ED Report Triggers Legal Review Before Formal Charges in Kerala
The Enforcement Directorate’s latest findings on the CMRL‑Exalogic transaction have prompted Kerala’s administration to initiate a comprehensive legal review. The 25‑page report, accompanied by annexures, was delivered to the state police chief for appraisal.
Kerala’s officials stress that a preliminary check by the vigilance department will decide if the ED’s allegations meet the evidentiary threshold required under the Prevention of Corruption Act. The government is also mindful of a recent High Court decision dismissing a petition by Congress leader Matthew Kuzhalnadan that sought a vigilance probe into the same deal.
Legal commentators warn that proceeding with an FIR without an independent verification could expose the state to judicial scrutiny, especially concerning the weight of statements recorded by the ED under the anti‑money‑laundering legislation.
