The Chhattisgarh High Court has introduced a sophisticated approach to the management of frozen financial assets, highlighting the risks of market volatility. During the hearing of a case linked to businessman Hari Shankar Tibrewal, the court observed that merely securing an asset is insufficient if its economic value is allowed to deteriorate. The case centers on assets worth Rs 423 crore held by several companies, including Discovery Buildcon and Forest Wincom. The court noted that because these assets primarily consist of market-based investments, they are susceptible to price fluctuations that could cause irreparable harm over time. To mitigate this risk, the court has allowed the concerned companies to present a value-preservation strategy to the Enforcement Directorate (ED).
