  • HC transfers special judge hearing ED case against Anil Deshmukh to Yavatmal district

    MUMBAI: Special judge HS Satbhai, who was hearing the applications of the Enforcement Directorate (ED) for remand of former Maharashtra home minister Anil Deshmukh in a money laundering case and other cases pertaining to MPs and MLAs, has been transferred to Yavatmal district by the Bombay High Court with immediate effect.

    He had been hearing cases pertaining to MPs and MLAs since July this year at the sessions court here.

    On Monday, judge Satbhai had remanded Deshmukh in 14-day judicial custody.

    Besides Deshmukh’s case, judge Satbhai was also hearing a case against Maharashtra minister Chhagan Bhujbal in connection with the alleged Maharashtra Sadan scam and discharged the latter.

    Deshmukh was arrested on November 1 by the ED under provisions of the Prevention of Money Laundering Act (PMLA).

    In a notification issued on Monday, the Bombay High Court said it was pleased to transfer and post H S Satbhai, Judge, City Civil Court and Additional Sessions Judge, Mumbai as District Judge, 2 and Additional Sessions Judge, Kelapur, district Yavatmal with immediate effect.

    Yavatmal district in east Maharashtra is located 685 km away from Mumbai.

    Judge Satbhai recently discharged Bhujbal and others in the Maharashtra Sadan case, observing that there was no “substantial material” to suggest that he and his kin received any kind of “illegal gratification” in the contract for constructing new Maharashtra Sadan in Delhi.

    Judge Satbhai was also hearing the pre-arrest bail plea of former Shiv Sena MP Anand Adsul in a case pertaining to an alleged scam in a cooperative bank.

    He was also hearing the alleged Pune land deal case involving former Maharashtra minister Eknath Khadse, an NCP leader.

  • Money laundering case: Court sends Anil Deshmukh sent to 14-day judicial custody

    MUMBAI: A special PMLA court here on Monday sent former Maharashtra home minister Anil Deshmukh in 14-day judicial custody as the Enforcement Directorate did not seek his remand further in connection with a multi-crore money laundering case.

    Deshmukh was arrested by the Enforcement Directorate (ED) on November 1 after questioning in the case, under provisions of the Prevention of Money Laundering Act (PMLA). At the end of his ED custody on Monday, the NCP leader was produced before special judge H S Sathbhai. The court sent Deshmukh in judicial custody as no further remand was sought by the probe agency.

    After Deshmukh (71) was remanded to judicial custody, his legal team moved a plea before the court, seeking that he be allowed to have home food and medicines, considering his age and medical history.

    Deshmukh’s lawyers also sought a bed for the former minister, saying he has severe lower backache and he would not be able to sleep on the floor.

    The court directed the jail authorities to provide him a bed. It also said he can take medicines as prescribed by doctor. However, the court kept his home food plea pending. It said if there is any complaint about food after a few days, he can approach the court.

    The ED had initiated a probe against Deshmukh and his associates after the Central Bureau of Investigation (CBI) filed its FIR against the NCP leader on April 21 this year on charges of corruption and misuse of official position.

    The money laundering case against Deshmukh and others was made out after the CBI booked him in a corruption case related to allegations of at least Rs 100 crore bribery made by former Mumbai police commissioner Param Bir Singh.

    The ED’s case is that Deshmukh, while serving as the state’s home minister, misused his official position and through dismissed police officer Sachin Waze collected Rs 4.70 crore from various bars and restaurants in Mumbai.

    Deshmukh had refuted these allegations earlier and said the agency’s whole case was based on malicious statements made by a tainted cop (Waze).

    The ED had earlier also arrested his two aides- Sanjeev Palande (additional collector rank official who was working as Deshmukh’s private secretary) and Kundan Shinde (Deshmukh’s personal assistant) – in connection with the case.

    They are currently in judicial custody. The agency had also submitted its prosecution complaint (equivalent to a charge sheet) against the duo before a special court.

  • Money laundering: PMLA court extends Anil Deshmukh’s ED custody till November 15

    MUMBAI: A special PMLA court here on Friday extended the ED custody of former Maharashtra home minister Anil Deshmukh till November 15 in connection with a multi-crore money laundering case. He was arrested by the Enforcement Directorate (ED) early last week.

    A special holiday court on November 6 had sent the 71-year-old NCP leader to judicial custody after rejecting the ED’s plea seeking extension of his remand. However, a day later, the Bombay High Court set aside the lower court’s order and sent Deshmukh in ED remand till November 12.

    On Friday, the former minister was produced before special PMLA court judge HS Sathbhai, who extended his custody till November 15.

  • Criminal complaint and civil suit filed against Kirit Somaiya for ‘defaming’ Maha Congress

    NAGPUR: A criminal complaint was filed on Monday against former BJP MP Kirit Somaiya in a court here in Maharashtra for allegedly defaming state Congress by levelling false allegations, a party spokesperson said.

    The complaint was filed by Maharashtra Congress chief spokesperson Atul Londhe in the court of Judicial Magistrate First Class (JFMC).

    Somaiya had alleged during a debate on a television channel on November 3 that out of the Rs 100 crore extortion money taken by former Maharashtra home minister Anil Deshmukh, 40 per cent went to NCP, 40 per cent to Shiv Sena and the rest 20 per cent to the Congress party.

    “I was also part of the debate and I immediately asked Somaiya to either furnish proof or withdraw his allegations. However, Somaiya, who had joined over the phone, switched it off and left the discussion,” alleged Londhe while speaking to reporters.

    He said Somaiya’s remarks were aimed at defaming Congress and the ruling Maha Vikas Aghadi, of which Congress is one of the constituents.

    Londhe said he has sought registration of FIR against Somaiya under sections related to criminal defamation and 504 (Intentional insult with intent to provoke breach of the peace) and 505 (Statements conducing to public mischief) of the Indian Penal Code.

    Londhe told reporters that he has filed a separate civil suit demanding a permanent restraining order against Somaiya from making false allegations against the Congress party and sought a symbolic compensation of Rs 1.

  • Bombay HC remands Anil Deshmukh in ED custody till November 12; sets aside judicial custody order

    MUMBAI: The Bombay High Court on Sunday set aside a special court’s order remanding former Maharashtra home minister Anil Deshmukh to judicial custody, and sent him in the Enforcement Directorate’s (ED) custody till November 12 in a money laundering case.

    A vacation bench of Justice Madhav Jamdar was hearing an application filed by the ED, challenging the special court’s order of November 6 remanding Deshmukh to 14-day judicial custody, on the ground that it was bad in law and against the principles of natural justice.

    Deshmukh’s counsel Vikram Chaudhri and advocate Aniket Nikam told the court that while they were opposing the plea on merits and maintainability, the NCP leader has consented and volunteered to be interrogated by the ED.

    The court then remanded Deshmukh to ED custody till November 12.

    Deshmukh was arrested by the ED on November 1 after 12 hours of questioning in connection with a multi-crore money laundering case.

    He was produced before a special holiday court on November 2 which remanded him to ED’s custody till November 6.

    When he was produced before the special court on Saturday, the ED had sought further custody, but the court refused and sent him in judicial custody.

    The ED had initiated a probe against Deshmukh and his associates after the CBI filed its FIR against the NCP leader on April 21 on charges of corruption and misuse of official position.

    The ED had earlier arrested two persons in the case, Sanjeev Palande (additional collector rank official who was working as Deshmukh’s private secretary) and Kundan Shinde (Deshmukh’s personal assistant).

    The agency earlier submitted its prosecution complaint (equivalent to a charge sheet) against the duo before a special court.

    A Mumbai court on Saturday sent former Maharashtra home minister Anil Deshmukh, arrested in a money laundering case, to 14-day judicial custody.

    Earlier in the day, a medical examination of Deshmukh was conducted at a state-run hospital in Mumbai before he was taken to a special court in the afternoon as his Enforcement Directorate (ED) custody ended, an official said.

    Deshmukh (71) was arrested by the ED late Monday night after 12 hours of questioning.

    A Mumbai court had on Tuesday remanded Deshmukh in ED’s custody till November 6 in connection with a multi-crore money laundering case.

    “As Deshmukh’s ED custody ended on Saturday, he was taken out of the central agency’s office here around 12.20 pm. Before being produced in the special PMLA court, he was taken to the state-run J J Hospital for his routine medical checkup in the morning,” the official said.

    The ED case against Deshmukh and others was made out after the CBI booked him in a corruption case related to allegations of at least Rs 100 crore bribery made by former Mumbai police commissioner Param Bir Singh. 

    Singh had alleged that Deshmukh was involved in several wrongdoings, including asking the sacked police officer Sachin Waze to collect Rs 100 crore from bars and restaurants in Mumbai.

    The ED had on Thursday summoned Deshmukh’s son Hrishikesh Deshmukh for questioning in connection with the money laundering case. He was quizzed on Friday.

    MUMBAI: Anil Deshmukh, former Home Minister of Maharashtra who was arrested in a money laundering case, has been taken for medical examination from the ED office, prior to appearing before special PMLA Court today.

    The Mumbai Court on November 2, remanded Deshmukh to Enforcement Directorate’s custody for 4 days i.e., till November 6.

    The Enforcement Directorate (ED) on Thursday summoned former state home minister Anil Deshmukh’s son, Hrishikesh Deshmukh for questioning on Friday in connection with the money laundering case. The said questioning took place yesterday.

    Deshmukh was arrested by the agency on Monday in connection with extortion and money laundering allegations levelled against him by the former Mumbai Police Commissioner Param Bir Singh.

    Singh had alleged that Anil Deshmukh was involved in several wrongdoings, including asking Sachin Waze to collect Rs 100 crore from bars and restaurants in Mumbai.

  • Ex-Maharashtra Home Minister Anil Deshmukh, held by ED in money laundering case, taken for medical checkup

    MUMBAI: Former Maharashtra home minister Anil Deshmukh, arrested by the Enforcement Directorate in a money laundering case, was taken to the state-run J J Hospital here on Thursday for a medical checkup, an official said.

    His all vital parameters are stable, the official said.

    Deshmukh is currently in the ED’s custody, where his interrogation in connection with the money laundering case is on.

    The NCP leader was brought out of the ED’s office around 12 noon and taken to the hospital in south Mumbai, the official said.

    His routine check up was conducted at the hospital between 12.30 pm and 1.30 pm following which he taken back to the ED’s office, the official added.

    Deshmukh (71) was arrested by the ED late Monday night after being questioned for over 12 hours in connection with the money laundering case.

    The former minister had skipped multiple summonses issued by the ED in the case, but after the Bombay High Court last week refused to quash them, he appeared before the agency on Monday.

    On Tuesday, a special holiday court here remanded him in the ED’s custody till November 6.

    The ED had told the court that Deshmukh was the “prime beneficiary” of proceeds of crime and directly involved in the offence of money laundering.

    The central agency, in its remand note, said the NCP leader emerged as an “important cog in the wheels” in the case, in which there has been an allegation of collection of Rs 100 crore, and maintained the involvement of foreign angle cannot be ruled out.

    The ED had told the court that Deshmukh’s custodial interrogation was the need of the hour in the interest of the ongoing investigation, and that the entire money trail requires to be established in order to bring the guilty to book.
