BNSS Implementation Shifts Authority to Police, Not District Courts

In a detailed statement, Noida's district administration clarified the procedural changes brought about by the BNSS. With the police commissionerate now overseeing law‑and‑order functions, all BNSS powers are exercised by police officials, removing the district magistrate from the decision‑making loop. When BNSS orders refer to an executive magistrate, the execution is handled by the executive magistrate appointed within the police structure. The case files never appear before the district magistrate, senior magistrate, or sub‑magistrate, eliminating any judicial overlap. The police commissionerate possesses its own executive magistrates, allowing it to independently administer BNSS provisions. As such, attributing BNSS directives to the district magistrate's office would be factually incorrect. The administration also addressed rumors concerning Section 130 of the BNSS, stating unequivocally that the Noida district magistrate has not issued any order under that clause.
