Legal Notice Demands X Remove Content Claiming Hate Speech Against Bihar Chief Minister

A legal notice issued by the Bihar cyber crime department has ordered the platform X to take down four posts that it claims constitute hate speech against Chief Minister Samrat Chaudhary. The notice points to the dissemination of content that could inflame communal tensions and violate the state’s anti‑hate‑speech statutes.

According to the notice, the posts authored by Tejashwi Yadav, Misa Bharti, Alok Chikku and journalist Abhinav contain language that “incites hatred based on religion and caste” and “aggravates public sentiment.” The cyber cell invoked Section 79 of the Information Technology Act alongside Sections 94 of the BNSS rules to demand immediate removal.

X has been given 72 hours to comply. Non‑compliance could result in penalties, including potential blocking of the specific content or broader sanctions under Indian cyber law. The notice also warns that the platform may be held liable for hosting unlawful material if it fails to act promptly.

The case is linked to an ongoing investigation involving a minor girl from Jamui who visited the chief minister’s residence, leading to a disputed photograph and subsequent legal filings against the chief minister and a government stenographer.
