Rahul Gandhi’s Argument on Lack of Identifiable Victim Rejected by Bombay High Court

Rahul Gandhi’s attempt to have the criminal defamation case against Prime Minister Modi dismissed was turned down by the Bombay High Court. Gandhi’s legal team contended that the tweet "security guard is a thief" did not single out any party or identifiable class, thus failing to satisfy the legal requirement of a specific victim. Justice Nitin Borcar, however, pointed out that the BJP is a registered national party, making it a recognizable entity under the law. The court concluded that the complainant’s long‑standing association with the BJP strengthens the view that the statement was aimed at the party as a whole, and therefore the case can proceed.
