New Circular Bars Entry of Flats Violating Building Plans

A fresh circular issued by Maharashtra's revenue department bars the entry of any flat that conflicts with the approved building plan. Effective immediately, the registry will not record the first‑sale agreement, purchase deed, deed of apartment or transfer deed for units whose construction exceeds the dimensions laid out in the authorized layout.

The directive follows a high‑level meeting on 22 September 2026, where officials highlighted that several developers were selling units without securing the required clearance from the competent authority, and were also flouting the sanctioned area limits. The circular mandates that, for projects covered by the Real Estate (Regulation and Development) Act, 2016, a RERA registration certificate, occupancy certificate and the approved plan must be attached to the registration file. For projects outside RERA's scope, a construction‑completion certificate, approved plan, zoning certificate and measurement map are compulsory.

Any flat whose documented area exceeds the area mentioned in the approved plan will be denied registration. The government also warned that any sub‑registrar who intentionally disregards these instructions will face a departmental investigation.
