Legal Ruling Forces EPFO to Add 6% Interest for PF Claim Delays

In a landmark decision, the Mumbai Suburban Consumer Disputes Redressal Commission ordered the Employees’ Provident Fund Organisation to pay interest for a delayed PF settlement. The court specified a 6 percent annual rate on the overdue amount of ₹14,06,272, to be calculated from 9 November 2016 until the claim’s clearance on 13 December 2016.

The grievance was filed by a retired staff member of Fleet Maritime Services (India) Pvt Ltd, who claimed to have submitted a full PF application on 19 October 2016. EPFO failed to honour the 20‑day settlement rule, and the payout was finally made on 14 December 2016.

EPFO argued that the original submission missed a required joint declaration, asserting that incomplete documents were returned on 7 November 2016 and that a complete set arrived on 2 December 2016, after which the claim was processed within the stipulated timeframe.

The commission dismissed EPFO’s justification, highlighting the lack of any written rejection or deficiency notice. Without such proof, EPFO was deemed responsible for the delay, and the interest penalty was imposed to safeguard contributors’ financial rights.
