Petitioner’s Demand for CBI Probe and Independent Panel Dismissed by SC Bench
Advocate Vishal Tiwari had filed a public interest petition seeking a Central Bureau of Investigation probe into the Bhojpur encounter that resulted in the death of Bharat Bhuushan Tiwari. The petition also called for registration of FIRs against all officers present at the scene and for an expert committee, chaired by a former Supreme Court judge, to examine the circumstances.
The two‑judge bench, however, rejected these requests, stating that the petition lacked substantive merit and that the petitioner had not demonstrated a sufficient interest to compel the Court’s intervention. The judges further directed the petitioner to present the same facts before the Bihar High Court, where the state’s procedural machinery could address the allegations.
The dismissal has been criticized by human‑rights groups, who argue that the refusal to entertain the petition undermines accountability for alleged extrajudicial killings.
