High Court to Rethink Election Petition After Supreme Court’s Stay

Following a stay issued by the Supreme Court, the Guwahati High Court has been instructed to reconsider the election petition against Kripanath Mallah.

The petition, originally filed by Congress leader Hafiz Rashid Ahmad Chaudhary, accused the BJP candidate of corruption, booth‑capturing and vote tally discrepancies.

The High Court had dismissed the case in April 2025, pointing to irregularities in the submission of supporting documents. The apex court’s order overturns that dismissal, directing a fresh hearing based on earlier constitutional bench rulings.

Justice J.B. Pardiwala and Justice Vinod Chandra authored the order, noting that the appeal meets the criteria established by prior judgments.

The renewed examination will focus on 47 polling stations where alleged malpractice occurred, and could reshape the final verdict on the 2024 election result.
