Delhi High Court Refuses Sonam Wangchuk’s Transfer to Private Hospital, Wife Appeals

July 20, New Delhi – In a repeat legal move, Geetanjali Angmo has lodged a petition before the Division Bench of the Delhi High Court, challenging the single bench’s refusal to move her husband, activist Sonam Wangchuk, from Safdarjung Hospital to a private establishment.

Angmo asserts that Wangchuk’s liberty to be treated at a private hospital of his choosing is a fundamental right, and that no governmental or judicial body can force a particular venue for his care.

Her lawyers will request a prompt hearing on Monday, and the petition also serves notice to the central and Delhi administrations as well as the police.

The earlier single bench order, delivered on Sunday, dismissed the demand for relocation to Medanta, stating that ongoing treatment would stay at Safdarjung given the prevailing conditions. Justice Mini Pushkarna’s bench reiterated that the admission decision was legally sound and that every life is valuable.

The court directed that doctors cooperate fully, and if Wangchuk declines medication, they will provide required alternatives. Final treatment decisions rest with the hospital’s medical staff.

Additionally, the ruling clarified that Wangchuk is not in custody; his wife, brother and brother‑in‑law may stay with him around the clock, and a separate family room has been allotted. The request for a private hospital shift was not granted, and the next hearing is set for 24 July.
