  • Samajwadi Party’s Azam Khan gets relief: SC sets aside Allahabad HC order on bail condition

    NEW DELHI: The Supreme Court Friday set aside a part of the Allahabad High Court order concerning bail conditions imposed on Samajwadi Party MLA Azam Khan by which the District Magistrate of Rampur was directed to take possession of land attached to the Jauhar University campus.

    The apex court observed that it is “disturbed about this trend” where the high court has referred to a matter which is unrelated to the consideration of prayer for bail.

    While setting aside the bail condition imposed by the high court directing the District Magistrate to take possession of the land, a bench of Justices A M Khanwilkar and J B Pardiwala retained the other conditions which were relevant for the grant of bail to Khan, who is the Chancellor of Jauhar University.

    “This is yet another matter where we find that the high court has referred to matters which are unrelated to the consideration of prayer for bail relating to the crime registered against the concerned accused,” the bench said.

    It noted that Additional Solicitor General S V Raju, appearing for the state, has urged the court to impose additional conditions that Khan be directed to refrain from entering Rampur district during the bail period.

    “We are not impressed by this submission,” the bench said.

    The apex court said the authorities, acting upon the observations made in the high court judgement, had initiated action including sealing of certain premises as noted in a May 18 communication.

    “All actions taken by the revenue authorities or state authorities in reference to the observations made in the impugned bail order dated May 10, 2022, be deemed to have been effaced from the record,” it said.

    However, the bench said it would not preclude the competent authority to initiate action independently based on other tangible material, information/documents, or evidence available to initiate action under the concerned legislation, including in respect of the management and properties of the university.

    “In terms of these observations, we direct the joint magistrate/deputy district magistrate to take immediate steps for unsealing the property referred to in the communication dated May 18, 2022,” the bench said.

    The top court disposed of the pleas, including the appeal filed by Khan against the May 10 order of the high court.

    On May 27, a vacation bench of the top court stayed the high court’s bail condition imposed on Khan directing the District Magistrate to take possession of the land attached to the Jauhar University campus.

    It had said that prima facie the bail condition imposed on Khan was disproportionate and sounds like a decree of a civil court.

  • ‘UP government working in autocratic manner’: Azam Khan hits out at CM Yogi

    BAREILLY/AZAMGARH: Alleging Uttar Pradesh government was working in an autocratic manner, senior Samajwadi Party leader Azam Khan on Saturday said he and his family members were even accused of stealing goats.

    While addressing a public meeting organized in Nasirpur on Saturday in support of SP candidate Dharmendra Yadav in the Azamgarh parliamentary constituency by-election, Khan expressed his pain and attacked the BJP government.

    He alleged things were made difficult for him in the jail so as to force him to commit suicide or kneel before the government but he did not do so.

    Azam Khan, was released from Sitapur Jail in May on getting interim bail from the Supreme Court.

    Earlier, before reaching Azamgarh, in a conversation with reporters at Bareilly airport he hit out at the Yogi Adityanath government.

    The Rampur MLA also attacked the BJP-led central government over the ‘Agnipath’ scheme saying it is quite evident as how beneficial it is for the youth who are agitating over it.

    “Dictatorship will be better than the present situation prevailing in the state. The state government is working in an autocratic manner,” the SP leader who recently got released from jail following the Supreme Court order told newspersons at the Bareilly airport here.

    “Allegations like having stolen hen and goat, robbing a liquor shop were levelled against me and my family. In such a situation, you yourself can understand the level of the government’s functioning,” Khan, who had been in Sitapur Jail for 27 months, said.

    On the way to Varanasi, the SP leader said,”the treatment given to my city, my district and my loved ones, I can bet no government in the world would have treated any political leader so badly.

    No government would have fallen so low to lodge cases such as robbing liquor shops and theft of Rs 16 thousand rupees from my college,” he said.

    To a question on the ‘Agnipath’ scheme, he said “All know as to who will benefit from the Agnipath scheme. Everyone knows the whole country is burning.”

    “It is clear from the circumstances what interest of youth the ‘Agnipath’ scheme will serve,” he added.

    The Centre on Saturday announced several incentives including reserving 10 per cent vacancies in its paramilitary and the defence ministry for Agnipath retirees and said it will look into any grievance about the new military recruitment scheme “with an open mind”, even as violent protests raged on in many states and opposition parties stepped up pressure for a rollback.

    Unveiling the scheme on Tuesday, the government said youths between the ages of 17-and-a-half and 21 years would be inducted for a four-year tenure while 25 per cent of the recruits will be retained for regular service.

    The upper age limit was raised to 23 years on Thursday.

    The new scheme for the recruitment of soldiers in the Army, Navy and Air Force was projected by the government as a major overhaul of the decades-old selection process to enhance the youthful profile of the three services.

  • Samajwadi Party leader Azam Khan’s condition perfectly stable: Hospital sources

    NEW DELHI: The condition of Samajwadi Party leader Azam Khan, who is admitted to the Sir Ganga Ram Hospital here, is “perfectly stable”, hospital sources said on Tuesday.

    He was admitted to the Medicine Department of the facility on Sunday for a routine medical check-up.

    His condition is perfectly stable, hospital sources said, amid reports in a section of the media that his condition was not good.

    Khan was released from the Sitapur Jail in Uttar Pradesh on May 20, a day after the Supreme Court had granted him interim bail in a cheating case.

  • Samajwadi Party may reciprocate Kapil Sibal’s help to Azam Khan, send him to Rajya Sabha

    LUCKNOW: While the process of filing nomination for the upcoming Rajya Sabha elections took off on Tuesday, the parties including the ruling BJP and main opposition SP are in the process of finalizing their list of candidates. Of the 57 seats, set to go to polls on June 10, UP will send 11 members to the upper house.

    As per the numbers, the BJP is sure to win at least 7 seats and SP three comfortably. However, for 11th seat, there could be a contest as the BJP with 273 members in Assembly, is short of 15 votes to win an added seat and SP, with 125 MLAs, would need 20 more votes to win the fourth seat. So, this situation may bring second preference vote into play as each member will need 36.63 votes to get elected. As per the highly-placed sources, of the three seats which SP is sure to win, one each may be given to RLD chief Jayant Chaudhury and veteran Congress leader Kapil Sibal.

    The party insiders also claimed that SP is scheduled to convene a meeting of its MLAs an MLCs this weekend to take a final call on candidates for the three seats the party is sure to win of the 11 seats that are up for grabs. The 11 seats are currently represented by BJP(5), SP(3), BSP(2) and Congress (1).

    If Jayant Chaudhury makes it to Rajya Sabha, he will return to Parliament after eight years as he had represented Mathura in Lok Sabha from 2009-2014.

    However, the fate of Kapil Sibal, a prominent face of Congress’s G-23, is still uncertain. In his last term, Sibal was elected from UP with the support of the Samajwadi Party. Sibal, completing term in Rajya Sabha in July, is believed to have a warm relationship with many SP leaders including the SP chief and Azam Khan.

    Sibal represented jailed SP leader Azam Khan in Supreme Court and helped him secure interim bail. He also helped Akhilesh Yadav retain the party’s bicycle symbol in 2017 when the first family was locked in an intense family feud, probably the worst in the SP’s existence.

    As per the SP sources, the Samajwadi Party is seeking to reciprocate for the help Sibal extended to Azam Khan in his legal battle. However, there has not be an official word on it. “The party has not decided on the candidates yet”, said SP national secretary and the state spokesperson, Rajendra Chaudhary.

    However, when Azam Khan, who is currently in Lucknow to attend the ongoing Assembly session, asked about the probability of Sibal being sent to Rajya Sabha from UP by the SP, he expressed his happiness saying if the party was thinking on those lines, he would support the move.

    On the other, state Congress leaders chose to remain non-committal over the possibility saying the Congress high command would take the decision. However, this time, the Congress, with two MLAs in UP, is not in a position to field a candidate on its own. 

  • Azam Khan skips UP Assembly for second consecutive day; SC to hear his plea challenging bail condition

    LUCKNOW: Senior Samajwadi Party leader Azam Khan skipped Uttar Pradesh assembly proceedings for a second day in a row on Tuesday amid speculation of a rift between him and party president Akhilesh Yadav.

    Khan, who had taken oath at Speaker Satish Mahan’s chamber on Monday, had not attended the proceedings of the house and had left after being sworn in as member of the house even then.

    Khan was recently released on bail from Sitapur Jail where he was lodged on various charges, including that of land grabbing.

    When asked whether Khan will be attending the house, his MLA son Abdullah Azam avoided giving a categorical reply to the media in the morning.

    “I am getting delayed for the assembly. You can ask him (Azam) when he comes out,” Abdullah Azam, who had taken oath with his father on Monday, said.

    Khan had on Monday evening met Pragatisheel Samajwadi Party Lohia (PSPL) founder Shivpal Yadav at his residence and discussed various issues.

    PSPL spokesperson Deepak Mishra told PTI, “Yes both the leaders had met on Monday evening.”

    He, however, did not divulge details of the meeting.

    Sources suggest that Khan wants his lawyer, Kapil Sibal, to be sent to Rajya Sabha on an SP ticket.

    However, there is no official confirmation in this regard either from Khan’s side or from any SP leaders.

    Akhilesh Yadav’s party that had won 111 seats in the recent state polls can send three members to the RS after 11 of its seats fall vacant from the state by July.

    The process of elections for the RS seats began on Tuesday.

    Sibal, who is representing Khan in the Supreme Court, was elected to the RS on a Congress ticket from Uttar Pradesh with the help of SP in 2016.

    Since the Congress, which had fought the latest state election on its own, could manage to win only two seats, it has no chance to send him or any other leader of the party to the upper house of Parliament.

    This is the second meeting between Khan and socialist leader Shivpal Yadav in recent days.

    Yadav had earlier visited him in Sitapur Jail in March end and had called out SP patriarch Mulayam Singh Yadav, as well as Akhilesh Yadav, for not agitating for his release.

    The absence of Khan — the 10th term MLA from Rampur Sadar seat — from the ongoing assembly session is generating a lot of speculation about his displeasure with the party president.

    Khan has been allocated a seat in the assembly next to Akhilesh Yadav.

    Meanwhile, 

    The Supreme Court Tuesday said that a plea filed by Samajwadi Party MLA Azam Khan challenging a bail condition imposed by the Allahabad High Court, which he claimed is for demolishing a part of his Jauhar University allegedly built by grabbing of enemy property, would be heard during this week.

    The matter was mentioned before a vacation bench of Justices D Y Chandrachud and Bela M Trivedi.

    Senior advocate Kapil Sibal, appearing for Khan, said one of his colleagues had mentioned the matter before the apex court and the bench had asked him to mention it before the registrar.

    “Your lordships said to mention it before the registrar. It was mentioned, but it is not being listed,” Sibal said.

    “We will list in the course of this week,” the bench said.

    Advocate Nizam Pasha, representing the petitioner, had on Monday mentioned the matter for urgent listing before the top court and said the high court has ordered “demolition” of the university as a condition for interim bail, and now the district administration seeks to execute the order.

    The bench had asked him to mention the matter before the mentioning registrar.

    On May 10, the high court while granting interim bail had directed the Rampur district magistrate to take possession of the enemy property attached to the campus of Jauhar University by June 30, 2022, and raise a boundary wall with barbed wire around it.

    It had said that on completion of the mentioned exercise of taking the possession of the land to the satisfaction of the DM, Rampur, the interim bail of Azam Khan shall be converted into regular bail.

    While mentioning the matter on Monday, Pasha had told the apex court that the status of the land, on which the university is built, is the subject matter of a writ petition in the high court between the Waqf Board and the custodian of the land in which a stay has been ordered.

    He had said that despite this, the single judge of the high court has put handover of land to the custodian as a condition of bail.

    He had pointed out that now, the district administration has identified that land as a parcel of land underlying between two buildings of the university and has issued notice to vacate the buildings so that they can be demolished in order to comply with the bail order.

    On May 19, the top court while exercising its powers under Article 142 of the Constitution had granted Khan (73) interim bail in an alleged cheating case paving way for his release from prison.

    On May 10, the Allahabad High Court had granted him interim bail in a case related to the alleged grabbing of enemy property for his Jauhar University project on the condition that he has to return the entire enemy property to paramilitary forces and has to furnish a personal bond of Rs 1 lakh and two sureties of like amount.

    Khan, who is a Member of the Legislative Assembly from Rampur Sadar constituency, was lodged in the Sitapur jail of the State for more than two years.

    An FIR was lodged at Azem Nagar police station in Rampur against Khan and others in 2019 for alleged grabbing of enemy property and misappropriation of public money of more than hundreds of crores of rupees.

    It was alleged in the FIR that during partition one Imamuddin Qureshi went to Pakistan and his land was recorded as enemy property, but Khan in collusion with others grabbed the 13.842-hectare plot.

    On May 6, the top court had said it is a “travesty of justice” that the high court has not delivered its verdict on the bail plea despite reserving the order last December in the grabbing of enemy property case.

    The top court had noted that Khan has been granted bail in 86 out of 87 cases lodged against him and observed that it is keeping the plea of Khan pending till the high court delivered its order on his bail.

    The high court on December 4, 2021, had reserved its decision.

    However, the state government later submitted an application and sought permission to present some new facts through fresh affidavits, which were filed on May 5.

    The high court had then on May 10 delivered its verdict in the case.

    NEW DELHI: Samajwadi Party MLA Azam Khan Monday moved the Supreme Court challenging a bail condition imposed by the Allahabad High Court which he claimed is for demolishing of buildings of his Jauhar University allegedly built by grabbing of enemy property.

    A bench of Justices DY Chandrachud and Bela M Trivedi was told by advocate Nizam Pasha that the High Court has ordered the “demolition” of the University as a condition for interim bail and now the district administration seeks to execute the order.

    “Please list this plea for urgent hearing”, Pasha urged the court.

    The bench said how can a University be demolished as a bail condition and asked Pasha to mention the matter before mentioning the registrar.

  • I’m poor person without base, have no reason to be upset with party leadership: Azam Khan

    RAMPUR: As his absence from the SP MLAs meet fuelled speculation about his resentment with the party leadership, senior leader Azam Khan on Sunday said he is a “poor person” without any base and does not have any reason for being upset.

    Khan, who held immense sway in the party during the SP rule, was released from the Sitapur jail on Friday after spending 27 months in judicial custody in dozens of cases.

    Asked if he would end his “continuing resentment”, Khan told reporters, “I am getting this information about the resentment only from you. I don’t understand any reason.”

    He said there should be some “basis” for resentment.

    “I am a man without any base, so where will the basis for resentment come from? I am a poor person now and live in a bylane. I am a poor person who lives in such a congested lane that not even a single four-wheeler could enter it,” he added.

    Khan who skipped the Samajwadi Party’s legislators’ meet on Sunday, a day ahead of the beginning of the maiden session of the Uttar Pradesh assembly, also said, “The Vidhan Sabha is not a new place for me. I will be entering it for the 10th time.”

    Apparently referring to Jauhar University, founded during the Akhilesh Yadav government with he himself playing a major role in its establishment, Khan said, “If this university is demolished or bulldozer is moved over it, its razed remains will narrate the history more than the standing building.”

    “I want to give pens to children and the mission is still alive,” he added.

    Azam also visited the Rampur district jail on Sunday to meet his close aide Guddu Massod who has been lodged there in judicial custody in a case of forgery.

    Khan visited the jail along with his MLA son from the Suar assembly segment, Abdullah Azam, and met other jail inmates also.

    Azam Khan was released from the Sitapur jail on Friday, a day after the Supreme Court granted him interim bail in a cheating case.

    He was lodged in jail for the last 27 months, facing trial in several cases, including that of land grabbing.

    Earlier amid complaints from Khan’s camp that SP supremo Akhilesh Yadav has been “ignoring” Khan and the Muslim community, though it backed the SP in the UP assembly polls, the party veteran had not met SP MLA Ravidas Mehrotra when he had visited him in the Sitapur jail on April 24.

    But only a day later on April 25, he had met Congress leader and spiritual guru Pramod Krishnam.

  • Azam Khan appears before court in fake birth certificate case of son

    RAMPUR: Senior Samajwadi Party leader Azam Khan on Saturday appeared before a court in connection with the fake birth certificate case of his son Abdullah Azam Khan.

    Azam’s son Abdullah Azam Khan also appeared before the court meant for the trial of MPs and MLAs.

    He is facing trial for allegedly forging documents to obtain a passport.

    Azam Khan, his wife Tazeen Fatima and son Abdullah Azam Khan were sent to jail in a criminal case registered against them, alleging that Abdullah got two fake birth certificates issued through fraudulent means from two different places.

    In an FIR lodged by BJP leader Akash Saxena at the Ganj police station in Rampur on January 3, 2019, it was alleged that Azam Khan and his wife helped their son obtain two fake date of birth certificates, one from Lucknow and another from Rampur.

    According to the prosecution, testimony of the witnesses is being recorded before the court.

    Azam Khan appeared before Additional Chief Judicial Magistrate Nishant Mann.

    District Government Counsel Arun Prakash Saxena, said, “Azam Khan appeared in the fake birth certificate case before the special MP-MLA court, which has fixed May 26 as the next date of hearing.”

    Assistant Prosecution Officer Neeraj Kumar Singh said, “Mohammad Naseem, the passport officer posted at Bareilly appeared as a public witness and recorded his statement. He will have to appear again before the court for cross examination by the defense counsel.”

    Saxena said the court has fixed May 30 as the next date for hearing the passport case.

    At present, Azam Khan is the MLA from Rampur Assembly constituency while his son Abdullah is an MLA from Suar in the district.

    Azam Khan was released from the Sitapur Jail in Uttar Pradesh on Friday morning, a day after the Supreme Court granted him interim bail in a cheating case.

    Khan was lodged in jail for the last 27 months in connection with several cases, including that of land grabbing.

    The grant of the interim bail by the Supreme Court paved the way for his release from the prison.

  • Justice will be done to Azam Khan, says Akhilesh Yadav

    AZAMGARH: Samajwadi Party president Akhilesh Yadav on Wednesday expressed hope that justice will be done to Azam Khan, the SP leader languishing in jail for over two years.

    Yadav, who attended a function in Azamgarh, alleged that the government is tightening legal grip on Azam Khan so that he could not get out of jail.

    Khan, a senior SP leader and MLA from Rampur, is currently in jail on several charges including corruption. “The way the court hearing is going on, Samajwadis hope that justice will be done to him,” said Yadav.

    Khan has been lodged in Sitapur jail for over two years.

    In a major relief to him, the Allahabad High Court on Wednesday granted Khan bail in the case of illegal possession of enemy property. Khan, a former state minister, has got bail in 88 out of 89 cases. He will be released from jail only after the bail is granted in the last case.

    The SP president alleged that ever since the BJP government has come to power, it has imposed serious sections like sedition against the political leaders who are vocal against the government. “Bulldozers are being used to demolish the homes of Muslims and people seeking justice in the state,” said Yadav.

    The former Chief Minister of UP said that the condition of the country will become like Sri Lanka if the government ends the free ration scheme.

    “The government now lacks budget, it now is looking for excuses to stop the ‘Kisan Samman Nidhi’ and ration distribution. The government has forgotten that the country is run by law and constitution and not by bulldozers,” said Yadav.

    Asked about controversy over videography survey in Gyanvapi campus of Varanasi, Yadav alleged that the BJP is deliberately stoking hatred among the people. He said that there is an order of the Supreme Court that old heritage should not be tampered with.

    “Will the government also not accept this decision of the court?” Yadav asked.

  • Uttar Pradesh: Special court issues NBW against Azam Khan’s wife, son in two birth certificates case

    LUCKNOW: A day after Samajwadi Party (SP) MLA Azam Khan was granted bail in a case related to the illegal occupation of ‘enemy property,’ his wife and son got embroiled in another litigation getting a non-bailable warrant (NBW) issued against them by the Rampur special MP/MLA court on Thursday.

    While issuing the NBW against Tazeen Fatima and her son and SP MLA from Suar, Abdullah Azam, the MP/MLA court set the deadline of May 16 for the surrender failing which the duo would be arrested by the district police.

    The non-bailable warrant has now been issued against Azam’s wife and his son in connection with a case of two birth certificates. According to a report, in the case registered by Ganj police, Azam and Tazeen got two birth certificates issued for their son from two places. Both certificates have two different dates of birth. Both were allegedly fabricated and used for personal gains, according to the complainant Akash Saxena.

    In this case, the mother and son were supposed to appear in the court on Wednesday but they did not show up. 

    As per the sources, both Tazeen Fatima and Abdullah had presented an apology in the court for non-attendance on Wednesday but the court cancelled it and issued the NBW.

    While public prosecutor Arun Prakash Saxena informed the MP/MLA Court (ACGM First) Rampur had to hear the matter related to crime number 4/19 regarding two birth certificates on Wednesday, it was argued on behalf of Tazeen Fatima and Abdullah in the court that their lawyers who could not come as they had to come from Delhi. Consequently, the cross-examination could not take place on Wednesday.

    On this basis, the apology should be accepted. But the court did not accept the argument.

    On the other hand, Azam Khan’s bail application was heard in the Supreme Court on Wednesday. The apex court posted the matter for the next hearing next Tuesday. The court has also sought a reply from the Uttar Pradesh government in this regard.
