  • Allahabad HC Rules Maintaining A List Of Gifts Received At Wedding, Know-Why? |

    The Allahabad High Court ruled that keeping a list of gifts received by the bride or bridegroom at the time of marriage, as required by Section 3(2) of the Dowry Prohibition Act of 1961, is critical to preventing false allegations of dowry in subsequent disputes. “Maintaining the list is also important so that both parties to the marriage and their family members do not later make false allegations about taking or giving dowry in a marriage. The arrangement made by the Dowry Prohibition Act may also help in subsequent litigation between the parties to determine whether the allegations regarding the taking or giving of dowry are covered by the exception carved out under section 3(2) of the Dowry Prohibition Act, 1961,” Justice Vikram D. Chauhan said.

    Section 3 of the Act imposes penalties for giving or receiving dowry, including imprisonment for not less than 5 years and a fine of not less than Rs 50,000 or the value of the dowry, whichever is higher. Sub-section (2) of Section 3 states that presents given to the bride or bridegroom at the time of marriage and not demanded are not considered ‘dowry’, provided that a list of such gifts received by either person is kept in accordance with the rules.

    Rule 2 of the Dowry Prohibition (Maintenance of Lists of Presents to the Bride and Bridegroom) Rules, 1985 specifies how the list of gifts under Section 3(2) is to be maintained.

    “The Central government framed the Dowry Prohibition (Maintenance of Lists of Presents to the Bride and Bridegroom) Rules, 1985 in this regard, as gifts and presents serve as a token of celebration and honour in the Indian marriage system. The legislature was aware of the Indian tradition, and thus the aforementioned exception was carved out. The aforementioned list would also serve as a means of resolving dowry allegations that are later raised in matrimonial disputes, according to the court.

    The court observed that Section 8B requires the appointment of a Dowry Prohibition Officer for the purpose of implementing the Act and, as a result, requested a response from the Uttar Pradesh Chief Secretary as to how many Dowry Prohibition Officers have been appointed in the state and, if not, why they have not been appointed at a time when dowry cases are increasing. The next hearing in the case will be held on May 23.

    The BJP attacked Delhi Chief Minister Arvind Kejriwal on Thursday for avoiding media questions about the alleged assault on his party MP Swati Maliwal at his residence in Delhi, accusing him of behaving more like a “goon”. The Aam Aadmi Party convener was speaking at a press conference earlier in the day in Lucknow with Samajwadi Party leader Akhilesh Yadav, when the Delhi chief minister was questioned about the incident. Kejriwal avoided the question, which was fielded by AAP MP Sanjay Singh, who was also present. Singh stated that his party has already taken a clear position on the issue.

    Delhi BJP chief Virendra Sachdeva chastised the chief minister for avoiding media questions and demanded his resignation immediately, accepting responsibility for the incident.

    BJP national spokesperson Gaurav Bhatia claimed Kejriwal is the main “criminal” in the incident in which his aide Bibhav Kumar allegedly physically attacked Maliwal at the chief minister’s residence. Bhatia also mentioned a phone call Maliwal made to the Delhi Police on the day of the incident.

    “Kejriwal’s silence speaks volumes. “Out of jail, he’s more of a ‘goonda’ than a chief minister,” Bhatia told journalists. Bhatia noted that Bibhav Kumar was photographed with Kejriwal during his visit to Lucknow.
    At the press conference, Sanjay Singh used incidents of crimes against women in Manipur, women wrestlers’ complaints against BJP MP Brij Bhushan Sharan Singh, and the Prajwal Revanna case to criticise the BJP.

    The AAP has made its position clear in the Maliwal case, and no one should politicise it, Singh said.
    Bhatia noted that Singh admitted that a condemnable incident had occurred against Maliwal, and that Kejriwal was expected to act in a case involving a party colleague. Instead, he described the accused as a “twin brother” travelling with him.

    “This shows Kejriwal has no commitment to justice for women, while the BJP is fighting for justice for an opposition leader,” he said, accusing him of cowardice. Bhatia demanded that the AAP leader break his silence or, if he is a coward, resign. He said that the woman The Rajya Sabha MP has been incommunicado since the incident, and the BJP leader wondered if she had been kidnapped or forcibly removed from the public eye.

    He also criticised Yadav for attempting to downplay the incident by claiming that it is not a big deal. Targeting the Samajwadi Party, Bhatia recalled the late SP leader Mulayam Singh Yadav’s controversial defence of some men accused of rape, claiming that “they are boys, they make mistakes.”

    Sachdeva echoed Bhatia’s attack on Akhilesh Yadav, saying nothing more was expected of him. Sachdeva stated that Kejriwal was photographed with Bibhav Kumar and Sanjay Singh at Lucknow airport, demonstrating how seriously the Chief Minister is taking the matter.

    “They are travelling with Kumar, whom they consider an offender. “Lies, deception, and cunning are the hallmarks of Kejriwal and his Aam Aadmi Party,” the Delhi BJP president charged. “Was it not a responsibility of Kejriwal who holds the constitutional post of chief minister and was present at his home at the time of the incident, to lodge a police complaint,” he asked.

    Lok Sabha Elections 2024: RJD supremo and former Chief Minister of Bihar Lalu Prasad Yadav today launched a scathing attack against the BJP alleging that the saffron party is ‘hell-bent on ending reservation and democracy’. Taking to social media amid the Lok Sabha campaign, Lalu Yadav warned people against voting for the BJP. 

    “Dear countrymen, Be alert and cautious! BJP is hell-bent on ending your reservation, democracy and constitution of the country. If the constitution of the country does not remain, then democracy will also not remain in the country. You will not remain equal citizens of the country. You will not remain citizens who have rights, constitutional protection and remedies. You will remain just slaves of a few people,” said the RJD chief.

    The RJD is contesting the Lok Sabha polls as a part of the INDIA bloc which consists of Congress and the Left party in Bihar. The NDA consists of the BJP, LJP-RV, JDU, RLM and HAM.

    Lalu Yadav further said, “If there is a constitution, then there is a reservation and if there is a reservation, then there is protection from inequality, oppression and tyranny. There is a sense of equality, there is a remedy. The BJP’s conduct is anti-equality by nature. These people want to increase inequality in society by abolishing the constitution and reservation and make people mental slaves again.”

    The RJD leader further claimed that Prime Minister Narendra Modi never took action against the BJP leaders who claimed that their party would end democracy and make a new constitution. 

    “It is clear that they (BJP leaders) have deliberately got a green signal from the top leadership of the BJP. Through such statements, BJP people test your seriousness, awareness and commitment towards reservation and constitution.  If you do not contribute today in the fight to save the Constitution, reservation and democracy, then you and your future generations will live the same vicious cycle of oppression and neglect that your ancestors once lived through,” warned Lalu Yadav. 

    Lalu Yadav further urged people to participate enthusiastically in this festival of democracy and ‘teach a tough lesson to the anti-Constitution and anti-reservation BJP’.

    Another high-profile seat that will be going to polls in the fifth phase is Kaiserganj where the sitting MP and former Wrestling Federation of India (WFI) president Brij Bhushan Sharan Singh has been denied a ticket and his son Karan Bhushan Singh is in the electoral fray. Brij Bhushan is seeking votes for his son, but speeches often reflect the pain of not getting a ticket and this time he became emotional on the election stage in Gonda. Karan Bhushan Singh is pitted against Bhagat Ram Mishra of SP and Narendra Pandey of BSP.

    The former Wresling Federation of India (WFI) head while addressing a public meeting in Katra Bazar assembly constituency said that “I cannot remain silent, that is why conspiracies are being hatched against me. There was a conspiracy in 1996 when my wife became an MP and there is a conspiracy in 2024 when my son is going to become an MP. An emotional BJP MP said from the stage that for one and a half years my body has turned into a stone. There have so many injuries on this body.”

    During his address, the Kaiserganj MP told Muslim voters that, “Whether someone says it or not, yours and our blood is same, If you don’t believe it, take a DNA test. The DNA of 5 generations back will match”. Brij Bhushan was seen getting emotional during the speech. “Vote for Karan, I will be grateful to you, I will be with you in all your sorrows and sorrows,” the MP said.  “If you want to sow seeds, sow in our favour, otherwise don’t sow,” he added.

    Brij Bushan Criticizes ‘Bulldozer Policy’ In UP

    Meanwhile, the Kaiserganj MP once again criticized CM Yogi’s bulldozer policy. He said that the bulldozer policy has also caused damage to the party. “Bulldozers were brought for removing encroachments on Nazul land in Gonda but the entire city is built upon government land, will you demolish entire Gonda?” the former WFI chief said while criticising the policy.

    Nazul is referred to type of government land which is used for non-agricultural purpose like building, road, market, playground or any other public purpose. It is owned by the government.

    Responding to a question on bulldozer action on criminals’ properties, Brij Bhushan said that determining who is a criminal and who is not is a lengthy process. “Bulldozer action is acceptable if there is great misery and terror in the society but when the same bulldozer runs over the poor, common man, and shopkeepers, it is not acceptable,” he added. 

    The Kaiserganj Lok Sabha constituency comprises three assembly segments – Tarabganj, Karnailganj and Katra – in Gonda district and two assembly segments – Kaiserganj and Payagpur – in Bahraich district.Brij Bhushan Sharan Singh has been elected from here for the last three consecutive terms. He won from Samajwadi Party in 2009. He won the seat in 2014 and 2019 as a BJP candidate.
