,” CBI spokesperson R C Joshi said.

    The agency had on Saturday arrested two people — Pattapu Aadarsh and Lavanuru Samba Siva Reddy — from Andhra Pradesh.

    Earlier, the CBI had arrested Dhami Reddy Konda Reddy and Pamula Sudheer on July 28, while Lingareddy Rajasekhar Reddy, who was residing in Kuwait, was arrested on July 9 when he landed in India, the officials said.

    “The agency was monitoring his movements. The moment he landed in India, the officers took him into their custody”, an official said.

    The arrests were made by the CBI in the case in which it had booked 16 individuals for allegedly posting defamatory content against the judges.

    The Andhra Pradesh High Court had directed the agency to probe the case and submit a report to it in a sealed cover.

    “It was alleged that the accused, by intentionally targeting the judiciary, made derogatory posts on social media platforms against judges and judiciary, following some court verdicts delivered by the judges of the High Court of Andhra Pradesh,” Joshi said.

     

  • HC to hear on Monday CBI’s plea in INX Media corruption case involving Chidambaram, others

    NEW DELHI: The Delhi High Court is scheduled to hear on Monday the CBI’s plea in the INX Media corruption case involving Congress leader P Chidambaram and his son Karti.

    The CBI has challenged a trial court’s order directing the agency to allow inspection of documents kept in the ‘malkhana’ (room where case properties are kept) by the accused and their counsel.

    The plea is listed for hearing before Justice Mukta Gupta.

    The high court had on May 18 stayed trial proceedings in the case involving Chidambaram and his son Karti.

    It had also issued notice and sought responses of Chidambaram and others on the CBI’s plea.

    The CBI has sought to set aside the special judge’s March 5, 2021 order to the extent that it directed the CBI to allow inspection of documents kept in malkhana by the respondents/accused/ their counsel.

    Besides, the CBI has also sought setting aside the observations in the order which says that the agency is required to file or produce before the court all the documents collected by it during investigation.

    The trial court had also said that the accused are also entitled to copies of such documents or inspections thereof, irrespective of the fact whether they are being relied upon by the CBI or not.

    The CBI had registered its case on May 15, 2017, alleging irregularities in a Foreign Investment Promotion Board clearance granted to INX Media group for receiving overseas funds of Rs 305 crore in 2007 during Chidambaram’s tenure as finance minister.

    Thereafter, the ED had lodged the money laundering case.

    The CBI had said this case involved high level of corruption with wide ramifications on society and while the accused have a right to a fair trial, the collective interest of the society cannot be impinged.

    “A fair trial is not what the accused wants in the name of a fair trial but must soothe the ultimate justice. Although right of fair trial of the respondents/accused was not infringed, since all documents relied upon by petitioner-CBI were provided to the respondents/accused,” it has said.

    It has added that it is trite that the right to fair trial is not singularly absolute, as is perceived, from the perspective of the accused and it also takes within its ambit and sweep the rights of the society at large.

    The agency has contended that the very essence of trial is to unearth the truth for which the court cannot assist the accused in search of a plausible defence.

    “This is against all principles of fair trial and due process of law. It is the basic principle of criminal law that though it is the duty of the prosecution to prove its case, however, the accused is supposed to either give the true version before the court or remain silent.”

    “An accused cannot build a false and imaginary defence, after examining the documents. A false defence is a circumstance which incriminates the accused,” the CBI has said in its petition.

    It has alleged that the trial court’s order reflected intrusion into the investigative process of the CBI which is impermissible in law and the special judge lost sight of the fact that further investigation in the present matter is underway and if the accused persons are allowed to inspect documents available at the malkhana, the same would subvert the probe and there is every likelihood that they may tamper with evidence available.

    “Secrecy is a pre-requisite of investigation into any offence. Confidentiality and insulation of the investigating agency and its investigation from leaks and disclosures at every stage has to be ensured”, it has said.

    It has added that this would impinge the power of the CBI to enquire and investigate into the allegations of huge economic fraud and corruption at the highest level, having national and international ramifications.

    “One cannot lose sight that the respondents/accused are highly influential people having huge resources, which can be gathered from the very fact that during the course of arguments, the respondents/accused referred to and also filed along with their applications, extracts/pages of relevant rules of the CBI Crime Manual 2020, although it is a restricted document and is meant for internal circulation within the CBI,” it has said.

    Seeking to set aside the trial court’s order, the agency has said the legitimate aim would suffer irreparably if protection is not given to the documents and record which was permitted to be inspected by the accused.

    It has said out of 14 accused, only Karti had made the prayer to inspect malkhana documents, however, the trial court erroneously allowed all the accused to inspect it and exceeded the judicial powers by giving relief which was not prayed for.

    “Further, not all respondents/accused preferred applications under Section 207 CrPC, however, documents were directed to be supplied to all of them and also, inspection was also permitted to all,” it has said.

    The Chidambarams are already out on bail in the case.

    The court had earlier granted interim bail to other accused on a personal bond of Rs 2 lakh and one surety of the like amount.

    Chidambaram was taken into custody on August 21, 2019 when he was arrested by the Central Bureau of Investigation (CBI) in the INX Media corruption case.

    On October 16, 2019, the ED arrested him in the separate money-laundering case.

    Six days later, on October 22, 2019, the apex court had granted him bail in the case lodged by the CBI.

    On December 4, 2019, after 105 days of custody, Chidambaram was granted bail by the Supreme Court in the money laundering case lodged by the ED.

  • CBI team recreates accident scene of Dhanbad judge’s suspicious death

    DHANBAD: The Central Bureau of Investigation (CBI) team on Saturday recreated accident scene of the Dhanbad district and sessions judge Uttam Anand at the incident site at Randhir Verma Chowk here and did digital mapping of the occurence.

    The CBI officials on their third day of investigation along with the experts of Central Forensic Science Lab (CFSL) reached the spot and recreated accident scene with the autorickshaw which was used in the crime from different angles.

    The premier investigative agency is probing the incident since August 4 after taking over the case from Special Investigating Team (SIT ) of Jharkhand police, constituted by the state government on the instruction of the Jharkhand High Court.

    During about four hours stay at the accident site, the CBI team got driver and a person seated on the autorickshaw and rejuvenated the scene as how the vehicle may have knocked the judge on the left side of the road.

    The CFSL team had also brought speed scanner machines and recorded what may have been the speed of the auto at the time of incident and its speed during escape after committing crime.

    During the scene recreation on the spot, the CFSL team members also collected blood soaked clay of the spot where district and sessions judge-8 Uttam Anand had died after being knocked down by a heavy autorickshaw on July 28 in the early morning, when he was on morning walk.

    This was the second time when the accident scene was regenerated.

    Earlier SIT of the state government under Additional Director General (ADG) of police Sanjay Anand Lathkar had also recreated the scene in course of investigation.

    The CBI team got recreation of the crime scene with the auto used in the crime after taking both the accused of the case- Lakhan Verma (driver) and Rahul Verma- on five days remand from the court here Saturday.

    Though the CBI officials refused to share any information about the investigation with the media persons, a senior police official of the district who was assisting them said that recreation of the crime scene would help agency understand how the incident may have taken place.

    Earlier after taking over the case of the 49-year-old Dhanbad Judge death, the CBI team from Delhi had swung into action on Thursday to crack the issue that triggered nationwide outrage.

    The probe team of the premier investigative agency is headed by Additional Superintendent of police (ASP) Vijay Kumar Shukla.

    The CBI had on Wednesday taken over the investigation into the death of the judge who was allegedly mowed down by a heavy autorickshaw while he was on a morning jog.

    A 20-member team has been sent by the CBI to probe the matter.

    A senior police officer had said besides Dhanbad sadar police station, the CBI team in different groups visited varied places associated with the tragic incident and questioned people in connection with the incident.

    At sadar police station the CBI team took information from city superintendent of police R Ramkumar, additional superintendent of police Manoj Swargyari and police station officer in-charge Vinay Kumar.

    All these police officers were also members of SIT.

    The 20-member team under ASP Shukla had reached Dhanbad on Wednesday and took over the case from Dhanbad senior superintendent of police (SSP) cum SIT member Sanjiv Kumar.

    The team had started investigation after lodging an FIR in Dhanbad Sadar police station making auto driver Lakhan Verma and his accomplice Rahul Verma as accused under IPC Section 302.

    Both the accused were in jail after their five days police remand ended on Tuesday.

    Anand was killed by a heavy autorickshaw on July 28 at Randhir Verma Chowk close to district court while he was on morning walk at around 5.30 am.

    The CBI received the Jharkhand government’s request, routed through the Centre, to investigate the matter.

    Jharkhand Chief Minister Hemant Soren had on last Saturday decided to hand over the probe into the hit-and-run case of the Dhanbad judge to the Central Bureau of Investigation.

    CCTV footage showed that the judge was jogging on one side of a fairly wide road at Randhir Verma Chowk when a heavy auto-rickshaw veered towards him, hit him from behind and fled.

    Doctors at hospital declared him brought dead.

    The bench of Chief Justice Ravi Ranjan and Justice Sujit Narayan Prasad had directed the CBI to initiate a probe at the earliest.

    It had also directed the government to hand over all the documents of the case to the CBI.

    Taking cognizance of a letter filed before the court by the Dhanbad principal district judge in the case, Justice Ranjan had converted it into a writ petition and ordered formation of an SIT headed by Additional Director General of Police Sanjay Lathkar to look into the matter.

    The bench, dissatisfied with the progress report, had questioned why there was a delay in registering an FIR in the case.

    The incident occurred at 5.30 am, and the FIR was registered at 12.45 pm when it was clear from CCTV footage that the judge was picked up from the spot and taken to a hospital, the court had said.

    The Jharkhand High Court had Tuesday pulled up the police for the manner in which it was investigating the death by unnecessarily “feeding question” to doctor about possibility of head injuries by fall on a road surface when the post-mortem report clearly stated that the death was due to the head injuries.

    The court expressed its dismay over Special Investigating Team (SIT) ways of probing the matter while hearing a PIL on the issue the previous day.

    The court said it posed questions to the investigating officer regarding the probe in the presence of the Director-General of Police and head of the Special Investigating Team (SIT).

    The Supreme Court had on July 30 taken suo motu cognizance of the “sad demise” of the Dhanbad judge.

  • Maharashtra Congress questions CBI’s ‘silence’ over probe into death of Sushant Singh Rajput

    MUMBAI: The Maharashtra Congress on Thursday questioned the Central Bureau of Investigation’s “silence” over the death of actor Sushant Singh Rajput, a year after it took over the probe into the case.

    The party alleged that the national investigation agencies were being used by the Centre for its own “political agenda”.

    Rajput, 34, was found hanging from the ceiling of his apartment in Mumbai’s Bandra area on June 14, 2020, and the CBI took over the probe into the case in August last year.

    “It’s been a year today since CBI took over investigation of unfortunate death of Sushant Singh Rajput from Bihar police. Registration of FIR by Bihar police was against article 177 of CRPC. Supreme court also had expressed satisfaction in the overall investigation by Mumbai Police,” Maharashtra Congress spokesperson Sachin Sawant tweeted.

    He said it has been more than 300 days now since the AIIMS panel ruled out murder.

    “CBI is maintaining deliberate silence. This mockery of investigation by national investigation agencies is an apt example of how these agencies are being used by Modi government for their political agenda,” he alleged in a tweet.

    In another tweet, Sawant claimed that Gupteshwar Pandey (former Bihar DGP) was being used to further political agenda of the BJP, which was to “malign” the image of the Mumbai police and “destabilise” the Maha Vikas Aghadi (MVA) government in Maharashtra.

    “BJP stooped to the lowest possible level when they openly gave murder, rape angles and used Sushant’s death in Bihar elections as well,” the Congress leader alleged.

    There was a “coordinated attack” on the MVA government, claimed Sawant, whose party shares power with the Shiv Sena and NCP in Maharashtra.

    “Some pliable channels were asked to keep peddling murder theories. BJP leaders kept defaming Maharashtra. CBI and other agencies kept leaking fake info. Thousands of fake twitter, FB and YouTube accounts were created by BJP IT cell,” he further alleged.

  • CBI moves HC, seeks documents related to Anil Deshmukh probe from Maharashtra govt

    MUMBAI: The Central Bureau of Investigation (CBI) on Wednesday filed an application before the Bombay High Court, seeking a direction to the Maharashtra government to provide documents needed for the agency’s probe against former state home minister Anil Deshmukh.

    It had written a letter to the State Intelligence Department seeking details of a communication sent by senior IPS officer Rashmi Shukla on the issue of corruption in police transfers and postings, but the SID refused to provide them claiming it was part of an ongoing investigation, the CBI said.

    The high court had, on July 22, held that the CBI can inquire into the allegations of corruption in transfers and postings of police personnel and dismissed a petition filed by the Maharashtra government seeking that some parts of the Central agency’s FIR against Deshmukh be quashed.

    The Maharashtra government stated that as it was approaching the Supreme Court against the HC order, it will not be sharing the documents with the CBI, the agency told the court.

    “This was in clear violation of the order of the High Court which categorically had refused a stay on its order and no such order had yet been obtained from the Supreme Court,” the CBI said.

    “In view of the constant hindrance of the state government to the investigation, the CBI has sought for directions to the Maharashtra government to provide documents,” the petition said.

    A division bench of Justices S S Shinde and N J Jamadar will hear the application on Thursday.

    The CBI had on April 21 this year registered an FIR against Deshmukh on the charges of corruption and misuse of official position.

    The FIR was lodged after the agency conducted a preliminary enquiry against the NCP leader following an order from the HC on April 5.

They said the agency has received the Jharkhand government’s request, routed through the Centre, to investigate the matter.

    Sources said according to the laid down procedure, the agency has taken over the Dhanbad Police FIR in the matter. Jharkhand Chief Minister Hemant Soren on last Saturday had decided to hand over the probe into the hit-and-run case of the 49-year-old Dhanbad judge to the Central Bureau of Investigation.
