  • SC dismisses CBI appeal against bail for ex-Maharashtra home minister Anil Deshmukh

    NEW DELHI: In a major relief for former Maharashtra home minister Anil Deshmukh, the Supreme Court on Monday dismissed the CBI’s appeal challenging the Bombay High Court order granting bail to the Nationalist Congress Party (NCP) leader in a corruption case.

    A bench comprising Chief Justice DY Chandrachud and Justices V Ramasubramanian and JB Pardiwala noted that Deshmukh has also been granted bail in the related money laundering case.

    The CBI, in December last year, approached the Supreme Court challenging the Bombay High Court order granting bail to Deshmukh in the graft case.

    The high court had on December 12 granted bail to the 73-year-old NCP leader but said the order will be effective after 10 days, as the Central Bureau of Investigation sought time to challenge it in the apex court.

    The high court had said except for dismissed police officer Sachin Waze’s statement, none recorded by the CBI indicated money was extorted from bar owners in Mumbai at the behest of the politician.

    In its plea filed in the top court, the probe agency has claimed the high court committed a “grave error” in granting bail to Deshmukh disregarding the serious objections raised by the probe agency both on the merits of the case as well as the effect his bail will have on the continuing investigation.

  • Special court likely to pass order on ex-Maha minister Anil Deshmukh’s bail plea in corruption case

    MUMBAI: A special court here is likely to pass an order on Friday on the bail application of former Maharashtra home minister Anil Deshmukh in alleged corruption and misuse of official position case being probed by the Central Bureau of Investigation (CBI).

    Deshmukh (71) had sought bail in the case as soon as the Bombay High Court granted him bail on October 4 in a money laundering case registered against him by the Enforcement Directorate (ED).

    Special CBI court judge S H Gwalani on Thursday concluded hearing in the arguments on the bail plea and closed it for orders.

    The Nationalist Congress Party (NCP) leader was arrested on November 2, 2021 and has been in judicial custody. He was admitted to a private hospital last week for coronary angiography.

    Deshmukh, who was a minister in the previous Maha Vikas Aghadi (MVA) government comprising Shiv Sena, NCP and Congress, is currently lodged in Arthur Road jail in Mumbai.

    In March 2021, senior IPS officer Param Bir Singh had alleged that Deshmukh, the then-home minister, had given a target to police officers to collect Rs 100 crore per month from restaurants and bars in Mumbai.

    Former assistant police inspector Sachin Waze, arrested in the ‘Antilia’ bomb scare case in March 2021, had levelled similar allegations against him.

    The high court in April 2021 directed the CBI to carry out a preliminary inquiry.

    The CBI, based on this inquiry, registered a first information report (FIR) against Deshmukh and his associates for alleged corruption and misuse of official power.

    Deshmukh had resigned as the home minister in April 2021 after the Bombay High Court ordered a CBI probe into the corruption charges levelled against him by Singh, former Mumbai police commissioner.

    NEW DELHI: In a huge relief for former Maharashtra Home Minister Anil Deshmukh, the Supreme Court on Tuesday dismissed the Enforcement Directorate’s plea challenging the bail granted to him by the Bombay HC in a money laundering case.

    A bench of Justices DY Chandrachud and Hima Kohli, in their order, observed, “since the observations in the impugned order of the High Court are confined to the question of whether the respondent could be granted bail, we clarify that these observations in itself will not affect the merit of the trial or other collateral proceedings. We are not inclined to entertain the SLP (Special Leave Petition) against the bail order.” 

    Assailing the HC’s order, Solicitor General Tushar Mehta contended that the lower court had conducted a “mini-trial” and had discussed evidence selectively which resulted in perverse findings. It was also his contention that the health grounds on which bail was sought were lifestyle diseases and not hazardous ones. It was also his contention that the money which was collected in the form of bribes from bar hotels eventually went to an organisation of which Deshmukh was the Chairman and that the transaction happened through shell companies. He also added that there were statements of witnesses corroborating these transactions. 

    Appearing for Deshmukh, senior advocate Kapil Sibal argued that other co-accused were on bail and there was no evidence on record related to the link of money laundering.

    “The trial has to be shown and there is no trial. You just have Waze’s statement who has turned into an approver. Waze is being protected by them to implicate the home minister. The racket was being run by Waze and the commissioner of police,” Sibal added.

    While granting him bail, the HC had directed Deshmukh to pay Rs 1 lakh as bail bond. To enable ED to file an appeal, the bench had however stayed the implementation of its bail order till October 12. This meant that Deshmukh would continue to remain in judicial custody in Arthur Road prison since he is also being investigated by the CBI in a corruption case.

    HC on October 4 had observed that “two components of credits” in the account of his family trust were not “proceeds of crime”. The bench had also considered Deshmukh’s age and the fact that he had no criminal antecedents. 

    On September 26, SC bench led by Justices DY Chandrachud had directed the Bombay HC to consider and dispose of Maharashtra’s former minister Anil Deshmukh’s plea seeking bail in money laundering case being investigated by the ED. Noting that Deshmukh’s bail application is listed before Justice NJ Jamadar of the Bombay HC, a SC granted him the liberty to mention his application before a single judge. 

    Deshmukh who was arrested in November 2021 by the Enforcement Directorate in a case of money laundering has been in judicial custody since then.

    MUMBAI: The Bombay High Court on Tuesday granted bail to former Maharashtra home minister Anil Deshmukh in an alleged money laundering case. Justice N J Jamadar pronounced the order.

    Earlier, the Supreme Court had directed the HC to hear and decide the NCP leader’s plea expeditiously as it was pending for six months.

    His lawyers Vikram Chaudhari and Aniket Nikam argued that considering his age (72), health and the fact that he had no criminal antecedents he should be granted bail.

    Additional Solicitor General Anil Singh, appearing for the Enforcement Directorate (ED), opposed the application arguing that Deshmukh did not suffer from any ailments that cannot be treated at the jail hospital.

    Arrested by the ED in November 2021, Deshmukh is now in judicial custody.

    The ED booked him after the Central Bureau of Investigation (CBI) registered a corruption case against him following allegations made by former Mumbai Police commissioner Param Bir Singh.

    The ED claimed that Deshmukh misused his official position and collected Rs 4.7 crore from various bars and restaurants in Mumbai.

    The ill-gotten money was channelled to Nagpur-based Shri Sai Shikshan Sansthan, an educational trust controlled by his family, it alleged.

    Deshmukh, lodged in the Arthur Road prison here in an alleged corruption case, felt dizzy and fainted, a prison official said.

    The Nationalist Congress Party leader also complained of chest pain.

    His blood pressure was found to have increased and ECG report was abnormal, the official said, adding that Deshmukh was undergoing treatment at the hospital now.

    He was arrested first by the Enforcement Directorate in November 2021 and later by the Central Bureau of Investigation.

    Currently, he is in judicial custody.

    Pandey is also facing investigation in a case of illegal phone tapping of some NSE employees.

    The agency has booked Deshmukh and unidentified others under IPC sections related to criminal conspiracy and section of the Prevention of Corruption Act for alleged “attempt to obtain undue advantage for improper and dishonest performance of public duty” on a complaint of Singh.

  • Anil Deshmukh, Nawab Malik move HC seeking release from jail to vote in MLC polls; CBI opposes move

    MUMBAI: Jailed NCP legislators Nawab Malik and Anil Deshmukh on Monday approached the Bombay High Court seeking to be released from prison for a day on June 20 to cast their vote in elections to the Maharashtra Legislative Council.

    Deshmukh and Malik, both members of the Legislative Assembly, could not cast their vote in the Rajya Sabha elections held on June 10 after a special court refused to release them to take part in the poll process.

    The duo has now sought to be released from jail for one day on June 20 to vote in MLC elections.

    Deshmukh, a former home minister of Maharashtra, filed an application for one day release from prison in his bail plea submitted earlier this year.

    The NCP leader’s application was mentioned by his advocate Inderpal Singh before a single bench of Justice N J Jamadar.

    Justice Jamadar posted the matter for hearing on June 15.

    The plea of Malik, a sitting cabinet minister, was mentioned before a single bench of Justice Bharati Dangre.

    His lawyer Kushal Mor sought permission to get Malik’s plea tagged with Deshmukh’s application and for both the matters to be heard on June 15 by Justice Jamadar.

    Justice Dangre asked Mor to mention the matter on June 14 (Tuesday).

    Malik’s lawyers Taraq Sayed and Kushal Mor had initially sought to amend an earlier petition filed by the state minister challenging a special court order refusing to release him on June 10 for voting in the Rajya Sabha polls.

    Sayed told a single bench of Justice P D Naik that the prayers are still the same and that only the date would have to be amended from June 10 to June 20.

    Justice Naik, however, noted that the cause of action was different and that Malik’s earlier petition had become infructuous as the elections he wanted to vote in (Rajya Sabha) was over.

    “You (Malik) will have to file a fresh plea seeking to be released on June 20 for the MLC elections,” Justice Naik said, indicating he was not inclined to allow the amendment.

    Malik’s lawyers then withdrew the earlier petition and said they would file a fresh one.

    Malik was arrested by the Enforcement Directorate (ED) on February 23 this year in connection with a money laundering probe linked to the activities of fugitive underworld don Dawood Ibrahim and his aides.

    His party colleague Deshmukh was arrested in November 2021 by the ED on money laundering charges.

    The biennial elections for 10 vacant seats of the Upper House of the state Legislature will be held on next Monday.

    Members of the state Legislative Assembly constitute the electoral college for these polls.

    Eleven candidates are in the fray.

    The opposition BJP has fielded five candidates, while the Shiv Sena, the NCP and the Congress, all constituents of the ruling MVA, have given tickets to two nominees each.

    Meanwhile, the CBI on Monday submitted before a special court here that it had filed a charge-sheet against Deshmukh and his former aides within the mandated time period of 60 days in a corruption case, and opposed their pleas for default bail.

    The central agency submitted an affidavit in the court opposing the pleas of Deshmukh and his former aide and co-accused Sanjeev Palande seeking default bail on the ground that the CBI had filed an “incomplete” charge-sheet in the case.

    The pleas had claimed the CBI had not submitted relevant documents along with the charge-sheet and those papers were deposited in the court after the mandated time period.

    As per section 173 of the Criminal Procedure Code (CrPC), a charge-sheet in a case ought to be filed within 60 days from arrest of an accused.

    If this was not done, then the accused can seek default bail.

    The CBI, in its affidavit, said the law mandates completion of investigation within 60 days and that in the present case the report (charge-sheet) was filed by the agency on June 2, 2022, which is within the period of 60 days.

    It added that the contention of the accused persons that since the documents accompanying the charge-sheet were not deposited in the court on June 2, 2022, it cannot be termed as a complete charge-sheet is entirely misplaced.

    “Such misplaced understanding cannot be used/ utilized to seek the benefit of default bail,” the CBI said.

    The affidavit further said that it was the court that directed the investigating officer to deposit the documents on or before June 7 and hence the accused cannot claim benefit under section 167(2) of the CrPC (accused can seek default bail if charge-sheet is not filed within 60 days).

    The CBI had last week filed a 59-page charge-sheet against NCP leader Deshmukh and his two former aides – Sanjeev Palande and Kundan Shinde – in the case related to alleged corruption and misuse of office.

    Former Mumbai police commissioner Param Bir Singh in March last year alleged that Deshmukh, the then-state home minister, had given a target to police officers to collect Rs 100 crore per month from restaurants and bars in the city.

    Deshmukh denied the allegations, but stepped down from his ministerial post after the Bombay High Court directed the CBI to register a case against him.

    The 72-year-old politician is currently in jail under judicial custody in a money laundering case being probed by the Enforcement Directorate (ED).

  • Corruption probe against Anil Deshmukh: Chandiwal Commission submits report to Maha CM

    MUMBAI: The Chandiwal Commission, probing corruption allegations against former Maharashtra home minister Anil Deshmukh, submitted its report to state Chief Minister Uddhav Thackeray on Tuesday.

    The Maharashtra government had formed the single-member commission, headed by Justice K U Chandiwal (retired) in March last year the conduct a probe into the corruption allegations levelled against Deshmukh by former Mumbai police commissioner Param Bir Singh.

    During the nearly year-long probe, the commission recorded the statements of Deshmukh, dismissed police officer Sachin Waze and others. Singh had appeared before the commission once, after multiple summons.

    The former Mumbai police chief, through multiple affidavits, told the commission that he had nothing more to share other than the information he provided in his letter to the chief minister.

    Singh was the Mumbai police commissioner when an explosives-laden SUV was found parked near industrialist Mukesh Ambani’s residence ‘Antilia’ in south Mumbai in February 2021.

    Singh, who was transferred from the police commissioner’s post in March last year in the aftermath of a ‘Antilia’ bomb scare, had alleged that Deshmukh asked police officers to collect Rs 100 crore every month from bars and restaurants in the city.

    The Central Bureau of Investigation (CBI) and the Enforcement Directorate (ED) are also probing the allegations made against Deshmukh by Singh.

    Deshmukh, who resigned from the post of state home minister in April 2021, was arrested by the ED in November last year in connection with a money laundering case. He is currently in judicial custody.
